This inspection was conducted in response to a Rescission Request submitted to rescind NCGO80742 and merge the

This letter serves as a rescission request for NPDES Stormwater Permit
NCG080742 - Frito-Lay Rolling Sales LP, located at 2700 Nevada Blvd., Charlotte,
NC 28273. The existing structure and property at this address are currently
under construction/renovation. Construction activities will continue into 2018
in order to finish installing equipment for the distribution of Frito-Lay products
to retail service areas. Current construction related stormwater and erosion
controls were permitted in 2017 by the general construction contractor, CHATS.
This is an adjacent property (separated physically by Nevada Blvd., to the west)
to the Frito-Lay, Inc. snack food manufacturing facility, located at 2911 Nevada
Blvd., Charlotte, NC 28273 (NPDES Stormwater Permit NCG060000-Food and
Kindred Products). �' �o �D o /
Both of these properties are owned and managed by the same parent company,
Frito-Lay (PepsiCo), and operations at both locations are slated to be part of the
same manufacturing process. We are requesting that NCDEQ grant the
rescission of the 2700 Nevada Blvd. permit NCG080742, and the merging of
stormwater protection activities for these facilities under the current 2911

Note: Question 2. on the bottom of the first page of the November 1, 2007,
transmittal letter contains a DWQ error, subsequently corrected in later
transmittal letters.
Correct response: 2. Must analytical results be by a certified lab? Any
analytical testing must be conducted in accordance with the EPA methods for
that test, However, the analysis does not have to be by a lab or technician
holding a DWQ certification. The point is almost moot, because any
commercial lab offering water or wastewater services in NC will already be a
DWQ Certified lab. This distinction comes into play more when a facility
wants to train on -site staff to run the analyses. Those staff don't have to
hold a DWQ certification, but they do have to conduct the analyses per EPA
methods.

In response to your renewal application for continued coverage under stormwater General Permit NCGO80000 the Division of
Water Quality (DWQ) is forwarding heFewith the reissued stormwater General Permit. This permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated December f, 1983.
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Permit NCGO80000
• A copy of a Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all
the changes in the reissued permit.
The more significant changes'in the General Permit since your last Certificate of Coverage include the following:
• Part I Section A — A new notation that the No Exposure Exclusion from permitting option may be available to the
permittee.
• Part I Section A — A now provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL,
may not be eligible for renewed coverage under the General Permit.
• Part II Section B Table 1 — An increased sampling frequency from once per year to twice per year.
• Part 11 Section B Table 3 — Benchmark concentrations now replace cutoff concentrations; the elimination of the option to
avoid sampling based on cutoff concentrations.
• Part 11 Section B — New provisions requiring the permittee to execute Tier One and Tier Two response actions, based on
the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two
requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive
monitoring events show no benchmark exceedences.
• Part II Section B — A new provision that four exceedences of any particular benchmark will trigger Increased DWQ
involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for
an individual permit, or may direct the implementation or installation of specific stormwater control measures.
DWQ received a number of comments on a series of general permits similar to this one. A full response to comments can be
found at http://ncwaterquality.org/suAndustriaigpinfo.htm. Some comments resulted in permit modifications, others are
addressed in the response document or Fact Sheet. A few specific requests for clarification are addressed below.
1. What is the deadline for having a revised SPPP that reflects the provisions of the new General Permit? DWQ will require
that the permittee have a revised, complete SPPP no later than six months after the date of issue of that permittee's new
Certificate of Coverage. -
2. Must analytical results be by a certified lab? What about pH measurements? All analytical results obtained to satisfy
NPDES permit requirements must be certified, as directed in North Carolina regulations at 15A NCAC 2H .0800, and as
administered by DWQ's Laboratory Section Certification Branch. This includes -field pH measurements. �

On February 9, 2010, Heather Sorensen from Charlotte -Mecklenburg Stormwater Services (CMSWS),
conducted a site inspection of the Rolling, Frito-Lay Sales, LP facility located at 2700 Nevada Boulevard in
Charlotte, Mecklenburg County, North Carolina. The site drains to an unnamed tributary to Steele Creek,
Class C waters located in the Catwaba River Basin. The site visit and file review revealed that the subject
facility is covered by NPDES General Stormwater Permit — NCG0800000.
This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and
the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part II Section H. The following observations were
noted during the Charlotte -Mecklenburg Stormwater Services inspection (please see the attached addendum
for information about your permit):

Outfall #001 — Heavy sedimentation was observed around the outfall. The facility should conduct proper
maintenance of the outfall and search for ways to reduce sediment discharges from the property.
Outfall #003 — A new storm drain outfall, #003, that receives discharges from the facility's roof drains was
identified during the inspection. This outfall was added to the permittee's SPPP. This outfall appeared to be in
good condition.
5) City of Charlotte Stormwater Ordinance Review:
Floor Stripper — One 55-gallon barrel of Scrubmaster 2001-ES Floor Stripper was observed outside on a pallet,
exposed to stormwater. Product was observed inside a hose attached to the bung of the barrel. No spills were
observed. A water hose was also observed in the area. The facility should properly store chemical containers
in an area elevated off the ground, covered, and not exposed to stormwater. The facility should also ensure
proper handling and disposal of materials to prevent potential stormwater pollution.
Thank you for the assistance and cooperation during the inspection. Overall, the facility's Stormwater program
was well developed and implemented and this Office commends the permittee's efforts to ensure compliance
with your NPDES permit.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase,/ focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge.

discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES
General Stormwater Permit] can be found on this website.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit.. Please see the
above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of
the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day. .
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):

o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable)
o Records — Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to the expiration date. Any permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the expiration and has not requested renewal at least 180 days prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed, The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes require you to complete a
Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit..

Facility Description:
This facility is a distribution center that receives packaged products from plants then warehouses the products at the
facility. Orders are sorted, loaded onto trucks, and dispatched out to customers. Approximately 70 employees are based
out of the facility which operates 24 hours a day, seven days a week, No hazardous materials are handled at the facility.
Waste oils are taken to the Frito-Lay facility across the street for disposal. There have been no spills in the previous three
years. Vehicle washing occurs on site by a contractor that reclaims all wastewater. Light maintenance occurs outside in
the parking lot by a contractor. The facility is surrounded by a fence and secured with a locked gate.
Compliance History:
The permitteelfacility does not have any prior compliance issues with the NC Division of Water Quality or with
Charlotte -Mecklenburg Storm Water Services (CMSWS).

This permit does not affect the legal requirements to obtain other permits which may be

Resources, Coastal Area Management Act or any other Federal or Local governmental permit
that may be required.
