The Mooresville Regional Office staff have reviewed your request received on June 2, 2009 for a
determination that stormwater discharge outfall (SDO) 004 be granted representative outfall status for
stormwater outfalls 002 and 003, Based on the analytical information and maps provided and the site
visit on November 4, 2008, we are approving this request. In accordance with 40 CFR §122.21(g)(7),
you are authorized to sample outfall number 004 as a representative outfall. This approval is effective
with the next sampling event. We also want to remind you that the permit still requires Qualitative
Monitoring be performed at all SDOs, regardless of representative status.
Please remember that any actions you initiate in response to benchmark exceedances as directed in the
tiered response provisions of your permit must address all drainage areas represented by SDO 004,
where appropriate,
Please append this letter to your Stormwater Pollution Prevention Plan (SPPP) or permit to document
that representative outfall status has been approved. If changes in drainage areas, structures,
processes, storage practices, or other activities occur that significantly alter the basis of this approval,
representative outfall status may no longer be valid. You should either resume sampling at all SDOs, or
reapply to this Office for representative outfall status based on updated information. If you have any

If a facility Is required to sample multiple discharge locations with very similar stormwater discharges, the
permittee may petition the Director for Representative Outfall Status (ROS). DWO may grant
Representative Outfall Status It stormwater discharges from a single outfall are established as
representative of discharges from multiple outfalls. Approved ROS will reduce the number of outfalls
where an sampling requirements apply.
If Representative Outfall Status is granted, ALL outfalls are still subject to the gualltative monitoring
requirements of the facility's permit. After ROS Is granted, the facility must notify DWO In writing if any
changes to the facility or its operations take place that would affect this status. The approval letter from
DINO must be kept on -site with the facility's Stormwater Pollution Prevention Plan.

On behalf of my client, I am submitting this petition letter requesting representative outfall status
for SDO-001 and SDO-004. Refer to the enclosed Map 2 for the location and drainage area of
this facility's outfalls. The following are our reasons for choosing SDO-001 and SDO-004:
SDO-001 has the most variety of industrial activity within its drainage area, consisting of a
portion of the truck garage, the wash bay, the fueling station, and a small POL tank farm. Its
drainage area is 375,575 sf and is 100% impervious. The end of the pipe, for sampling purposes,
is easy to access.
SDO-004 has within its drainage area a portion of the Garage, a portion of the terminal docks,
outside tire and wheel storage, and tractor and trailer parking. Its drainage area is 708,930 sf and
is 100% impervious. The end of the pipe, for sampling purposes, is easy to access.
SDO-002 and SDO-003 are similar to SDO-004, but do not include the truck garage within their
drainage areas. Due to the electric fence surrounding this property, and other fence on adjoining
properties, the ends of these pipes are more difficult to access. While monitoring could be
performed at interior catch basins, we prefer to access end of pipe monitoring points that are
outside the fence line.
Our visual observations on both dry and wet days indicate that all of the outfalls will have
similar discharge characteristics and water quality. However, in our opinion, SDO-001 and
SDO-004 are the preferable choice for analytical monitoring.
SDO-005 collects runoff only from the employee parking lot and is thus designated a non-
industrial outfall and is not subject to monitoring.

On February 15, 2012, Heather Sorensen from Charlotte -Mecklenburg Stormwater Services (CMSWS),
conducted a site inspection of the YRC, Inc. facility located at 11010 Reames Road in Charlotte, Mecklenburg
County, North Carolina. A follow-up site visit was conducted on February 17, 2012, The site drains to both
Long Creek and Dixon Tributary #1, a tributary of Long Creek, Class C waters located in the Catawba River
Basin. The site visit and file review revealed that the subject facility is covered by NPDES General Stormwater
Permit — NCG0080000.
This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and
the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part II Section H. The following observations were
noted during the Charlotte -Mecklenburg Stormwater Services inspection (please see the attached addendum
for information about your permit):

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge.

discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES
General Stormwater Permit] can be found on this website.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. Please see the
above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of
the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the. permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting, and recording of Qualitative Monitoring

o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable)
o Records — Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to the expiration date. Any permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the expiration and has not requested renewal at least 180 days prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes require you to complete a
Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

Inspection Summary:
Facility Description:
The facility provides motor freight transportation of both hazardous and non -hazardous materials. Truck and engine
repair, fueling, and washing occur on site. The facility is 66 acres with approximately 70% impervious surface.
Compliance History:
The facility was inspected on February 22, 2008, by Charlotte -Mecklenburg Storm Water Services (CMSWS). The
Division of Water Quality issued a Notice of Violation (NOV-2008-PC-0223) as a result of the inspection. The facility was
compliant during the follow-up inspection on November 4, 2008.
Industrial Operations/City of Charlotte Stormwater Ordinance Review:
Illicit Discharges/Connections —
Four bleed off lines from air compressors were plumbed to the paved ground outside. No oil staining was observed on the
pavement due to the bleed off lines. On 2-17-2012, a follow-up inspection verified the lines were plumbed to a bucket
inside the air compressor room.
Aboveground Storage Tanks (ASTs) —
Two 80,000-gallon diesel tanks are located inside a concrete secondary containment wall. All stormwater is pumped to an
oil/water separator. One 6,000-gallon antifreeze, 6,000-gallon gear oil, 8,000-gallon motor oil, and one 6,000-gallon used
oil tank are all double walled. All tanks appeared to be free of rust and leaks. A pipe to the 8,000-gallon motor oil AST
was leaking and the lock to the fueling port was missing. A follow-up inspection on 2-17-2012 verified that the pipe was
repaired and the lock was replaced on the fueling port. No further leaks or spills were observed.
Outdoor material storage area(s) —
New tires are stored outside. Empty 55-gallon drums are stored outside in the fenced in "Empty Drum Storage" area.
Three full 55-gallon drums were stored in this area on a spill cart and not exposed to stormwater,
Loading/unloading area(s) -
Trailers are loaded and unloaded along the docks in an area that is not exposed to stormwater.
Vehicle/equipment area(s) (fueling, washing, storage, etc.) —
Tractors and trailers are fueled, washed and maintained on site. Fueling occurs in a covered area. Vehicles are
maintained inside the garage in an area not exposed to storm water. Vehicle washing occurs in a covered wash bay off
the side of the garage. Floor drains in each of these areas drain to the oil/water separator.
Oil/water separator and/or pretreatment —
The facility has an oil/water separator that is pumped out on an as need basis by HAZMAT Transportation and Disposal.
Waste storage/disposal areas (dumpsters, scrap metal bins, etc.) —
One covered scrap metal roll off bin is located outside. One trash compactor was observed near the loading docks. One
covered and plugged trash dumpster was observed near the garage, No leaks or spills were observed.
Floor drains — All floor drains discharge to an onsite oil/water separator.
Spill response equipment — Spill response equipment is available in the garage, loading docks and the fueling area.

Comment. There are four stormwater outfalls that serve the facility. SDO#001, 002,
and 003 drain to Long Creek and SDO#004 drains to Dixon Creek, a tributary of Long
Creek. SDO#001 had a low flow of water discharging from the pipe. The flow was too
low to sample and appeared clear. SDO#002, 003, and 004 were dry. SDO #004 is the
representative outfall for SDO #002 and #003. Representative outfall status was
granted on 9-16-2009 by DWQ.
Non-stormwater discharge evaluations were documented on 3-21-2008, 11-3-2008,

Enclosed is a copy of the Follow-up Compliance Evaluation Inspection (CEI) report for
the inspection conducted at the subject facility on November 4, 2008, by Heather Sorensen of
Charlotte -Mecklenburg Storm Water Services and Marcia Allocco with North Carolina
Department of Natural Resources, Division of Water Quality. This inspection was conducted as
part of a cooperative working agreement between Mecklenburg County and the Division of
Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part 11 Section H. Thank you for your
assistance and cooperation during the inspection.
The follow-up inspection found that Yellow Transportation, Inc. has implemented the
corrective actions as stated in the subject facility's response letter dated April 24, 2008. The
corrective actions included:
Installation of fabric inserts in two storm drain inlets located near the service wash
bays
Updating of the Stormwater Pollution Prevention Plan
During the inspection, Representative Outfall Status was discussed for Outfalls 002 and
003 and the permittee/designee was asked to submit analytical monitoring data for these outfalls
along with a formal request (Outfalls 001 and 004 representative of Outfalls 002 and 003) to the
Mooresville Regional Office. As of the date of this letter, neither analytical monitoring data nor
a Representative Outfall Status request has been received in the Mooresville Regional Office. If
the analytical monitoring and formal request for Representative Outfall Status is not received by
June 30, 2009, the permittee is required to sample all stormwater outfalls at the facility semi-
annually as required by General permit NCG080000.

Facility Description:
Facility Description: Facility specializes in motor freight transportation of both hazardous and non -hazardous materials.
Truck and engine repair, fueling operations, hazardous materials storage and han&ng, and non -hazardous materials
processes occur on site. Trailers and tractors are stored on site. Approximately 115 trucks and trailers are serviced per
month. The facility operates 24 hours a day, 7 days a week. The facility is located within a chain link fence (reinforced with
—an electric.fence) that surrounds the entire perimeter. Oil Enterprise out of Knoxville, TN collects and disposes of used oil.
Safety Kleen collects and disposes of used antifreeze and parts washer fluid.
Compliance History:
Charlotte Mecklenburg Storm Water Services inspected the facility on February 22, 2008. The Division of Water Quality
issued a Notice of Violation as a result of the inspection.
Industrial Operations/City of Charlotte Stormwater Ordinance Review
SDO#001 - This outfall receives discharges from the Truck Garage, Wash Bay, Diesel Tank Above Ground Storage Area,
the Fueling Station, and the truck travel areas. The outfall was clear of sedimentation. The stormwater discharge was
clear with no odor and no observed sheen. Severe erosion was observed on the adjacent property that resulted in an
accumulation of sediment below the concrete outfall structure maintained by Yellow Transportation.
SDO#002 — This outfall receives discharges from the Hazardous Trailer Parking Area, the Fifth Wheel Assembly Area,
and truck travel areas. Minor sedimentation was observed below the outfall. The outfall was difficult to access due to
vegetation.
The facility should clear an access path to the storm drain outfall for monitoring.
SDO#003 -- This outfall receives discharges from the Docks, Trailer Parking, and truck travel areas. The outfall was free
of sedimentation; however, staining was observed around the outfall. The dark staining appears to be the breakdown of
asphalt. A small pond like structure is located below the outfall. No odor was present.
SDO#004 — This outfall receives discharges from the Terminal Docks, Garage, Trailer Parking, Outside Tire and Wheel
Storage Area, and the truck travel areas. Staining was observed on the concrete around the outfall. There was no
indication of when staining occurred. During the inspection, there were no indicators of pollution discharge,
Garage -- Service Cleaning Bay -- Tractors are serviced in this area. Staff explained that windows are washed and fluids
are topped off in this bay. The facility has installed a fabric insert into two storm drain inlets in the area. The inserts
collect hydrocarbons and sediment.

Petition for Representative Outfall Status
Dear Mr. Bennett:
On behalf of my client, I am submitting this petition letter requesting representative outfall status
for SDO-001 and SDO-004. Refer to the enclosed Map 2 for the location and drainage area of
this facility's outfalls. The following are our reasons for choosing SDO-001 and SDO-004:
SDO-001 has the most variety of industrial activity within its drainage area, consisting of a
portion of the truck garage, the wash bay, the fueling station, and a small POL tank farm. Its
drainage area is 375,575 sf and is 100% impervious. The end of the pipe, for sampling purposes,
is easy to access.
SDO-004 has within its drainage area a portion of the Garage, a portion of the terminal docks,
outside tire and wheel storage, and tractor and trailer parking. Its drainage area is 708,930 sf and
is 100% impervious. The end of the pipe, for sampling purposes, is easy to access.
SDO-002 and SDO-003 are similar to SDO-004, but do not include the truck garage within their
drainage areas. Due to the electric fence surrounding this property, and other fence on adjoining
properties, the ends of these pipes are more difficult to access. While monitoring could be
performed at interior catch basins, we prefer to access end of pipe monitoring points that are
outside the fence line.
Our visual observations on both dry and wet days indicate that all of the outfalls will have
similar discharge characteristics and water quality. However, in our opinion, SDO-001 and
SDO-004 are the preferable choice for analytical monitoring.
SDO-005 collects runoff only from the employee parking lot and is thus designated a non-
industrial outfall and is not subject to monitoring.

Dear Mr. Godwin:
Enclosed are the monitoring results from the laboratory analyses performed on the
discharge from Stormwater Outfall 004' at the subject facility. The samples analyzed were grab
samples collected during the sampling investigation performed on June 26, 2008, by Heather
Sorensen and Jason Klingler of Charlotte -Mecklenburg Storm Water Services. This sampling
investigation was conducted as part of a cooperative working agreement between Mecklenburg
County and the Division of Water Quality. In addition, the sampling investigation was
conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit,
NCS000240, Part II Section H.
The enclosed monitoring results indicate that the concentrations of pollutants in the
stormwater discharged on June 26, 2008, were below the benchmark values contained in
Storlwater general permit NCG080000. However, elevated concentrations of chemical oxygen
demand (COD); zinc, and fecal coliform bacteria were noted in the stormwater discharge from
your facility to Little Sugar Creek.
Little Sugar Creek is currently listed on the North Carolina 303(d) list of impaired waters
and has TMDLs in place for fecal coliform, dissolved oxygen, and turbidity. As noted in Part I
of your general permit, facilities which discharge stormwater into 303(d) impaired waters may be
required to demonstrate at permit renewal that they do not have a reasonable potential to violate
applicable water quality standards for such pollutants due to the stormwater discharge(s) on site.
Through the development and implementation of stormwater management programs it is the
Division of Water Quality's expectation that the stormwater discharges at industrial sites covered
by NPDES stormwater permits do not impact receiving waters.
The enclosed results should be self-explanatory; however should you have any questions
concerning the sampling results or have any questions regarding your permit, please do not
hesitate to contact Ms. Marcia Allocco of this Office at [phone].

Enclosed is a copy of the Compliance Evaluation Inspection (CET) report for the
inspection conducted at the subject facility on February 22, 2008, by Heather Sorensen and Erin
Hall of Charlotte -Mecklenburg Storm Water Services. This inspection was conducted as part of
a cooperative working agreement between Mecklenburg County and the Division of Water
Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part II Section ff. Thank you for your
assistance and cooperation during the inspection.
This report is being issued as a Notice of Violation (NOV) due to the permittee's failure
to prevent the discharge of petroleum and other pollutants to surface waters in violation of the
subject Stormwater Permit and North Carolina General Statute (G.S,) 143-215.75, as detailed in
the Industrial Operations/City of Charlotte Stormwater Review and Permit and Outfalls
sections of the enclosed report. In addition, the permittee failed to sample each stormwater
discharge outfall in violation of the subject Stormwater Permit and North Carolina General
Statute (G.S.) 143-215.1, as detailed in the Analytical Monitoring and Permit and Outfalls
sections of the enclosed report.
Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand
dollars ($25,000.00) may be assessed against any person who violates or fails to act in
accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S.
143-215.1.

Inspection Summary:
Facility Description:
Facility specializes in motor freight transportation of both hazardous and non -hazardous materials. Truck and engine
repair, fueling operations, hazardous materials storage and handling, and non -hazardous materials processes occur
on site. Trailers and tractors are stored on site. Approximately 115 trucks and trailers are serviced per month. The
facility operates 24 hours a day, 7 days a week. The facility is located within a chain link fence (reinforced with an
electric fence) that surrounds the entire perimeter. Oil Enterprise out of Knoxville, TN collects and disposes of used
oil. Safety Kleen collects and disposes of used antifreeze and parts washer fluid.
The facility has an on -site wastewater treatment plant. The wastewater treatment plant is monitored on a daily basis.
There is no alarm for the treatment plant. There is no record of a Charlotte -Mecklenburg Utilities (CMU) Pre -
Treatment Permit and the facility has been referred to the CMU System Protection Unit for action.
Compliance History:
The permitteelfacility does not have any prior compliance issues with either the NC Division of Water Quality or
Charlotte -Mecklenburg Storm Water Services.
Industrial Ooorations/City of Charlotte Stormwater Ordinance Review:
Docks — Materials, both hazardous and non -hazardous, are loaded and unloaded from trailers in this area. The docks
are covered and not exposed to stormwater. There are no floor drains located in this area and a floor sweeper is used
to clean the floors. This area appeared to be in good condition.
Trailer Parking — Tractors and trailers are stored outside and exposed to stormwater in this area. Minor oil sheens
were present in this area.
The facility should ensure that all leaks or spills are promptly removed.

Fifth Wheel Assembly Area — Fifth wheels, or "yard dogs" are stored outside and exposed to stormwater in this area.
This area appeared to be in good condition.
Hazardous Trailer Parking Area — Trailers with hazardous materials that have spills or leaks are staged in this area
until a clean up contractor removes the spill and trailer for disposal, This area is comprised of a gravel lot with one
storm drain. Stormwater entering the storm drain was clear with no odor. Empty trailers were stored in this area at the
time of inspection. This area appeared to be in good condition.
Trash Dumpsters — One large general trash dumpster and one large scrap metal dumpster are located outside and
under cover. The dumpsters appeared to be in good condition with no signs of leaks.
Wash Bay — Tractors are washed in the covered wash bay that is attached to the garage. Trailers are not washed at
this facility. A berm was recently installed to prevent wastewater from discharging into a nearby storm drain.
Wastewater is discharged town onsite wastewater treatment plant, which includes an oil skimmer, The wastewater is
then discharged to CMU sanitary sewer system.
Garage — This building consists of two bays where truck maintenance, service, and window washing occurs. Floor
drains are located along most overhead bay doors. Floor drains were not located beneath the overhead bay doors in
the Service Cleaning Bay. All floor drains discharge to the onsite wastewater treatment plant. A scrubber with a
vacuum is used to clean the floors,

• One 150-gallon used antifreeze container is located in the garage in double -walled containment. Safety Keen
collects and disposes of the used antifreeze on a monthly basis. The container appeared to be in good
condition.
• One parts washer is located in the garage. Safety Kleen collects and disposes of the parts washer fluid on a
monthly basis. The parts washer appeared to be in good condition.
• Used oil filters are drained into a container for 2 to 3 days then disposed of in the trash dumpster. The used oil
is stored in a used oil tank located outside of the garage. The used oil filter drain container appeared to be in
good condition.
• Two 55-gallon new transmission fluid barrels were observed in the garage during the inspection. They
appeared to be in good condition.
• Two 55-gallon new hydraulic oil barrels were observed in the garage during the inspection. They appeared to
be in good condition.
• Four 55-gallon new oil barrels were observed in the garage during the inspection. They appeared to be in
good condition.
• Tire Storage Area — new and used tires are stored inside the garage in this area. The area appeared to be in
good condition.
• Air Compressor — One large air compressor is located inside the garage. There was no bleed off line
observed. There was no staining observed around the compressor.
• Water Sprinkler Discharge Line — One pipe was observed during the inspection that discharged to the
pavement surface outside. The line was verified to be a discharge pipe for the water sprinkler system.
Potable water is an allowable discharge.
• Service Cleaning Say — Tractors are serviced in this area. Staff explained that windows are washed and fluids
are topped off in this bay. An oily sheen was observed originating from the Service Cleaning Bay door and
discharging into the nearby storm drain inlet. A diesel odor was present. This discharge is suspected to be
the source of the excessive oil sheen observed at Outfall 004.
The facility MUST immediately stop all petroleum discharges, which are a violation of G.S. 143-215.75 - Oil Pollution
and Hazardous Substances Control Act of 1978. The facility MUST evaluate and implement measures to prevent oil
and other pollutants from discharging to the storm drain system.
Outside Tire and Wheel Storage Area — New and used tires are stored outside and exposed to stormwater in this area.
This area appeared to be in good condition.
Used Oil Tank — One 6,000 gallon used oil tank is located outside and exposed to stormwater. The tank is double
walled. Rust was observed on the unloading port line and waste oil supply line.
The facility should implement routine maintenance on all storage tanks and associated lines to prevent the potential
discharge of pollutants to the ground and storm drain system.
Aboveground Storage Tanks — One 6,000-gallon gear oil tank, one 8,000-gallon motor oil tank, and one 6,000-gallon
antifreeze tank are located on a concrete pad, outside and exposed to stormwater. All tanks are double walled with an
audible and visual alarm located inside the garage. Rust was observed on the outflow line of the antifreeze tank. Rust
was also observed on the lines of the motor oil tank. Minor rust was observed on the body of the motor oil tank. All
fueling ports are locked.
The facility should implement routine maintenance on all storage tanks and associated lines to prevent the potential
discharge of pollutants to the ground and storm drain system.

Diesel Fuel Storage Tanks — Two 8,000-gallon aboveground diesel storage tanks are located inside a shared concrete
containment structure. One 2,000-gallon diesel tank is also located within the concrete containment structure and is
empty and out of service. Stormwater that collects inside the containment structure is discharged by a manual sump
pump to an oil/water separator, and then discharged to the wash bay. From the wash bay the stormwater is sent to
the on -site wastewater treatment plant that includes an oil skimmer. The treated discharge is released to CMU
sanitary sewer system. In the event of a spill, Haz-Mat Transportation and Disposal is utilized to remove and properly
dispose of the spilled material. An underground storage tank is connected to the oil/water separator to reclaim spilled
fuel. A Diesel Fuel Spill Kit is located adjacent to the Diesel Storage Tank area. The oil/water separator is monitored
for disposal every two to three weeks. This area appeared to be in good condition.
Diesel Fueling Area — This area is adjacent to the Diesel Fuel Storage Tanks; it is located under cover and is not
exposed to stormwater. A trench drain is located near the fueling pump and the concrete surface is sloped towards
the drain to catch any spilled materials. The trench drain leads into the Diesel Fuel Storage Tank containment
structure. Fluids that collect inside the containment structure are discharged by a manual sump to an oil/water
separator and then discharged to the wash bay. From the wash bay the discharge is sent to the on -site wastewater
treatment plant that includes an oil skimmer. Treated discharge is released to CMU sanitary sewer system. This area
appeared to be in good condition.

Permit and Outfalls Section (cunt.):
The permittee was conducting analytical monitoring of the stormwater outfalls as if the Division of Water Quality had
granted representative outfall status. However, a request for representative outfall status could not be produced
except for one dated February 28, 2008 (post -inspection).
This inspection was conducted during'a storm event. Storm water discharges were observed at each storm water
outfall and therefore the inspectors were unable to determine if dry weather illicit discharges exist.
Outfall 001 — This outfall receives discharges from the truck garage, wash bay, aboveground diesel tank storage area,
the fueling station, and the truck travel areas. The outfall was clear of sedimentation. The stormwater discharge was
clear with no odor and no observed sheen. Severe erosion was observed on the adjacent property that resulted in an
accumulation of sediment below the concrete outfall structure maintained by Yellow Transportation.
Outfall 002 — This outfall receives discharges from the hazardous trailer parking area, the fifth wheel assembly area,
and truck travel areas. Minor sedimentation was observed below the outfall. Standing water was observed in the
storm drain due to a blockage of the drainage area approximately 50 feet down from the outfall. The blockage
comprised of sediment, leaves, and tree branches.
The facility should remove blockages and conducting proper maintenance of storm drain outfalls.
Outfall 003 — This outfall receives discharges from the docks, trailer parking, and truck travel areas. The stormwater
discharge was clear with no odor. An oily sheen was present in the discharge. The outfall was free of sedimentation;
however, staining was observed around the outfall. Minor sedimentation was observed below the outfall. A small
pond like structure is located below the outfall. The pond water was a murky gray color covered with an oily sheen.
The facility MUST evaluate and implement measures to prevent oil and other pollutants from discharging to the storm
drain system.
Outfall 004 —This outfall receives discharges from the terminal docks, garage, trailer parking, outside fire/wheel
storage area, and the truck travel areas. During the inspection an excessive petroleum sheen was coming from the
pipe that drains the trailer parking, outside tire/wheel storage area, and garage. There was an obvious diesel odor
present. Later in the inspection it was determined that discharges from the garage wash bay was the source of the
excessive sheen. Oily sheens were observed on the pavement around the tractor and trailer storage areas and travel
ways throughout the facility that may have contributed to the sheen.
The facility MUST immediately stop all petroleum discharges, which are a violation of G.S. 143-215.75 - Oil Pollution
and Hazardous Substances Control Act of 1978. The facility MUST evaluate and implement measures to prevent oil
and other pollutants from discharging to the storm drain system.
Outfall 005 — This outfall receives discharges from the employee parking lot. The outfall had received recent repairs to
correct erosion issues. The outfall was clear of sedimentation. The stormwater discharge was clear with no odor or
sheen.

We have reviewed the NOV dated April 3, 2008 and issued by the NCDWQ Mooresville
Regional Office. On behalf of my client, I will address each negative finding:
1. Discharge of Petroleum — The entry of petroleum residue into the stormwater outfalls is
incidental to the operation of a large trucking terminal. There are no intentional
discharges, leaking storage tanks or pipelines, or leaking truck fuel tanks in evidence.
a. The oil sheen visible during the inspection is an accumulation of runoff from
many acres of pavement. There was another definitive source emanating from the
service cleaning bays that are not equipped with trench drains across the overhead
door thresholds.
b. The definition of "discharge" within Article 21 A "Oil Pollution and Hazardous
Substances Control Act of 1978" includes the phrase "shall not include amounts
less than quantities which may be harmful to the public health or welfare"
c. You have presented no evidence that the oil sheen visible at any of the Permittee's
outfalls is harmful.
d. A sample of the stormwater discharge at SDO-004 taken November 15, 2007
indicated Oil & Grease at < 5 ppm even though an oil sheen was present.
e. A sample of the stormwater discharge at SDO-004 was taken within four (4)
hours after the City.'s inspector made her observation. The Oil & Grease analysis
showed a concentration of 10.9 ppm which is LESS THAN the benchmark value
of 30 ppm specified in General Permit NCG080000.
f The observed oil sheen IS NOT a violation of the General Permit NCG080000.
g. Stormwater discharge samples will be collected at SDO-001 and SDO-004 again
in the second half of 2008 with the results submitted to NCDWQ.
h. If subsequent Stormwater discharge sample analyses show Oil & Grease at greater
than 30 ppm, then additional BMPs will be implemented.
2. Failure to sample each Stormwater Outfall — Based upon advice from Yellow's
consultant, Stormwater Services Group, it was decided that outfalls SDO-001 and SDO-
004 would be representative for this facility.

permit compliance services for calendar year 2007.

b. Previous petition letters sent to NCDWQ on behalf of other facilities requesting
representative outfall status have gone unanswered.
c. The Discharge Monitoring Report for the 2007 samples submitted to NCDWQ
stated that SDO-002 and SDO-003 were represented by SDO-004. NCDWQ has
yet to question or reject this statement.
d. SDO-005 is not an industrial outfall subject to monitoring under General Permit
NCG080000.
e. A formal petition letter was mailed to Bradley Bennett at NCDWQ on February
26, 2008 requesting representative status for SDO-001 and SDO-004. He did not
respond within 45 days as requested in the letter.
3. We disagree with the finding on Page 1 of the Compliance Inspection Report that this
facility is "Not Compliant".
a. The facility obtained General Permit coverage prior to December 2006.
b. A new SWPPP was written effective February 28, 2007 that contained all the
elements required by the 2002-2007 General Permit.
c. Stormwater Services Group was contracted December 18, 2007 to perform
calendar year 2008 compliance tasks, including the update of the SWPPP to
reflect the 2007-2012 permit requirements.
d. The Permit allows twelve (12) months after the issuance of the certificate of
coverage (COC) to develop and implement the SWPPP:
e. The site inspection occurred about four (4) months after the COC was issued on
November 1, 2007.
f. Any deficiencies with the current SWPPP are moot until October 31, 2008.
4. The rust on the exposed POL storage tanks and piping is minor and is not compromising
the structural integrity of the tanks or pipes.
a. The Permittee will remove the rust down to bare metal, and re -paint the portions
of the tanks and piping where rust was present no later than August 31, 2008.
b. The Permittee visually inspects the tanks and piping at least once per year.
Maintenance and repairs are made when the tank inspector deems necessary.
5. The Permittee will consider several options for preventing the emission of oily flows
from the cleaning service (checklane) bays.' A final decision on which option to install
will be made by August 31, 2008. These options may include:
a. Inlet inserts in several catch basins near the garage
b. "Speed -bump" diverters across the bay doors
c. Trench drains across the bay doors which will be connected to the on -site WWTP.
6. Regarding the Page 5 comments on the SWPPP, the Permittee has contracted with
Stormwater Services Group to update the SWPPP to reflect the 2007-2012 Permit
requirements. This update will be finished by April 30, 2008.
a. All of the USGS map items are included in the SWPPP, if not always on the
actual USGS map; we disagree with the inspector's comment.
i. The 2002-2007 Permit did not .have a requirement for listing 303d
streams; the updated SWPPP will include a narrative regarding 303d
streams.
ii. Table 3 in the SWPPP lists the outfalls and their latitude and longitude.
iii. The names of the receiving streams are part of the original USGS 7.5'
quad sheet, and the names of the receiving streams are indicated on Page
B-9 in the SWPPP.

iv. We reserve the option to include the items that are to be shown on the
USGS map using other methods within the SWPPP for clarity and ease of
reading.
b. The previous SWPPP developed in February 2007 included statements referring
to the feasibility of selecting or rejecting certain BMPs; we disagree with the "no"
finding.
i. All of the BMPs indicated in the 2007 SWPPP were deemed to be
feasible.
ii. Non -feasible BMPs were not included in the SWPPP.
iii. The Permit does not specify a format or level of detail for a "feasibility
study".
iv. The updated SWPPP will provide a brief narrative describing the
feasibility of changing current practices to reduce stormwater pollution.
c. The sentence "A responsible party shall be on -site at all times during facility
operations...." is in the Permit which is included in the SWPPP notebook at
Appendix E; since the Permit does not say to write this sentence into the SWPPP
or the SPRP, we do not think it necessary to repeat this language.
L A member of the SWPPT is always on -site when bulk POL and antifreeze
shipments are received.
ii. The updated SWPPP will include the sentence as noted by the Inspector.
d. The "responsible party" was identified in the 2007 SWPPP; we disagree with the
"no" finding.
i. The "responsible party" narrative is provided in § 1.2 of the SWPPP which
describes the responsibilities of the Stormwater Pollution Prevention Team
and shows an organization chart arranged by job position.
ii. Form 1 is provided in the SWPPP for writing in the names of the
Stormwater Pollution Prevention Team.
iii. Names were added to Form 1 on March 28, 2007; this completed form is
in the SWPPP notebook.
iv. A new Form 1 is completed each year; the 2008 Form 1 will be completed
by April 30, 2008.
e. No amendments to the SWPPP have been made since it had only been written
eleven (11) months before the City's inspection; we disagree with the inspector's
comment.
i. Form 5 is provided in the SWPPP for recording amendments. 4
7. Regarding the representative outfall status item on Page 6, we notified NCDWQ via the
2007 DMR that SDO-004 represents SDO-002 and SDO-003.
8. The blockage occurring downstream of the SDO-002 outlet is natural and is providing
detention. As long as it does not create a problem with this terminal's operations, we see
no need to remove it.
9. The staining and murky gray color at the SDO-003 outlet is caused by the type of rock
used in the riprap apron. This shale rock weathers into a very fine dust that creates a gray
discoloration.
10. The Permittee will reduce all POL discharges that are a violation of General Permit
NCO080000 and applicable North Carolina General Statutes. Discharges that are not a
violation will be controlled with feasible BMPs.

Permit.

with no odor or sheen.
Docks — Materials, both hazardous and non -hazardous, are loaded and unloaded from trailers in this area. The
docks are covered and not exposed to storm water. There are no floor drains located in this area. A floor
sweeper is used to clean the floors. This area appeared to be in good condition.
Trailer Parking — Tractors and trailers are stored outside and exposed to storm water in this area. Minor oil
sheens were present in this area. The facility should ensure that all leaks or spills are promptly removed.
Fifth Wheel Assembly Area — Fifth wheels, or "yard dogs" are stored outside and exposed to storm water in this
area. This area appeared to be in good condition.
Hazardous Trailer Parking Area — Trailers with hazardous materials that have spills or leaks are staged in this
area until a clean up contractor removes the spill and trailer for disposal. This area is comprised of a gravel lot
with one storm drain. Storm water entering the storm drain was clear with no odor. Empty trailers were stored in
this area at the time of inspection. This area appeared to be in good condition.
Trash Dumpsters — One large general trash dumpster and one large scrap metal dumpster are located outside
and under cover. The dumpsters appeared to be in good condition with no signs of leaks.
Wash Bay — Tractors are washed in the covered Wash Bay that is attached to the Garage. Trailers are not
washed at this facility. A berm was recently installed to prevent waste water from discharging to a storm drain.
Waste water is discharged to an onsite wastewater treatment plant, which includes an oil skimmer. The
wastewater is then discharged to CMl.1 sanitary sewer system.

Garage — This building consist of two bays where truck maintenance, service and window washing occurs. Floor
drains are located along most overhead bay doors. Floor drains were not located beneath the overhead bay
doors in the Service Cleaning,Bay, All floor drain discharge to the onsite wastewater treatment plant. A scrubber,
with a vacuum is used to clean the floors.
• One 150-gallon used antifreeze container is located in the Garage in double walled containment. Safety
Kleen collects and disposes of the used antifreeze on a monthly basis. The container appeared to be in
good condition.
• One parts washer is located in the Garage. Safety Kleen collects and disposes of the parts washer fluid
on a monthly basis. The parts washer appeared to be in good condition.
• Used oil filters are drained into a container for 2 to 3 days then disposed of in the trash dumpster. The
used oil is stored in a used oil tank located outside of the Garage. The used oil filter drain container
appeared to be in good condition.
• Two 55-gallon new transmission fluid barrels were observed in the Garage during the inspection. They
appeared to be in good condition.
• Two 55-gallon new hydraulic oil barrels were observed in the Garage during the inspection. They
appeared to be in good condition.
• Four 55-gallon new oil barrels were observed in the Garage during the inspection. They appeared to be in
good condition.
• Tire Storage Area — New and used tires are stored inside the Garage in this area. The area appeared to
be in good condition.
• Air Compressor — One large air compressor is located inside the Garage. There was no bleed off line
observed. There was no staining observed around the compressor.
• Water Sprinkler Discharge Line — One pipe was observed during the inspection that discharged to the
pavement surface outside. The line was verified to be a discharge pipe for the water sprinkler system.
Potable water is an allowable discharge.
• Service Cleaning Bay — Tractors are serviced in this area. Staff explained that windows are washed and
fluids are topped off in this bay. An oil sheen was observed originating from the Service Cleaning Bay
door and discharging into the nearby storm drain inlet. A diesel odor was present. This discharge is
suspected to be the source of the excessive oil sheen observed at SDO#004. The facility should
implement measures to prevent the discharge of pollutants to the ground and storm drain system.
Outside Tire and Wheel Storage Area — New and used tires are stored outside and exposed to storm water in this
area. This area appeared to be in good condition.
Used Oil Tank — One 6,000 gallon used oil tank is located outside and exposed to storm water. The tank is
double walled. Rust was observed on the unloading port line and waste oil supply line. The facility should
implement routine maintenance on all storage tanks and associated lines to prevent the potential discharge of
pollutants to the ground and storm drain system.
Above Ground Storage Tanks — One 6,000-gallon gear oil tank, one 8,000-gallon motor oil tank, and one 6,000-
gallon antifreeze tank are located on a concrete pad, outside and exposed to storm water. All tanks are double
walled with an audible and visual alarm located inside the Garage. Rust was observed on the outflow line of the
antifreeze tank. Rust was also observed on the lines of the motor oil tank. Minor rust was observed on the body
of the motor oil tank. All fueling ports are locked. The facility should implement routine maintenance on all
storage tanks and associated lines to prevent the potential discharge of pollutants to the ground and storm drain
system.
Diesel Fuel Storage Tanks — Two 8,000-gallon above ground diesel storage tanks are located inside a shared
concrete containment structure. One 2,000-gallon diesel tank is also located within the concrete containment
structure and is empty and out of service. Storm water that collects inside the containment structure is
discharged by a manual sump pump to an oil water separator, then to the Wash Bay. From the wash bay the
storm water is sent to the onsite wastewater treatment plant that includes an oil skimmer. Treated discharge is
released to CMU sanitary sewer system. In the event of a spill, Haz-Mat Transportation and Disposal is utilized to
remove and properly dispose of the spilled material. An underground storage tank is connected to the oil water
separator to reclaim spilled fuel. A Diesel Fuel Spill Kit is located adjacent to the Diesel Storage Tank area. The
oil water separator is monitored for disposal every two to three weeks. This area appeared to be in good
condition.

Diesel Fueling Area — This area is adjacent to the Diesel Fuel Storage Tanks, it is located under cover and is not
exposed to storm water. A trench drain is located by the fueling pump and the concrete surface is sloped towards
the drain to catch any spilled materials. The trench drain leads into the Diesel Fuel Storage Tank containment
structure. Fluids that collect inside the containment structure are discharged by a manual sump to an oil water
separator, then to the wash bay. From the wash bay the discharge is sent to the onsite wastewater treatment
plant that includes an oil skimmer. Treated discharge is released to CMU sanitary sewer system. This area
appeared to be in good condition.

Enclosed are the monitoring results from the laboratory analyses performed on the
discharge from Stormwater Outfall 004 at the subject facility. The samples analyzed were grab
samples collected during the sampling investigation performed on June 26, 2008, by Heather
Sorensen and Jason Klingler of Charlotte -Mecklenburg Storm Water Services. This sampling
investigation was conducted as part of a cooperative working agreement between Mecklenburg
County and the Division of Water Quality. In addition, the sampling investigation was
conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit,
NCS000240, Part II Section H.
The enclosed monitoring results indicate that the concentrations of pollutants in the
stormwater discharged on June 26, 2008, were below the benchmark values contained in
Stormwater general permit NCG080000. However, elevated concentrations of chemical oxygen
demand (COD), zinc, and fecal coliform bacteria were noted in the stormwater.discharge from
your facility to Little Sugar Creek.
Little Sugar Creek is currently listed on the North Carolina 303(d) list of impaired waters
and has TMDLs in place for fecal coliform, dissolved oxygen, and turbidity. As noted in Part I
of your general permit, facilities which discharge stormwater into 303(d) impaired waters may be
required to demonstrate at permit renewal that they do not have a reasonable potential to violate
applicable water quality standards for such pollutants due to the stonmwater discharge(s) on site.
Through the development and implementation of stormwater management programs it is the
Division of Water Quality's expectation that the stormwater discharges at industrial sites covered
by NPDES stormwater permits do not impact receiving waters.
The enclosed results should be self-explanatory; however should you have any questions

The Mooresville Regional Office staff have reviewed your request received on June 2, 2009 for a
determination that stormwater discharge outfall (SDO) 004 be granted representative outfall status for
stormwater outfalls 002 and 003. Based on the analytical information and maps provided and the site
visit on November 4, 2008, we are approving this request. In accordance with 40 CFR §122.21(g)(7),
you are authorized to sample outfall number 004 as a representative outfall. This approval is effective
with the next sampling event. We also want to remind you that the permit still requires Qualitative
Monitoring be performed at all SDOs, regardless of representative status.
Please remember that any actions you initiate in response to benchmark exceedances as directed in the
tiered response provisions of your permit must address all drainage areas represented by SDO 004,
where appropriate.
Please append this letter to your Stormwater Pollution Prevention Plan (SPPP) or permit to document
that representative outfall status has-been approved. If changes in drainage areas, structures,
processes, storage practices, or other activities occur that significantly alter the basis of this approval,
representative outfall status may no longer be valid, You should either resume sampling at all SDOs, or

On behalf of my client, I am submitting this petition letter requesting representative outfall status
for SDO-001 and SDO-004. Refer to the enclosed Map 2 for the location and drainage area of
this facility's outfalls. The following are our reasons for choosing SDO-001 and SDO-004:
SDO-001 has the most variety of industrial activity within its drainage area, consisting of a
portion of the truck garage, the wash bay, the fueling station, and a small POL tank farm. Its
drainage area is 375,575 sf and is 100% impervious. The end of the pipe, for sampling purposes,
is easy to access.
SDO-004 has within its drainage area a portion of the Garage, a portion of the terminal docks,
outside tire and wheel storage, and tractor and trailer parking. Its drainage area is 708,930 sf and
is 100% impervious. The end of the pipe, for sampling purposes, is easy to access.
SDO-002 and SDO-003 are similar to SDO-004, but do not include the truck garage within their
drainage areas. Due to the electric fence surrounding this property, and other fence on adjoining
properties, the ends of these pipes are more difficult to access. While monitoring could be
performed at interior catch basins, we prefer to access end of pipe monitoring points that are
outside the fence line.
Our visual observations on both dry and wet days indicate that all of the outfalls will have
similar discharge characteristics and water quality. However, in our opinion, SDO-001 and
SDO-004 are the preferable choice for analytical monitoring.
SDO-005 collects runoff only from the employee parking lot and is thus designated a non-
industrial outfall and is not subject to monitoring.

facility discharges into Little Sugar Creek. This fact is not accurate; this facility is in the Long Creek watershed.
SDO-004 discharges into an unnamed trib to Dixon Creek which is a trib to Long Creek. tong Creek enters the
Catawba River about 1.4 miles downstream of the NC27 bridge.
Long Creek is NOT on the draft 2008 303d list. Long Creek does have a TMDL for Turbidity (est. 02/08/05) and
no other parameters.
The above may affect your conclusions regarding this facility's stormwater discharges.

Enclosed are the monitoring results from the laboratory analyses performed on the
discharge from Stormwater Outfall 004 at the subject facility. The samples analyzed were grab
samples collected during the sampling investigation performed on June 26, 2008, by Heather
Sorensen and Jason Klingler of Charlotte -Mecklenburg Storm Water Services. This sampling
investigation was conducted as part of a cooperative working agreement between Mecklenburg
County and the Division of Water Quality. "In addition, the sampling investigation was
conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit,
NCS000240, Part II Section H.
The enclosed monitoring results indicate that the concentrations of pollutants in the
stormwater discharged on June 26, 2008, were below the benchmark values contained in
Stormwater general permit NCG080000. However, elevated concentrations of chemical oxygen
demand (COD), zinc, and fecal coliform bacteria were noted in the stormwater discharge from
your facility to Little Sugar Creek.
Little Sugar Creek -is currently listed on the North Carolina 303(d) list of impaired waters
and has TMDLs in place for fecal coliform, dissolved oxygen, and turbidity. As noted in Part I
of your general permit, facilities which discharge stormwater into 303(d) 'impaired waters may be
required to demonstrate at permit renewal that they do not have a reasonable potential to violate
applicable water quality standards for such pollutants due to the stormwater discharge(s) on site.
Through the development and implementation of stormwater management programs it is the
Division of Water Quality's expectation that the stormwater discharges at industrial sites covered
by NPDES stormwater permits do not impact receiving waters.
The enclosed results should be self-explanatory; however should you have any questions
concerning the sampling results or have any questions regarding your permit, please do not

In accordance with your application for a discharge permit received on August 22, 2006
we are forwarding herewith the subject certificate of coverage (COC) to discharge under the
subject state — NPDES general permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection Agency dated May 9, 1994 (or as subsequently
amended).
.If any parts, measurement frequencies, or sampling requirements contained in this permit
are unacceptable to you, you have the right to request an individual permit by submitting an
individual permit application. Unless such demand is made, this certificate of coverage shall be
final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to
the Division of Water Quality. The Division of Water Quality may require modification or
revocation and reissuance of the certificate of coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or
permits required by the Division of Land Resources, Coastal Area Management Act or any other
federal or local governmental permit that may be required.
