I apologize up -front for not having our Stormwater Pollution Prevention Plan updated on an annual basis. I am in the process of updating this plan using the Plan Template found on your website. I will also begin qualitative testing of our outfalls. I will complete these steps by April 30, 2012. 1 will update the plan each calendar year in December. I have halted all vehicle washing referred to in the February 27th Inspection Summary ("equipment wash area"). Any cleaning on -site since this date has been conducted in a gravel area removed from the stormwater system. I will not allow vehicle washing in the referenced area (shop wash area) until the NCDENR approves a method to prevent the discharge of wash waters to the surface waters of North Carolina. I am hopeful that I could meet again with Mr. Michael Parker in the beginning of May to review the updated Stormwater Pollution Prevention Plan and to review the options that I have researched to allow for vehicle washing and prevent the discharge of wash waters to the surface waters of North Carolina. Parker with this Office. Thank you for your assistance and cooperation during the inspection. The enclosed report should be self-explanatory. Please note the comments located in the summary portion of the inspection report. As required by Part II, Section A. of the subject permit, a Stormwater and Pollution Prevention Plan (SPPP) should have been developed and implemented subsequent to the issuance of your permit. The SPPP also requires the implementation of qualitative monitoring, which has not been performed at this facility. In addition, an unpermitted discharge of vehicle wash water was observed during the inspection, which is not authorized by the subject permit. Such being the case, this inspection report is being issued as a Notice of Violation for the failure to comply with the terms and conditions of the subject General Permit. Please be advised that NCGS 143-215.6A (a)(2) provides for a civil penalty of not more than $25,000 per day per violation, which may be assessed against any person who fails to act in accordance with the terms, conditions and requirements of such Permit. Furthermore, no qualitative monitoring had been conducted as required by Part II, Section D of the Permit. The permittee will be issued a NOV for the failure to implement a SPPP and for the failure to conduct qualitative monitoring as required. During the course of the inspection, a discharge pipe from an equipment wash area was observed. This wash area was located at the rear of the facility and it involved a wash pit, followed by an oil/water separator, which then discharged via a SW drainage pipe to an unnamed tributary to Third Creek. Part Il, Section 1(e) of the Permit addresses Vehicle and Equipment Cleaning Areas. In essence, this Section states that all wastewaters from vehicle and equipment cleaning must be either be directed to the sanitary sewer, collected for off -site treatment and disposal, disposed on on -site through approved sub -surface disposal facilities, recycled, or some other equivalent means and under no condition is the discharge of wash waters authorized by the subject.permit. In the absence of sanitary sewer on on -site disposal, and cleaning operations take place outdoors, the permit does allow for the cleaning operations to be performed in a grassed or gravel area so as to prevent the wash water from entering the SW drainage system. Holland Transfer does not have access to municipal sewer, The site is served by a subsurface disposal system permitted through the Iredell County Department of Environmental Health (ICDEH). This system has recently been repaired and a new drainfield added to replace an older section of drainfield that had developed hydraulic problems. Depending on the amount of water generated in the vehicle washing operations, it may be possible to direct this water to the older section of drainfield pending an evaluation of it's acceptability. If the old section of drainfield is used for the disposal of the wash water, it will be necessary, however, to segregate the wash water from any SW that may enter the drain so as not to hydraulically overload the drainfield. A thorough evaluation of the older drainfield and the oil/water separator should be performed to ascertain the ability of these facilities to accept and treat the wash water. Approval from the ICDEH may also be necessary before the wash water is introduced into the older drainfield area. Another option that should be considered is the pumping and hauling of the wash water to an approved disposal location. Pumping and hauling will not require a permit from the Division of Water Quality, however, a written contract between the hauler and Holland Transfer as well as documentation that the wash water is being taken to an approved disposal location should be maintained on file at all times and available for review.
