Dear Mr. Mitchem:
On February 15, 2013 and March 7, 2013, Andrew Martin from Charlotte -Mecklenburg Stormwater Services
(CMSWS), conducted a site inspection of the Wilson Trucking facility located at 7500 Statesville Road in
Charlotte, Mecklenburg County, North Carolina. The site drains to tong Creek, Class C waters located in the
Catawba River Basin. The site visit and file review revealed that the subject facility is covered by NPDES
General Stormwater Permit — NCGO80000
This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and
the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part II Section H. The following observations were
noted during the Charlotte -Mecklenburg Stormwater Services inspection (please see the attached addendum
for information about your permit):

4) _City of Charlotte Stormwater Ordinance Review:
A summary of the review completed for compliance with the City of Charlotte Stormwater Ordinance is
contained in the Summary section of the enclosed report.
Thank you for the assistance and cooperation during the inspection. Overall, the facility's Stormwater program
was well developed and implemented and this Office commends the permittee's efforts to ensure compliance
with your NPDES permit.
However, as noted above and in the enclosed report, deficiencies were noted during the inspection regarding
the required monitoring and it is requested that a written response be submitted to this Office by July 15, 2013,
addressing these deficiencies. In responding to the violations, please address your comments to the attention
of Ms. Allocco at the letterhead address.
A follow-up evaluation will be conducted by CMSWS after September 14, 2013, to ensure compliance with the
facility's Stormwater Permit and/or compliance with the City of Charlotte Stormwater Ordinance.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge.

discharge monitoring forms, and a Notice of intent [which is the application for coverage under a NPDES
General Stormwater Permit] can be found on this website.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. Please see the
above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, is. a violations) of
the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day.
• industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NO[) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):

o Collection, reporting, and recording of Qualitative Monitoring
o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable)
o Records — Visual monitoring shall be documented and records maintained at the facility along
'with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to the expiration date. Any permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the expiration and has not requested renewal at least 180 days prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes require you to complete a
Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

Inspection Summary:
Facility Description:
The facility is involved in motor freight service and loads and unloads tractor -trailers, including hazardous and
non -hazardous materials. Tractors and trailers are stored and maintained on site and operations include fueling and
washing.
Compliance History:
A Compliance Evaluation Inspection (CEI) was last conducted on April 1, 2008 and resulted in a Notice of Violation. A
follow-up inspection (August 12, 2008) found the facility to be in compliance.
Industrial Operations/City of Charlotte Stormwater Ordinance Review:
Illicit discharges/connections —
No illicit discharges or dry weather flows were observed on the property.
Aboveground storage tank(s) —
The generator has a 55-gallon diesel tank. No stains were observed on the ground around the generator. A 300-gallon
tote of Diesel Emission Fluid is stored at the fuel island. A 405-gallon used oil tank is located outside with secondary
containment. A 500-gallon new oil tank is located in the shop area.
Underground storage tank(s) —
The permittee has three 10;000-gallon diesel and one 4,000-gallon gasoline underground storage tanks on site.
Outdoor material storage —
New and used tires are stored outdoors. No deficiencies were observed.
Loading/unloading area(s)-
Materials, both hazardous and non -hazardous, are loaded and unloaded from trailers in a covered area. No deficiencies
were observed.
Vehicle/equipment area(s) -.
Vehicles are washed, fueled and maintained under covered areas not exposed to stormwater. Semi -trucks and trailers are
stored outdoors. No deficiencies were observed.
Oil/water separator and/or pretreatment -
There is an oil/water separator located inside the wash bay that is connected to the sanitary sewer system. All floor
drains in the shop area drain to the oil/water separator.
Waste storage/disposal areas (dumpsters, scrap metal bins, etc.) —
One small general trash dumpster was located outside on pavement. At the time of the inspection the dumpster was
missing its drain plug and was leaking. The facility has since placed a plug in the dumpster. One small scrap metal
dumpster was located outside and is covered with a tarp.
Spill response equipment —
The permittee has spill response equipment located on site.

Comment: Analytical monitoring has not been conducted by the permittee. The
permittee had noted that the basin does not discharge. Evidence was found during the
inspection that indicated the basin does indeed discharge. DMRs indicating "No Flow"
have not been submitted. If no discharge occurs during the sampling period, the
permittee must submit a monitoring report indicating "No Flow" or "No Discharge" within
30 days of the end of the sampling period. "No Discharge" from the outfall or inability to
collect a sample because of adverse weather conditions during the monitoring period
does not constitute failure to monitor, as long as it is properly reported and documented
in the SPPP. Sampling is not required outside of the facility's normal operating hours.

Enclosed is a copy of the Follow-up Compliance Evaluation Inspection (CEI) report regarding the
compliance documentation submitted to Mrs. Heather Sorensen of Charlotte -Mecklenburg Storm Water
Service from the subject facility on August 12, 2008. A follow-up inspection of the subject facility was not
needed for the follow-up evaluation. This follow-up process was conducted as part of a cooperative
working agreement between Mecklenburg County and the Division of Water Quality. In addition, the
follow-up process was conducted on behalf of the City of Charlotte in compliance with the City's NPDES
Permit, NCS000240, Part II Section H. Thank you for your assistance and cooperation during the
inspection.
The follow-up compliance evaluation found that Wilson Trucking Corporation has implemented
the corrective actions as stated in the subject facility's response letter dated June 4, 2008. The corrective
actions included:
• Updated the Stormwater Pollution Prevention Plan
• Secured manually activated valve on the containment structure for the used oil tank with a
lock.
The enclosed report should be self-explanatory; however should you have any questions

Inspection Summary:
Facility Description:
The facility is involved in motor freight service and loads and unloads tractor trailers, including hazardous and
non -hazardous materials. Tractors and trailers are stored and maintained on site and operations include fueling and
washing (tractors but not trailers). Approximately 150 trailers and 65 tractors are based out of this facility and
approximately 250 trailers and 300 tractors are maintained out of this facility monthly, The facility operates 24 hours a
day, 6 days a week. The facility is located inside a wire fence reinforced with an electric fence that extends around the
entire perimeter, Universal Environmental Services collects and disposes of used oil and antifreeze. Used parts cleaner
fluid is shipped back to the home office for disposa{. The oil/water separator is pumped out twice a year by Northstar
Environmental Group out of Gallatin, Tennessee.
Compliance History:
Charlotte Mecklenburg Storm Water Services conducted a Stormwater Inspection at Wilson Trucking on April 1, 2008.
The Division of Water Quality issued a Notice of Violation as a result of the inspection.

Enclosed is a copy of the Compliance Evaluation Inspection (CEI) report for the
inspection conducted at the subject facility on April 1, 2008, by Ms. Heather Sorensen of
Charlotte -Mecklenburg Storm Water Services. This inspection was conducted as part of a
cooperative working agreement between Mecklenburg County and the Division of Water
Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part 11 Section H. Thank you for your
assistance and cooperation during the inspection.
This report is being issued as a Notice of Violation (NOV) due to the permittee's failure
to conduct analytical monitoring in violation of the subject Stormwater Permit and North
Carolina General Statute (G.S.) 143-215.1, as detailed in the Analytical Monitoring section of
the enclosed report. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five
thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in
accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S.
143-215.1.

Inspection Summary:
Facility Description:
The facility is involved in motor freight service and loads and unloads tractor -trailers, including hazardous and non-
hazardous materials. Tractors and trailers are stored and maintained on site and operations include fueling and
washing (tractors but not trailers). Approximately 150 trailers and 65 tractors are based out of this facility and
approximately 250 trailers and 300 tractors are maintained out of this facility monthly. The facility operates 24 hours a
day, 6 days a week. The facility is located inside a wire fence reinforced with an electric fence that extends around the
entire perimeter. Universal Environmental Services collects and disposes of used oil and antifreeze. Used parts
cleaner fluid is shipped back to the home office for disposal. Northstar Environmental Group out of Gallatin, Tennessee
pumps the oil/water separator out twice a year.
Compliance History:
The permittee/facility does not have any prior compliance issues with either the NC Division of Water Quality or
Charlotte -Mecklenburg Storm Water Services.
Industrial Operations/City of Charlotte stormwater Ordinance Review:
Dock — Materials, both hazardous and non -hazardous, are loaded and unloaded from trailers in this covered area.
There are no floor drains located in the Dock. The dock area appeared to be in good condition.
Shog �- Floor drains are located in the middle of the shop area. No drains are located along the overhead doors. A spill
kit is located inside the shop. The following were observed in the shop during the inspection:
• One 55-gallon parts washer barrel. Used parts washer fluid is sent to the Wilson Trucking home office.
This barrel appeared to be in good condition.
• One 500-gallon new motor oil tank. This tank is single walled and appeared to be in good condition,
• Seven 55-gallon containers of new grease and motor oil. The barrels were up off the shop floor without
spill containment. The barrels appeared to be in good condition.
• Used batteries - there were no used batteries in the staging area during the inspection. Staff commented
that used batteries are picked up the same day or the next day after staging inside of the shop for pick up.
The area where used batteries are staged appeared to be in good condition.
Used Oil Tank -- One 405-gallon used oil aboveground storage tank with secondary containment is located outside,
exposed to stormwater. Standing water was present inside the containment structure during the inspection. The water
was clear with no oil sheen. The containment structure has a manual valve that was in the closed position, but not
locked during the inspection.
The NCGO80000 NPDES Permit in Part 11, Section A, Item #2(b) requires that the connection of secondary
containment devices connected directly to stormwater conveyance systems, shall be controlled by manually activated
valves or other similar devices (which shall be secured closed with a locking mechanism.) The facility shall secure
closed, with a locking mechanism, the manually activated valve on the containment structure for the used oil tank.
Tire Storage -- New and used tires are stored outside, exposed to stormwater. This area appeared to be in good
condition.
Air Compressor — The air compressor is located inside a covered shed and is not exposed to stormwater. No bleed off
line could be found during the inspection. There was no indication of a bleed off discharge to the ground. The air
compressor appeared to be in good condition.

Industrial_ Operations/City of Charlotte Stormwater Ordinance Review (cont.):
Wash Bay — Only tractors are washed inside the enclosed wash bay. One floor drain is located in the middle of the
wash bay. There are no drains located along the overhead door. There is an oil/water separator located inside the
wash bay that is cleaned out twice a year by Northstar Environmental Group, out of Gallatin, Tennessee. Washwater is
discharged to a second oil/water separator that is plumbed to the CMU sanitary sewer system. One 55-gallon barrel of
detergent is located inside the Wash Bay. This area appeared to be in good condition.
Fueling Area —
Tractors are fueled in this covered area. There are three 10,000-gallon underground diesel storage tanks and one
7,500-gallon gasoline underground storage tank that service the fueling pumps located in the fueling area. Spill kit
materials are accessible and located inside the shop. This area appeared to be in good condition.
Generator —
One generator is located outside and exposed to stormwater. The generator has a 55-gallon diesel tank. No stains
were observed on the ground around the generator. The generator appeared to be in good condition.
Scrap Metal Dumpster —
One small scrap metal dumpster was located outside, uncovered and exposed to stormwater. This area appeared to
be in good condition.
Tractor Storage Area —
Tractors are stored outside on pavement. Minor oil stains were located on the pavement throughout this area. The
facility should consider implementing methods to remove oil from the tractor parking area.
Trailer Storage Area —
Trailers are stored outside on pavement and gravel surfaces. These areas appeared to be in good condition.
Tractor Travel Areas —
Tractors and trailers travel throughout the facility in these areas. Dung the inspection, minor oil sheens were
observed on stormwater going into the associated storm drains. The facility should implement methods to remove oil
from the tractor travel areas.
Twin Dolly Storage Area —
Dollies are stored outside on pavement and exposed to stormwater. This area appeared to be in good condition.
Trash Dumpster—
One small general trash dumpster was located outside on pavement; covered and plugged. The dumpster appeared to
be in good condition.
Stormwater Pollution Prevention Plan [SPPP) (cont):
There was no documentation that an annual review of the SPPP had been completed as required by the permit.
Stormwater Inspections were conducted in 2005, 2006, and 2007 but there was no documentation that the inspections
had been completed in 2003 and 2004.

Outfall #1 — This outfall had standing water in the discharge pipe and a minor sheen was observed. Rocks,
sedimentation, and plants were preventing water from discharging from the pipe.
Outfall #2 — This outfall was clear of debris and no oil sheen observed.
Outfall #3 — This outfall had standing water in the discharge pipe and a slight oil sheen was observed during the
inspection. Major sedimentation at the outfall was preventing the water from discharging from the pipe.
The permittee is required by Part III, Section C, Item #1 of the permit to properly operate and maintain all facilities and
systems of treatment and control (and related appurtenances) which are installed or used by the permittee to achieve
compliance with the conditions of this general permit.

Comment: The general location map latitude and longitude coordinate for the point of
discharge is inaccurate (given for the main building) and the map was missing the name
of the receiving stream.; The detailed site map does not show the impervious surfaces
on site or the percentage of each drainage area that is impervious.
The secondary containment manually activated valve was closed on the day of the
inspection but it was not locked to prevent an unapproved discharge. The permittee did
not have documentation of any visual inspections and approval to release collected
water from the secondary containment structure.
The permittee provided documentation of employee training completed in 2005 and
2007 but could not provide documentation that training occurred in 2003, 2004, or
2006.

Comment: There are three stormwater outfalls on site that discharge to an on -site
retention pond. The retention pond discharges to the northeast corner of the property.
The permittee has conducted the semi-annual qualitative monitoring at the three outfalls
during 2005-2007. The permittee could not provide documentation that the semi-annual
qualitative monitoring was completed in 2003 or 2004.
Analytical Monitoring

Comment: This facility uses more than 55 gallons of new motor oil per month when
averaged over a calendar year. No documentation of completed analytical monitoring
was provided during the inspection. The permittee is required to perform analytical
monitoring for vehicle maintenance activities (due to oil usage) as required by Part II,
Section B of the permit. Results from the analytical monitoring shall be recorded on the
Discharge Monitoring Report for permit NCG080000 and submitted to the Stormwater
Permitting Unit in Raleigh. Please review the requirements for pH analysis, which
requires a 15-minute hold time as required by Standard Methods. Information regarding
pH analysis and copies of the Discharge Monitoring Report can be found on the
Division's Stormwater website at http://h2o.enr.state.nc.us/su/Forms—Documents.htm.

retention pond. The retention pond discharges to the northeast corner of the property.
The BMP outfall was clear of sediment with no erosion.

This letter is being forwarded in response to Notice of Violation # NOV-2008-PC-0334 issued as a result of a
compliance inspection on Stormwater Permit # COC NCG080323. In reviewing the report, we have made
notations and have plans in place to correct any violations as noted to be in need of correction. Below is an
itemization of our corrective actions to address specifically noted violations.
Used Oil Tank: NCGO80000 NPDES Permit In Part 11, Section #2, Item #2(b)- The facility shall secure
closed, with a locking mechanism, the manually activated valve on the containment structure for the used
oil tank. A locking mechanism has been installed on the valve for securing in the closed position and a lock
will secured the valve in the locked position. Enclosed is a photo documenting installation of valve
lock mechanism.
Outfall #1 & Outfall #3: We are in the process of arranging debris, vegetation, and sediment removal
from above outfalls to conform with general permit conditions.
Site Map: The general location map has been revised to include more accurate latitude and longitude
coordinates for the point of discharge. A copy of the revised site map is filed in Corporate SWPPP
Plan book for this location and well as filed in the local SWPPP Documentation at that location.
Detailed Site Man: The detailed site amp has been revised to show imperious site surfaces as well as
percentage for impervious surfaces of each drainage area. A copy has been filed in the Corporate Office
in addition to the local SWPPP documentation for at location.
Analytical Monitoring;: A plan has been implemented where a third party contractor and independent
laboratory will conduct analytical reports and forward test results to Division of Water Quality Raleigh
Office,

This letter is to inform you that, as of the date of this letter, the Division of Water Quality has not received a
renewal request for the subject permit certificate of coverage. This is a violation of NCGS § 143.215.1 (c)(1) which
states "All applications shall be filed with the commission at least 180 days in advance of the date on which it is
desired to commence the discharge of wastes or the date on which an existing permit expires, as the case may be".
Any permittee that has not requested renewal at least 180 days prior to expiration or permittee that does not have a
permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subjected to
enforcement procedures as provided in NCGS § 143-215.6 and 33 USC 1251 et. seq.
In order to prevent continued, escalated action, including the assessment of civil penalties you must submit a
completed permit coverage renewal application to the attention of the "Stormwater and General Permits Unit" at
the letterhead address within ten (10) days of your receipt of this letter (renewal application enclosed). If the
subject discharge has been terminated, please complete the enclosed rescission request form. Mailing instructions
are listed on the bottom of the form. You will be notified when the rescission process has been completed.
