On February 7, 2013, Ron Eubanks from Charlotte -Mecklenburg Stormwater Services (CMSWS), conducted a
site inspection of the National Railroad Passenger Corporation located at 1914 N. Tryon Street in Charlotte,
Mecklenburg County, North Carolina. The site drains to Little Sugar Creek located in the Catawba River Basin.
The site visit and file review revealed that the subject facility is covered by NPDES General Stormwater Permit
— NCG080000.
This inspection was conducted as part of.a cooperative working agreement between Mecklenburg County and
the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part II Section H. The following observations were
noted during the Charlotte -Mecklenburg Stormwater Services inspection (please see the attached addendum
for information about your permit):

The facility was observed to be in compliance with the City of Charlotte's Storm Water Pollution Control
Ordinance.
Thank you for your assistance and cooperation during the inspection. Overall, the facility's Stormwater
Program was well developed and implemented and this Office commends the permittee's efforts to ensure
compliance with your NPDES permit.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge.

discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES
General Stormwater Permit] can be found on this website.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. Please see the
above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of
the permit and subject to civil penalty assessments) of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NO[) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):

o Collection, reporting, and recording of Analytical Monitoring

o Collection, reporting, and recording of Qualitative Monitoring
o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable)
o Records -- Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to the expiration date. Any permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the expiration and has not requested renewal at least 180 days prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act: The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The. Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes require you to complete a
Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
a Proper Operation and Maintenance is a requirement of the permit.

Inspection Summary:
Facility Description:
The National Railroad Passenger Corporation - Amtrak Station is located at 1914 North Tryon St. on property it leases
from Norfolk Southern Railroad. The Amtrak facility transports passengers and cargo via trains, and it loads/unloads as
necessary.
Compliance History:
An industrial facility inspection was conducted by CMSWS at the National Railroad Passenger Corp. - Amtrak Station on
May 28, 2008. The report was issued as a Notice of Violation by the Division. A follow-up inspection found the facility to
be in compliance.
Industrial Operations/City of Charlotte Stormwater Ordinance Review:
Erosion Issues —
No erosion control issues were observed on the property.
Loading/unloading area(s)-
The loading/unloading areas appeared to be in good condition; no problems were observed.
Vehicle/equipment area(s) -.
The trains are fueled each day at the station by a contracted fuel vendor. There is some minor cleaning of the trains
performed at the Amtrak Station.
Oil/water separator and/or pretreatment —
There is no oil/water separator located on the property; however, Drummac Inc. conducts on -site sewage removal from
the trains with a vacuum truck.
Waste storage/disposal areas (dumpsters, scrap metal bins, etc.) —
There is one (1) municipal waste dumpster located on the property. The waste dumpster appeared to be in good condition.

Maintenance supplies are stored indoors.

Spill kits are located at the site to clean up spills and leaks on the property.

Comment: Stormwater runoff from the paved areas on the property drains by sheet
flow into a series of catch basins to a single outfall. The stormwater outfall appeared to
be in good condition. The storm drainage system appeared to be well maintained; no
storm water pollution problems were observed.

Enclosed are the monitoring results from the laboratory analyses performed on the
discharge from Stormwater Outfall 01 at the subject facility. The samples analyzed were grab
samples collected during the sampling investigation performed on October 17, 2008, by Heather
Sorensen of Charlotte -Mecklenburg Storm Water Services. This sampling investigation was
conducted as part of a cooperative working agreement between Mecklenburg County and the
Division of Water Quality. In addition, the sampling investigation was conducted on behalf of
the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part II Section
H.
The enclosed monitoring results indicate that the stormwater discharged on October 17,
2008, contained an elevated concentration of Total Suspended Solids compared with the
benchmark values contained in Stormwater general permit NCG080000. Please review the
requirements of your stormwater permit and take the required steps/actions to reduce the
concentration of Total Suspended Solids leaving your site. Through the development and
implementation of stormwater management programs it is the Division of Water Quality's
expectation that stormwater discharges at industrial sites covered by NPDES stormwater permits
do not impact receiving waters.,
Little Sugar Creek is currently listed on the North Carolina 303(d) list of impaired waters
and has TMDLs in place for fecal coliform, dissolved oxygen, and turbidity. As noted in Part I
of your general permit, facilities which discharge stormwater into 303(d) impaired waters may be
required to demonstrate at permit renewal that they do not have a reasonable potential to violate
applicable water quality standards for such pollutants due to the stormwater discharge(s) on site.

Enclosed is a copy of the Compliance Evaluation Inspection (CEI) report for the

This report is being issued as a Notice of Violation (NOV) due to the permittee's failure
to implement the Stormwater Pollution Prevention Plan in violation of the subject Stormwater
Permit and North Carolina General Statute (G.S.) 143-215.1, as detailed in the Stormwater
Pollution Prevention Plan and Qualitative Monitoring sections of the enclosed report.
Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars
($25,000.00) may be assessed against any person who violates or fails to act in accordance with
the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1.
It is requested that a written response be submitted to this Office by July 21, 2008,
addressing the above -noted violations in the enclosed report. In responding to the violations,
please address your comments to the attention of Ms. Marcia Allocco at the letterhead address.

Inspection Summary:
Facility Description;
The Amtrak facility transports passengers and cargo via trains and loads/unloads at the Charlotte facility as necessary.
Contracted fueling operations, minor servicing of locomotives and cars, and sewage removal from passenger trains also
occurs on site. Purser Oil conducts on site fueling of locomotives. Drummac Incorporated conducts on site sewage
removal, which is discharged into the municipal sanitary sewer system owned by Charlotte Mecklenburg Utilities. One
train is based out of this facility with run through trains also receiving on site fueling. The facility operates 24 hours a day,
7 days a week.
Compliance History:
The permittee/facility does not have any prior compliance issues with the NC Division of Water Quality and the following
was found in the Charlotte Mecklenburg Storm Water Services Compliance files.
On May 17, 2008, approximately 200 gallons of diesel fuel was spilled to the gravel area around the train tracks during a
fueling operation by Purser Oil. No fuel reached surface waters or the storm drain system. The spill was contained and
removed by HEPACO.
Industrial Operations/City of Charlotte Stormwater Ordinance Review:
Contractor Area —
An outside contractor, Drummac Incorporated, uses this outside area for staging. The area includes two small storage
sheds and a graveled area around the sheds. The following was observed in the contractor area outside and exposed to
stormwater.
• Two weed killer containers stored outside on pallet. One container containing product was open.
• Four empty 55-gallon detergent barrels were sealed and turned upside down on earthen ground for storage.
• Three 55-gallon barrels of detergent, cleaning compound, and deodorant were located outside on a pallet, Each barrel
had a pump or nozzle for bulk product dispensing. There was a bucket located under the nozzle of the deodorant barrel.
Product was observed on the top and sides of the detergent and cleaning compound barrel.
The perm4tee should implement proper chemical storage practices to prevent pollution discharges by its employees or
contracted personnel.
Fueling Operations —
Fueling operations occur along two separate lines; the service track and run through outside track. Fueling of locomotives
is conducted by outside contractor Purser oil that delivers diesel fuel by vehicle. Each locomotive holds 2,200 gallons of
diesel fuel. The fueling areas appeared to be in good condition.
Trash Dumpster —
One small trash dumpster with no cover is located outside and exposed to stormwater. During the inspection, liquid was
leaking from rusted holes in the base of the dumpster.
The facility should cover the dumpster to reduce exposure to stormwater and seal all holes to ensure no pollutant
discharge.

Comment: The SPPP did not include a general location (USGS) map. The SPPP
contained a site map but it only contained details of building locations on site. None of
the other permit required information was included on the site map. The permittee has
not documented an evaluation of feasible alternatives to current practices. The
permittee conducted preventative maintenance and good housekeeping inspections in
December 2007 and March 2008 but there is no documentation of inspections from
2004 through the Spring of 2007. The permittee provided employee training in
September 2007 but there was no documentation of training in 2004 through 2006. The
SPPP was reviewed and updated in September 2007 but there was no documentation
of updates in 2004 through 2006. The SPPP did not contain any Stormwater Facility
Inspection records.

Comment: The permittee has.not completed an evaluation of illicit discharges at the
stormwater outfall.
One storm drain outfall collects stormwater discharge from the site. During the
inspection, major sedimentation was observed inside two catch basins on site. A dry
weather flow was also observed originating from the storm drain line under the train
yard. The water appeared to originate from beyond the Amtrak facility on property
owned by Nor -folk Southern and it was clear with no odor, A rain event had occurred
within the prior 24 hours. No sedimentation or erosion was observed at the stormwater
outfall during the inspection and it appeared to be in good condition.

We appreciate your inquiry for response to the Notice of Violation (NOV)
dated June 23, 2008, reference NCDENR tracking No. NOV-2008-PC-0446.
Amtrak is committed to operating its facilities in compliance with all
environmental rules and regulations.
The above referenced NOV was issued for Amtrak's non-compliance with
certain requirements of the General Stormwater Permit NCG080000- A
number of the issues have already been addressed. The inspection findings
and SWPPP deficiencies are anticipated to be corrected by August 29, 2008.
• The contractor storage area has been cleaned up.
• The empty drums and pump sprayers have been removed.
• A secondary containment covered but has been ordered and will be
utilized for storage of the cleaning chemical drums.
• The open top trash dumpster has been replaced with a new unit which
has an operable flip -top cover.
• SWPP Plan will be revised to correct deficiencies as Identified: a new
facility map and diagram which meet Permit requirements; a
discussion of the feasibility of alternatives to current practices; and
update of the Spill History narrative which will include the fuel release
on May 17, 2008,
• SWPP Plan records, including inspections, evaluations, and training will
be properly filed at the site. A number of the missing documents were
located in the computer files of a former employee who previously
handled the environmental compliance duties for the site. The files
have been updated and will be kept current.
• Sedimentation adjacent to storm drains and in several catch basins as
noted during the inspection will be removed.

Enclosed is a copy of the Compliance Evaluation inspection (CEI) report for the
inspection conducted at the subject facility on September 9, 2008, by Heather Sorensen of
Charlotte -Mecklenburg Storm Water Services. This inspection was conducted as part of a
cooperative working agreement between Mecklenburg County and the Division of Water
Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part 11 Section H. Thank you for your
assistance and cooperation during the inspection.
The follow-up inspection found that Amtrak Station has implemented the corrective
action as stated in the subject facility's response letter dated July 22, 2008. The corrective
actions include:
• Cleaning of the contractor storage area and the removal of empty drums and pump
sprayers,
• Installation of a secondary containment structure for the storage of drums,
• Replacement of the trash dumpster,
• Removal of sedimentation in the on -site storm drain system,
• Updating of the Stormwater Pollution Prevention Plan (SPPP) to include a facility
map and diagram that meets permit requirements, feasible alternatives to current
practices, and an updated fuel release history,
• Storage of the SPPP records on site.

In accordance with your application for discharge permit received on May 22, 2001, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES
general permit. This permit is issued pursuant to the requirements of North Carolina General Statute
143-215 .l and the Memorandum of Agreement between North Carolina and the US Environmental
Protection agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual
permit application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the
Division of Water Quality. The Division of Water Quality may require modification or revocation and
reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required
by the Division of Water Quality or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.
