APPROVAL of 401 Water Quality Certification and ADDITIONAL CONDITIONS

Dear Mr. Powell:

You have our approval to place fill material in 1.64 acres of wetlands or waters for the purpose of
developing a mobile home court at SR 1539 and SR 1538, as you described in your application dated
20 December 1995. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification 1'umber 2671. This certification allows you to use Nauonwide
Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your applic:J.tion. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. ~d
restrictions shall be placed on all lots with jurisdictional wetlands to prevent future fill. Stcm1water
shall be directed to sheet flow into wetlands along Compass Creek at non erosive velocities at several
points and shallnm directly flow into Compass Creek. In addition, you should get any othe,:- federal,
state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjedicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a tearing, send
a written petition which conforms to Chapter 150B of the North Carolina General Statutes L0 the Office
of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-.7447. This certification end its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Proposed fill 1.64 acres.

Mr. Powell explained that this tract was boug~t~in the early 80's
and clear cut. The tract is cleared stumpsAnave been burned and
the tact is now a large field dominated with fescue. The wetlands
are hydrologica]y contiguous to the adjacent Compass Creek flood
plain and was likely a mixed pine/hardwood finger of the adjacent
hardwood bottom.

This wetland is primarily a large (broad) toe slope seepage with
Juncus and Carex dominating (as a result of previous clearing
activities). The wetland has function with respect to nutrient
removal (nitrification - denitrification) through both surface and
subsurface inundation change. However, overbank flooding from
adjacent Compass Creek is abated due to the "up slope" location of
the wetland. Therefore only storm event and subsurface runoff is
available to this wetland..

Issues:

170 trailersare currently located adjacent ~ this site. Mr. Powell
wants to add another 110 trailers to this tract.

Sewer is available through Rocky Mou\'S WWTP.

Given the density of houses, drive ways, and roads, I expect that
the impervious surfaces associated with this development will be
comparable to Commercial sites.

Further, Mr. Powell explained that he rents the spaces and the
tenants buy the trailers. This is clearly a commercial operation
and location of this development adjacent to Compass Creek
absolutely warran~stormwater controls,

Recommendation:
I have requested more information. That is, a map with wetlands
and proposed lot/road footprint.

Require avoidance of location (A) the construction of a stormwater
pond and the respective water should be sheet flow into remaining
wetlands (A). (as per DEM policy)

Note attached is a list of call dates (a chronology of the RRO's
efforts to conduct a site visit). A slow turn around is not always
due to DEM's (RRO's) responsiveness. ...

Proposed fill 1.64 acres.

Mr. Powell explained that this tract was bought in the early 80's
-~nd clear cut. The tract is cleared/stumps have been burned/and
the tact is now a large field dominated with fescue. The wetlands
are hydrologicaly contiguous to the adjacent Compass Creek flood
plain and was likely a mixed pine/hardwood finger of the adjacent
hardwood bottom.

This wetland is primarily a large (broad) toe slope seepage with
Juncus and Carex dominating (as a result of previous clearing
acti vi ties) . The wetland has function with respect to nutrient
removal (nitrification - denitrification) through both surface and
subsurface inundation change. However, overbank flooding from
adjacent Compass Creek is abated due to the "up slope" location of
the wetland. Therefore only storm event and subsurface runoff is
available to this wetland..

Issues:

170 traile55are currently located adjacent to this site Mr. Powell
wants to add another 110 trailers to this tract.

Sewer is available through Rocky Mout's WWTP.

Gi ven the density of houses, drive ways, and roads, I expect that '\ "Duk\l)
the impervious surfaces associated with this development will be ) k~' 1",,0
comparable to Commercial sites.

Further, Mr. Powell explained that he rents the spaces and the
tenants buy the trailers. This is clearly a commercial' operation
and location of this development adjacent- to CQmpass Cre~k
absolutely warran!5 stormwater controls. "--~- 1\1\1 \1'v\U,{\ f\1)e'\' n

Recommendation:
I have requested more information. That is, a map with wetlands
and proposed lot/road footprint.

Require avoidance of location (A) the construction of a stormwater
pond and the respective water should ~ sheet flow into remaining
wetlands (A). (as per DEM policy) I

Note attached is a list of call dates (a chronology of the RRO's
efforts to conduct a site visit). A slow turn around is not always
due to DEM's (RRO's) responsiveness....

Based on the most recent maps provided by your office, we would like to request doed
restrictions on some lots that were not shown on the original application. Lots 47. 48, 49, 50, 51, 52,
53,54,55,56,57.58,59, and 60 arc: continuous with the large wetland along Cross Creek.
Therefore, \W request that these lots nol be filled as part of this application and have deed restrictions
placed on them to prevent fllture wetland destruction.

Compass Creek, Tar River Basin

BioloKists on the North Carolina Wildlife Resources Commission staffhave reviewed the
subject project. A site visit was made on February 9, 11995. our comments are provided in
accordance with certain provisions of the Clean Water Act of 1977 (U.S.C. 466 et seq.).

The applicant proposes to ftlll.64 acres of scattered wetlands for the purpose of
constructinl' a mobile home park. The property is located near the intersection of Crnsenberry and
Fenner roads in Rocky Mount, and is supplied with water and sewage easements from the city,

The wetlands to be filled aro :scaUercd, isol4ted &ress with little filtering capability. Cross
Creek is located near the southern boundary of the project area. This project area IS adjacent to an
existing mobile home park, Inspection of the area revealed no stormwater runoff control for the
existing park. The slope of the proposed park Is similar to that of the existing pnrk and if built will
increase water volwne and siltation in Cross Creek. The area southeast of the proposed project
currently floods due to unrestricted development and poor stormwater management as CIted by the
City of Rocky Mount in pennits to snag and clear Cokey Swamp.

We recommend that the permit include the following moditlcations:

1 A 150-100t undisturbed buffer should be established from tiJQ (;enter of Crol!Js Creek along
the proposed project Trees and shrubs should be maintained or established in the buffer,

2. Deed restrictions should be placed on this property to prevent further destruction of created
or tlQtural wetlands by current or future owners,

3. An approved stonnwater management plan should be in place prior to be,pnning
comrtruclion of this project. A wet mention pond is recOmmended.
