Skvaia, III Secretary On April 9, 2013, Anthony Roux from Charlotte -Mecklenburg Stormwater Services (CMSWS), conducted a site inspection of the Advantage Machinery Services facility located at 3027 N. Tryon Street in Charlotte, Mecklenburg County, North Carolina. The site drains to an unnamed tributary to Little Sugar Creek, Class C waters located in the Catawba River Basin. The site -visit and file review revealed that the subject facility is covered by NPDES General Stormwater Permit -- NCG080000. This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part II Section H. The following observations were noted during the Charlotte -Mecklenburg Stormwater Services inspection (please see the attached addendum for information about your permit): 1) Stormwater Pollution Prevention Plan (SPPP) A Stormwater Pollution Prevention Plan (SPPP) has been developed, recorded, and properly implemented. No stormwater pollution problems were observed. 5) City of Charlotte Stormwater Ordinance Review: A few items of concern were noted during the inspection with regarding to the stormwater ordinance; they are noted in the Summary section of the attached report. Compliance Evaluation Inspection, Page 3 June 13, 2013 ADDENDUM The National Pollutant Discharge Elimination System (NPDES) program was established under the federal Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The NPDES permitting program for stormwater discharges was established in 1990, Phase I focuses on site and operations planning to reduce pollutant sources. Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general stormwater permits in North Carolina. One condition that is applicable to both the general permits and individual stormwater permits is the requirement to develop and implement site -specific comprehensive Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge. Copies of the general permits and accompanying documents can be accessed from the following webpage: http://portal.ncdenr.org/web/wq/ws/su/npdessw#General_Permits_NPDES. Permit text, technical bulletins, discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES General Stormwater Permit] can be found on this website. The following items are a subset of permit requirements and are listed to assist you and help bring your attention to certain permitting issues, process and condition requirements of your permit. Please see the above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein. Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day. • Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general NPDES stormwater permit or an individual NPDES stormwater permit • All persons desiring to have facilities covered by a General Permit must register with the Division of Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees. • This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any discharge of stormwater associated with the industrial activity, process wastewater, and/or mine dewatering. • Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked. • Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable non-stormwater discharge or is covered by another permit, authorization, or approval. • There are currently 19 active general permits. Copies of the analytical monitoring results shall also be maintained on site. The Permittee shall retain records of all monitoring information, including all calibration and maintenance records and all original strip -chart recordings for continuous monitoring instrumentation, and copies of all reports required by this general permit for a period of at least 5 years from the date of the sample measurement, report, or application. o Expiration — The permittee is not authorized to discharge after the expiration date of the general permit. In order to receive automatic authorization to discharge beyond the expiration date, the permittee shall submit forms and fees as are required by the agency authorized to issue permits no later than 180-days prior to the expiration date. Any permittee that has not requested renewal at least 180 days prior to expiration, or any permittee that does not have a permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subject to enforcement. Failure to renew your permit is a violation. o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not transferable to any person expect after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the Certificate of Coverage to change the name and incorporate such other requirements as may be necessary under the Clean Water Act. Advantage Machinery Services maintains the trucks in the Advantage Machinery Services fleet. Industrial Operations/City of Charlotte Stormwater Ordinance Review: Aboveground storage tank(s) - Two aboveground storage tanks (ASTs) are located on site; a 10,000-gallon wastewater tank and a 400-gallon waste oil tank. Vehicle/equipment area(s) -. Two truck wash bays drain wash water to a waste collection system that is filtered through an aboveground oil/water separator then pumped to the 10,000-gallon wastewater AST. The facility plans to upgrade the wash bay on the left side of the main service building and place it under roof. Waste storage/disposal areas (dumpsters, scrap metal bins, etc.) -- A significant amount of scrap metal and abandoned industrial equipment is stored on site. it is recommended that the permittee review the need for this material and consider disposing any scrap metal and old industrial equipment that is no longer needed to prevent pollutants from entering stormwater runoff; this review can be included in the feasibility section of the SPPP. Indoor Material storage Area(s) — A waste oil storage tank in the vehicle maintenance shop is located within secondary containment. Empty 5-gallon buckets containing residual used oil were observed outside the containment. In addition, empty oil containers were being stored in a 55-gallon drum that was overfilled. Spilled oil was observed on the outside of the drum. It is recommended the permittee review the housekeeping measures employed for the used oil storage tank and 55-gallon drum. Stormwater pollution prevention training needs to be extended to all employees whose job duties could affect stormwater leaving the site. The facility is inspected weekly. Documentation is completed for any noted issued and the associated corrective actions. The follow-up inspection found that Advantage Machinery Services, Inc. has implemented the corrective actions as stated in the subject facility's response letter dated June 3, 2008. The corrective actions include: • Moving the storage of old equipment in doors so the equipment is not exposed to stormwater, • Excavation and restoration• of the oil impacted areas on site, • Proper disposal of used drums and buckets, • Installation of a condensate pan for the facility's air compressor, • Construction of a berm around the water recycling system and the engine steam wash bay to contain runoff, • Discontinuing the use of detergents when washing vehicles, and • Updating and implementing the Stormwater Pollution Prevention Plan. The facility conducts vehicle maintenance activities including oil changes. Compliance History, Ms. Aliyah Turner and Ms. Heather Sorenson of the Charlotte Mecklenburg Storm Water Services (CMSWS) inspected advantage Machinery Services on April 2, 2008. The Division of Water Quality issued a Notice of Violation on May 8, 2008. Industrial Operations/City of Charlotte Stormwater Ordinance Review General Housekeeping - The stormwater inspection conducted on April 2, 2008 revealed several housekeeping issues at the Advantage Machinery Services facility. Oil stains were observed on the ground along with several five gallon buckets stored under a canopy The buckets were severely corroded and were not labeled. Also, during the inspection the facility's air compressor was observed discharging condensate onto the ground. The follow up inspection conducted on July 11, 2008, found that the housekeeping issues found during the initial inspection had been corrected. The permittee has remediated the oil -impacted soils by excavating and restoring the affected areas with new gravel and dirt. The permittee has installed a bucket to catch the air compressor condensate discharges and when full the waster is discharged to the sanitary sewer system. Finally, the permittee no longer stores abandoned industrial equipment and has disposed of the corroded five gallon buckets. Prohibited Discharges - The initial stormwater inspection found that there was the potential for two prohibited discharges on site. The facility's water recycling system collects stormwater and vehicle washwater. It is then manually pumped into a drum and used to produce steam for engine cleaning. According to facility personnel detergents are used to clean the truck cabs. A berm separates the water recycling area and a storm drain, however, during a heavy storm event it is possible for the area to overflow causing washwater to enter into the storm drain. Also, the facility steam cleans vehicle engines in a steam engine bay, and to prevent run-off, the facility has constructed a wooden berm around this area. The front of the berm has been compromised and is in poor condition, which may allow vehicle fluids to run-off onto the pavement. The follow-up inspection conducted on July 11, 2008, found that the permittee no longer uses detergents when cleaning the truck cabs. An electrical pump was installed along with a new berm around the water recycling system to prevent any pollutants from entering the storm sewer system. The permittee created a bypass to take runoff directly into the holding tank, As a precaution a new berm was constructed in front of the steam engine bay area to prevent pollution runoff into the storm sewer system, Page: 2 z Permit: NCGO80286 Owner - Facility: Advantage Machinery Services Inc Inspection Date: 07/1112008 Inspection Type! Industrial Operations/City of Charlotte Stormwater Ordinance Review Abandoned Industrial Equipment - The facility stores abandoned industrial equipment on site. As a general housekeeping recommendation the facility should dispose of industrial equipment that is no longer being used at the facility. Oil Staining - Several oil stains were observed on the gravel surface during the inspection. The discharge of oil to the ground is a prohibited discharge. The facility should explore options to prevent oil leaks from vehicles. The facility should remove the dirt and gravel and restore the affected area. Buckets - Several five -gallon buckets were stored under a covered canopy on the ground surface. The buckets were severely corroded. The buckets were not labeled. The facility should explore options to provide secondary containment for the buckets and ensure that buckets containing chemicals are clearly labeled. Air Compressor - Staining was observed on the ground at the base of the facility's air compressor. The discharge of air compressor condensate to the ground is an illicit discharge. The facility should explore options to properly dispose of the air compressor condensate into the sanitary sewer. Water Recycling System - Stormwater and vehicle washwater is collected in a trough and is manually pumped into a 55-gallon drum and is then used to produce steam for cleaning engines. According to facility personnel the facility uses a car washing agent on the cabs of trucks. There is a berm separating the water recycling area and a storm drain. However, during a heavy storm event it is possible for the area to overflow causing water to enter the storm drain. The facility should explore options to ensure that the trough does not overflow and enter the storm drain, discontinue the use of detergents on vehicles, or consider installing a vehicle wash bay area equipped with an oil water separator, Steam Engine Bay - Vehicle engines are steamed in this area. The facility has constructed a wooden berm around the area to prevent run-off. The front area of the berm has been compromised and is in poor condition. The facility should explore options to restore this area to prevent run-off. ( C ) Buckets: All containers were removed from this site and disposed of properly. (D) Air Compressors: A catch container were placed at each compressor drain to contain any discharge of condensate. Also a automatic pump was added to the system with the manual pump as a back up. This automatic pump system will pump straight to the waste water storage tank for pick up.
