Comment: A spill of 330 gallons of vinvl acetate occurred on 7/24/14 and a will of 600 gallons of terathane
occurred on 9/23/14. The National Response Center (NRC) and NCDEQ were alerted of the
spills. and remediation activities were documented_ in the SPPP. As Der part II, Section A. 7(a) of
the permit. the
Facility should record a "notation of no spills" during the annual SPPP review far years in which
no significant spills have occurred.
The most recent documented non-stormwater discharge evaluation was conducted on
3/17/2015.

A follow-up evaluation was conducted by Aliyah Owens of Charlotte -Mecklenburg Stormwater Services (CMSWS) in
response to the violations noted in the Compliance Evaluation inspection conducted on February 3, 2011. A site visit was
conducted on June 10, 2011 to complete the follow-up evaluation. The follow-up evaluation was conducted as part of a
cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the
inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240,
Part II Section H.
The follow-up compliance evaluation found that the UPS Ground Freight Inc. has implemented corrective actions to
address the deficiencies noted in the original inspection including:
• Submittal of paperwork documenting an evaluation of outfalls for non-stormwater discharges.
• Submittal of paperwork documenting qualitative monitoring activities..
• The facility's oil water separator discharges into the sanitary sewer system, therefore analytical monitoring is not
required in accordance with the general stormwater permit NCG080000.
• The facility has seven documented stormwater outfalis.
Thank you for the assistance and cooperation following the original inspection. As noted above and in the enclosed
report; the facility has corrected deficiencies and has satisfied the conditions of the Notice of Deficiency. The facility has
developed and implemented a Stormwater program and this Office commends the permittee's efforts to ensure
compliance with your NPDES permit.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge.

forms, and a Notice of Intent [which is the application for coverage under a NPDES General Stormwater
Permit] can be found on this website.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. Please see the
above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of
the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, andlor mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting, and recording of Qualitative Monitoring

o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable)
o Records — Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to the expiration date. Any permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the expiration and has not requested renewal at least 180 days.prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes require you to complete a
Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

Compliance History:
A file review found that a Compliance Evaluation Inspection was conducted at the GP Transflo Terminal on March 23,
2005, by Charlotte -Mecklenburg Storm Water Services (CMSWS) personnel. The permittee was compliant with the
requirements of the permit at the time of the inspection. This inspection is a
follow-up to the February 3, 2011, inspection.

On February 3, 2011, Aliyah Owens from Charlotte -Mecklenburg Stormwater Services (CMSWS), conducted a
site inspection of the charlotte GP Transflo facility located at 601 North Hoskins Road. in Charlotte,
Mecklenburg County, North Carolina. The site drains to Irwin Creek, Class C waters located in the Catawba
River Basin. The site visit and file review revealed that the subject facility is covered by NPDES General
Stormwater Permit — NCG080000.
This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and
the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part II Section H. The following observations and/or
permit condition violations were noted during the CMSWS inspection (p4ease see the attached addendum for
information about your permit):

permit NCG080000.

Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may
be assessed against any person who violates or fails to act in accordance with the terms, conditions, or
requirements of any permit issued pursuant to G.S. 143-215.1,
The subject facility will have 90 days from the letterhead date to come into compliance with the noted issues.
A follow-up evaluation will be conducted by CMSWS after July 8, 2011, to ensure compliance with the facility's
Stormwater Permit and/or compliance with the City of Charlotte Stormwater Ordinance.

• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly, however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):

o Records —Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to the expiration date. Any permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the expiration and has not requested renewal at least 180 days prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change'— Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes require you to complete a
Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

On February 3, 2011, the Charlotte East TRANSFLO Terminal, located at 601 North Hoskins
Road, Charlotte, NC 28216, was inspected by your Department staff to determine compliance
with the National Pollutant Discharge Elimination System (NPDES) General Stormwater Permit
NCG080000 and with the City of Charlotte NPDES Permit NCS000240, Part II, Section H. This
letter is to serve as documentation that the following violations have been corrected or were
incorrectly identified as violations.
Observation: The permittee improperly conducted qualitative monitoring. The permittee did not
monitor runoff from the facility during a storm event. The permittee monitored and documented
water in the creek that runs adjacent to the property. Future qualitative monitoring should be
conducted during a representative storm event of the facility's stormwater discharges.
TRANSFLO Response: TRANSFLO prepared a new Stormwater Pollution Prevention Plan
(SWP3) and provided the plan to the facility on April 21, 2011. This plan includes a map showing
each of the seven stormwater outfalls. The plan states that "The storm water discharge from each
outfall associated with industrial activity shall be visually examined at least semi-annually". The
Terminal Manager of this facility, who is responsible for sampling, was new to the role during the
State's visit and was not fully aware of sampling requirements. TRANSFLO reviewed the
stormwater outfalls with the Terminal Manager on April 20, 2011 and verified each outfall location.
In addition, TRANSFLO sent a copy of a memo defining "representative storm event" to the
Terminal Manager on May 3, 2011. The corrective actions communicated to the Terminal explain
in detail where, how and when to take future samples. Refer to Attachment A.
Observation: The facility has an oil -water separator that discharges water into the stormwater
system. The permittee is required to perform semi-annual analytical monitoring of outfalls
receiving discharges from oil/water separators in accordance with General Stormwater Permit
NCG080000.
TRANSFLO Response: The oillwater separator located at this facility discharges to the sanitary
sewer and not to the stormwater system. Personnel interviewed during the State's inspection
were not familiar with the underground piping at the Terminal and may have mistakenly indicated
that the separator drained to the storm water system. Attached is a copy of the site plan for the
facility showing the connection to the sanitary sewer. Semi-annual analytical monitoring of the
outfalls will not be necessary since the discharge is directed to the sanitary sewer. Refer to
Attachment B.

TRANSFLO Response: TRANSFLO recently revised its SWPPP template to include an annual

certification. TRANSFLO has included this item in its database tracking system to insure that the

Collect the sample in a clean, clear glass container. The sample should sit for 30 minutes before the
observations are made.
3.6 Employee Training
Terminal employees, at all levels of responsibility, shall be informed as to the components of the SWPPP.
Training addresses the following topics:
Good housekeeping;
Preventive Maintenance; and
Spill prevention and response.
Training is completed annually, documented and attendance records are maintained at the facility and are hereby
incorporated into the plan by reference.
3.7 Recordkeeping and Internal Reporting
This plan will be retained onsite at the terminal until at least three (3) years after coverage under the permit
terminates 10/31/2012. Also, this plan will be made available, upon request, to the NC DENR.
The following SWPPP elements will be updated as appropriate:
• Figure 2 - Facility Site Plan.
• Appendix F, Table 2.2.
• All required monitoring and inspections will be conducted as required, and will be incorporated as a
part of the plan.
• SWPPP training records will be maintained on -site and will become a part of the plan by reference.
3.8 Non-Stormwater Discharges
There are no identified non -storm water discharges at the terminal. The Non -Storm Water Discharge
Assessment and Certification form can be found in Appendix E of this plan.
3.9 Sediment and Erosion Control
There are no areas that have a high potential for significant soil erosion. Other than ballast, no additional
sediment and erosion controls are recommended for the terminal.

Routine Compliance Inspections
We have noticed some variances with the routine compliance inspections at TRANSFLO
terminals. To ensure consistent compliance recordkeeping, please attempt to complete routine
inspections during the same time period each month.
Monthly inspection records which are due by the first of each month are for the previous month's
data: SPCC, maintenance records, air monitoring records, etc. Unless specifically requested, or
if equipment changes are made, only one inspection is required per month. One inspection
should be completed for each month. For example, if the due date is June 1, 2010, then the
inspection should occur sometime during the month of May 2010.
uarterl inspections should be completed during the three month quarterly period and
submitted to TRANSFLO HS&E prior to the beginning of the next quarter: Storm water
monitoring and facility review inspections.
• Quarter 1 — January 1 through March 31 — Due 411
• Quarter 2 - April 1 through June 30 — Due 711
• Quarter 3 — July 1 through September 31 — Due 1011
• Quarter 4 — October 1 through December 31 — Due 111
These records will be saved to the appropriate portal folders and named for the corresponding
compliance quarter: Q1, Q2, Q3 or Q4. If the inspection is completed late, it will still be named for
the intended compliance quarter. However, this will be noted as a non-compliance issue.
Semi-annual and Annual compliance inspections should be completed during the appropriate
(time frame. Annual training records should be completed prior to the due date, roughly one yea
(after the last_ occurrence.)
(Qualitative Monitorina- {Visual Insaectlonl of storm water is required by many of the storm,
water permits. The Qualitative Monitoring Report form should be completed during representative
rainfall events according to the frequency required by the facility storm water permit. Note. A
representative rainfall measures greater than 0.1 inches of rainfall and. is preceded by at least 3
days in which no storm event greater than 0.1 inches has occurred. For example, if your permit
requires quarterly qualitative monitoring, complete the form during .any representative rainfall
occurring between the first and last day of the quarter, (e.g. Quarter 2: April 1 .and June 30`nj
Avoid completing forms on the last day of the frequency interval

The Charlotte North TRANSFLO Terminal holds General Permit NCG080000,
Certificate of Coverage NCG080664. 'The Certificate of Coverage was issued on June 13, 2003
and will remain effective for the duration of the General -Permit, expiring on August 31, 2007.
This permit authorizes the permittee to discharge storm water. associated with industrial
.activities, to the surface waters of -the State or to'the Municipal Separate'Storm'Sewer System,
providing that the,permittee treats, controls, limits and monitors the discharge as•specified in the
permit.
RECORDS/REPORTS:
A file review was conducted prior to the,Charlotte North TRANSFLO Terminal
_inspection. A review of.the facility Storm Water Pollution Prevention Plan (SPPP) and related
:sub plans was conducted during the inspection. All,documents maintained by the Charlotte
North TRANSFLO Terminal were well organized, -legible and readily available- for inspection
upon request. These files included the°Charlotte North TRANSFLO Terminal's -Storm Water
Pollution Prevention, Storm Water Management, and Spill Prevention and Response Plans as
well as documentation of existing -qualitative monitoring. It was noted that the SPPP was
current, included updated employee training records, and also included updated Qualitative
Monitoring Reports. The documentation maintained by the Charlotte North TRANSFLO
Terminal in_part satisfies their NPDES permit obligations.
,FACILITY.SITE REVIEW:
The facility is -a railcar. transfer station where materials are transferred from railcar to
freight.truck,or,vice versa for transport. The facility is'located at 601 N. Hoskins Rd, :Charlotte,
NC 28216. There -are 13 railcar.tracks.on site used for the'transfer of materials. There is.also a
garage -area and hazardous waste storage area'located-on the property. Tanker trucks -are parked
in a gravel•parking lot on the west side of the facility. Three (3) emergency shut.off valves for
the storm water drainage system are'in place to prevent any accidental releases from reaching
surface waters.
The indoor garage area is located in a building on the southwestern corner of the property.
It appeared clean and in good condition. The garage area includes two floor drains, which were
clean and free -of debris. These drains are connected to a 1000 gallon oil/water separator which
discharges to the Charlotte -Mecklenburg Utilities sanitary sewer collection system. A covered
bay adjacent to the north side of the garage area is equipped with, one floor drain that drains to
the oil/water separator and sanitary sewer system as well.
Adjacent to the north side of the garage is a hazardous waste storage area. This area is
covered and secured by a fence. Drums stored in the area are clearly labeled and stored off of the
ground surface on pallets. The floor drain in this area has been sealed and the area has

a raised berm to prevent a liquid spill from migrating from the covered area. Any accumulated
storm water in the hazardous waste area is analyzed before being pumped out to the ground and
the storm drainage system.
Four (4) above ground fuel storage tanks are located on the property near the garage area
These tanks range in capacity from 275.to 10,000 gallons. All of the tanks are double -walled to
provide secondary containment. A fifth tank is'located-in:the southeastern corner of the property.
This 1-000 gallon tank is aalso double -walled to provide secondary containment. All tanks
:appeared to be in good working condition, with no visible leaks or staining. Spill kits were
accessible,and located througbout-the.property.
The.railcar yard is located at.the center of the Charlotte North TRANSFLO Terminal
property. The railcar yard features .13 tracks used for'the transfer of materials. The yard appears
.to be -clean and appropriately maintained. Storm drains are located between the railroad tracks.
These storm -drains appeared to be clean and in good working order. Some railcars are heated
with steam, and condensate formed on the railcars discharges to the ground. All of the tracks
drain to -catch basins or a 12 foot trench drain. These in turn each drain to one of three outfalls.
Three (3) storm drainage system outfalls are located on the property.
Outfall 001: This outfall is located on the northwestern corner of the property and discharges.to
an unnamed -tributary of Stewart Creek. This outfall drains the railcar yard. It features an
{emergency shut-off valve and appears to be in .good working condition.
;Outfall 002: This outfall is located on the southwestern corner of the property, and discharges to
an unnamed ,tributary of Stewart ' Creek. This outfall drains the 12 foot trench and
(which
partially draitns.the railcar yard), catch basins from -the railcar yard, as well as the area of
buildings located behind the office. It features an -emergency shut-off valve and appears to be in
.good working. condition.
-Outfall 003: This.outfall is located on the southeastern edge of the property and discharges to a
storm water ditch along Hoskins Road. This storm water ditch drains the eastern side of the
railcar yard and discharges to an unnamed tributary of Stewart Creek. The outfall features an
emergency shut-off valve and appears to be in good working condition.
EFFLUENT/RECEIVING WATERS:
The inspection was conducted during rainy weather. The waters of the receiving stream
at the discharge point of Outfall 002 were visually evaluated at the time of the inspection. The
discharge did not appear to negatively impact the receiving stream at the time of the inspection.
MCWQP collected grab samples from the discharge point of Outfall 002 during the
facility inspection. MCWQP measured effluent Temperature, pH, Conductivity and Dissolved
Oxygen using a multi -parameter field instrument in -situ. All samples were collected at
approximately 8:20 am and submitted to the Land Use and Environmental Services Agency
Laboratory at approximately 9:00 am. Analytical results from the sampling are as follows:

The sampling results for all parameters collected during the inspection were below
concentrations that would potentially have a negative impact on the receiving stream.
SELF -MONITORING PROGRAM:
Part II, Section B: Analytical Monitoring Requirements of the permit requires that

facilities utilizing more than 55 gallons of new motor oil per month perform annual analytical
monitoring of storm water discharges during representative storm events. Since the facility does
not have vehicle maintenance activties that uses more than 55 gallons of new motor oil per
month, the facility is not required to perform. analytical monitoring.
Part 1I;'Section.F.'Qualitative Monitoring Requirements of the permit requires that
semi-annual qualitative monitoring -be conducted. Adequate records of qualitative monitoring
were kept on site.
OPERATIONS & MAINTENANCE:
Overall, .the'facility's housekeeping and record -keeping were satisfactory.
STORMWATER POLLUTION PREVENTION:
The permittee has successfully developed and implemented a plan -that is adequate and
innovative. Documentation appeared accurate and up-to-date.

This serves as the final report detailing the emergency response and corrective actions taken for the caustic
release that occurred on April 27, 2008, at the above -referenced location.
Incident Background:
On April 27, 2008, at approximately 8:00 pm, CDT, a dumpster containing hydrated lime reacted with rain
water producing meat. Asa result, the contents of the dumpster ignited.
Emergency Response:
The Charlotte lire Department applied water to extinguish the fire. Approximately 750 gallons of lime -
impacted fire fighting water were flushed from the dumpster across the gravel parking lot and into a nearby
ditch. On April 27, 2008, Mr. Matthew Martin with CSN retained Curt Emergency Services (CES) to manage
the environmental cleanup operations. The C13S incident manger contacted Ms. Tara Stone with the
Nfecklenburg County division of NVaier Quality to gain additional information about the release. Based on
available information, the CES incident manger dispatched a crew from 1-Icpaco located in Charlotte, North
Carolina toassess the release and initiate corrective actions,
Regulatory Notification:
On April 27, 2008, a courtesy notification was madc to the Meckleaberg County Division of Water Quality.
Corrective Actions:
The crew from I-lepaco arrived on site field-tested the freestanding product, with most areas indication a pl-I of
14, The freestanding rinsate was Elcutrallzed until field screenings yielded a 1)1-1 of 7. I-lepaco personnel then
utilized a vacLium truck to collect approximately 750 gallons of rinsate from the parking lot, ditch line and
dumpster. One (1) confirmation soil sample was secured from the soil ditch line and submitted for-,malysis.

Waste Disposal:
On April 28, 2008, approximately 750 gallons of non -hazardous rinse waiter were transported to, and disposed
of at, I-Iazittat "Transportation located in Charlotte, North Carolina (sec attached disposal immifest).
Conclusion:
Analytical data returned from soil -sampling activities suggest that no sig iftcant impact remains at the site
following corrective actions. 13ased on these results, it appears the corrective action was successful :uid no
further action should be required.
