PROJECT SUMMARY: Applicant proposes to construct a pier on a joint property line to serve two single family residences. Ken Dull Page 2 9. PROJECT DESCRIP'T'ION 4/10/96 The project site is located on Cedar Island in the development known as Cedar Island North. The two lots involved are the first two to the north of the bridge, on the east side of the island adjacent to Greenville Sound. This island has been recently developed, though the area has evidence of overwash throughout. Topography maps show the average elevation in this area to be 3.8' mean sea level; however, in the application, the consultant claims 5' mean high water. Given a tidal amplitude of approximately 4' in the area, a more reasonable high ground elevation for the tract would seem to be around 2' above mean high water. The island contains many acres of coastal and Section 404 wetlands. Lots 6 (.45 acres) and Lot 7 (.67 acres) are involved in this application, with a newly constructed residence on Lot 7. Lot 6 is currently vacant. This area is served by county sewer and private wells. The tract is vegetated with pines, oaks, wax myrtle, and yaupon on the high ground. At the eastern side there is a wetland buffer of approximately 5' of Borrichia frutescens, S artina patens, and Iva frutescens. There is a span of S artina alterniflora for approximately 325' to the open water. Within the riparian corridor lines of the two properties, and in the path of the proposed pier lies a small island with a fringe of Borrichia frutescens, Salicornia spy, and Iva frutescens. The higher portions of this island are vegetated with oaks and red cedar. The point of this island where the pier crosses is approximately 40' across. The applicant's deeded tract does not incorporate this area. However, being above mean high water would remove it from state ownership. The applicant has searched the county records and determined that there is no ownership of this area, and is currently placing a quit claim to the property. The substrate beyond the marshgrass is sandy and the body of water is approximately 560' across. Cedar Island lies on the border of the Masonboro Sound Outstanding Resource Waters designated area. The Division of Environmental Management has placed the island in the ORW area at times, and out of the area at others. It is my understanding that the current interpretation is that the island lies within the ORW boundary. The water classification is SA-ORW. The Division of Marine Fisheries has designated Greenville Sound as Primary Nursery, and the area is open to the taking of shellfish for consumption. The New Hanover County Land Use Plan classifies the area as Conservation. The applicant is proposing to construct a 420' pier along the common property line between Lots 6 and Lots 7. Authorization is on file from Mr. Walden, the owner of Lot 6, for Mr. Dull to apply for this project on both properties. The pier would begin as two 6' wide walkways 10' inside each property line. They converge approximately 20' from their beginnings, and become one 6' wide structure. The pier crosses the above mentioned wetland fringe, a 30' span of S artina alterniflora, the 40' stretch of high ground and high marsh that has no ownership, and another 295' of S artina alterniflora. There is a small creek that becomes an unvegetated slough within the marsh span. While this probably cannot be called a channel, it is in fact navigable during the top half of the tidal schedule, and is connected to Greenville Sound. The applicant has proposed to construct an 8' wide manual drawbridge at the most navigable portion of this area. The pier extends beyond the edge of the marsh for 50' and connects to a 14' x 14' gazebo. A ramp with a 15' span connects this structure to a 61' x 6' floating dock that parallels the shoreline, supporting two finger docks. The finger docks are proposed to be 4.5' in width and 30' in length. Six mooring pilings are to be placed to the north, south, and center of the fingers (the applicant states the intent to place 8 pilings, but 2 of these are supporting the finger docks, and not to be used for mooring). The structure terminates in -7' mean low water, and is intended to support the mooring of 4 vessels (the waterdepth on the west side of the support float is -2 mean low water). The total project length is 485', extending approximately 115' into the body of water, and ceases approximately 90' from the AIWW. The project is 70' from the riparian corridor to the north, and 48' from the corridor to the south. 10. ANTICIPATED IMPACTS The most significant impact to be incurred by this project is the encouragement to development this very fragile property prone to flooding. The direct impacts from the project are the shading of approximately 2070 square feet of regularly flooded marsh and approximately 180 square feet of high marsh. The pier will cover 120 square feet of high ground on the small island, and will incorporate approximately 2692 square feet of open water within the docking system. Actual deck and dock space total 832 square feet. Turbidity can be expected to increase during construction. Submitted by: T.
