under the subject state — NPDES general permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the US Environmental Protection Agency dated
October 15, 2007 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except upon
approval of the Division of Energy, Mineral, and Land Resources. The Division of Energy,
Mineral, and Land Resources may require modification or revocation and reissuance of the
certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may
be required by the Division of Energy, Mineral, and Land Resources, the Coastal Area
Management Act, or any other federal or local government permit that may be required.
In addition to your application for coverage under NCG080000, we also received
your request to rescind coverage under NCG130000. In accordance with your request, your
coverage under Certificate of Coverage NCG130030 has been rescinded effectively
immediately.

Hi Todd,
First, I want to apologize for the delay in getting back to you with a definitive answer to your original question which had
to do with whether NCG13 is the appropriate permit for Safety Kleen's waste oil recycling facility in Mecklenburg County
(the Goodrich site). After conferring with our regional staff, looking into permits for other companies with similar
activities, and discussions with staff in the Stormwater Permitting Unit, I can now recommend that the more appropriate
permit would be NCG08 (Vehicle Maintenance Areas). The reasons for this are primarily: 1) As you originally pointed
out, the NCG13 permit specifically excludes waste oil recycling facilities; and 2) NCG08 requires analytical monitoring for -
non -polar oil and grease, which we believe is warranted for a facility such as this.
We did consider the possibility of an individual stormwater permit, but decided that the NCG08 adequately addresses
the main concerns we would have for stormwater constituents at this site. One thing I'm not sure I ever asked you is the
whether the total petroleum storage capacity at this facility is less than one million gallons. If it is greater than one
million gallons, that may automatically exclude it from coverage under a general permit.
Assuming the total capacity at the Goodrich site is less than one million gallons, my recommendation to you would be to
go ahead and apply for coverage under NCG08. Forms can be found here. You do not need to submit the $100 fee with
your application since you've paid a fee already this year when you renewed the NCG13 permit. In your NCG08
application, please indicate that you would also like to rescind NCG130030 and include a note stating that the fee is
being waived per my request.
Thank you for your patience on this. Please don't hesitate to give me a tail if you have any questions. Also, note that
our Stormwater Permitting Unit has changed divisions — we are now in the Division of Energy, Mineral, and Land
Resources. For now, we have the same mailing address, but that may change in the coming weeks.

I do not believe that the Charlotte Used Oil Recycling facility (Goodrich Drive) would qualify for No Exposure
since they currently utilize an oil/water separator to collect and convey storm water to a concrete holding
reservoir prior to discharge. The concrete bulk tanker truck unloading stations contain sumps and underground
piping to convey any spilled oil and storm water across the property to the oil/water separate system. I wouldn't
think that this type of process would qualify for the exemption. Would you concur?

Hi Todd,
I'm following up on your earlier question about whether your Raleigh Safety Kleen site (NCG130026) could be
considered for No Exposure Certification. You explained that the site has double -walled frac tanks containing oily water
set on concrete pads, with tankers hooking up to them with flexible hoses,
According to the governing federal rules on No Exposure Certification, 40 CFR 122.26(g), facilities may qualify for no
exposure if all facilities and activities are protected by a storm -resistant shelter. It goes on to describe types of
containers that aren't required to have a storm resistant shelter in order to qualify for No Exposure: "Drums, barrels,
tanks, and similar containers that are tightly sealed, provided those containers are not deteriorated and do not leak
("Sealed" means banded or otherwise secured and without operational taps or valves)." Our take on this provision in
regard to your Raleigh facility is that the facility would not qualify for No Exposure Certification because the frac tanks
are not under a "storm -resistant shelter," and they are not "sealed" per federal rule definition.
Here's the rule I'm referring to: 40 CFR 122.26 (R)
As I mentioned on the phone, I'll be back in touch with you regarding the appropriate permit for the Goodrich facility in
Charlotte. We are looking into that same question for a facility that has similar activities in the Raleigh region. In the
meantime, your NCG13 permit for the Goodrich facility will be renewed and will remain active.
I'm copying Danny Smith on this email in case he has anything to add to my analysis. He is a supervisor with the Raleigh
Regional Office of DWQ. The Regional Office would have final say on whether a facility is granted No Exposure
Certification. You are always welcome to call the RO or me if you have further questions.

1 spoke with Julie this morning, and it sounds like there was some confusion about what would trigger analytical
monitoring under NCG08. It was an easy mix-up, as this is not the most straight -forward permit.
Under the NCG08 permit, analytical monitoring is triggered by:

Because activities at this facility do not fit either of those categories exactly, and the issuance letter did not specify
coverage under this General Permit was contingent on certain analytical monitoring, we understand how the permittee
could conclude analytical monitoring provisions ore not applicable at the Goodrich Drive site.
This was not the intent at issuance, according to the email correspondence in the file. DEQ will likely address these
circumstances at renewal later this year. (In fact, it's something that we need to do in the General Permit itself for other
similar facilities that may be under this permit.) I hope this helps clear up the questions you had. Please Include this
record of guidance for your SPPP records In case any questions arise In the future about this topic.

I pulled the permit file today, and I did not see any specific monitoring instructions or clarification in the cover letter
from 2013. 1 did find a copy of Julie's August 7, 2013 email to you explaining that the decision for the NCG08 permit
swap was in part based on non -polar oil and grease monitoring requirements that she and regional staff believed were
warranted for the site. This is a general permit that has confused more than its share of stormwater staff in its history,
though, I can tell you! The assumption appears to be that the facility would monitor, even though it doesn't fit the mold
in the way NCG08 is written.
She is out the rest of the day, so I'll confer with her next week on this and follow back up with you. This may be
something we can handle during the NCG08 renewal process for the Goodrich site so there is less confusion in the
future.

attached.
This certificate of coverage shall become effective December 18, 2013.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.
