I am submitting this letter to assign Ms. Kristen O'Reilly, Water Quality Program
Specialist with Charlotte -Mecklenburg Storm Water Services, as my duly authorized
representative for the purposes of submitting reports required by this General Permit.
Kristen O'Reilly manages the City of Charlotte's Municipal Pollution Prevention and
Good Housekeeping program and coordinates activities of the above facilities for
compliance with their Storm Water Pollution Prevention Plans and this General Permit.

This Office is in receipt of your letter dated December 3, 2013, requesting temporary relief from the Tier 11
monthly monitoring for total suspended solids (TSS) as contained in the subject stormwater permit. Your
request was prompted by construction activities at the Sweden Road Shop that have disturbed areas in
and around existing stormwater outfalls. You noted that during construction there is high probability that
additional benchmark exceedances will occur until the construction activities have ceased and the site
stabilized. As you note the construction activities are not covered under the State's Construction
Stormwater permit (NCG100000) because the disturbed area is less than one acre.
Since construction stormwater permit coverage is not applicable for the site, the analytical monitoring as
required by NCG080000 should be continued semi-annually. However, after the site visit of January 10,
2013, this office agrees that suspension of the Tier 11 monthly monitoring for TSS at Outfalls 001, 002, and
003 is warranted until the ongoing construction activities are completed. The permittee and its contractors
is expected to take every measure necessary to prevent sediment from the construction activities from
entering stormwater inlets that exist in the vicinity of the construction activities.

On January, 2012, Ms. Marcia Allocco from the Mooresville Regional Office of the Division of Water Quality (DWQ)
conducted a site inspection of the City of Charlotte Sweden Road Shop. The site drains to an unnamed tributary to
Kings Branch, Class C waters located in the Catawba River Basin.' The site visit and file review revealed that the
subject facility is cov6red by NPDES General Stormwater Permit — NCG080000.
Accordingly, the following observations were noted during the DWQ inspection as detailed in the attached inspection
report (please see the attached addendum for information about your permit):

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general. permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
stormwater pollution prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge in stormwater
runoff.

The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process, and condition requirements of your permit. Please'see'the
abovementioned website to obtain a copy of the'permit so you may fully. comply with the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, constitutes permit
violations and is subject to civil penalty assessment of up to $25,000.00 per day. ,
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit ; ,
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by the filing of a Notice of Intent (NO[) and Applicable Fees.
• This Notice of Intent (NOi) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering (pursuant to the type of General Permit) until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):
o Development and, compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting, and recording of Qualitative Monitoring

o Collection, reporting, and recording of Vehicle Maintenance Monitoring
o Records — Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o' Expiration — The permittee is not authorized to discharge after the -expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to expiration date. Any permittee that has not requested renewal at
least 180 days prior to expiration, or any permittee that does not have a permit after the
expiration and has not requested renewal at least 180 days prior to expiration, will be subject to
enforcement. Failure to renew your permit is a. violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director of the Division of
Water Quality. The Director may require modification or revocation and reissuance of the
Certificate of Coverage to change the name and incorporate such other requirements as may be
necessary under the Clean Water Act. The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change — The permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes required you to complete
a Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

Comment: The SPPP was very detailed and had been updated annually; the last
review conducted in December 2012. Employee training is -conducted annually; the
2012 training list did not contain any training dates for a few employees at the facility.
This was attributed to computer database issues as well as an employee being away
from work long-term. Please ensure that the annual review includes a review of any
outstanding training requirements.

Comment: The facility has three outfalls. Outfall 002 has entered into Tiered response
for elevated TSS concentrations. BMPs have been implemented and average TSS
concentrations have been reduced but below benchmarks. Active construction at site
during inspection could lead to exceedances as well as upstream sources (CDOT
facility). Inspector discussed some avenues to explore on TSS sources once
construction is completed.

This Office is in receipt of your letter dated December 3, 2013, requesting temporary relief from the Tier II
monthly monitoring for total suspended solids (TSS) as contained in the subject stormwater permit. Your
request was prompted by construction activities at the Sweden Road Shop that have disturbed areas in
and around existing stormwater outfalls. You noted that during construction there is high probability that
additional benchmark exceedances will occur until the construction activities have ceased and the site
stabilized. As you note the construction activities are not covered under the State's Construction
Stormwater, permit (NCG100000) because the disturbed area is less than one acre.
Since construction stormwater permit coverage is not applicable for the site, the analytical monitoring as
required by NCG080000 should be continued semi-annually. However, after the site visit of January 10,
2013, this office agrees that suspension of the Tier II monthly monitoring for TSS at Outfalls 001, 002, and
003 is warranted until the ongoing construction activities are completed. The permittee and its contractors
is expected to take every measure necessary to prevent sediment from the construction activities from
entering stormwater inlets that exist in the vicinity of the construction activities.

I am writing on behalf of the City of Charlotte -- Sweden Road Shop facility, which
operates under Certificate of Coverage No. NCG080840 to discharge stormwater from
the facility into surface waters. We are requesting to be granted a waiver from Tier II
monthly monitoring associated with the permit.
We have been doing monthly monitoring at one outfall (Outfall 002) for total suspended

I have led meetings and site inspections with key personnel to identify and attempt to
minimize pollution sources that may be contributing to elevated TSS levels. We have
implemented several BMPs at the site, including increased sweeping, inlet protection,
increased emphasis on drip/leak. response and cleanup, and employee training. Despite
these efforts, we have not been completely successful at obtaining TSS results below the
benchmark value, although 4 of the last 11 results were below the benchmark.
Additionally, the average of the last I 1 samples was 184 mg/L compared to the average
of the first 11 samples (outlier of 24,000 mg/L not included) of 950 mg/L. That data
shows that considerable progress has been made.
Currently, a significant construction addition to the maintenance building is underway.
The project will create disturbed areas with exposed sediment. While erosion and
sedimentation control measures will be used according to the site's erosion control plan,
and all measures will be inspected and maintained, we are concerned that the construction
project will inevitably result in some sediment loss that will affect TSS results at Outfall
002. For this reason, we are requesting to temporarily suspend Tier It monthly
monitoring for TSS at Outfall 002 until the project is completed.
We will, ofcourse, continue with sampling as required by the permit until we hear further
from your office. Once the project is complete, we will monitor the site closely and
address any additional concerns according to permit conditions.
