On behalf of YRC Worldwide, Inc., Mid -Atlantic Associates, Inc. (Mid -Atlantic) is pleased to
submit this letter in response to the Notice of Deficiency (Notice) issued to YRC Worldwide, Inc.
by the North Carolina Department of Environment and Natural Resources (NCDENR) and dated
July 3, 2013. The Notice was issued based on the results of an initial site inspection conducted
at the above -referenced facility on March 5, 2013, which identified several permit and/or City of
Charlotte Stormwater Ordinance deficiencies. The comments associated with these deficiencies
are listed below in italics, with the responses and/or actions taken provided directly beneath
them. These comments/items were also discussed during a July 17, 2013 site inspection
conducted with representatives of Mid -Atlantic, NCDENR and Charlotte -Mecklenburg
Stormwater Services (CMSWS).
Comment 1: "Annual employee training was not documented in the SPPP. At the time of
the inspection, the permittee had a consultant updating the SPPP to the requirements listed
in the NCG080000 Permit that became effective November 1, 2012. The stormwater facility
inspections were not conducted and documented semi-annually as required"
Stormwater training will be conducted and documented on an annual basis in accordance
with the General Permit. In the past, annual training has reportedly consisted of a series of
training videos; however, these activities do not appear to have been properly documented,
in the Stormwater Pollution and Prevention Plan (SPPP). In the future, Mid -Atlantic will
either conduct and/or ensure that personnel training is conducted on an annual basis (or as
necessary) in accordance with the General Permit. Records documenting the personnel
training will be kept on file with the facility's updated SPPP.

Routine inspections are conducted by facility staff and personnel as part of the general
housekeeping and preventative maintenance program implemented at the site. Equipment,
tanks and storage areas are evaluated almost daily during normal production. in addition,
facility inspections are also conducted by Mid -Atlantic during semi-annual qualitative and
quantitative monitoring events. The results of the semi-annual inspections are documented
and will continue to be documented and kept on file with the facility's updated SPPP.
Comment 2: "The permittee is not monitoring all outfalls. The pennitfee is required to conduct
qualitative monitoring at all outfalls regardless of whether the permittee has received
representative outfall status for analytical monitoring."
Semi-annual qualitative monitoring will be conducted at Outfall Nos. 1, 2 and 3 during a
measurable storm event, as required by the General Permit. In addition, qualitative monitoring
will also be conducted at two spillways on the north side of the facility in Drainage Area No. 2
during the qualitative/quantitative monitoring events. The results of these activities will be
recorded on the appropriate monitoring forms and kept on file with the facility's updated SPPP.
Comment 3: "The permittee is not monitoring all outfalls. The permittee requested
representative outfall status on May 13, 2008; it was neither granted nor declined by the
Division. The permittee should monitor all outfalls until the request is granted in writing by
the Division. A review of the analytical and qualitative monitoring documents was
performed. A comparison of rainfall data from three local USGS gauges suggest the
permittee should ensure the sampling meets the requirements of a measurable storm event
as noted in NCG080000. "
In accordance with NCDENR's correspondence dated July 25, 2013, Outfall No. 1 has
been granted representative outfall status for Outfall Nos. 2 and 3 (Note: a copy of the
correspondence is provided as an attachment. Approval for Representative Outfall Status
was granted based on previous information provided to NCDENR and confirmed during the
follow-up site inspection conducted on July 17, 2013. Semi-annual stormwater samples will
continue to be collected from Outfall No. 1 during measurable storm events, with the results
submitted to NCDENR and copies maintained on file with the facility's updated SPPP. Mid -
Atlantic will ensure the sampling meets the requirements of a measurable storm event as
noted in NCG080000.
Comment 4: "The stormwater system consists of a series of drop inlets and curb cuts.
Dark sandy sediment was observed in many areas of the parking lot. The permittee should
consider sweeping the parking lot to remove the excess buildup of sediment. Dark
sediment was observed at the outfall near the vehicle maintenance shop. The permittee is
required to properly operate and maintain all facilities required for compliance with the
permit. Non-stormwater discharge evaluations of the permittee's outfalls were not
documented in the SPPP. "
Facility personnel will focus on monitoring routine cleaning schedules and overall.
housekeeping practices, especially in the vicinity of the on -site loading docks and vehicle
maintenance garage. Facility personnel will attempt to minimize stormwater exposure to
sensitive materials such as drums, wheels and vehicle parts (i.e. these materials will be
moved indoors and/or covered if possible, vehicles will be parked with hoods down, etc.).
These practices should help prevent trash/excess sediment from building up and washing

off -site. If these measures do not reduce and/or eliminate the excess buildup of sediment,
dry sweeping measures will be evaluated to determine whether these alternative
procedures would be more effective.
The General Permit also requires that each stormwater outfall be evaluated for the presence
of non-stormwater discharges. Non-stormwater discharges would be seen by the observance
of surface flow during dry periods. In order to evaluate the facility for non-stormwater
discharges, the drainage surfaces are routinely inspected during dry periods, when there is no
potential for stormwater flow. The visual inspections will be documented on an annual basis
and the certification form will be maintained on file with the facility's updated SPPP.
Mid -Atlantic appreciates this opportunity to respond to the Notice of Deficiency. The July 17,
2013 site inspection conducted with representatives of Mid -Atlantic, NCDENR and CMSWS
present on -site has clarified the necessary procedures required to remain in compliance with
state and/or City of Charlotte Stormwater Ordinance. It is hoped that these actions and

The Mooresville Regional Office staff have reviewed your request for a determination that stormwater
discharge outfall (SDO) 001 be granted representative outfall status for stormwater outfalls 002 and 003.
Based on the information and maps provided and the site inspection on July 17, 2013, we are approving this
request. In accordance with 40 CFR §122.21(g)(7), you are authorized to sample outfall number 001 as a
representative outfall. This approval is effective with the next sampling event. We also want to remind you
that the permit still requires Qualitative Monitoring be performed at all SDOs, regardless of representative
status. In addition, you should add qualitative monitoring at the two spillways on the north side of the facility
in drainage area #2. Qualitative monitoring should be added at these two locations since they merge with
other stormwater in the drainage area at an elevation below the current qualitative monitoring location for
Outfall 002.
Please remember that any actions you initiate in response to benchmark exceedances as directed in the
tiered response provisions of your permit must address all drainage areas represented by SDO 001, where
appropriate. Please append this letter to your Stormwater Pollution Prevention Plan (SPPP) or permit to
document that representative outfall status has been approved. If changes in drainage areas, structures,
processes, storage practices, or other activities occur that significantly alter the basis of this approval,
representative outfall status may no longer be valid. You should either resume sampling at all SDOs, or
reapply to this office for representative outfall status based on updated information. If you have any questions

are forwarding herewith the subject certificate of coverage (COC) to discharge under the subject state —
NPDES general permit. This permit is, issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US
Environmental Protection Agency dated May 9, 1994 (or as subsequently amended).
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage. This permit does not affect the legal requirements to'obtain
other permits which may be required by the Division of Water Quality or permits required by the
Division of Land Resources, Coastal Area Management Act or any other federal or local governmental
permit that may be required.
Please note that this permit does not cover the equipment washing (wash water) you mentioned
in your NOl application. You will need to apply for a separate waste water permit for that operation. If

On behalf of USF Holland and YRC Worldwide Enterprise Services, Inc., Mid -Atlantic Associates,
Inc. requests representative outfall status for the above referenced site. The facility is permitted to
discharge stormwater under the North Carolina Department of Environment and Natural
Resources, Division of Water Quality, . General Permit NCG080000. ' Stormwater currently
discharges off site.at three outfalls (See Attached Drawing 2.1). Potential pollutants associated
with stormwater discharges at each outfall include oils, greases, petroleum, vehicle fluids, and
suspended solids. Based on our recent evaluation of the site and its stormwater outfalls, it appears
that the stormwater discharge from Outfall 1 is representative of discharges from each outfall at the
site. It also appears that the discharge at Outfall 1 would be the "worst -case" discharge of the

Yes, it's in our file. It was stamped received May 20, 2008. 1 was coordinating those at the time, and it should have gone
to the MRO. I had a scanned file on my computer (attached), and here's the entry from the spreadsheet I was keeping

This was a few months before we delegated these all out to the ROs to handle, and we just waited for a response back
from the RO before issuing. It was also before we set up the events in BIMS to track these ROS requests, so I that event
wasn't entered for this permit either.
The e-mail record of what I sent on. 6/4/08 is in the Mimosa Archive or maybe in an old archive of mine, but I can't figure
out how to get in that right now! I'm headed out for the next week, so hopefully this helps for now. I probably won't
have time to investigate any further for a while.

been officially granted. The only thing I could find was the report for the inspection that Heather conducted the
month before the letter was sent to us. Have they been doing their monitoring?

On March 5, 2013, Jeff Mitchell from Charlotte -Mecklenburg Stormwater Services (CMSWS), conducted a site
inspection of the USF Holland facility located at 5201 Sunset Road in Charlotte, Mecklenburg County, North
Carolina. The site drains to Long Creek, Class C waters located in the Catawba River Basin. The site visit
and file review revealed that the subject facility is covered by NPDES General Stormwater Permit —
NCG080000.
This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and
the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part II Section H. The following observations and/or
permit condition violations were noted during the CMSWS inspection (please see the attached addendum for
information about your permit):

regarding ensuring you are sampling a "measureable" storm event.
4) Permit and Outfalls
The enclosed report notes that the annual illicit discharge evaluation was not completed and there were issues
with sediment in one of the outfalls.
5) City of Charlotte Stormwater Ordinance Review:
No deficiencies were observed; however, several recommendations for the permittee can be found in the
attached report.

report, permit and/or City of Charlotte Stormwater Ordinance deficiencies were noted during the inspection. It
is requested that a written response be submitted to this Office by August 2, 2013, addressing these

Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may
be assessed against any person who violates or fails to act in accordance with the terms, conditions, or
requirements of any permit issued pursuant to G.S. 143-215.1.
A follow-up evaluation will be conducted by CMSWS after October 3, 2013, to ensure compliance with the
facility's Stormwater Permit and/or compliance with the City of Charlotte Stormwater Ordinance. If you have

The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources. Through the NPDES permitting program industrial facilities
that fall into one of the subject ten categories are required to obtain permit coverage under a general permit
or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the
facility. There are currently 19 active general stormwater permits in North Carolina. One condition that is
applicable to both the general permits and individual stormwater, permits is the requirement to develop and
implement site -specific comprehensive Stormwater Pollution Prevention plans (SPPP). These plans are
required to include a comprehensive evaluation of the site and operations to reduce pollutant sources and
prevent pollutant discharge.

discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES
General Stormwater Permit] can be found on this website.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. Please see the
above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of
the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type, of General Permit until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting, and recording of Qualitative Monitoring
o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable)

o Records — Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to the expiration date. Any permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the expiration and has not requested renewal at least 180 days prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation.
o Transfer —The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes require you to complete a
Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

Comment: The stormwater system consists of a series of drop inlets and curb cuts.
Dark sandy sediment was observed in many areas of the parking lot. The permittee
should consider sweeping the parking lot to remove the excess buildup of sediment.
Dark sediment was observed at the outfall near the vehicle maintenance shop. The
mouth of one of the stormwater outfalls was partially obstructed with sediment. The
permittee is required to properly operate and maintain all facilities required for
compliance with the permit. Non-stormwater discharge evaluations of the permittee's
outfalls were not documented in the SPPP.

This facility loads and unloads tractor -trailers which transport hazardous and non -hazardous materials and approximately
150 tractors and 250 trailers are based out of this facility. Approximately 10 tractors and 40 trailers are maintained on site
monthly (not including vehicle washing). Rex Oil Company is contracted to provide mobile fueling operations at the
facility. This facility operates 24 hours a day, 6 days a week. The facility is located inside a wire fence reinforced with an
electric fence that extends around half of the perimeter. The on -site maintenance oil/water separator has been
abandoned and Charlotte -Mecklenburg Utilities was informed of this information. Atlantic Environmental collects and
disposes of used oil and used antifreeze generated on site and Interstate Batteries collects any used batteries. Heritage
Crystal Clean collects used parts cleaning fluid generated by facility operations.
Compliance History:
The permitteelfacility does not have any prior compliance issues with the NC Division of Water Quality or
Charlotte -Mecklenburg Storm Water Services (CMSWS).
Industrial Operations/City of Charlotte Stormwater Ordinance Review
Tractor Storage Area --
Tractors are stored outside on both pavement and gravel. Staining was observed on the pavement surface beneath most
tractors. The facility should consider implementing methods to remove oil from the tractor parking area.
Trailer Storage Area —
Empty Trailers are stored outside on both pavement and gravel and the storage areas appeared to be in good condition.
Gravel Lot —
Tractors and empty trailers are stored outside in this area. During the inspection two open top 55-gallon barrels were
observed sitting on a pallet in the gravel lot. Both barrels were almost full with an unidentified liquid. One barrel
contained a one -gallon petroleum container. The facility should properly dispose of materials and ensure proper storage
and labeling of barrels to prevent illicit discharges.
Large Trash Dumpster —
One large covered dumpster was observed on site near the loading dock and it appeared to be in good condition.
Small Trash Dumpster —
One small trash dumpster was observed near the Maintenance Building. The dumpster was covered and plugged and
appeared to be in good condition. There was standing water around the base of the dumpster due to a recent rain event
and no sheen was observed in the standing water.
Outside Tire Storage Area —
New and used tires are stored outside, on pavement, and exposed to stormwater. This area appeared to be in good
condition and the storm drain inlet in this area contained a fabric filter.
Covered Shed —
Six 55-gallon barrels were stored outside on pavement in a covered shed. During the inspection dark staining was
observed on the pavement originating from the covered shed. Facility personnel noted that the barrels are typically empty
and awaiting disposal pickup. In addition, the staining was attributed to historic activities in this area when tractors were
washed and fluids topped off, The permittee no longer conducts these activities in this area. The storm drain inlet in this
area contained a fabric filter.

Tractors and trailers are maintained in this building. The floor drains located in the building have been sealed with
concrete and the on -site oil/water separator has been abandoned. Used batteries are staged in the Maintenance Building
and collected for disposal once a week. There were no used batteries staged for pickup during the inspection. A spill kit
was located inside the building.
The following were observed inside the Maintenance Building, not exposed to stormwater:
• One 550-gallon tank of new motor oil. Standing petroleum was observed on the floor around the base of the tank.
• Five 35-gallon grease barrels were located on a pallet.
One 290-gallon used oil tank was located on a spill cart.
• One 55-gallon barrel for draining used oil filters. Used oil filters are disposed of by Atlantic Environmental.
One 55-gallon degreaser barrel.
Air Compressor --
An air compressor is located outside the Maintenance Building in an enclosed shed and not exposed to stormwater. The
bleed off line for the compressor discharges to the floor of the shed. Discharge from the air compressor to the outside of
the shed was difficult to determine during the inspection due to heavy oil staining on the pavement from the adjacent
secondary containment sheds. The facility should ensure oil/water discharges are properly contained and disposed of.
Secondary Containment Sheds —
Two roll-top secondary containment sheds are exposed to stormwater and located outside on pavement. Each
containment shed contained two 55-gallon barrels of petroleum products. Tractors top off engine fluids in this area.
During the inspection, heavy oil staining was observed on the ground around the containment sheds. Absorbent material
was also observed on the ground. The permittee should ensure proper cleanup and disposal for all spills and absorbent
material and implement measures to prevent future spills.
Loading Dock —
Both hazardous and non -hazardous materials are loaded and unloaded from trailers in this covered area. This area
appeared to be in good condition.
Permit and Outfalls (cont.) -
Outfall #3 — This storm drain outfall receives discharges from trailer parking areas, the loading dock, and truck travel
areas. The storm drain pipe was clear of sedimentation. The area around the pipe had an accumulation of dark
sediment. Facility personnel were unsure if this accumulation of dark sediment was by engineering design or by
sedimentation. The facility should conduct proper maintenance of their stormwater outfalls.

Comment: Outfall #1 —This storm drain outfall receives discharges from the loading
dock, tractor parking areas, trailer parking areas, truck travel areas, and maintenance
building. Dark sediment was observed at the spillway that collects stormwater from the
maintenance building. Facility personnel explained that approximately two years ago
the facility removed impacted soil from Outfall #1 and restored the area. This was done
as a result from the accumulated discharges from the vehicle maintenance area. The
sample point for the outfall appeared to be in good condition. The facility should
remove any remaining impacted soils from the storm drain system and outfall.
Outfall #2 — This storm drain outfall receives discharges from the loading dock, trailer
parking areas, and truck travel areas. This outfall consists of a concrete spillway. This
outfall appeared to be in good condition.

The Mooresville Regional Office staff have reviewed your request for a determination that stormwater
discharge outfall (SDO) 001 be granted representative outfall status for stormwater outfalls 002 and 003.
Based on the information and maps provided and the site inspection on July 17, 2013, we are approving this
request. In accordance with 40 CFR §122.21(g)(7), you are authorized to sample outfall number 001 as a
representative outfall. This approval is effective with the next sampling event. We also want to remind you
that the permit still requires Qualitative Monitoring be performed at all SDOs, regardless of representative
status. In addition, you should add qualitative monitoring at the two spillways on the north side of the facility
in drainage area #2. Qualitative monitoring should be added at these two locations since they merge with
other stormwater in the drainage area at an elevation below the current qualitative monitoring location for
Outfall 002.
Please remember that any actions you initiate in response to benchmark exceedances as directed in the
tiered response provisions of your permit must address all drainage areas represented by SDO 001, where
appropriate. Please append this letter to your Stormwater Pollution Prevention Plan (SPPP) or permit to
document that representative outfall status has been approved. If changes in drainage areas, structures,
processes, storage practices, or other activities occur that significantly alter the basis of this approval,
representative outfall status may no longer be valid. You should either resume sampling at all SDOs, or
reapply to this office for representative outfall status based on updated information. If you have any questions

Inc. requests representative outfall status for the above referenced site. The facility is permitted to
discharge stormwater under the North Carolina Department of Environment and Natural
Resources, Division of Water Quality, . General Permit NCG080000. ' Stormwater currently'
discharges off site.at three outfalls (See Attached Drawing 2.1). Potential pollutants associated
with stormwater discharges at each outfall include oils, greases, petroleum, vehicle fluids, and
suspended solids. Based on our recent evaluation of the site and its stormwater outfalls, it appears
that the stormwater discharge from Outfall 1 is representative of discharges from each outfall at the
site. It also appears that the discharge at Outfali 1 would be the "worst -case" discharge of the
