Inspection Summary:
Valspar Industries is located at 10300 Claude Freeman Drive on approximately 18 acres. The facility produces powder
coatings for use on construction rebar, appliances, pipe coatings, and lawn & garden products.
At the time of inspection, this facility was found to be in compliance with the City of Charlotte Storm Water Pollution
Control Ordinance; however, violations of the facility's NPDES stormwater permit were observed. Please see the inspection
report for deficiencies, recommendations, and comments.

Comment No significant spills in 3_years. The facility made a notation of no spills during the most recent
update of the stormwater pollution Prevention plan SWPPP .
The facility has not been conducting non-stormwater discharge evaluations of the facility's
outfall. As per Part 1_1. Section A, 1(e) of the permk the facility should conduct and document an
annual certification that stormwater outfalls have been evaluated for the presence of
non-stormwater discharges.
Water collected in the spill containment pallet at the waste disposal dumpster is collected via
vacuum and discharged to the facility's settling _basin.
CMSWS recommends maintaining records of employee training in the SWPPP or along with
monitoring data in the fadlity's stormwater database.
The SWPPP was most recentlyupdated/reviewed on 11124/2016.
The facility conducts weekly ins ections of the facility rounds.

On 9/23/2010, the Division of Water Quality received your request to rescind your coverage under
Certificate of Coverage Number NCG0900 tO. In accordance with your request, Certificate of Coverage
Number NCG090010 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold; you will be performing a public service if you would inform
the new or prospective owners of their potential need for NPDES permit coverage.

Your facility is currently covered for stormwater discharge under General Permit NCG090000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your pennit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Lars=er
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional
information contact the Central Office Stormwater Staff member listed below or check the Stormwater & General
Permits Unit Web Site at http:/Ih2o.enr.state.nc.us/su/stormwater.html
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom of the form. You will he notified when the
rescission process has been completed.

We've received an NOI and a rescission request for an existing facility in your region:
NCG090033 — Engineered Polymer Solutions dba Valspar in Mecklenburg County. This site discharges stormwater at one
point to UT to Mallard Creek (Class C). The NOI is attached. This facility is currently covered under NCGO50118 for
which they are requesting rescission (request also attached). Their cover letter states that according to their facility SIC
code, NCG09 is the more appropriate permit. They have already discussed this with Donna Hood, so a site visit may not
be needed.
Please let me know if the Mooresville Regional Office has any concerns about issuing this COC. Please also let me Know
if you recommend the simultaneous rescission of NCG050118.

Deer Mr. Bennett:
During a routine review of our environmental permits and related records, Valspar doted a
discrepancy between the facility SIC code (2851) and the applicable SIC cedes for the current
facility General Storm Water Permit (# NCG050118).
Valspar contacted Ms. Donna Hood (NCDENR-DEMLR) to notify NCDENR of the discrepancy
and solicit guidance on what steps needed to be taken. Ms. Hood recommended that we request
rescission of the NCG050118 permit and file a NOI for a NCG090000 General permit with the
Permitting Section.
Based on this guidance, Valspar hereby requests rescission of our current permit (# NCG050118).
Enclosed are the following documents:
1.Check for $100 made payable to NCDENR
2.Completed NPDES NOI application for coverage under General Permit NCG090000
3.Site diagram
4.USGS quad sheet with location of facility clearly marked on map
