Enclosed is a copy of the Compliance Evaluation Inspection (CEI) report for the inspection
conducted at the subject facility on February 24, 2012, by Mr. Michael L. Parker with this Office. During
the inspection, the Kannapolis Public Works Operation Center was represented by Mr. Jason Gillespie.
The enclosed report should be self-explanatory. Please note the comments located in the summary
portion of the inspection report. As noted by Mr. Parker during his inspection, a Stormwater Pollution
Prevention Plan (SPPP) had not been implemented for your facility as required by Part II, Section A of
your permit. Furthermore, qualitative monitoring has not been performed as required by Part 11, Section
D. Once implemented, your facilities SPPP should be updated on an annual basis as required by Part I1,
Section A, No. 7. Such being the case, this inspection report is being issued as a Notice of Deficiency for
the failure to comply with the terms and conditions of your General Permit, Please be advised that NCGS
143-215.6A(a)(2) provides for a civil penalty of not more than $25,000 per day per violation, which may
be assessed against any person who fails to act in accordance with the terms, conditions and requirements
of such Permit.

Inspection Summary:
At the time of the site visit, the Kannapolis Public Works Department (KPWD) was operating under a SPPP that had been
prepared for this subject facility in 2009, however, the SPPP had not been implemented as required by the Permit. -The -
SPPP had a number of areas that had not been updated or should have been included in the Plan. These area include:
1. There was no general location map (USGS) as required by Part II, Section A, No. 1(a) of the Permit.
2, The SPPP did not include a site map detailing all outfalls and drainage area as required by Part ll, Section A, No. 1(c)
of the Permit.
3. The SPPP did not include a list of significant spills (if any) that had occurred in the past three years as required by Part
ll, Section A, No. 1(d) of the Permit.
4. There was no mention in the SPPP of where an annual evaluation of the feasible alternatives to current practices had
been conducted as required by Part li, Section A, No. 2(a) of the Permit.
5. Although employee training is conducted, there is no mention in the SPPP as to when the training is conducted or a list
of the person(s) or team responsible for conducting the training as required by Part ll, Section A, No. 5 of the Permit.
6. The SPPP has a page where the personnel responsible for the implementation of SPPP are to be listed, however,
there are no names found in the SPPP as required by Part Il, Section A. No. 6 of the Permit.
7. The SPPP was developed in February, 2009, however, there have been no updates to the Plan to -date as required by
Part ll, Section A, No. 7 of the Permit.
8. As required by Part Il, Section A, No. 8 of the SPPP, the facility is required to inspect all SW systems on at least a
semi-annual basis. Records of these inspections should include the date and time of the inspection, individuals making
the inspection, and a narrative description of the facilities SW systems. There was no record of these inspections found
the in the facilities SPPP.
9. Qualitative monitoring, as required by Part ll, Section D of the Permit has not been conducted.
In general, the KPWD site was relatively clean and exposure to contaminants were minimized by the amount of roofing
that had been installed over equipment and materials. There were, however, areas where exposure existed and the
potential for contaminents to be captured by SW were evident. in the rear of the site, some areas had not been paved and
were covered with gravel, which during heavy rainfall events contribute to elevated TSS levels in the site's SW. A large
portion of these graveled areas bordered a small SW detention pond constructed on the south side of the property
adjacent to the property line. The water in this pond was fairly turbid at the time of the site visit. Grading activities had
recently occurred adjacent to the pond and the pond may have been negatively affected by the runoff from the exposed
soils and gravel areas that drain to it. It did not appear that the pond was receiving regular maintenance, which may be
compromising it's efficiency. As required by Part ll, Section A, No. 4 of the subject Permit, regular maintenance of all SW
structures should be a regular part of the site's SPPP.
The KPWD site had an area where vehicles were hosed off to remove dust. There was no evidence that any type of
detergents or other cleaning agents were being used in the cleaning process. Please noted that the subject Permit does
not authorize the discharge of water used in vehicle and equipment cleaning where the discharge of the wash water is
discharge to the receiving waters. Please refer to Part Il, Section A, No. 2(e) for more information on Vehicle and
Equipment Cleaning Areas.
Please note that the General Permit for this facility expires on October 31, 2012. A renewal should be requested at least
180 days from the date that the General Permit expires.

forwarding herewith the subject certificate of coverage to discharge under the subject state — NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215 .1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated May
9, 1994 (or as subsequently amended).
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the
certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management
Act or any other Federal or Local governmental permit that may be required.
