After review of your Certificate of Coverage we have determined that an extended Certificate should be
issued, therefore we are forwarding herewith the subject certificate of coverage to discharge under the subject
state - NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215 .1 and the Memorandum of Agreement between North Carolina and the US Environmental
Protection agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Water Quality. The Division of Water Quality may require modification or revocation and reissuance of the
certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, Coastal Area Management
Act or any other Federal or Local governmental permit that may be required.

RE: Corrective Actions to Improve Storm Water Quality, Schneider National Facility,
2420 Starita Road, Charlotte, North Carolina.
Dear Mr. Buctow:
Pursuant to your recent letter to Mr. Gene Gore, Facility Coordinator for Schneider National
Carriers, and a similar letter from Marcia Allocco, Division of Water Quality, GEI Consultants,
Inc. (GEI) has prepared this summary of proposed corrective action for addressing storm water
quality at the Schneider National property located at 2420 Starita Road in Charlotte, North
Carolina.
As discussed during our telephone conversation on June 18, 2013, Schneider National has been
working with Mecklenburg County to finalize an agreement to access the county property as
necessary to make repairs to the storm water outfall structures along the cast side of the Schneider
National site. This agreement has been finalized and a contractor has been retained to implement
the repairs. Construction is scheduled to begin on July 8, 2013 and we expect about a two to
three week construction period.
As part of the repair work, the contractor will also be installing storm water inlet filters (Drain
Guard) at up to five locations on the property. These inlet filters consist of a non -woven
geotextile filter and containment device anchored within the existing catch basin. The
performance of these filters at the initial locations will be evaluated and additional filters installed
as appropriate. Detailed material specifications for these filters are attached to this letter.

B. Compensation for procuring and installing more than five (5) inlet filters will be based on
a negotiated cost mutually acceptable to Contractor and Owner.

Dear Mr. Gore:
Enclosed are the monitoring results from the stormwater sampling on the discharge from Stormwater Clutfall
SNCO03 at the subject facility on December 10, 2012. The grab samples were collected during the sampling
investigation performed by David Buetow of Charlotte -Mecklenburg Storm Water Services and included
analyses required by your permit and additional analyses of interest in stormwater discharges. This sampling
investigation was conducted as part of a cooperative working agreement between Mecklenburg County and
the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part II Section H.
The enclosed monitoring results indicate that the stormwater discharged on December 10, 2012 contained an
elevated concentration of total suspended solids compared with the benchmark concentrations contained in
NCG080000. In addition, elevated concentrations of turbidity, fecal coliform, enterococcus, E. Cali, copper, and
zinc were also detected as compared with the Division's benchmarks developed for these parameters (usually
contained in individual stormwater permits; turbidity— 50 NTU; fecal coliform and E. coli —1,000 CFU1100 ml;
enterococcus - 500 enterococcus/100 ml; copper— 7 pg/L; and zinc — 67 pg/L). Please review the requirements
of your stormwater permit and consider steps/actions to reduce the concentration of turbidity leaving your site.
Through the development and implementation of stormwater management programs it is the Division of Water
Quality's expectation that stormwater discharges at industrial sites covered by NPDES stormwater permits do
not impact receiving waters. The enclosed results should be self-explanatory; however should you have any
questions concerning the interpretation of the sampling results or questions regarding your permit

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge.
Copies of the general permits and accompanying documents can be accessed from the following webpage:

discharge monitoring forms, and a Notice of Intent (which is the application for coverage under a NPDES
General Stormwater Permit) can be found on this website.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. Please see the
above mentioned website to obtain a copy of the permit so you may fully comply with. all the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of
the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine'
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revolted.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting, and recording of Qualitative Monitoring

o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable)
o Records — Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration -- The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to the expiration date. Any permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the expiration and has not requested renewal at least 180 days prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
o 'Name Change, Closure, or Facility Ownership change'— Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes require you to,complete a
Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

On behalf of Schneider National, Inc. (SNI), GEI Consultants, Inc. (GEI) is submitting
this formal response to the Notice of Violation and Compliance Evaluation Inspection
dated May 25, 2012. We understand a site inspection of the SNI facility located at
2420 Starita Road in Charlotte, North Carolina was conducted on May 7 and May 18,
2012. Based on site conditions observed during this inspection, the facility was
considered "Not Compliant". Conditions which contributed to this conclusion and our
proposed response actions are summarized below:
1. The Stormwater Pollution Prevention Plan (SWPPP) was missing the
following:
a. A list of significant spills occurring during the past 3 years,
b. An evaluation of feasible alternatives to current practices,
e. A Stormwater facility inspection program,
d. Preventative maintenance and good housekeeping documentation
for 2009,
e. Employee training documentation for all personnel involved in
facility operations that have the potential to contaminate
stormwater runoff.
The SWPPP was recently updated addressing all the items above, with the
exception of the 2009 documentation of preventative maintenance and good
housekeeping. This documentation could not be located; however, documentation
forms are provided in the updated SWPPP and will be completed in the future as
required. A final copy of the SWPPP is available at the SNI facility and can be
submitted to NCDENR upon request.

2. Documentation of Qualitative Monitoring was not available for 2008
period 1 and 2, 2009 period 2, 2010 period 1 and 2 and 2011 period 1.
Qualitative monitoring will be conducted on a semi-annual basis. Monitoring
forms will be completed documenting conditions at each outfall inspected.
3. Documentation of analytical monitoring of stormwater events was not
provided for 2008 period 2, 2009 period 1, 2010 period 1 and 2, and 2011
period 1.
SNI is committed to complying with conditions of their NPDES Stormwater
Permit and has retained GET to assist in scheduling and documenting semi-
annual analytical monitoring of stormwater events. SNI and GEI are
evaluating means of acquiring representative stormwater samples from storm
drain inlets above the outfalls. If results of chemical analysis of stormwater
samples indicate an analytical benchmark exceedance, a Tier I response will
be prepared.
4. Annual non-stormwater discharge evaluations were not provided for
2010 and 2011.
SNI is reviewing the condition of each stormwater outfall. As indicated in the
inspection report, some of the outfalls are blocked with vegetation or undercut
by erosion. Additionally, accumulated sediment was observed at some of the
outfalls. SNI is considering alternatives for controlling sediment discharge
including the use of inlet filters, separators or detention basins. Conditions at
the outfalls will be repaired after alternatives for sediment control have been
evaluated in the event it is concluded that a detention structure at the outfalls
is the most economically feasible method for controlling sediment.
SNI is conducting reasonable measures to establish compliance with the NPDES
Stormwater Permit and address the issues outlined above by August 27, 2012. In the

(CMSWS), conducted a site inspection of the Schneider National Carriers facility located at 2420 Starita Road
in Charlotte, Mecklenburg County, North Carolina. The site drains to Irwin Creek, Class C waters located in
the Catawba River Basin. The site visit and file review revealed that the subject facility is covered by NPDES
General Stormwater Permit — NCG0080000..
This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and
the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part II Section H. The following observations and/or
permit condition violations were noted during the CMSWS inspection (please see the attached addendum for
information about your permit):

Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may

The subject facility will have 90 days from the letterhead date to come into compliance with the noted issues.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge.

discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES
General Stormwater Permit] can be found on this website.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. Please see the
above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of
the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of Stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-Stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):

o Collection, reporting, and recording of Analytical Monitoring

o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable)
o Records -- Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information, .
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at feast 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to the expiration date. Any permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the expiration and has not requested renewal at least 180 days prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change -- Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes require you to complete a
Name/Ownership Change Form from the Division and mail it hack to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

Facility Description:
This facility is a trucking hub where tractor washing, fueling, and maintenance occur on site. Trailer maintenance also
occurs on site. The facility is 28.62 acres in size with approximately 82% impervious surface. The facility operates 2417.
Compliance History:
A NPDES Stormwater Compliance inspection was conducted on June 6, 2007, for Schneider National
Carriers. The facility has been issued Certificate of Coverage NCG510513 for a groundwater remediation system.
Industrial Operations/City of Charlotte Stormwater Ordinance Review:
Illicit Discharges/connections —
A dry weather flow of wash water from SDO#22 was observed originating from the tractor wash bay. The discharge was
from wash water over spray and a minor amount from incidental dripping from tractors after the washing was completed.
The over spray is considered an industrial wash water and may contain soap or other pollutants. The permittee shall
cease the discharge of the over spray to the storm drain system.
Aboveground Storage Tanks (ASTs) —
A 1,000-gallon used oil, 560-gallon recovered diesel oil, two 275-gallon used antifreeze, 150-gallon mobile diesel,
55-gallon used oil filters, 55-gallon grease, and 55-gallon auto transmission fluid aboveground storage tanks are located
on site. No spills or leaks were observed.
Underground storage Tanks (USTs)/fill port area(s) —
Four 2,000-gallon motor oil, 2,000-gallon gear oil, two 2,000-gallon antifreeze underground storage tanks are located on
site in the "pit' of the maintenance garage. Spills observed in the pit were contained,
Outdoor material storage area(s) —
Used batteries are washed then stored outside on pallets and not exposed to stormwater. New 55-gallon drums of motor
oil were located on spill carts and not exposed to stormwater. No spills or leak were observed.
Vehicle/equipment area(s) (fueling, washing, storage, etc.) -
Tractor washing, fueling, maintenance and short term parking occurs on site. Trailer maintenance and short term parking

Comment: There are seven storm drain outfalls that collect and discharge water from
the property. Outfall #34 was 100% blocked and previously misidentified. Outfalls #28
& #22 combine into one outfall which is heavily undercut and eroded. One previously
undocumented outfall was identified and will be added for inspections and monitoring;
this outfall is undercut with erosion issues. Outfall #37 is blocked by a tree. The
permittee should conduct maintenance on the outfalls as required by the NPDES
Stormwater Permit (Part III, Section C, paragraph 1).
A measurable amount of gravel and silt from gravel lots was observed below the
facility's storm drain outfalls. As noted above,
two outfalls were observed with erosion issues and one was blocked with sediment.
The facility should implement a best management practice to reduce sediment
discharges to the storm drain system.

We are approaching the end of October which was the revised deadline for repairing the stormwater outfall structures
services the Schneider National Facility, 2420 Starita Road in Charlotte. We did receive the attached correspondence
from Mecklenberg County indicating they will be reviewing our request as soon as they can.
We have a contractor on site through the end of October and our preference would be to utilize the equipment and
personnel while they are on site as opposed to re -mobilizing for the outfall repair work. Efforts to date include the
following:
• Gene Gore, Site Manager for Schneider National contacted Mecklenburg County following the site inspection
completed on May 18, 2012.
• I had a telephone conversation with a representative of Mecklenburg County on June 26, 2012.
• We sent a formal request to access county property on June 27, 2012.
• We participated in an on -site meeting with county representatives on July 16, 2012.
• We sent a Draft proposed Access Agreement to the County on August 10, 2012.
We realize the county is addressing other business and trust they will be responding to us shortly. However, based on
the circumstances, it is unlikely the repair work will be completed by the end of October. Accordingly, it is necessary for
us to request another extension to the October deadline.
Please consider granting an extension to complete the outfall repair work within 60-days of finalizing an access
agreement with Mecklenburg County.

outfall structures at the SNI facility located at 2420.Starita Road in Charlotte, North
Carolina.
A site inspection of the SNI facility was conducted on .May 7 and May 18, 2012.
Based on site conditions observed during this inspection, the facility was considered
"Not Compliant" and a Notice of Violation was issued dated May 25, 2012. In
general, there were four conditions which contributed to this conclusion:
1) Stormwater Pollution Prevention Plan (S W PPP)
2) Qualitative Monitoring
3) Analytical Monitoring
4) Permit and Outfalls.
Since receiving the Notice of Violation, SNI has progressed toward establishing
compliance with permit conditions and has completed the following activities: .
• Preparation and implementation of employee training on storm water
management and best management practices,
• 6/27/2012, a letter to Mecklenberg County requesting access permission ,
• A survey of the outfalls to document existing conditions and facilitate
preparation of technical recommendations,
• Preparation of a Technical Memo with recommendations for outfall repair
work,
• 8/10/2012, proposed language for an Access Agreement with the county to
implement the repair work.
At this time, the only outstanding issue is the repair of the storm water outfall
structures. The storm water outfalls 4, 5, 6 and 7 are located on or adjacent to

at these outfalls, it will be necessary to access and conduct work on Mecklenburg
County property. As indicated by the summary above, SKI has been communicating
with Mecklenburg County Real Estate Services to obtain permission to access their
property as necessary to make repairs. Attached to this letter is a copy of the
8/10/2012 correspondence to Mecklcnbcrg County, along with a copy of technical
recommendations for repairing the outfall structures.
While we are waiting for a response from the county on the proposed Access
Agreement, we have been soliciting cost estimates from qualified local contractors to
implement the repairs. Once the Access Agreement is finalized, repair work should
proceed promptly.
Due to the complications related to property ownership and access permission, the
outfall repair work could not be completed by the August 27, 2012 deadline
established in the May 25, 2012 Notice of Violation. As evident from the progress
and actions of SNI, they are committed to repairing the outfall structures and
maintaining compliance with permit conditions. We are requesting a 60-day
extension to the August 27, 2012 deadline to allow adequate time to finalize the
Access Agreement and complete the repair work.

ACCESS AGREEMENT
Between Schneider National Inc. and Mecklenburg County, North Carolina
This Access Agreement (Agreement) is made between Schneider National Inc, with
corporate headquarters in Green Bay Wisconsin and an operating center located at 2420 Starita
Road in Charlotte, North Carolina (SNI) and Mecklenburg County, North Carolina (County).
The County owns the property bordering the east and southeast limits of the SNI property
at 2420 Starita Road in Charloitte, North Carolina. (PID#04503101) The County property
extends along the west and north shore of a portion of Irwin Creek and exists as a forested buffer
along Irwin Creek. Diffuse flow should be maintained through the buffer to the extent
practicable.
When the SNI facility was constructed in 1995, stormwater outfall structures were
installed at several locations along the common property boundary to convey stormwater runoff
generated from the SNI property, (and other properties to the west) to Irwin Creek. Several of
the outfall structures are located on or near the County property.
Over time, soil erosion at some of the stormwter outfall structures has occurred and
vegetation, including trees and shrubs, have grown in and around the stormwater outfall
structures. A storm water inspection of the SNI facility was conducted on May 7 and May 18,
2012 by Charlotte -Mecklenburg Storm Water Services. The inspection report concluded that
conditions at the outfalls must be mitigated to maintain compliance with the storm water
discharge permit. In general, the following conditions must be addressed;
Outfall 1 - blocked by sediment and vegetation
Outfall 3 - eroded and undercut
Outfall 4 - eroded and undercut
Outfall 6 - blocked by vegetation
SNI desires access the County property for the purpose of conducting the following
activities;
Clear vegetation to allow personnel access to each storm water outfall location for the
purpose of visually observing conditions and for the purpose of collecting storm
water samples. The access would consist of a walking path at the general locations
indicated in Exhibit A of this Agreement. The path would be maintained by routinely
cutting grass and vegetation to allow safe access of personnel and sampling
equipment.
2. Repair conditions at outfall locations 1,3,4, and 6 in accordance with the technical
recommendations summarized in Exhibit B of this Agreement.
A 100-foot Surface Water Improvement and Management (SWIM) buffer currently exist
along the portion of Irwin Creek that flows along PID#04503101. The proposed improvements
to the outfall conditions may encroach onto the SWIM buffer. The intent of.the proposed
improvements is to dissipate the energy of the storm water to allow diffuse overland flow to
Irwin Creek. The extent of the repairs will be limited to the dimensions indicated in Exhibit B.
Any deviation from the requirements of the SWIM Stream Buffer ordinance requires written
approval from Charlotte -Mecklenburg Stormwater Services. Execution of this Agreement shall
constitute the required approval.
Pursuant to the terms of this Agreement, County grants to SNI and its employees, agents,
contractors, consultants, or other representatives permission to enter and perform work on the
County property. The permission that is granted herein shall remain in effect until this
Agreement is formally terminated by the County.
In carrying out its operations at the County property, SNI and its designees shall comply
with all applicable federal, state and local laws, regulations, ordinances and other governmental
requirements and shall insure that all operations are conducted in a professional manner. SNI
and its designees shall enter and use the County property pursuant to this Agreement only for the
purpose of performing the work outlined in this Agreement and referenced Exhibits and shall not
have the right to assign its rights under this Agreement without the prior written consent of the
County.
SNI and its designees and the County and its designees shall cooperate with each other
and perform their authorized and properly noticed activities at the County property in a manner
which shall minimize, to the extent practicable, the disruption of other's activities.
SNI shall provide the County with at least three (3) business'days advanced notice of its
intention to,enter the property to perform the work pursuant to this Agreement and shall
cooperate with County's representatives present to observe the work.
Notice shall be provided to the individuals set forth below by electronic mail to the
indicated email, and such notice shall be deemed received at the time and date shown by the
email confirmation receipt generated by the sender.

This Technical Memorandum (TM) summarizes our evaluation of the stormwater outfall
issues at the Schneider National, Inc. (SNI) facility in Charlotte, North Carolina, The TM
includes photo evaluations of the issues, hydraulic calculations for each of the designated
outfalls, and recommendations for improvements to be made at each outfall.
BACKGROUND AND SITE DESCRIPTION
The existing facility is a regional operating center for SNI and includes vehicle maintenance,
fueling and driver amenities. The original stormwater permit for the Charlotte facility was
granted in 1995 at the time the site was constructed_ In general, storm water runoff from the
Sail property, as well as runoff from upgradient properties to the west, is directed to several
out fall structures located along the west side of the SNI property. Storm water directed to
these outfalls is discharged to Irwin Creek which extends along the west end of the property_
A storm water inspectinn of the SNI facility was conducted on May 7 and May 18, 2012 by
Charlotte -Mecklenburg Storm Water Services. The inspe ctitm report concluded that some of

the recommended 'improvements.

ASSUMPTIONS
GEI used existing topographical data from the 1995 record drawings provided by SNI and
supplemented by a limited site survey of the eroded areas recently completed by Lawrence
Associates, a local surveyor. Watershed delineations are based on the recent Storm Water
Pollution Prevention Plan (SWPPP) prepared by GEI. GEI used aerial photographs acquired
from Google Earth to estimate percentages of impervious and lawn areas. Where elevation
data was not available on plan sheds, GEI assumed pipe slopes typical of those listed.
HYDROLOGIC CALCULATIONS
Hydrologic Calculations were performed for each of the catchment areas, as delineated in the
topographic plums included with the SWPPP. Aerial photography was used to estimate the
impervious areas on the site. Because a majority ofthe site appears to be pav4 impervious
surface, a typical parking lot time of concenuauon of 15 minutes was used as the basis for
determining peak flows. A return storm of 10 years was used. (A storm of 15 minute
durntion, with a 10% chance of occurring in any year).
The IDF crave for the Charlotte region could not be accessed from the NOAA website, as the
database was unreachable at the time of this study. Instead, variables for the Steel formula
were used based on the Civil Engineer's Reference Manual, and can be found as
Attachment 1.
Peak flow rates were calculated using the rational method, with curve numbers estimated
using the Civil Engineer's Reference Manual, 6 ° Edition. Peak velocities were determined
using the ratios of full flow to peak flow along with the nomograph that is listed as
Attachment 2_
RESULTS AND RECOMMENDATIONS
GEI has performed hydraulic calculations for each of the four outfalls, and has the
recommendations for improvements as listed below.
Outfall No.
The peak velocity ofthis outfall is 10.87 fps. A standard precast concrete headwall and
riprap apron with geutextile fabric, with dimensions shown in Attachment 3, should limit
further erosion to the area. (;El also recommends an energy dissipating end section to slow
the velocity during peak flow situations.
Outfall No. 3
This outfall has experienced severe erosion, with the culvert end section hanging roughly five
feet above the bottom of the discharge zone. To reduce impact erosion, a drop structure is
recommended upstream of the end section. This structure would consist of an "" diameter
manhole, with the outlet elevation being placed at a 0.5% grade from the existing outfall

landing area. This new drop structure shall be placed back in the slope far enough to allow
for sufficient earth compaction around the structure, to counteract tipping forces firm the
incoming stormwater. Peak velocity of this section of pipe would be 8.57 fps.
Once the culvert has been lowered to the elevation of the current channel, the area can be
protected via a standard precast concrete headwall and standard riprap apron with geotcxtile
fabric. GE] recommends an energy dissipating end section to slow the velocity during peak
flow situations.
Outfall No. 4
The peak velocity of this outfall is 10.81 fps, A standard precast concrete headwall and
standard riprap apron, with dimensions shown in Attachment 3, will limit further erosion to
the area. GEI also recommends an energy dissipating end section to slow the velocity during
peak flow situations.
Ontfall Na 6
This oultfall will experience peak velocities of 7.84 fps. Currently, a hoe has grown directly
in the flowline o£tlie culvert. The tree should be removed and the area regraded. A standard
precast concrete headwal I and standard riprap apron, with dimensions shown in Attachment
3, will limit further erosion to the area GEI also recommends an energy dissipating end
section to slow the velocity during peak flow situations_
Attachment 3 contains a standard detail for the precast concrete headwall and riprap aprons
along with a conceptual plan showing the locations and dimensions of the proposed
improvements for the site. More detailed construction specifications can be provided if
necessary.

Chapter 143, Article 21 of the North Carolina General Statutes (G.S.) authorizes and
directs the Environmental Management Commission of this Department to protect and preserve
the water resources of the State. The Division of Water Quality has the delegated authority to
enforce adopted pollution control rules and regulations.
On June 20, 2006, Meredith Moore of the Mecklenburg County Water Quality Program
(MCWQP) conducted an investigation of your property located at 2420 Starita Road. This
investigation was conducted as part of a cooperative working agreement between Mecklenburg
County and the Division of Water Quality. As a result of this investigation, the following
condition was found on the property in violation of G.S. 143-215.83(a):
Discharge of oil to Irwin Creek, a Class C water, in the Catawba River Basin.
Further, the failures to immediately notify this Department of the discharge and to
immediately undertake to collect and remove the discharge are violations of G.S. 143-215.85 and

To comply with the law, it will be necessary to immediately discontinue all illegal
discharge activity, to collect, remove, and properly dispose of the discharge material including
any contaminated soil, and to restore all affected areas as nearly as may be possible to the
conditions existing prior to the discharge. It is recommended that you implement corrective
actions to eliminate the potential for recurrent illegal discharges.
Be advised that, pursuant to G.S. 143-215.88A, any person who intentionally or
negligently discharges oil or other hazardous substances, or knowingly causes or permits the
discharge of oil in violation of G.S. 143-215.83(a), or who fails to report a discharge as required
by G.S. 143-215.85, or who fails to comply with the clean up requirements of G.S. 143-
215.84(a), shall incur, in addition to any other penalty provided by law, a penalty in an amount
not to exceed five thousand dollars ($5,000) for each such violation. Penalties may also be
assessed for the damages to the surface waters of the State that may result from the unpermitted
discharge pursuant to G.S. 143-215.90(a).
There is evidence that the soil contamination is of a long-term nature. Therefore,
following removal of the contaminated soil, samples should be collected from the base and
sidewall areas of the excavated sites to confirm no residual contamination is present. Samples
should also be collected from the excavated material to identify the petroleum contaminants
present. Your consultant or the MCWQP staff would be able to advise you concerning the
appropriate analyses for petroleum -contaminated soil. It is recommended that no backfill, to any
of the excavated sites, be made until MCWQP staff has completed a review of the analytical
data.
It is requested that you respond, in writing, to this Notice, indicating the measures taken
to collect and remove the discharge and to restore all affected areas, and any measures taken to
prevent future discharges. The response should also indicate the disposal location for any
removed discharge material, contaminated soils, or waters and include a copy of the analytical
documentation for the site remediation. Please address your response to Ms. Marcia Allocco
no later than July 12, 2006. Also, please send a copy of this response to Mr. Rusty Rozzelle of
MCWQP at 700 North Tryon Street, Suite 205, Charlotte, NC 28202.
This purpose of this letter is also to notify you that this Office is considering sending a

Action Taken:
6-19-06: Meredith Moore and Syliva Trogdon of MCWQP began a scheduled
streamwalk of Irwin Creek at Starita Road. An oil sheen and strong petroleum odor were
observed immediately upon entering Irwin Creek. Moore and Trogdon attempted to track
the oil sheen to a source, but no definitive source could be located. The sheen dissipated
above a tributary that was piped underneath property belonging to Schneider National at
2420 Starita Road. Moore suspected that the petroleum was originating somewhere on
Schneider's property. Moore and Trogdon drove upstream of the Schneider property and
inspected the tributary to determine if the tributary was impacted at that point. No
impacts were observed.
Moore and Trogdon visited the Schneider facility and met with Gene Gore (Facility
Coordinator 704-219-1030) and David Heckman (Operating Center Service Manager
704-599-7490). Schneider holds NPDES Stormwater Permit Certificate of Coverage
NCG080583. Moore explained that she suspected that a petroleum release to Irwin Creek
had originated on Schneider's property, and that she wished to inspect the grounds in
order to locate any possible sources. Moore also reviewed Schneider's Stormwater
Pollution Prevention Plan, related sub -plans, and other records that were provided by
Gore. All records were up-to-date. Heckman & Gore were very cooperative and escorted
Moore & Trogdon on an inspection of the facility. Multiple storm drain inlets were
inspected, yet no evidence of a petroleum spill was observed.
Upon returned to the office, Moore reviewed Schneider's file. Multiple incidents had
been investigated by MCWQP. Moore spoke with Tony Roux of MCWQP, who
mentioned that in a previous incident in January 2006 (EPIC #2006-00039, NCDENR
NOV Tracking #: NOV-2006-OC-0003), Schneider's oil/water separator had overflowed.
The resulting petroleum -containing wastewater entered Irwin Creek from an outfall set
approximately 6 feet from the top of the stream bank. The outfall pipe was buried in
sediment, except for a small section of the pipe that was visible at the top. The stream
channel is very incised, and the outfall is set 6 feet back from the stream bank and just
above eye -level when walking in the stream.
6-20-2006: Moore and Trogdon returned to Irwin Creek at Starita Road. A petroleum
sheen was still visible on the water surface. Moore and Trogdon looked specifically for
the outfall that Roux had mentioned. The outfall was located. A puddle of water in front
of the outfall contained petroleum product and an oil sheen. A rainbow -sheen could be
seen tracking down in the soil of the stream bank into the water. There was no active
discharge; the contaminated soil was leaching petroleum product into the creek (see
attached pictures).
Moore called Gore and informed him that she had located the discharge point. Gore did
not know what area of the facility drained to the outfall. Moore informed him that the
discharge point was the same one involved in the January oil/water separator incident.
She advised Gore to contract with a clean-up company and begin cleanup of the
contaminated soil immediately. Gore mentioned that the oil/water separator had recently
been pressure washed, and that it was a possibility that this wastewater had overflowed
into a parking lot storm drain.
Gore could not locate the outfall, so later in the day Moore and Trogdon met with him on
site and directed him to the outfall.
That afternoon, Curtis Helms (office: 704-523-4726, cell: 704-604-6463, fax: 704-525-
3953) of S&ME contacted Moore and informed her that his company would be handling
the cleanup. S&ME had already collected analytical samples to determine the exact
petroleum products involved. Moore advised him to place several oil booms in the creek
immediately.
6-22-06: Trogdon and Catherine Knight, also of MCWQP, visited the site and confirmed
that oil booms were in place.
6-26-06: Moore spoke with Helms and Steve Law (Mecklenburg County Real Estate
Services) to coordinate a Right -of -Entry letter for S&ME, for Mecklenburg County owns
the affected portion of the Irwin Creek stream bank 1 floodplain. Helms plans to begin
excavation of the contaminated soil on 6-27-06.
Moore drafted a Notice of Violation and Recommendation for Enforcement.

Your facility is currently covered for stormwater discharge under General Pennit NCG080000. This Permit expires
on August 3I, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would he eligible for
continued coverage under the reissued permit.
In order io assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal ofyourpermit coverage. To make this renewal process easier, we are informing you in
advance that your permit will he expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be comPlctcd and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may he assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent I'cderal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilly industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional
