Staff with the Division's Mooresville Regional Office have reviewed your request for a determination that
stormwater discharge outfall (SDO) FLSW01 ("C") be granted representative outfall status. Based on the
information provided and a site visit by Mr. Michael Parker with this Office on November 18, 2009, we are hereby
approving this request effective immediately. In accordance with 40 CFR §122.21(g)(7), you are authorized to
sample outfalI number FLSW01 as a representative outfall. Sampling of SDO FLSW01 should begin at your next
representative sampling event. Please be reminded that the permit still requires Qualitative Monitoring be
performed at all SDOs, regardless of representative status unless the outfall is not captured by the Phase I
stormwater program.
Please append this letter to your Stormwater Pollution Prevention Plan (SPPP) or permit to document that
representative outfall status has been approved. In addition, Best Management Practices implemented at this
facility should be included in your SPPP to reflect recent changes in your operational activities. if changes in
drainage areas, structures, processes, storage practices, or other activities occur that significantly alter the basis of
this approval, representative outfall status may no longer be valid. You should either resume sampling at all
SDOs, or reapply to this Office for representative outfall status based on updated information. If you have any

Dear Mr. Parker,
Per your site visit on March 17, 2009, you suggested that the City investigate Catch basin
# 1 as an alternative representative sampling point for the subject permitted site. Please refer to the
attached map for the proposed sample location. The findings of Catch basin # 1 are as follows:
Catch basin # 1 is located on Franklin Street and collects runoff from the entire subject
permitted site. Please note that catch basin # 1 also collects runoff from N. Fulton to N.
Church Streets and surrounding drainage areas. N. Fulton and N. Church Streets are
upstream from Catch basin # 1.
The sampling data from Catch basin # 1 shows a potential for exceeding the benchmark of
100 mg/L for TSS, due to the traffic from the railroad crossing on Church Street and the
surrounding residential lawn maintenance and car washing activities. Please note that
Public Services has assessed their site for all potential pollutant sources and made
corrective actions accordingly.
In summary, the City does not agree with Catch basin # 1 being assigned as its sampling
location for this facility. We feel it is not a "true" representative sample location due to the outside
contributors to this catch basin as stated above. Public Services has no authority outside its
property boundaries to regulate outside contributors' activities.

basin "l ". The City requests that monitoring be performed at stormdrain "C" due to the catch

the facility.
3) Stormdrain "E" is an elevated drain that doesn't receive any upstream runoff from the facility
process area. This drain discharges into catch basin "1". Catch basin "1" is combined flow
including the runoff from N. Fulton and Franklin Streets. The city has budgeted to rehab this drain
to a wash area (including the installation of an oil & water separator) to discharge to the city's
collection system. The city requests that monitoring from this drain be taken off our monitoring
requirements.
In summary, neither outfall "1 " or "2" is representative of the site. The city requests that

In accordance with your application for a discharge permit received on March 17th, 2008, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state — NPDES
general permit. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection Agency dated May 9, 1994 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area
Management Act or any other federal or local governmental permit that may be required.

We've received an NOI from the City of Salisbury (Rowan County) for coverage of
their Public services Facility under NCG08 ('transportation SW permit). The site
discharges stormwater into a UT to Grants Creek Creek (C). The NOI is attached.
The only thing that seems a bit odd about this permit was that they say they are
not a Hazardous waste Generator, but they do generate used motor oil - if they
recycle it its not considered Haz waste but if they don't recycle it its is
considered Haz waste. They were not clear in their NOT as to whether or not they
were recycling it or not.
Does the Mooresville Regional Office have any concerns about issuing this facility
a COC for this general permit? If you are unable to visit the site within 30 days
that is fine - please just review your files let me know if you have any concerns
regarding the issuance of this permit. If we don't receive any objections, we'll
issue the COC in 30 days (April 28th, 2008).

Dear Mr. Sterling:
Our records indicate that you have been issued the subject Certificate of Coverage (COC)
under General Permit (GP) No. NCGO80000 from the North Carolina Division of Water Quality to
discharge stormwater associated with industrial activities performed at your facility. The purpose of
this letter is to advise you of the importance of the GP and the liabilities in the event of failure to
comply with the terms and conditions of the GP. If you have not already done so, it is suggested that
you thoroughly read the GP. Of particular importance are Part II and Part 11I, Sections A & B.
Part 11 is titled "MONITORING, CONTROLS, AND LIMITATIONS FOR PERMITTED
DISCHARGERS". Part II, Section A discusses the need to develop a Stormwater Pollution
Prevention Plan (SPPP), which includes, but is not limited to the following components: a site plan, a
Stormwater management plan, a spill prevention and response plan, preventative maintenance and
good housekeeping program, and employee training. Specific guidance as to the information to be
included in each plan is also listed in this Section. Section B sets forth the analytical monitoring that
should be performed at all outfalls that discharge stormwater runoff from facilities that have vehicle
maintenance areas and use more than 55 gallons of new motor oil per month.
Part II, Sections C is titled "DISCHARGE LIMITATIONS AND ANALYTICAL
MONITORING REQUIREMENTS - OIL WATER SEPARATORS AND PETROLEUM BULK
STATIONS AND TERMINALS". Table 3 of this Section sets forth the analytical monitoring
required by your GP if you discharge from an oil/water separator and/or a petroleum bulk station or
terminal. Part II, Section D of the GP sets forth the qualitative monitoring required during the term of
your permit, which should coincide with the initial analytical monitoring event (regardless of the
season). Table 4 lists the qualitative monitoring to be performed during the term of this permit.

Part III of the GP consists of general conditions and definitions consistent with all GPs, which
are applicable to your SW discharge. These conditions also include special reporting requirements in
the event of noncompliance, bypassing of treatment works (if applicable), and other conditions that
pertain to your stormwater discharge. In Part III, Section B (2), please note that GPs are not
transferable. If you, as the permittee, cease to need this COC (for example: your facility has closed),
then you should request that the COC be rescinded. It should also be noted that the GP requires that
any monitoring data be retained by the permittee for a period of three (3) years and made available to
a Division representative upon request. If you haven't already done so, please note that any analytical
and/or qualitative monitoring as required by this GP should begin upon commencement of your SW
discharge as a result of a representative storm event.
Failure to comply with the terms and conditions of any NPDES Permit may subject the
permittee to enforcement action pursuant to Section 143-215.6 of the North Carolina General Statutes
in the form of civil penalties of up to $25,000 per violation. Criminal penalties may also be
recommended for violations determined to be intentional or willful. If you find that you are unable to
comply with the terms and conditions of the GP, you should contact this Office immediately.
Lastly, when representatives from this Office contact you in order to conduct an inspection of
your facility, you should be prepared to demonstrate compliance with all terms and conditions
included in the GP. When an inspection is scheduled at your facility, the inspection will focus on
evaluating the following items: Stormwater Pollution Prevention Plan, stormwater outfall locations, a
review of any qualitative and/or analytical monitoring data required by the GP, and any other
activities that may be required by the GP that are unique to your discharge. This information should
be readily available if requested by a Division representative.
