Listed below you will find the response to our Notice of Violation for Propst Bros. Dist.,
Inc. Permit #NCG080078. The tracking # is NOV-2012-PC-0105.
#1: 1 have attached a copy of our current SPPP.
#2 & #3: I have contracted with Phil Thompson a registered geologist from our area to
handle all our Qualitative and Analytical Monitoring. I have sent him all the information
required to make sure that we handle the monitoring in the proper method.
#4 All vehicle washing is being done to allow the wash product to be absorb into the soil.
I have attached photos of the 2 out fall areas where we have placed rip -rap to stabilize
these areas.
If there is anything else you need from me please give me a call and let me know.

Description of type of spill, including source, quantity, secondary

A. A broken pipe or valve could spill approximately 5 bbis of product.
This would be contained on the concrete containment slabs
and piped to an oil 1 water seperator.
B. A tank truck sould spill approximately 24 bbls. of product at the
loading or unloading area. This would flow through an oil 1 waer
seperator for treatment before discharge.
C. A storage tank rupture could spill approximately 476 bbls. of
product inside the Diked area. The Diked area is of sufficient
volume to hold the required volume.

DESIGN AND OPERATING INFORMATION
Bulk Storage tanks
A. Describe secondary containment design, construction materials
and volume:
An earthen. dike wall averaging 3' high surrounds the tank
farm on 3 sides. A concrete block wall 8" thick is on the
fourth side.
B. Describe Tank design, materials of construction, fail-safe
engineering features, and, if needed, corrosion protection:
Tanks are welded steel, cone roof with plug type valves at
nozzles. Valves are manually operated.
C. Describe tank inspection methods, procedures, and record
keeping:
Tanks, pumps, lines, valves, etc. are inspected periodically
and repairs made as needed. These are visual inspections
which are made on a daily basis when the tank volume
readings are made.
D. Are tanks drained, cleaned and inspected periodically? Yes,

E. Are tanks protected against overflow by valves, alarms or other
methods? Yes X No
Describe: Only measure amounts of fuel are ordered and
delivered and available storage space is verified upon

Daily visual inspection is made for pipelines, leaks, valves leaking and
loose connections. Necessary repairs are made.

Describe containment system design, construction materials and
volume: Any spill at the loading or unloading area would be
piped through the oil 1 water separator. This unit will contain
a spill of 3200 gallons.
E. Is an intelocked warning light or physical barrier
system, or warning sign, provided in loading 1
unloading areas to prevent vehicular departure
before disconnect of transfer lines? No

There is no exposed aboveground piping in the area of vehicle
traffic.
10. Facility Drainage
A. Drainage from diked storage areas is controlled as follows (include
operating description of valves, pumps, enjectors, etc.): Drainage
from dike area is by manually operated syphon and discharde is
piped through an oil 1 water seperator.
B. Drainage from undiked areas is controlled as follows (include
description of ponds, lagoons, or catchment basins and methods of
retaining and returning oil to facility): Drainage from loading or
unloading area is collected and piped through an oil water
seperator.
C. The procedure for supervising the drainage of rainwater from
secondary containment into a storm drain or an open water course
is as follows (include description of inspection for pollutants,
method of valving security). (A record of inspection and drainage
events is to be maintained on a form simular to Attachment No. 3):
Normal rainfall percolates into soil. Any excess is removed by
manually operated syphon and flows through oil 1 water seperator.
11. Effluent Discharge
Plant effluents which are discharged into navigable water
are observed frequently for indication of possible
upsets which may cause an oil spill event. Describe

Dear Mr. Propst:
Enclosed is a copy of the Compliance Evaluation Inspection (CEI) report for the
inspection conducted at Propst Brothers terminal at 145 Kerr St, on March 8, 2012, by Ms. Barbara
Sifford of this Office. The site drains to a tributary of Buffalo Creek, Class C water located in the
Yadkin River Basin. Your assistance was greatly appreciated during the inspection.
Accordingly, the following observations were noted during the inspection:
1} Stormwater Pollution Prevention Plan (SPPP)
A stormwater pollution prevention plan was not available for review. An annual review of the
plan is required.
2) Qualitative Monitoring
Qualitative monitoring has not been recorded and evaluated for all the outfalls.
3) Analytical Monitoring
No analytical monitoring has been performed on the discharges. You may request representative
outfall status when you respond to this letter with a map explaining each drainage area of the
property.

4) Other Observations
The outfall from the oil and water separator has some evidence of oil in the discharge.
Discussions during the inspection revealed that truck washing was being discharged into this
tank. Vehicle washing should be discharged to the soil for absorption. The drainage outfalls
should be stabilized to prevent erosion of the ditch.
This report is being issued as a Notice of Violation (NOV) due to the permittee's failure
to comply with the Stormwater Pollution Prevention Plan, Qualitative Monitoring and
Analytical Monitoring Sections of the general permit NCG080000 issued to Propst Brothers
Distributing in November 2007 under Certificate of Coverage number NCG080078 as noted
in the attached report. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-
five thousand dollars ($25,000) per violation, per day, may be assessed against any person
who violates or fails to act in accordance with the terms, conditions, or requirements of any
permit issued pursuant to G. S. 143-215.1.
It is requested that a written response be submitted to this Office by April 23, 2012,
addressing the above noted violations in the attached report. In responding to the violations
please address your response to the attention of Ms. Marcia Allocco. The report should be
self-explanatory; however, should you have any questions concerning the report, please do
not hesitate to contact Ms. Sifford at (704) 663-1699.
