Skvarla, III Secretary This Office is in receipt of your letter dated December 3, 2013, requesting temporary relief from the Tier 11 monthly monitoring for total suspended solids (TSS) as contained in the subject stormwater permit. Your request was prompted by construction activities at the Sweden Road Shop that have disturbed areas in and around existing stormwater outfalls. You noted that during construction there is high probability that additional benchmark exceedances will occur until the construction activities have ceased and the site stabilized. As you note the construction activities are not covered under the State's Construction Stormwater permit (NCG100000) because the disturbed area is less than one acre. Since construction stormwater permit coverage is not applicable for the site, the analytical monitoring as required by NCG080000 should be continued semi-annually. However, after the site visit of January 10, 2013, this office agrees that suspension of the Tier 11 monthly monitoring for TSS at Outfalls 001, 002, and 003 is warranted until the ongoing construction activities are completed. The permittee and its contractors is expected to take every measure necessary to prevent sediment from the construction activities from entering stormwater inlets that exist in the vicinity of the construction activities. If you have questions concerning this approval please contact Ms. Marcia Allocco at (704) 235-2204 or marcia.allocco(&ncdenr.govv. The NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and operations planning to reduce pollutant sources. Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general stormwater permits in North Carolina. One condition that is applicable to both the general. permits and individual stormwater permits is the requirement to develop and implement site -specific comprehensive stormwater pollution prevention plans (SPPP). These plans are required to include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge in stormwater runoff. Copies of the general permits and accompanying documents can be accessed from the following webpage: http://portal.ncdenr.Q cl/web/wp/ws/su/npdessw#General Permits NPDES Permit text, technical bulletins, discharge monitoring forms, a Notice of Intent [which is the application of for coverage under a NPDES General Stormwater Permit), and the Representative Outfall Status application can be found on this website. The following items are a subset of permit requirements and are listed to assist you and help bring your attention to certain permitting issues, process, and condition requirements of your permit. Please'see'the abovementioned website to obtain a copy of the'permit so you may fully. comply with the conditions therein. Failure to properly comply with conditions of the permit, like those bulleted below, constitutes permit violations and is subject to civil penalty assessment of up to $25,000.00 per day. , • Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general NPDES stormwater permit or an individual NPDES stormwater permit ; , • All persons desiring to have facilities covered by a General Permit must register with the Division of Water Quality (DWQ) by the filing of a Notice of Intent (NO[) and Applicable Fees. • This Notice of Intent (NOi) must be submitted and a Certificate of Coverage issued prior to any discharge of stormwater associated with the industrial activity, process wastewater, and/or mine dewatering. • Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine dewatering (pursuant to the type of General Permit) until the permit expires or is modified or revoked. • Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable non-stormwater discharge or is covered by another permit, authorization, or approval • There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the permits have the following condition requirements (you must read your entire permit to ensure full compliance): o Development and, compliance with the Stormwater Pollution Prevention Plan o Collection, reporting, and recording of Analytical Monitoring o Collection, reporting, and recording of Qualitative Monitoring Mooresville Regional Office Location: 610 East Center Ave., Suite 301 Mooresville, NC 28115 Phone: (704) 663.16991 Fax: (704) 663-60401 Customer Service:1-877-623-6748 Internet: http://partal.nodenr.orglweblwq/home An Equal Oppalunity l Affirmative Action Employer - 30% Recycled)10% Post Consumer paper hxoli NCana. atur!! Governor Director January 30, 2013 Mr. Craig Miller, Senior Water Quality Specialist Charlotte -Mecklenburg Stormwater Services 600 East Fourth Street Charlotte, North Carolina 28202 Dear Mr. Miller: FILE Natural Resources Subject: Tier If Monitoring Waiver Request City of Charlotte — Sweden Road Shop NPDES Stormwater Permit NCG080000 Certificate of Coverage NCGO80840 Mecklenburg County John E. Skvada, III Secretary This Office is in receipt of your letter dated December 3, 2013, requesting temporary relief from the Tier II monthly monitoring for total suspended solids (TSS) as contained in the subject stormwater permit. Your request was prompted by construction activities at the Sweden Road Shop that have disturbed areas in and around existing stormwater outfalls. You noted that during construction there is high probability that additional benchmark exceedances will occur until the construction activities have ceased and the site stabilized. As you note the construction activities are not covered under the State's Construction Stormwater, permit (NCG100000) because the disturbed area is less than one acre. Since construction stormwater permit coverage is not applicable for the site, the analytical monitoring as required by NCG080000 should be continued semi-annually. However, after the site visit of January 10, 2013, this office agrees that suspension of the Tier II monthly monitoring for TSS at Outfalls 001, 002, and 003 is warranted until the ongoing construction activities are completed. The permittee and its contractors is expected to take every measure necessary to prevent sediment from the construction activities from entering stormwater inlets that exist in the vicinity of the construction activities. If you have questions concerning this approval please contact Ms. Marcia Allocco at (704) 235-2204 or mar_cia.allocco@ncdenr.gov. jSincerely Michael L. We are requesting to be granted a waiver from Tier II monthly monitoring associated with the permit. We have been doing monthly monitoring at one outfall (Outfall 002) for total suspended solids (TSS) due to repeated exceedances of the benchmark value for that parameter. Following is a summary of analytical monitoring results for TSS at Outfall 002: Sampling Date TSS Result m /L Oct 2009 Tier I began) 110 June 2010 Tier II began) 24,000 Oct 2010 240 Jan 2011 1000 Feb 2011 4800 Mar 2011 140 Apr 2011 45 May 2011 2000 Jun 2011 1200 Ju12011 450 Aug2011 220 Se t 2011 250 Oct 2011 44 Nov 2011 67 Mar 2012 270 Apr 2012 220 May 2012 52 Jun 2012 180 • Cb To report pollution, call: 704.336.5500 To report drainage problems, call: 311 CIIAHIHTIT http://stormwater.charmeck,org . Jul 2012 220 Aug2012 470 Sept 2012 56 Oct 2012 160 Nov 2012 290 I have led meetings and site inspections with key personnel to identify and attempt to minimize pollution sources that may be contributing to elevated TSS levels. We have implemented several BMPs at the site, including increased sweeping, inlet protection, increased emphasis on drip/leak. response and cleanup, and employee training. Despite these efforts, we have not been completely successful at obtaining TSS results below the benchmark value, although 4 of the last 11 results were below the benchmark. Additionally, the average of the last I 1 samples was 184 mg/L compared to the average of the first 11 samples (outlier of 24,000 mg/L not included) of 950 mg/L. That data shows that considerable progress has been made. Currently, a significant construction addition to the maintenance building is underway. The project will create disturbed areas with exposed sediment. While erosion and sedimentation control measures will be used according to the site's erosion control plan, and all measures will be inspected and maintained, we are concerned that the construction project will inevitably result in some sediment loss that will affect TSS results at Outfall 002. For this reason, we are requesting to temporarily suspend Tier It monthly monitoring for TSS at Outfall 002 until the project is completed. We will, ofcourse, continue with sampling as required by the permit until we hear further from your office. Once the project is complete, we will monitor the site closely and address any additional concerns according to permit conditions. Thank you for considering our request. Please contact me at (704) 336-7605 or at emmiller charlottene. ov if you would like to discuss this request in further detail.
