The Division staff is currently in the process of rewriting this permit and is scheduled to have the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for continued coverage under the reissued permit. In order to assure your continued coverage under the general permit, you must apply to the Division of Water Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal Application Form. The application must he completed and returned by March 4, 2002 in order to assure continued coverage under the general permit. Failure to request renewal within this time period may result in a civil assessment of at least $250.00, Larger penalties may be assessed depending on the delinquency of the request. The site drains to the Henry Fork River and Barger Branch, Class C waters located in'the Catawba River Basin. The site visit and file review revealed that the subject facility is covered by NPDES General Stormwater Permit — NCG090000. The following observations and/or permit condition violations were noted during the inspection (please see the attached addendum for information about your permit): 1) Summary Section Please review the storage capacity of the back-up boiler fuel tank and install secondary containment if needed as required by the permit. The spilled material near the drum cleaning facility should be cleaned up and properly disposed. 2) Stormwater Pollution Prevention Plan (SPPP) A Stormwater Pollution Prevention Plan (SPPP) has been developed, recorded, and properly implemented. NOV-2011-PC-0223, Page 3 Marcie 29, 2011 ADDENDUM The National Pollutant Discharge Elimination System (NPDES) program was established under the federal Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and operations planning to reduce pollutant sources. Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general stormwater permits in North Carolina. One condition that is applicable to both the general permits and individual stormwater permits is the requirement to develop and implement site -specific comprehensive stormwater pollution prevention plans (SPPP). These plans are required to include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge in stormwater runoff - Copies of the general permits and accompanying documents can be accessed from the following webpage: http://portal.ncdenr.org/web/wq/ws/su/npdessw#General Permits NPDES Permit text, technical bulletins, discharge monitoring forms, a Notice of Intent [which is the application of for coverage under a NPDES General Stormwater Permit], and the Representative Outfall Status application can be found on this website. The following items are a subset of permit requirements and are listed to assist you and help bring your attention to certain permitting issues, process, and condition requirements of your permit. Please see the abovementioned website to obtain a copy of the permit so you may fully comply with the conditions therein. Failure to property comply with conditions of the permit, like those bulleted below, constitutes permit violations and is subject to civil penalty assessment of up to $25,000.00 per day. • Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general NPDES stormwater permit or an individual NPDES stormwater permit • All persons desiring to have facilities covered by a General Permit must register with the Division of Water Quality (DWQ) by the filing of a Notice of Intent (NOI) and Applicable Fees. • This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any discharge of stormwater associated with the industrial activity, process wastewater, and/or mine dewatering. • Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine dewatering (pursuant to the type of General Permit) until the permit expires or is modified or revoked. • Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable non-stormwater discharge or is covered by another permit, authorization, or approval. • There are currently 19 active general permits. Copies of the analytical monitoring results shall also be maintained on site. The Permittee shall retain records of all monitoring information, including all calibration and maintenance records and all original strip -chart recordings for continuous monitoring ifistr+umentation: and ccp,es of all reports regi.iired by this general permit for a perio i of at least 5 years from the state of the sample measurement, report; or application. Expiration — The permittee is not authorized to discharge after the expiration dale of tt1W gwnleraI permit. In order to receive automatic authorization to discharge beyond the expiration date; the permittee shall submit forms and fees as are required by the agency authorized to issue permits no later than 180-days prior to expiration date. Any permittee that has not requested renewal at least 180 days prior to expiration, or any permittee that does not have a permit after the expiration and has not requested renewal at least 180 days prior to expiration, wilt be subject to erlforcen-lent. Failure to renew your permit is a violation. c Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not transferable to any person expect after notice to and approval by the Director of the Division of Water Quality The Director may require modification or revocation and reissuance of the Certificate of Coverage to change the name and incorporate such other requirements as may be necessary under the Clean Water Act. The Permit is NOT transferable. o Name Change, Closure, or Facility Ownership change — The permittee is required to notify the Division in writing in the event the permitted facility is sold or dosed. The Division of Water Quality views changes of name or ownership as a modification that requires the Director's approval and reissuance of the permit. Name and ownership changes required you to complete a Name/Ownership Change Form from the Division and mail it back to the Division of Water Quality along with all appropriate information. c Proper Operation and Maintenance is a requirement of the permit. Please review the general permit and add all missing information. Please update the general location and site maps to include all permit requirements. The site discharges to the Henry Pork (listed on the 2010 303(d) list as impaired for pH and turbidity) and Barger Branch. A TMDE_ has not been developed for the Henry Fork. There have been no spills on site in the past three years but this had not been documented. The permittee has evaluated feasible alternatives, instituted BMPs, preventative maintenance, and good housekeeping practices although they were not documented. Please add this documentation and ensure it is updated annually as well as noting the site personnel responsible for implementing the SPPP. Primary Boiler Fuel Tank was moved into the secondary containment area at the front side of the concrete pad in front of the Maintenance Shed area. (Pictures attached) The spilled material near the drum cleaning facility, (dried, cut -back asphalt) was removed and properly disposed. (Pictures attached). Drum cleaning operation at CSI was discontinued 10+ years ago. Empty drums kept'in that area cannot be reconditioned and will be disposed of properly. 2) Stormwater Pollution Prevention Plan Deficiencies: # Does the Plan include a list of significant spills occurring during the past 3 years? Carolina Solvents, Inc. has had no significant spills within the past three years, 1/1/2008 to present. Chart for recording such spills has been included in the Stormwater Pollution Prevention Plan (SPPP). # Has the facility evaluated feasible alternatives to current practices_ Carolina Solvents, Inc. has reviewed our current practices. Inspections of storm drains, sand bags, and drainage pipes from the holding pond have been added to our SPPP. inspection check -off lists arc lucludrd_ CSI grouncls maintenance supervisor is respunsible for monthly inspections. # Docs the Plart include a BMP Summary' Best Management. Practices (I3r P .—,) include: Paved parking lot is surrounded by an asphalt berm to control any spill. Located at cach storm drain arc sand bags of sulticient nnmher and size to prevent a runoff from entering the drains. Annual training covers closing all storm drains with sand bags in the case of a spill or fire IF such action can be taken without endangering the safety of the employee. Containment dikes around bulk liquid storage containers and loading areas. Holding pond is maintained to catch runoff in the case of a spill. Periodic inspections are scheduled. Raw materials and CSI Products for shipment are stored in buildings or covered storage sheds. Annual training includes procedures to take in the case of any size spill. #Does the Plan include a Preventative Maintenance and Good Housekeeping Plan? Preventative Maintenance and Good Housekeeping Plan is the same for all areas of CSI operations (safe handling of hazardous materials and waste, proper packaging of hazardous materials and waste, proper disposal of hazardous and industrial wastes) and is covered in the annual training session. Preventative Maintenance also includes inspection of sand bags; as well as maintenance of an inventory of sorbant pads, rolls, booms and other material to cleanup and control spills. #Does the Plan include a list of Responsible Party(s)? List of Responsible Party(s): Jackie B. Yoder (Manager/chemist/safety coordinator) Dean Young (Plant Manager) These individuals, and others) participate in annual training that includes all safety, security, and regulatory concerns that pertain to Carolina Solvents, Inc. operations. #Is the Plan reviewed and Updated annually? A Formal Stormwater Pollution Prevention Plan is being written. It will be reviewed and updated annually beginning in 2012. 3) Qualitative Monitoring Has the facility conducted its Qualitative Monitoring semi-annually? Qualitative monitoring will begin in 2011 and will be performed January - June and July -December at each outfall provided a representative storm event occurs in June 2011. Carolina Solvents, Inc. will make application to obtain representative outfall status for outfall 005. 4) Analytical Monitoring Has the facility conducted its Analytical monitoring semi-annually? Analytical monitoring will begin in 2011 and will be performed January - June and July -December at each outfall provided a representative storm event occurs in June 2011. Carolina Solvents, Inc. will make application to obtain representative outfall status for outfall 005. 5) Permit and Outfalls #Has the facility evaluated all illicit (non stormwater) discharges? All storm drains have been inspected during dry weather as part of CSI site inspections. There has been no evidence of illicit discharge (no flow to the stormwater outfalls) during dry weather. Outfalls will continue to be inspected regularly, no less than annually, during dry weather for illicit discharges. Inspections will be recorded as part of our SPPP. Last inspection 6/3/2011.
