(Dynamis) has been authorized by Pilot Travel Centers LLC (Pilot) to prepare a written response to the North Carolina Department of Environment and Natural Resources letter dated March 8, 2012. NCDENR performed a Compliance Evaluation Inspection (CEi), for the above referenced facility on March 6, 2012. This response letter has been prepared in a NCDENR comment and Pilot response format, in order to properly address the reported non-compliance issues. NCDENR Noted Deficiency No. 1: The SPPP did not include a general location map (USGS) as required by Part 11, Section A, No. l(a) of the permit. Pilot's response to NCDENR Noted Deficiency No. 1: The Stormwater Pollution Prevention Plan, which includes the SPCC/I3MP, has been revised to address this comment. NCDENR Noted Deficiency No. 2: The site map did not include a relationship to property boundaries, nearby surface waters, topography, and percent of the site that is impervious as required by Part II, Section A, No. 1(c) of the permit. Pilot's response to NCDENR Noted Deficiency No. 2: The Stormwater Pollution Prevention Plan, which includes the SPCCBMP, has been revised to address this comment. NCDENR Noted Deficiency No. 3: The SPPP did to include a list of significant spills that may have occurred at the facility during the three previous years as require by Part H, Section A. No. 1(d) of the permit. If no significant spills have occurred in the three previous years, some reference should be included in the SPPP indicating such. Pilot Travel Center No. 056 COC No. NCG080143 Pilot's response to NCDENR Noted Deficiency No. 3: The Stormwater Pollution Prevention Plan, which includes the SPCC/BMP, has been revised to address this comment. NCDENR Noted Deficiency No. 4: There was no mention in the SPPP of where a Feasibility Study had been performed as required by Part 11, Section A, No. 2(a) of the permit. Pilot's response to NCDENR Noted Deficiency No. 4: The Stormwater Pollution Prevention Plan, which includes the SPCC/BMP, has been revised to address this comment. NCDENR Noted Deficiency No. S: The SPPP included a Spill Prevention and Countermeasure Plan, which after review appeared to be very similar -to a Spill Prevention and Response Plan (SPRP), which is required by Part I1, Section A, No. 3 of the permit. This Plan should also identify the person(s) and/or teams responsible for implementing the SPRP. Pilot's response to NCDENR Noted Deficiency No. 5: The Stormwater Pollution Prevention Plan, which includes the SPCC/BMP, has been revised to address this comment. NCDENR Noted Deficiency No. 6: Employee training on proper spill response is included in the -SPPP, however, the personnel responsible for implementing the training should be indentified in the SPPP as required by Part 11, Section A, No. S of the permit. Pilot's response to NCDENR Noted Deficiency No. 6: The Stormwater Pollution Prevention Plan, which includes the SPCC/BMP, has been revised to address this comment. NCDENR Noted Deficiency No. 7: Qualitative monitoring as required by Part II, Section D of the permit has not been performed even though inspections of the existing BMP (detention pond) have been conducted on a monthly basis. A Notice of Deficiency will be issued for the failure to conduct the required qualitative monitoring. Pilot's response to NCDENR Noted Deficiency No. 7: Pilot was unaware of the qualitative monitoring requirement. Since coming to our attention, qualitative monitoring will be done on a semi-annual basis ds required by the permit. Additional NCDENR Noted Deficiency: The existing stormwater detention pond was in need of routine maintenance. Excessive sand, silt, and road debris had accumulated in the bottom of the pond and were inhibiting treatment efficiency due to short circuiting. There appeared to be evidence of oil in some of the ponded water areas found on top of the accumulated sediment. The writer noted that there are stormwater drains onsite that by-pass the existing oil/water separator and travel directly into the pond. Minor fuel spillages from parked tractor trailers may be captured by stormwater and carried into this pond. The trash rack on the outlet structure of the pond was covered with debris and needed to be cleaned. Trees had established themselves both in and around the perimeter of the pond. These trees (and their associated roots) may pose a hazard to the integrity of the berm surrounding the pond. Consideration should be given to their removal to prevent future damage to the berm and to allow for routine maintenance of the pond. 2 Pilot Travel Center No. 056 COC No. NCG080143 Pilot's response to Additional NCDENR Noted Deficiency: The SW Detention Pond is scheduled for routine maintenance and will be cleared of excess vegetation (trees), silt, and sediment. Pilot and Dynamis are in the process of determining the level of effort needed to complete this project. Dynamis personnel called and spoke with Mr. Michael Parker of NCDENR on April 4, 2012. Dynamis, as Pilot's contractor for this project discussed a plan of action and schedule for removal of the excess trees and vegetation in and around the perimeter of the pond, and the removal of excess sand and silt in the pond. Review of Stormwater Pollution Prevention Plan (SPPP) Overall, the SPPP for this facility was generally complete and fairly accurate with respect to current site conditions. There were, however, a number of minor deficiencies noted that are listed below. 1.
