Hoskins Road NPDES Stormwater Permit NCGO80000 Certificate of Coverage — NCG080664 Mecklenburg County Dear Mr. Allen: Dee Freeman Secretary A follow-up evaluation was conducted by Aliyah Owens of Charlotte -Mecklenburg Stormwater Services (CMSWS) in response to the violations noted in the Compliance Evaluation inspection conducted on February 3, 2011. A site visit was conducted on June 10, 2011 to complete the follow-up evaluation. The follow-up evaluation was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part II Section H. The follow-up compliance evaluation found that the UPS Ground Freight Inc. has implemented corrective actions to address the deficiencies noted in the original inspection including: • Submittal of paperwork documenting an evaluation of outfalls for non-stormwater discharges. • Submittal of paperwork documenting qualitative monitoring activities.. • The facility's oil water separator discharges into the sanitary sewer system, therefore analytical monitoring is not required in accordance with the general stormwater permit NCG080000. • The facility has seven documented stormwater outfalis. Thank you for the assistance and cooperation following the original inspection. As noted above and in the enclosed report; the facility has corrected deficiencies and has satisfied the conditions of the Notice of Deficiency. The NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and operations planning to reduce pollutant sources. Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general stormwater permits in North Carolina. One condition that is applicable to both the general permits and individual stormwater permits is the requirement to develop and implement site -specific comprehensive Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge. Permit text, technical bulletins, discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES General Stormwater Permit] can be found on this website. Copies of the analytical monitoring results shall also be maintained on site. The Permittee shall retain records of all monitoring information, including all calibration and maintenance records and all original strip -chart recordings for continuous monitoring instrumentation, and copies of all reports required by this general permit for a period of at least 5 years from the date of the sample measurement, report, or application. o Expiration — The permittee is not authorized to discharge after the expiration date of the general permit. In order to receive automatic authorization to discharge beyond the expiration date, the permittee shall submit forms and fees as are required by the agency authorized to issue permits no later than 180-days prior to the expiration date. Any permittee that has not requested renewal at least 180 days prior to expiration, or any permittee that does not have a permit after the expiration and has not requested renewal at least 180 days.prior to expiration, will be subject to enforcement. Failure to renew your permit is a violation. o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not transferable to any person expect after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the Certificate of Coverage to change the name and incorporate such other requirements as may be necessary under the Clean Water Act. The Permit is NOT transferable. o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the Division in writing in the event the permitted facility is sold or closed. The site drains to Irwin Creek, Class C waters located in the Catawba River Basin. The site visit and file review revealed that the subject facility is covered by NPDES General Stormwater Permit — NCG080000. This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part II Section H. TRANSFLO Response: TRANSFLO prepared a new Stormwater Pollution Prevention Plan (SWP3) and provided the plan to the facility on April 21, 2011. This plan includes a map showing each of the seven stormwater outfalls. The plan states that "The storm water discharge from each outfall associated with industrial activity shall be visually examined at least semi-annually". The Terminal Manager of this facility, who is responsible for sampling, was new to the role during the State's visit and was not fully aware of sampling requirements. TRANSFLO reviewed the stormwater outfalls with the Terminal Manager on April 20, 2011 and verified each outfall location. In addition, TRANSFLO sent a copy of a memo defining "representative storm event" to the Terminal Manager on May 3, 2011. The corrective actions communicated to the Terminal explain in detail where, how and when to take future samples. Refer to Attachment A. Observation: The facility has an oil -water separator that discharges water into the stormwater system. The permittee is required to perform semi-annual analytical monitoring of outfalls receiving discharges from oil/water separators in accordance with General Stormwater Permit NCG080000. TRANSFLO Response: The oillwater separator located at this facility discharges to the sanitary sewer and not to the stormwater system. Personnel interviewed during the State's inspection were not familiar with the underground piping at the Terminal and may have mistakenly indicated that the separator drained to the storm water system. Attached is a copy of the site plan for the facility showing the connection to the sanitary sewer. Monthly inspection records which are due by the first of each month are for the previous month's data: SPCC, maintenance records, air monitoring records, etc. Unless specifically requested, or if equipment changes are made, only one inspection is required per month. One inspection should be completed for each month. RECORDS/REPORTS: A file review was conducted prior to the,Charlotte North TRANSFLO Terminal _inspection. A review of.the facility Storm Water Pollution Prevention Plan (SPPP) and related :sub plans was conducted during the inspection. All,documents maintained by the Charlotte North TRANSFLO Terminal were well organized, -legible and readily available- for inspection upon request. These files included the°Charlotte North TRANSFLO Terminal's -Storm Water Pollution Prevention, Storm Water Management, and Spill Prevention and Response Plans as well as documentation of existing -qualitative monitoring. It was noted that the SPPP was current, included updated employee training records, and also included updated Qualitative Monitoring Reports. The documentation maintained by the Charlotte North TRANSFLO Terminal in_part satisfies their NPDES permit obligations. ,FACILITY.SITE REVIEW: The facility is -a railcar. transfer station where materials are transferred from railcar to freight.truck,or,vice versa for transport. The facility is'located at 601 N. Hoskins Rd, :Charlotte, NC 28216. There -are 13 railcar.tracks.on site used for the'transfer of materials. There is.also a garage -area and hazardous waste storage area'located-on the property. Tanker trucks -are parked in a gravel•parking lot on the west side of the facility. Three (3) emergency shut.off valves for the storm water drainage system are'in place to prevent any accidental releases from reaching surface waters. The indoor garage area is located in a building on the southwestern corner of the property. It appeared clean and in good condition. The garage area includes two floor drains, which were clean and free -of debris. These drains are connected to a 1000 gallon oil/water separator which discharges to the Charlotte -Mecklenburg Utilities sanitary sewer collection system. A covered bay adjacent to the north side of the garage area is equipped with, one floor drain that drains to the oil/water separator and sanitary sewer system as well. Adjacent to the north side of the garage is a hazardous waste storage area. This area is covered and secured by a fence. Drums stored in the area are clearly labeled and stored off of the ground surface on pallets. J FACILITY SITE REVIEW (continued): a raised berm to prevent a liquid spill from migrating from the covered area. Any accumulated storm water in the hazardous waste area is analyzed before being pumped out to the ground and the storm drainage system. Four (4) above ground fuel storage tanks are located on the property near the garage area These tanks range in capacity from 275.to 10,000 gallons. All of the tanks are double -walled to provide secondary containment. A fifth tank is'located-in:the southeastern corner of the property. This 1-000 gallon tank is aalso double -walled to provide secondary containment. All tanks :appeared to be in good working condition, with no visible leaks or staining. Spill kits were accessible,and located througbout-the.property. The.railcar yard is located at.the center of the Charlotte North TRANSFLO Terminal property. The railcar yard features .13 tracks used for'the transfer of materials. The yard appears .to be -clean and appropriately maintained. Storm drains are located between the railroad tracks. These storm -drains appeared to be clean and in good working order. Some railcars are heated with steam, and condensate formed on the railcars discharges to the ground. All of the tracks drain to -catch basins or a 12 foot trench drain. These in turn each drain to one of three outfalls. Three (3) storm drainage system outfalls are located on the property. Outfall 001: This outfall is located on the northwestern corner of the property and discharges.to an unnamed -tributary of Stewart Creek. This outfall drains the railcar yard. It features an {emergency shut-off valve and appears to be in .good working condition. ;Outfall 002: This outfall is located on the southwestern corner of the property, and discharges to an unnamed ,tributary of Stewart ' Creek. This outfall drains the 12 foot trench and (which partially draitns.the railcar yard), catch basins from -the railcar yard, as well as the area of buildings located behind the office. It features an -emergency shut-off valve and appears to be in .good working. condition. -Outfall 003: This.outfall is located on the southeastern edge of the property and discharges to a storm water ditch along Hoskins Road. This storm water ditch drains the eastern side of the railcar yard and discharges to an unnamed tributary of Stewart Creek. The outfall features an emergency shut-off valve and appears to be in good working condition. EFFLUENT/RECEIVING WATERS: The inspection was conducted during rainy weather. The waters of the receiving stream at the discharge point of Outfall 002 were visually evaluated at the time of the inspection. The discharge did not appear to negatively impact the receiving stream at the time of the inspection. MCWQP collected grab samples from the discharge point of Outfall 002 during the facility inspection. MCWQP measured effluent Temperature, pH, Conductivity and Dissolved Oxygen using a multi -parameter field instrument in -situ. All samples were collected at approximately 8:20 am and submitted to the Land Use and Environmental Services Agency Laboratory at approximately 9:00 am. Incident Background: On April 27, 2008, at approximately 8:00 pm, CDT, a dumpster containing hydrated lime reacted with rain water producing meat. Asa result, the contents of the dumpster ignited. Emergency Response: The Charlotte lire Department applied water to extinguish the fire. Approximately 750 gallons of lime - impacted fire fighting water were flushed from the dumpster across the gravel parking lot and into a nearby ditch. On April 27, 2008, Mr. Matthew Martin with CSN retained Curt Emergency Services (CES) to manage the environmental cleanup operations. The C13S incident manger contacted Ms. Tara Stone with the Nfecklenburg County division of NVaier Quality to gain additional information about the release. Based on available information, the CES incident manger dispatched a crew from 1-Icpaco located in Charlotte, North Carolina toassess the release and initiate corrective actions, Regulatory Notification: On April 27, 2008, a courtesy notification was madc to the Meckleaberg County Division of Water Quality. Corrective Actions: The crew from I-lepaco arrived on site field-tested the freestanding product, with most areas indication a pl-I of 14, The freestanding rinsate was Elcutrallzed until field screenings yielded a 1)1-1 of 7. I-lepaco personnel then utilized a vacLium truck to collect approximately 750 gallons of rinsate from the parking lot, ditch line and dumpster.
