On July 17, 2012, Ms. Marcia Allocco from the Mooresville Regional Office of the Division of Water Quality
(DWQ) conducted a site inspection of the City of Charlotte Light Vehicle Maintenance facility. The site drains
to an unnamed tributary to Irwin Creek, Class C waters located in the Catawba River Basin. The site visit and
file review revealed that the subject facility is covered by NPDES General Stormwater Permit _ NCG080000.
Accordingly, the following observations were noted during the DWQ inspection as detailed in the attached
inspection report (please see the attached addendum for information about your permit):

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
stormwater pollution prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge in stormwater
runoff.

The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process, and condition requirements of your permit. Please see the
abovementioned website to obtain a copy of the permit so you may fully comply with the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, constitutes permit
violations and is subject to civil penalty assessment of up to $26,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES. stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by the filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering (pursuant to the type of General Permit) until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):

o Collection, reporting, and recording of Analytical Monitoring

o Collection, reporting, and recording of Vehicle Maintenance Monitoring
o Records — Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to expiration date. Any permittee that has not requested renewal at
least 180 days prior to expiration, or any permittee that does not have a permit after the
expiration and has not requested reriewal at least 180 days prior to expiration, will be subject to
enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director of the Division of
Water Quality. The Director may require modification or revocation and reissuance of the
Certificate of Coverage to change the name and incorporate such other requirements as may be
necessary under the Clean Water Act. The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change — The permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes required you to complete
a Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

Comment: The facility has had three spills in the last five years; clean-up summaries
were included in the SPPP. SPPP contains a very detailed description of the activities
conducted on site. Please ensure during the next annual update that the descriptions
have been updated to reflect current practices since upgrade to street sweeper area.
All ASTs on site are double -walled. The compliance task list is a great tracking tool to
ensure compliance obligations under the general permit are met.

Comment: Permittee has completed semi-annual monitoring since 2008. Monitoring
results have greatly improved since work was completed to capture and direct runoff
from the street sweeper discharge area to the sanitary sewer and to cover the area to
prevent stormwater introduction. The 2013 sampling showed a TSS benchmark
exceedance for Outfall 001. Prior sampling had resulted in a Tiered response by the
permittee including monthly monitoring. As discussed during the inspection the
samplinglexceedances are reset with the newest version of the general permit as are
the permittee's responsibilities for the tiered response(s).

Comment: Permittee was granted representative outfall status (Outfall 010
representative of Outfalls 008 & 009) in 2009 when the Light Vehicle shop was part of
this facility. The Light Vehicle shop has since moved and there are currently only 4
Outfalls. Two outfalls (001 & 004) are located west of Louise Ave. and two outfalls (002
and 003) are located east of Louise Ave. (where garbage trucks are parked). There
was staining on the parking lot leading to Outfalls 002 & 003 and during the inspection a
garbage truck was actively leaking "juice". The City has installed straw bales around
the curb inlets to mitigate these leaks. However, since the general permit does not
require monitoring for pollutants (BOD) that would indicate impacts from the garbage
truck releases the City should consider additional monitoring to ensure this selected
BMP is mitigating these types of stormwater pollutants and if necessary select
additional/different BMPs.

Coverage Number NCG080822 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of Stormwater to
waters of the State without valid coverage under an NPDES permit will subject the responsible party to a
civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will
occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing permit
coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should
notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's
surface waters, you must first apply for and receive a new NPDES permit.

the new or prospective owners of their potential need for NPDES permit coverage.

NC DENR recently informed the City of Charlotte that we need to obtain a Certificate of
Coverage (COC) under NCG080000 for one of our vehicle maintenance facilities that is currently
not covered. Rather than obtaining a separate COC for our Light Vehicle Shop on Seigle
Avenue, we will be including the facility under the existing COC for Central Yard (NCG080000).
The facility name listed in NC DENR's database is City of Charlotte-Stormwater Services -
Central Yard. Because the Light Vehicle Shop is part of Central Yard (a series of city operations
on contiguous properties) we felt that incorporating the facility under the existing COC was the
most logical decision.
The COC was not obtained last year because it was my feeling that NCG080000 did not apply to
the Light Vehicle Shop because its SIC Code was not one of those listed in the Transit and
Transportation general permit; however, we were informed that it still requires coverage because
of the following clause in the permit: Other activities, not categorically required to be permitted,
such as point source stormwater discharges from oil water separators, secondary containments
structures at petroleum storage facilities with total petroleum storage capacity of less than 1
million gallons, and/or vehicle maintenance areas at any facilities other than those listed above,
which may be designated on a case -by -case basis as being required -to be permitted.
We will spend the next thirty (30) days modifying the existing Stormwater Pollution Prevention
Plan for Central Yard, including the Site Map, and will subsequently notify you when the SPPP
modification is complete. We will then begin implementing the modified SPPP and all permit
requirements at the Light Vehicle Shop. Just to note, we are already implementing most permit
requirements at the shop as part of the requirements of the City of Charlotte's Phase I MS4
permit, specifically under the Municipal Good Housekeeping and Pollution Prevention program.
The main change will be conducting monitoring of additional outfalls at the shop.

As indicated in my letter to you dated June 1, 2009, we are adding the City of Charlotte Light
Vehicle Shop to Certificate of Coverage (COC) #NCG080822, which is for the City of Charlotte-
Stormwater Services -Central Yard. In that letter I also indicated that we would spend the next 30
days modifying the Stormwater Pollution Prevention Plan to include the Light Vehicle Shop. We
have completed that modification and are now implementing the revised SPPP.
Very soon I will be submitting a Representative Outfall Status Request Form for outfalls located
at the Light Vehicle Shop. As instructed by the form to do, I will send that form to the
Mooresville Regional Office and will copy you on that correspondence.

Our records indicate that you have been issued the subject Certificate of Coverage (COC) under
General Permit (GP) No. NCGO80000 from the North Carolina Division of Water Quality to discharge
stormwater associated with industrial activities performed at the subject facility. The purpose of this
letter is to advise you of the importance of the GP and the liabilities in the event of failure to comply
with the terms and conditions of the GP. If you have not already done so, it is suggested that you
thoroughly read the GP. Of particular importance is Part II, Sections A through D.
Part II is titled "MONITORING, CONTROLS, AND LIMITATIONS FOR PERMITTED
DISCHARGERS". Part II, Section A discusses the need to develop a Stormwater Pollution Prevention
Plan (SPPP), which includes, but is not limited to the following components: a site plan, a stormwater
management plan, a spill prevention and response plan, preventative maintenance and good
housekeeping program, and employee training. Specific guidance as to the information to be included in
each plan is also listed in this Section. Section B sets forth the analytical monitoring that should be
performed at all outfalls that discharge Stormwater runoff from facilities that have vehicle maintenance
areas and use more than 55 gallons of new motor oil per month.
Part II, Sections C is titled "DISCHARGE LIMITATIONS AND ANALYTICAL
MONITORING REQUIREMENTS - OIL WATER SEPARATORS AND PETROLEUM BULK
STATIONS AND TERMINALS". Table 3 of this Section sets forth the analytical monitoring required
by your GP if you discharge from an oil/water separator and/or a petroleum bulk station or terminal.
Part I1, Section D of the GP sets forth the qualitative monitoring required during the term of your permit,
which should coincide with the initial analytical monitoring event (regardless of the season). Table 4
lists the qualitative monitoring to be performed during the term of this permit.

Part III of the GP consists of general conditions and definitions consistent with all GPs, which are
applicable to your SW discharge. These conditions also include special reporting requirements in the
event of noncompliance, bypassing of treatment works (if applicable), and other conditions that pertain
to your stormwater discharge. In Part III, Section B (2), please note that GPs are not transferable. -If
you, as the permittee, cease to need this COC (for example: your facility has closed), then you should
submit a request to the Division that the COC be rescinded. It should also be noted that the GP requires
that any monitoring data be retained by the permittee for a period of three (3) years and made available
to a Division representative upon request. If you haven't already done so, please note that any analytical
and/or qualitative monitoring as required by this GP should begin upon commencement of your SW
discharge as a result of a representative storm event.
Failure to comply with the terms and conditions of any NPDES Permit may subject the permittee
to enforcement action pursuant to Section 143-215.6 of the North Carolina General Statutes in the form
of civil penalties of up to $25,000 per violation. Criminal penalties may also be recommended for
violations determined to be intentional or willful. If you find that you are unable to comply with the
terms and conditions of the GP, you should contact this Office immediately.
Lastly, when a representative from this Office contacts you in order to conduct an inspection of
your facility, you should be prepared to demonstrate compliance with all terms and conditions included
in the GP. When an inspection is scheduled at your facility, the inspection will focus on evaluating the
following items: Stormwater Pollution Prevention Plan, stormwater outfall locations, a review of any
qualitative and/or analytical monitoring data required by the GP, and any other activities that may be
required by the GP that are unique to your discharge.

I am writing on behalf of the City of Charlotte — Central Yard facility, which operates
under Certificate of Coverage No. NCG080822 to discharge stormwater from the facility
into surface waters. We are requesting to be granted a waiver for Tier II monthly
monitoring associated with the permit.
We have been doing monthly monitoring at one outfall (Outfall 001) for total suspended
solids (TSS) due to repeated exceedances of the benchmark value for that parameter.

I have led numerous meetings and site inspections with key Central Yard personnel to
identify and attempt to minimize pollution sources that may be contributing to elevated
TSS levels. We have implemented several BMPs at the site, including increased lot
sweeping, increased frequency of BMP cleanouts, increased emphasis on drip/leak
response and cleanup, and employee training. Despite these efforts, we have not been
completely successful at obtaining TSS results below the benchmark value, with the
exception of our latest sample collected on January 21, 2010 (66 mg/L).

The drainage area to Outfall 001 includes a heavy vehicle maintenance shop, two vehicle
wash bays and a Solid Waste Special Services yard, the latter of which includes a street
sweeper vehicle rinse pad, storage of street sweeping waste, and bulky item storage. All
vehicle washing and: rinsing wastewater is discharged to the sanitary sewer.
A lar ?capital improvement project is in progress for the entire Outfall 001 drainage
area. It has been in the design phase for quite some time, but design is near 100% and
construction should begin in the 2"d quarter of 2010. Major structural improvements
designed to improve stormwater quality are included in the project, and total cost for the
project exceeds $500;000. We are expecting significant improvement in stormwater
runoff quality once the project is completed.
As mentioned, we have attempted numerous improvements and have not achieved results
that are consistently below the benchmark value. For this reason, because of the
upcoming project, and because of significant costs associated with staff time and
laboratory analyses, we do not feel that additional monthly sampling is practical at this
time.
We will, of course, continue with sampling as required by the permit until we hear further
from your office. Once the capital improvement project is complete, we will monitor the
site closely and address any additional concerns according to permit conditions.

2009, for a determination that stormwater discharge outfall (SDO) 010 be granted representative outfall
status for stormwater outfalls 008 and 009. Based on the information provided, we are hereby approving
this request effective immediately. In accordance with 40 CFR §122.21(g)(7), you are authorized to
sample outfall number 010 as a representative outfall. Sampling of SDO 010 should begin at your next
representative sampling event. We also want to remind you that the permit still requires Qualitative
Monitoring be performed at all SDOs, regardless of representative status unless the outfall is not
captured by the Phase I stormwater program.

In accordance with your application for a discharge permit received on April 10, 2008, we are
forwarding herewith the subject certificate of coverage (COC) to discharge under the subject state —
NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
If any parts, measurement frequencies, or sampling requirements.contained in this permit are
unacceptable to you, you Have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality, The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the
Division of Land Resources, Coastal Area Management Act or any other federal or local governmental
permit that may be required.
In addition, the existing permit NCG080047, for the City of Charlotte Heavy Truck Shop will be
rescinded, since you have included that facility in this above new permit, NCG080822.
