The City of Charlotte has two Charlotte Area Transit System (CATS) bus maintenance
facilities with Certificates of Coverage under NPDES Stormwater General Permit
NCG080000:
• 3145 South Tryon Street, Certificate of Coverage number NCG080814,,and
• 901 North Davidson Street, Certificate of Coverage number NCG080815.
This General Permit requires municipal reports that are submitted to the state to be signed
and certified by a principal executive officer, ranking elected official, or a duly
authorized representative.
I am submitting this letter to assign Ms. Kristen O'Reilly, Water Quality Program
Specialist with Charlotte -Mecklenburg Storm Water Services, as my duly authorized
representative for the purposes of submitting reports required by this General Permit.
Kristen O'Reilly manages the City of Charlotte's Municipal Pollution Prevention and
Good Housekeeping program and coordinates activities of the above facilities for
compliance with their Storm Water Pollution Prevention Plans and this General Permit.

Dear Mr. Miller:
This Office is in receipt of your letter dated March 21, 2011, requesting temporary relief from the
benchmark value for Total Suspended Solids (TSS) as contained in the subject stormwater permit. The
reason for your request is due to ongoing construction activities at the site that have disturbed areas in
and around existing stormwater outfalls. Recent sampling of these outfalls has documented TSS values
that have exceeded the benchmark value for this parameter which is 100 mgll, In your letter you
indicated that as long as these land disturbing activities continue, there is a high probability that
additional benchmark exceedances will occur until such time as the construction activities have been
completed and the site stabilized. You also indicated that that the ongoing construction activities are not
covered by a separate Construction Stormwater permit (NCG010000) due to the fact that the area of
disturbance is less than 1 acre.
With no Construction Stormwater permit available to cover grading activities at this site,
analytical testing as prescribed in the subject COC should be continued at the prescribed frequencies.
This Office, however, grants permission for the suspension of Tier II level monitoring for TSS at outfalls
002 and 003 until such time as the ongoing construction activities are complete and the areas adjacent
to the outfalls are stabilized. The permittee is expected to take every measure necessary to prevent
sediment from ongoing construction activities to enter stormwater drainage inlets that exist in the
vicinity of the construction zone during the time the site grading activities are underway.

I am writing on behalf of the City of Charlotte — Charlotte Area Transit System Transit
Maintenance Operations Facility (CATS TMOC), which operates under Certificate of
Coverage # NCG080815 to discharge stormwater from the facility into surface waters.
We have been doing monthly total suspended solids (TSS) monitoring at two outfalls
(Outfalls 002 & 003) due to repeated exceedances of the benchmark value for that
parameter. The attached Site Map shows the location of the two referenced outfalls and
outlines their drainage areas. We are requesting to be granted a waiver from Tier II TSS
monitoring associated with the permit until all phases of a construction/renovation project
that's currently taking place are completed.
The project began approximately one year ago, and includes complete renovation of the
maintenance building and construction of a new parking deck. Despite implementing
erosion and sedimentation control best practices to minimize sediment runoff, the
analytical sampling results have continued to be above the permit benchmark of 100
mg/L. Prior to construction activities the facility experienced only one benchmark
exceedance at Outfall 002, and that was found to be due to an abundance of leaves in the
drainage area.
The current phase of the project will be completed in July 2011; however, another phase
of renovation is supposed to begin between November of 2011 and May of 2012. That
phase is estimated to be complete at the end of 2012. It too will involve exposed soils as
old underground storage tanks will be removed and replaced and new bus parking
canopies will be constructed.

Transit operations ceased at the facility at the time construction/renovation began. The
only activity taking place at the site is construction. Because the site is under one acre in
size, it was not issued coverage under the NPDES General Stormwater Permit for
Construction Activities. Since the site is and will continue to be a construction site rather
than a transit facility for some time, I would like to propose that, in lieu of continuing to
conduct analytical monitoring, we be allowed to follow the permit conditions in
NCGO10000.
We will, of course, continue with monitoring as required by the permit until we hear
further from your office. We will notify you of any significant changes in site activity,
including re -opening of the site for transit maintenance activities as well as the start of
the next construction/renovation phase.

Our records indicate that you have been issued the subject Certificate of Coverage (COC) under
General Permit (GP) No. NCGO80000 from the North Carolina Division of Water Quality to discharge
stormwater associated with industrial activities performed at the subject facility. The purpose of this
letter is to advise you of the importance of the GP and the liabilities in the event of failure to comply
with the terms and conditions of the GP. If you have not already done so, it is suggested that you
thoroughly read the GP. Of particular importance is Part II, Sections A through D.
Part II is titled "MONITORING, CONTROLS, AND LIMITATIONS FOR PERMITTED
DISCHARGERS". Part II, Section A discusses the need to develop a Stormwater Pollution Prevention
Plan (SPPP), which includes, but is not limited to the following components: a site plan, a stormwater
management plan, a spill prevention and response plan, preventative maintenance and good
housekeeping program, and employee training. Specific guidance as to the information to be included in
each plan is also listed in this Section. Section B sets forth the analytical monitoring that should be
performed at all outfalls that discharge stormwater runoff from facilities that have vehicle maintenance
areas and use more than 55 gallons of new motor oil per month.
Part II, Sections C is titled "DISCHARGE LIMITATIONS AND ANALYTICAL
MONITORING REQUIREMENTS - OIL WATER SEPARATORS AND PETROLEUM BULK
STATIONS AND TERMINALS". Table 3 of this Section sets forth the analytical monitoring required
by your GP if you discharge from an oil/water separator and/or a petroleum bulk station or terminal.
Part II, Section D of the GP sets forth the qualitative monitoring required during the term of your permit,
which should coincide with the initial analytical monitoring event (regardless of the season). Table 4
lists the qualitative monitoring to be performed during the term of this permit.

Part III of the GP consists of general conditions and definitions consistent with all GPs, which are
applicable to your SW discharge. These conditions also include special reporting requirements in the
event of noncompliance, bypassing of treatment works (if applicable), and other conditions that pertain
to your stormwater discharge. In Part III, Section B (2), please note that GPs are not transferable. if
you, as the permittee, cease to need this COC (for example: your facility has closed), then you should
submit a request to the Division that the COC be rescinded. It should also be noted that the GP requires
that any monitoring data be retained by the permittee for a period of three (3) years and made available
to a Division representative upon request. If you haven't already done so, please note that any analytical
and/or qualitative monitoring as required by this GP should begin upon commencement of your SW
discharge as a result of a representative storm event.
Failure to comply with the terms and conditions of any NPDES Permit may subject the permittee
to enforcement action pursuant to Section 143-215.6 of the North Carolina General Statutes in the form
of civil penalties of up to $25,000 per violation. Criminal penalties may also be recommended for
violations determined to be intentional or willful. If you find that you are unable to comply with the
terms and conditions of the GP, you should contact this Office immediately.
Lastly, when a representative from this Office contacts you in order to conduct an inspection of
your facility, you should be prepared to demonstrate compliance with all terms and conditions included
in the GP. When an inspection is scheduled at your facility, the inspection will focus on evaluating the
following items: Stormwater Pollution Prevention Plan, stormwater outfall locations, a review of any
qualitative and/or analytical monitoring data required by the GP, and any other activities that may be
required by the GP that are unique to your discharge.

general permit. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection Agency dated May 9, 1994 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
