Enclosed is a copy of the Compliance Evaluation Inspection (CEI) report for the
inspection conducted at the subject facility on March 20, 2009, by Jeff Mitchell of Charlotte -
Mecklenburg Storm Water Services (CMSWS). This inspection was conducted as part of a
cooperative working agreement between Mecklenburg County and the Division of Water
Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part II Section H. Thank you for your
assistance and cooperation during the inspection.
This report is being issued as a Notice of Violation (NOV) due to the permittee's failure
to update and implement the facility's Stormwater Pollution Prevention Plan in violation of the
subject Stormwater Permit and North Carolina General Statute (G.S.) 143-215.1, as detailed in
the Stormwater Pollution Prevention Plan and Analytical Monitoring sections of the
enclosed report. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five
thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in
accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S.
143-215.1.

Inspection Summary:
Facility Description:
FedEx Freight, Inc. operations consist of loading and unloading freight at a 227 loading bay facility. The permittee
performs maintenance on their trucks consisting of oil changes, auto repair, truck washing, shot blasting, and painting.
The vehicles are refueled on site from multiple underground storage tanks and washed at one of two truck washes.
Compliance History:
The permittee/facility does not have any prior compliance issues with the Division of Water Quality or
Charlotte -Mecklenburg Storm Water Services (CMSWS).
Industrial Operations/City of Charlotte Stormwater Ordinance Review:
The permittee should ensure spill kits near the refueling stations are kept filled and labeled and should add a spill kit at
each location where the underground storage tanks are refueled. The permittee needs to evaluate the truck washing
station to eliminate soaps from contacting the ground outside of the wash bay while trucks are entering the wash area.
The inspector noted a few 55-gallon drums that were stored outside were missing their bungs; the permittee shall replace
the bungs and should move the drums under shelter. Scrap metals should be removed from the surface of the ground
and placed in the appropriate scrap -metal dumpster.
Stormwater pollution Prevention Plan (continued from page 3):
The permittee's SPPP has documentation for employee training that was conducted in 2005-2007, but does not meet the
requirements of [Part II, Section A, 5.1 of the permit. The certification for the SPPP was last updated on December 8,
2004 whereas the permit requires annual updates [Part Il, Section A, 7]. The following items are missing or incomplete in
the SPPP: five years of documentation of monitoring and employee training. [Part II, Section A, 9.].
The permittee shall add a section to their Stormwater Pollution Prevention Plan (SPPP) to address the Vehicle and
Equipment Cleaning Areas section of the NCGO80000 permit. [Part II, Section A, 2.(e)] and the permittee should evaluate
the storage building to ensure compliance with secondary containment requirements. Specifically, the storage of multiple
55-gallon drums or other containers in close proximity of each other with a total capacity exceeding 1,320 gallons requires
the use of secondary containment.

Inspection Finding: The SPPP has not been implemented
Response: The SPPP is now being implemented and all items from the site inspection have beer'
addressed. The prior storm water consultant did not properly train the facility on the inspections
required and did not provide the facility with a SPPP which included, the North Carolina
requirements. The current SPPP is in compliance with the permit requirements, and the pollution
prevention team has been trained on all requirements.

general location snap which shows the name and location cif the receiving water. The SPPP• also
includes information that the receiving water is not an,iinpaired waterbody. The site rn ip is drawn
to scale and Filed as Figure I in the Figures'section of the SPPP. The employee training documents
are now current and meet the requirements of the permit. The SPPP certification is current and will
lie updated with permit requirements.

Inspection Finding: The Division of Water Quality recommends that the permitt&e. use the current
qualitative monitoring form supplied by the Division.
Response: The facility is now using the Stormwater Discharge Outfall Monitoring Qualitative
Monitoring Report.

Analvtical NIonitorin
Inspection Finding: Facility has not conducted Analytical Monitoring,
Response: The previous storm water consultant incorre'aly.instructed the facility to only perform
quarterly visual monitoring, but no analytical monitoring. The facility is now setup to conduct
semi-annual, sampling and DMRs will be submitted to [lie Division. Additionally -the total rainfall,
event duration and total flow are documented on the Discharge Monitoring Report and supporting'
documents. Total new motor oil usage will be recorded from this point forward.

Industrial Operations/Cityof Charlotte Stormwater Ordinance Review:
The facility has ordered additional spill kits and will be located wherefueling is performed: The
facility has changed the washing procedures at the wash bay so soap does not come in contact with
the.ground outside the wash bay by adjusting the nozzles of the soap dispenser and using"less soap. -
The 55-gallon drums that the inspector noted were stored outside have been either removed, or
moved indoors. The scrap metal has been removed and facility personnel have been reminded to
only place scrap metal in the scrap metal dumpster.

Your facility is currently covered for stormwater discharge under General Permit NCG080000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the ge:naral permit, you must apply to the Division of Walur
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance: that your permit will he expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must he completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may he assessed depending on the delinquency of the request. Discharge o1'stormwater from your facility
wilhout coverage under a valid stormwatcr NPDES permit would constititto a violalion of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per clay.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
