On March 22, 2010, Aliyah Owens from Charlotte -Mecklenburg Stormwater Services (CMSWS), conducted a
site inspection of the Rolling Frito Lay Sales LP facility located at 217 Stetson Drive in Charlotte, Mecklenburg
County, North Carolina. The site drains to Mallard Creek, Class C waters located in the Yadkin River Basin,
The site visit and file review revealed that the subject facility is covered by NPDES General Stormwater Permit
— NCGO80000.
This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and
the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part II Section H. The following observations were
noted during the Charlotte -Mecklenburg Stormwater Services inspection (please see the attached addendum
for information about your permit):
1) Stormwater Pollution Prevention Plan SPPP

conducted on site. The general location map did not include the longitude and latitude of the outfalls. The
permittee needs to evaluate the storm sewer system at the facility and document the last points of discharge
on the property as the facility's outfalls.

4) Permit and Outfalls
As noted above in the SPPP section please review the location of the facility's outfalls and update the SPPP
accordingly.
Thank you for the assistance and cooperation during the inspection. Overall, the facility's Stormwater program
was well developed and implemented and this Office commends the permittee's efforts to ensure compliance
with your NPDES permit.
However, as noted above and in the enclosed report, deficiencies were noted during the inspection and it is
requested that a written response be submitted to this Office by August 13, 2010, addressing these
deficiencies. In responding to the violations, please address your comments to the attention of Ms. Allocco at
the letterhead address,
The subject facility will have 90 days from the letterhead date to come into compliance with the noted issues.
A follow-up evaluation will be conducted by CMSWS after October 11, 2010, to ensure compliance with the
facility's Stormwater Permit and/or compliance with the City of Charlotte Stormwater Ordinance.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant. discharge.

discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES
General Stormwater Permit] can be found on this website.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. Please see the
above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein.
Failure to property comply with conditions of the permit, like those bulleted below, is a violation(s) of
the permit and subject to civil penalty assessment(s) of up to $25,000.Od per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Pees.
• This Notice of Intent (N01) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant'to the type of General Permit until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):

o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable)
o Records — Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to the expiration date. Any permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the expiration and has not requested renewal at least 180 days prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes require you to complete a
Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
c Proper Operation and Maintenance is a requirement of the permit.

Inspection Summary:
Facility Description:
The Rolling Frito Lay Sa4es LP facility is a receiving and distribution center for Frito Lay products. The permittee has five
employees in operations and one district manager at the facility. Hours of operation are 4 am-6 pm, seven days a week.
The permittee conducts vehicle maintenance activities on site. However, the activities are conducted by mechanics not
employed with Frito Lay. The permittee uses less than 55-gallons of new motor oil per month when averaged over a
calendar year.
Compliance History:
The permittee/facility does not have any prior compliance issues with the NC Division of Water Quality or with
Charlotte -Mecklenburg Storm Water Services (CMSWS).

Re: Inspection Report Response — North Charlotte Bin NCGO80738
This letter is in response to the inspection report for the above facility dated July 12, 2010.
Below are the planned actions to address the deficiencies identified in the report.
The existing narrative description for vehicle maintenance activities will be reviewed for
additional detail as needed. If required the narrative description will be modified.
A review of the site outfalls has been conducted. The area drains located in the truck well and
the cast parking area are connected to underground piping that leaves the facility at Stetson
Drive. As a result each of these inlet grates is considered an outfall. The parking and unloading
area on the northwest side of the facility does not have any area drain grates. All water flows to
Stetson Drive and discharges the facility at the curb where the drive way meets the street. A
discharge point has been identified on the north side of the drive. In addition this discharge point
will be considered the representative outfall for the facility and documentation will be developed
to reflect. All monitoring activities for the facility will be conducted at this location. The map
will be updated to reflect the changes to the outfalls, the latitude and longitude of the outfalls,
and the impervious surface square footage.
A USGS topographic general location map will be added to the SWPPP.
As requested these changes will be added to the SWPPP and implemented by October 11, 2010.

A follow-up evaluation was conducted by Aliyah Owens of Charlotte -Mecklenburg Stormwater Services (CMSWS) in
response to the deficiencies noted in the Compliance Evaluation inspection conducted on March 22, 2010. A site visit
was conducted on December 16, 2010 to comp€ete the follow-up evaluation. The follow-up evaluation was conducted as
part of a cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the
inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240,
Part II Section H.
The follow-up compliance evaluation found that the rolling Frito Lay Sales LP has implemented corrective actions to
address the deficiencies noted in the original inspection including:
• Submittal of facility maps that document the correct number of outfalls. As you requested, the North Carolina
Division of Water Quality (NCDWQ) has approved your request to cease qualitative monitoring activities at
outfalls that do not receive stormwater runoff from industrial activity areas
• Submittal of paperwork amending the Stormwater Pollution Prevention Plan (SPPP) stating that stormwater
outfalls 2 and 3 do not receive industrial stormwater runoff
• Submittal of a complete general location map
• Submittal of.paperwork documenting the permittee's facility site map including the proper location of outfalls
• Submittal of paperwork documenting an amendment to the SPPP for the location of maintenance activities
• Submittal of paperwork documenting that the narrative description of practices states that vehicle maintenance
activities are conducted on site
Thank you for the assistance and cooperation following the original inspection. Overall, the facility's Stormwater program
was well developed and implemented and this Office commends the permittee's efforts to ensure compliance with your
NPDES permit.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990, Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge.

forms, and a Notice of Intent [which is the application for coverage under a NPDES General Stormwater
Permit] can be found on this website.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. Please see the
above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of
the permit and subject to civil penalty assessments) of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting, and recording of Qualitative Monitoring

o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable)
o Records -- Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Flan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring informatics,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to the expiration date. Any permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the: expiration and has not requested renewal at least 180 days prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
a Name Change, Closure, or Facility Ownership change—'Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes require you to complete a
Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

Facility Description:
The Rolling Frito Lay Sales LP facility is a receiving and distriouticn center for Frito Lay products. The permittee has five
employees in operations and one district manager at the facility. Hours of operation are 4 art-6 pm, seven days a week.
The permittee conducts vehicle maintenance activities on site. However, the activities are conducted by mechanics not
employed with Frito Lay. The permittee uses less than 55-gallons of new motor oil per month when averaged over a
calendar year.
Compliance History:
A compliance evaluation inspection was conducted on March 22, 2010, by Aliyah Owens of Charlotte -Mecklenburg Storm
Water Services (CMSWS). A Notice of Deficiency (NOD) was issued to the Rolling Frito Lay Sales LP facility by the
Division of water Quality (DWQ) on July 12, 2010.

Comment: The permittee's SPPP during the initial inspection contained a narrative
description of practices. However, the narrative description did not document that
vehicle maintenance activities are conducted on site. The inspection also noted
deficiencies with the general location and site maps within the SPPP including the
location of the permittee's outfalls; located beyond the permittee's property line.
The permittee submitted updated general location and site maps to Ms. Owens on
December 22, 2010, which addressed the deficiencies noted during the initial
inspection. In addition, an amendment to the SPPP was submitted to Ms. Owens on
January 28, 2011, documenting the location of maintenance activities on site.

Comment; At the time of the inspection conducted on March 22, 2010 the facility site
map documented two storm drain inlets on Stetson Drive as the facility's outfalls. Drains
located beyond the permittee's property line are not facility outfalls, The permittee
should evaluate the storm sewer system at the facility and document the least points of
discharge on the property as the facility's outfalls.
The permittee submitted a map of the facility via email to Aliyah Owens of MCWQP. The
map documents that the facility has oWy one outfall that is exposed to industrial
stormwater.

Re: Inspection Report Response — North Charlotte Bin NCGO80738
This letter is in response to the follow-up visit by Ms. Owens on 12/16/2010. We reviewed the
inspection report for the above facility dated July 12, 2010, and our response letter dated August
3, 2010. Below is a modified response based on clarifications made by Ms. Owens during this
visit.
The existing narrative description for vehicle maintenance activities will be revised for additional
detail related to Truck Maintenance activities conducted periodically at the site.
A review of the site outfalls has been conducted. The area drains located in the truck well and
the east parking area are connected to underground piping that leaves the facility at Stetson
Drive. This storm water is not exposed to any industrial activity and has access restricted by
locked gates. Since no activity occurs in this area no visual monitoring is required according to
Ms. Owens. The parking and unloading area on the northwest side of the facility does not have
any area drain grates. All water flows to Stetson Drive and discharges the facility at the curb
where the drive way meets the street. A discharge point has been identified on the north side of
the drive before it joins the street curb/gutter. In addition this discharge point will be considered
the sole outfall for the facility. All monitoring activities for the facility will be conducted at this
location. The map will be updated to reflect the changes to the outfalls, the latitude and
longitude of the outfalls, and the impervious surface square footage.
A USGS topographic general location map has been added to the SWPPP.
As requested these changes will be added to the SWPPP and implemented by December 29,
2010.

FACILITY DESCRIPTION AND SITE MAP
Distribution Centers (DCs) and Bin facilities are the warehousing and distribution centers
for snack products utilized by Frito-Lay. These facilities have a fleet of trucks that are
used to transport the snack products from the manufacturing plant to a warehouse and
then redistribute the snack products to the point of sale locations. The Standard Industrial
Code (SIC) for a DC is 4213 (trucking, except local) and for a Bin, is 4214 (local trucking
with storage). North American Industry Classification System (NAICS) designations are
484121 and 48411 for a DC and Bin, respectively. Both DCs and Bins are included
under EPA's Category VIII (Transportation Facilities) which require a NPDES permit.
Fleet activities which trigger the requirement for a NPDES "storm water associated with
industrial activities" permit at this facility can include: maintenance (activfties include
fluid changes, minor mechanical repairs, and fluid makeup), washing (vehicle washing
procedures are located in the BMP Implementation Section of the SWPPP EMS-13-
W20), and fueling of the trucks. All of these activities are required to be performed in
designated areas at the facility.
