Howell's Motor Freight is a terminal for distribution of freight products by semi -trailer trucks. Food products make up most of the freight handled by the facility . The facility consists of a large warehouse with cooler and freezer areas as well as a vehicle maintenance shop and a fueling island. Approximately 30 company -owned trucks are stationed at the site; trucks from outside carriers also load and unload freight at the facility. The facility was found to be in compliance with the City of Charlotte's Storm Water Pollution Control Ordinance at the time of the inspection. See the report for recommendations and best management practices (BMPs) to protect water quality, as well as recommendations for compliance with the requirements of the facility's NPDES stormwater permit. The site drains to Dixon Branch Creek, Class C waters located in the Catawba River Basin. The site visit and file review revealed that the subject facility is covered by NPDES General Stormwater Permit — NCG080000. This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part II Section H. The following observations were noted during the Charlotte -Mecklenburg Stormwater Services inspection (please see the attached addendum for information about your permit): 1) Stormwater Pollution Prevention Plan (SPPP) A Stormwater Pollution Prevention Plan has been developed, recorded, and properly implemented. Please institute corrective actions so this evaluation is completed annually and documented in the SPPP. 5} City of Charlotte Stormwater Ordinance Review: A summary of the review completed for compliance with the City of Charlotte Stormwater Ordinance is contained in the Summary section of the enclosed report. The review noted that the dumpster located next to the maintenance shop was missing a lid. Please ensure that each dumpster is covered and plugged to prevent pollution discharges. Thank you for the assistance and cooperation during the inspection. Overall, the facility's Stormwater program was well developed and implemented and this Office commends the permittee's efforts to ensure compliance with your NPDES permit. However, as noted above and in the enclosed report, deficiencies were noted during the inspection and it is requested that a written response be submitted to this Office by May a, 2012, addressing these deficiencies. In responding to the violations, please address your comments to the attention of Ms. Allocco at the letterhead address. The subject facility will have 90 days from the letterhead date to come into compliance with the noted issues. Compliance Evaluation Inspection, Page 3 April 3, 2012 ADDENDUM The National Pollutant Discharge Elimination System (NPDES) program was established under the federal Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and operations planning to reduce pollutant sources. Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general stormwater permits in North Carolina. One condition that is applicable to both the general permits and individual stormwater permits is the requirement to develop and implement site -specific comprehensive Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge. Copies of the general permits and accompanying documents can be accessed from the following webpage: http://portal.ncdenr.org/web/wq/ws/su/npdessw#General_Permits_NPDES. Permit text, technical bulletins, discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES General Stormwater Permit] can be found on this website. The following items are a subset of permit requirements and are listed to assist you and help bring your attention to certain permitting issues, process and condition requirements of your permit. Please see the above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein. The facility is 12.17 acres with 65% impervious surfaces. The facility loads and unloads tractor trailer trucks, typically non -hazardous food goods. The facility operates Mon. — Fri. (6 AM to 11 PM) and Sat/Sun (6 AM to 12 PM). Compliance History: The facility was inspected on February 19, 2008, by Charlotte -Mecklenburg Storm Water Services (CMSWS). The Division of Water Quality issued a Notice of Deficiency as a result of the inspection. The facility was compliant during the follow-up inspection on July 1, 2008. Industrial Operations/City of Charlotte Stormwater Ordinance Review: Aboveground Storage Tanks (ASTs) — One 250-gallon new motor oil tank is located inside the maintenance shop and not exposed to stormwater. The tank is located inside a steel containment structure. Underground Storage Tanks (USTs) — One 10,000-gallon diesel underground storage tank is located onsite and serves above ground fueling pumps. Loading/unloading area(s) - Large trailers containing packaged dry goods are loaded and unloaded into a covered and enclosed warehouse. Vehicle/equipment area(s) (fueling, washing, storage, etc.) — Tractors are fueled at a covered fueling island that is not exposed to stormwater, Tractors and trailers are temporarily parked or stored in a gravel lot. Vehicle washing does not occur on site. Oil/water separator and/or pretreatment -- The maintenance shop contains an oil -water separator that discharges to the sanitary sewer system. Waste storage/disposal areas (dumpsters, scrap metal bins, etc.) — Two waste dumpsters are located onsite. The dumpster located next to the maintenance shop was missing a lid. The facility should ensure each dumpster is covered and plugged to prevent pollution discharges to the ground. In response to the noted observations, please see below: 1) Stormwater Pollution Prevention Plan- I am in Charlotte at least quarterly and whenever I am there I do a walk around and evaluation of the facility, and review the plan for possible updates. Admittedly however, I have done a poor job of annual documentation of spills (or lack thereof), employee training, and plan review. That will be corrected. 2) Analytical Monitoring — We will ensure the Tier I and Tier II responses are handled correctly going forward. 3) Permits and Outfalls — This will be corrected going forward. 4) City of Charlotte Stormwater Ordinance Review — The dumpster located next to the shop will be outfitted with a lid (plug is already in place). The BMP is built to function as a detention area for stormwater. The BMP has one outfall located on site. Sedimentation and erosion are evident inside the BMP. The storm water has short circuited the BMP and flows directly from the inlet of the BMP to the outlet pipe with no opportunity for disperse flow through the BMP. The outlet structure was clear of sediment. The outfall of the BMP was inaccessible due to the overgrowth of thorny plants. The facility should maintain access to the outlet structure. The facility should also conduct proper maintenance of the BMP. Shop Detention Area — Tractors and trailers are staged in this area while waiting for maintenance service. This area is outside on a gravel lot, exposed to storm water. This area appeared to be in good condition with no signs of tractor or trailer leaks. Fueling Island — The covered fueling island is located adjacent and down hill from the Old Shop, and is not exposed to stormwater. A spill kit is located at the fueling island. Staff fuel their tractor/trailers at this location. They can also service their tractor/trailers with motor oil and antifreeze in this area. Two large dark stains, with an approximate length of 25 feet, were observed on the gravel that originated from the fueling area. Staff commented that sometimes the drivers don't pay attention during fueling and spills occur, The facility should consider permanent methods to contain spills -One 5-gallon bucket of water and oil is located at the fueling island. This bucket catches drips from the new motor oil nozzle. Staff commented that the bucket is emptied into the trench drain in the Shop. The trench drain leads to an oil/water separator, then to the municipal sanitary sewer system. -One UST measure stick is located on the outside wall of the Old Shop and is exposed to storm water. A dark stain is present on the graveled surface beneath the stick. Staff commented that some diesel fuel drips off the end off the stick after measuring the UST. The facility should evaluate methods to contain, collect and properly dispose of diesel fuel from the UST measure stick. Shop —Tractor and trailer maintenance is performed in this area. Engine washing is also conducted in this area. One trench floor drain is located in the middle of the shop that discharges to the sanitary sewer system through an oil/water separator. Staff noted that the oil/water separator is emptied by a waste hauler every 5 years. One 250-gallon used motor oil tank is located inside the Shop and is not exposed to stormwater. The tank is located inside a steel containment structure. The used motor oil tank was not labeled. Oil absorbent was located inside the steel containment structure. Oil staining was present in the oil absorbent. The steel containment structure was missing the plug that contains spilled product. The facility should properly label all containers and provide a plug for the steel containment structure as well as promptly removing all spills. The facility should also evaluate the tank for leaks and alternatives to reduce spills. -An air Compressor is located on a concrete pad in a shed and is not exposed to storm water. Bleed off from the air compressor, a mixture of water and oil, discharges to the floor of the shed. A minor discharge of bleed off reaches the ground outside. The outlet structure was clear of sediment. The outfall of the BMP was inaccessible due to the overgrowth of thorny plants. The facility should maintain access to the outlet structure. The facility should also conduct proper maintenance of the BMP. Shop Detention Area — Tractors and trailers are staged in this area while waiting for maintenance service. This area is outside on a gravel lot, exposed to storm water. This area appeared to be in good condition with no signs of tractor or trailer leaks. Fueling Island — The covered fueling island is located adjacent and down hill from the Old Shop, and is not exposed to stormwater, A spill kit is located at the fueling island. Staff fuel their tractor/trailers at this location. They can also service their tractor/trailers with motor oil and antifreeze in this area. Two large dark stains, with an approximate length of 25 feet, were observed on the gravel that originated from the fueling area. Staff commented that sometimes the drivers don't pay attention during fueling and spills occur. The facility should consider permanent methods to contain spills. • One 10,000-Diesel Underground Storage Tank (UST) is located on site. • One 55-gallon antifreeze barrel is located at the fueling island. • One 5-gallon bucket of water and oil is located at the fueling island. This bucket catches drips from the new motor oil nozzle. Staff commented that the bucket is emptied into the trench drain in the Shop. The trench drain leads to an oil/water separator, then to the municipal sanitary sewer system. One UST measure stick is located on the outside wall of the Old Shop and is exposed to storm water. A dark stain is present on the graveled surface beneath the stick. Staff commented that some diesel fuel drips off the end off the stick after measuring the UST. The facility should evaluate methods to contain, collect and properly dispose of diesel fuel from the UST measure stick. Staff noted that the oil/water separator is emptied by a waste hauler every 5 years. • One 250-gallon used motor oil tank is located inside the Shop and is not exposed to stormwater. The tank is located inside a steel containment structure. The used motor oil tank was not labeled. Oil absorbent was located inside the steel containment structure. Oil staining was present in the oil absorbent. The steel containment structure was missing the plug that contains spilled product. The facility should properly label all containers. The facility should provide a plug for the steel containment structure and all spills should be promptly removed. The facility should also evaluate the tank for leaks and alternatives to reduce spills. • One 300-gallon new motor oil container is located inside the same steel containment structure as the 250-gallon used motor oil tank. • One parts cleaner with a 55-gallon barrel of used parts cleaner fluid is located inside the Shop. • Oil Filter Drain — Oil filters are drained into a container, then the used oil is stored inside the 250-gallon used oil container. • One 55-gallon barrel of antifreeze is located inside the shop. • One 55-gallon barrel of diesel fuel is located inside the shop. A container was present to contain any spills or drips from the barrel. • Air Compressor— One air compressor is located on a concrete pad in a shed and is not exposed to storm water. Bleed off from the air compressor, a mixture of water and oil, discharges to the floor of the shed. A minor discharge of bleed off reaches the outside ground. The facility should contain, collect and properly dispose of the oillwater mixture. The SWPPP is designed to limit the exposure and subsequent transport of potential source material in stormwater runoff from property. This SWPPP utilizes a series of worksheets to identify: Pollution Prevention Team members, exposed source materials, non-stormwater discharges (if any), best management practices (BMP's), employee training programs and emergency response contacts. An annual inspection program is designed to help ensure that all aspects of the SWPPP are being implemented.. 1.2 SITE LOCATION AND LAYOUT A site plan of the facility showing material storage areas, structures, and drainage patterns is shown in Figure 1. DESCRIPTION OF THE FACILITY 2.1 DE5CRIPTION OF INDUSTRIAL ACTIVITY Howell's operates the facility as a trucking terminal. The activities performed at this terminal that could impact stromwater are fuel dispensing and maintenance. Source materials which could affect stormwater runoff are generally stored either inside or under cover and are therefore not exposed to rainfall. 2.2 SOURCE MATgRIAL BEST MANAGEMENT PRACTICES Howell's policy is to store all materials which could cause adverse environmental impact either inside or under cover. This reduces the potential for source materials to come into direct contact with precipitation. Howell's fuels its equipment under cover for added protection. The USTs utilize Statistical Inventory Reconciliation (SIR) as a means of inventory control and leak detection. Tires, batteries, used motor oil, and parts cleaner are picked up and disposed of off -site by licensed suppliers and reeyclers. A description of source materials used at this facility is shown on Worksheet # 1. Copies of MSDs for source materials used at the facility are included in Appendix 1. 2.3 EXISTING 1✓NVQtENTI M►NAGEMENT FLANS Howell's maintains an Emergency Contingency Plan which includes corporate, local, and state personnel to be contacted should a discharge or release occur. A copy of the plan for this terminal is included in Appendix 2. 2.4 POLLUTION INCIDENT HISTORY See attached Worksheet#8 for a list of significant spills which have occurred at this facility during the past three years. 2.5 IMPLEMENTATION SCHEDULE Worksheet #2 shows the existing BMPs. and a schedule for BMPs currently not in place at this facility (if any). The Pollution Prevention Team is responsible for implementing these BMPs. PLAN IMPLEMENTATION 3.1 ORGANIZATION AND RESPONSIBILITIES Worksheet #3 lists the members of the Pollution Prevention Tram along with a description of each member's responsibility. This team is responsible for compliance with the SWPPP and for reporting and follow up on all emergency situations. Timothy S. Shephard shall have overall responsibility for the overall coordination, development, implementation and revision to this Plan. 3.2 ),IMERGENCY QGORDINATO The initial contact in all emergency situations is the Terminal Manager. In the event of an environmental situation, the Terminal Manager will assess the situation and notify appropriate Howell's personnel. The Corporate Office will make necessary determination regarding notification to regulatory agencies. Details of notification of such agencies is found in Section 6 of the SWPPP. A list of agencies, contacts, telephone numbers and the responsibility of each agency appears in Worksheet #4. SPR"EAK PREVENTION AND RESPONSE 4.1 PRE-RELEASE PLANNING Figure 1 shows the areas on the site where potential source materials are stored. The source materials used at the facility along with storage and materials management practices are summarized on Worksheet #1. 4.2 MATEMU COMPATIBILITY Currently there are no known material compatibility concerns. 4.3 INSPECTION PROCEDURES AND REPORTING The SWPPP requires that a minimum of one comprehensive site evaluation per year be performed by qualified Howell's personnel. The site evaluation is intended to verify that the SWPPP is being adhered to and to identify areas for improvement. Following that inspection the Safety Department will complete the inspection Report and Certification Form (Appendix 3). The SWPPP requires that analytical monitoring be performed on a semi- annual basis. Analytical results shall be attached to this plan in Appendix 4. The SWPPP also requires quarterly site inspections and examination of stormwater quality. Following the quarterly site inspection and examination an inspection report (Worksheet 05a) and report of stormwater quality (Worksheet #5) are prepared. The inspector is responsible for ensuring that any deficiencies noted on the inspection report are corrected. A corrective action schedule is required to be developed outlining a program for correcting any deficiencies noted during the inspection which can not be corrected within 15 days following the inspection. A copy of the inspection reports along with any proposed corrective action schedule is required to be forwarded to Howell's Safety Department. It is the responsibility of the Safbty Department to ensure all proposed corrective actions are appropriate and are implemented in a timely manner. 4.4 PREVENTATIVE ENAN E AND HOUSEIKEEPWG PROgRAMS Periodic site inspections are a key element of the SWPPP. Recommended BMPs used for preventative maintenance and housekeeping at this facility are described in Worksheet #2. 4.5 SITE SECURITY This facility operates 24 hours per day, 6 days per week The facility is lighted and fenced. 4.6 NATURAL„D&ASTE Should a natural disaster such as hurricane, tornado, flood, etc. occur, the Terminal Manager and Safety Department will be notified immediately in order to activate contingency plans. 4.7 EMPLOYEE TRAINING Howell's relies on employee training as the first line of defense in Pollution Prevention.
