We are working very hard to complete the necessary measures. Our plan is as follows: We have contacted James Enviromental and now have the Stormwater Pollution Prevention Plan available and in our files in a notebook binder for easy access. We have spoken to Annette McMurry of Two Rivers Utilities ( City of Gastonia Utilities Dept). Mrs. McMurry has agreed to provide testing for the samples needed. The sample kits have been picked up and are in our possession while we wait for a local grater to complete our Catch Basin in order to begin retrieving the samples. We are also in the process of finishing our Solvent Management Plan and updating the Stormwater management Plan. We hope to have all the records updated, samples completed, Employee training and Solvent management Plan in place and completed in the upcoming weeks. Skvarla. III Enclosed is a copy of the Compliance Evaluation Inspection Report for the inspection conducted at the subject facility on March 21, 2013 by Mr. Wes Bell of this Office. A copy of the enclosed report (including all attachments) will also be emailed to the Facility Manager for his review. This report is being issued as a Notice of Violation (NOV) due to the facility's failures to implement the Stormwater Pollution Prevention Plan and perform the required qualitative and analytical monitoring, all violations of the subject NPDES Stormwater Permit and North Carolina General Statute (G.S.) 143-215.1, as detailed in the Stormwater Pollution Prevention Plan, Qualitative Monitoring, and Analytical Monitoring Sections of the attached report. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) per violation, per day, may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1. It is requested that a written response be submitted to this Office by April 17, 2013, addressing the above - noted violations in the attached report. Please be advised that the stormwater samples (except pH) must be analyzed by a NC certified laboratory. The pH measurements must be performed within 15-minutes of sample collection; therefore, the pH measurements can be performed by the on -site personnel as long as the analytical method/testing procedures conform to Standard Methods for the Examination of Wastewater. Note. A guidance document for pH measurements including meter specifications, calibration procedures, documentation requirements, etc. has been attached to this report. The inspection revealed multiple outfalls at this property; however, the facility staff will have to identify and initiate sampling (visual and analytical) for all stormwater outfalls as part of the implementation of the SPPP. The Owners adjacent property/business (Auto Parts U Pull & Scrap Metal of Shelby) will have to be either included with this Permit or be covered under a separate Stormwater Permit (similiar industrial activity) if discharge outlets are present. Also, please note that Tier 3 Actions in Part II of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. This permit expires on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for continued coverage under the reissued permit. In order to assure your continued coverage under the general permit, you must apply to the Division of Water Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued coverage under the general permit. Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could result in assessments of civil penalties of up to $10,000 per day. Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial facilities in any of the I 1 categories of "storm water discharges associated with industrial activity," (except construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion.
