Dear Mr. Martin:
The Mooresville Regional Office staff has reviewed your request dated September 30, 2010 for a determination that
stormwater discharge outfall (SDO) 006 be granted representative outfall status for stormwater outfalls 001, 002,
003, 004, and 005. Based on the information and maps provided and previous site visits on May 8, 2009, and
October 15, 2009 (during a rain event), we are approving this request. In accordance with 40 CFR §122.21(g)(7),
you are authorized to sample outfall number 006 as a representative outfall. This approval is effective with the next
sampling event. We also want to remind you that the permit still requires Qualitative Monitoring be performed at all
S_DOs, regardless of representative status.
Please remember that any actions you initiate in response to benchmark exceedances as directed in the tiered
response provisions of your permit must address all drainage areas represented by SDO 006, where appropriate.
In addition, any BM Ps instituted due to prior exceedances of benchmarks at Outfalls 001, 002, 003, 004, and 005
should be continued; for example sweeping of the parking areas at the facility.
Please append this letter to your Stormwater Pollution Prevention Plan (SPPP) or permit to document that
representative outfall status has been approved. If changes in drainage areas, structures, processes, storage
practices, or other activities occur that significantly alter the basis of this approval, representative outfall status may
no longer be valid. You should either resume sampling at all SDOs, or reapply to this Office for representative
outfall status based on updated information.
Attached to this letter is an Annual Permit fee invoice for September 1, 2008 to August 31, 2009. Our Compliance
database shows this invoice as unpaid and the Annual Permit fee as overdue. Please review your files for previous
payment of this fee and if not paid please remit payment per the requirements spelled out on the invoice.

If a facility is required to sample multiple discharge locations with very similar stoMW6fi"kq*W H,'*WeoFt
permittee may petition the Director for Representative Outfall Status (ROS). DWQ may grant Representative
Outfall Status if storm water discharges from a single outfall are representative of discharges from multiple
outfalls. Approved ROS will reduce the number of outfalls where analytical sampling requirements apply.
If Representative Outfall Status is granted, ALL out are still subject to the qualitative monitoring
requirements of the facility's permit —unless otherwise allowed by the permit (such as NCGO20000) and DWQ
approval. The approval letter from DWQ must be kept an site with the facility's Stormwater Pollution
Prevention Plan. The facility must notify DWQ in writing if any changes affect representative status.

Outfalls 001. 002,_003. 004, and 005 are mostly used as panting for vehicles awaiting maintenance
or for vehicles that are awaiting pickup after maintenance has been completed. Outfall 006 contains
similar activities to the rest of the outfalls and discharges stormwater from the primate maintenance _
bays and material storage areas, Outfall 006 is more representative of the maintenance _
activities and storage practices occurring at the facility..
5) Certification:
North Carolina General Statute 143-215.6 13(i) provides that:
Any person who knowingly makes any false statement, representation, or certification in any application, record,
report, plan, or other document filed or required to be maintained under this Article or a rule implementing this
Article; or who knowingly makes a false statement of a material fact In a ruiemaking proceeding or contested case
under this Article; or who faisines, tampers with, or knowingly renders Inaccurate any recording or monitoring device
or method required to be operated or maintained under this Article or rules of the (Environmental Management]
Commission implementing this Article shall be guilty of a Class 2 misdemeanor which may Include a fine not to exceed
ten thousand dollars ($10,000).

The Division has reviewed your submittal of the No Exposure Certification for Exclusion from NPDES Stormwater
Permitting form, which we received on September 16, 2009. The Division is unable to concur with your certification of
no exposure.
Based on an inspection of your facility on October 15, 2009 during a rain event, Mooresville Regional Office staff found
that industrial activities or materials on your site either are exposed, or have the potential to be exposed. DWQ cannot
grant your requested exemption from permit coverage when industrial activities or materials are exposed or have the
potential to be exposed. Please continue to operate under the General Permit NCG080000.

On.May 8, 2009, Ms. Marcia Allocco from the Mooresville Regional Office of the Division of Water Quality,
conducted a site inspection of the Mecklenburg County Fleet Management facility located at 900 West 121n
Street in Charlotte, Mecklenburg County, North Carolina. The, site drains to Irwin Creek, Class C waters
located in the Catawba River Basin. The site visit and file review revealed that the subject facility is covered by
NPDES Stormwater General Permit — NCG080000.
Accordingly, the following observations were noted during the Division of Water Quality inspection (please see
the attached addendum for information about your permit):
1) Stormwater Pollution Prevention Plan (SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has been developed, .recorded, and properly implemented.

However, as noted in the SPPP section of.the attached report those individuals responsible for the various parts
of the stormwater program at the facility need to be documented in the plan and the contact information for the
permit needs to be updated with the Division of Water Quality.

As noted in the Analytical Monitoring section of the attached report the permittee should consider vegetating
those outfalls with soil/sediment bottoms to reduce the chance of false benchmarks exceedances of total
suspended solids and/or facilitate ponding of stormwater during sampling events to obtain representative
samples.
4) Permit and Outfalls
As noted in this section of the attached report the Certificate of Coverage was not available at the facility. A
copy of the transmittal letter for your coverage under the general stormwater permit is attached. An additional
outfall was identified during the inspection, which should be added to the qualitative and analytical monitoring
at the facility. Finally, the permittee needs to review the Signatory Requirements of the permit and ensure all
documentation regarding the permit (permit application, Discharge Monitoring Reports, illicit discharge
evaluations, etc.) adheres to these requirements.
Thank you for the assistance and cooperation during this inspection. Please be advised that violations of the
NPDES General Permit are subject to a civil penalty assessment of up to $25,000.00 per day for each

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES'perrhitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
stormwater pollution prevention plans (SPPP). These plans are required to include a comprehensive evaluation
of the site and operations to reduce pollutant sources and prevent pollutant discharge.

The following items are a subset of permit requirements and are listed to assist you and help bring your'
attention to certain permitting issues, process and condition requirements of your permit. That said, please see
the above mentioned'web site in order to obtain a copy of the permit such that you may fully comply with all
the conditions therein. Failure to properly comply with conditions of the permit, like those bulleted below,
constitutes violations and are subject civil penalty assessment of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (D WQ) by the filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of
Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the
General Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or
mine dewatering pursuant to the type of General Permit until the permit expires or is modified or
revoked.
• Any other point source discharge to surface water of the state is prohibited unless it is an allowable non-
stormwater discharge or is covered by another permit, authorization or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have following condition requirements (you must read your entire permit to ensure full
compliance):

o Records — Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on -site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of least 5 years for the date of the sample measurement, report or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to expiration date. Any permittee that has not requested renewal at
least 180 days prior to expiration, or any permittee that does not have a permit after the
expiration and has not requested renewal at least 180 days prior to expiration, will be subject to
enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water Act.
The Permit is NOT transferable.
o Name Change, Closure or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes required you to complete a
Name/ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

Inspection Summary:
The Fleet Management facility repairs vehicles used by Mecklenburg County employees in the completion of their work
duties The City of Charlotte took over operation of the facility in 2008 but the propertylbuilding is still owned by the
County. The County is still responsible for providing the resources needed to ensure the facility maintains compliance
with the permit.
Mr. Andrew Martin and Mr. Richard Farmer of the Mecklenburg County Water Quality Program accompanied the inspector
during the inspection. The inspector also spoke with Terry Hilton and Richard Laird with the City of Charlotte at the
facility. Mr. Laird was asked to ensure that the spill absorbent (Speedi-dri) that was observed near the fueling island in
the front of the facility and the spill absorbent applied to the antifreeze spill during the inspection were disposed of
properly.

audit by MCWQP. Bulk storage of liquids on site consists of underground storage tanks
and storage within the facility. The permittee should ensure in the planned update to the
SPPP that all BMPs active at the facility are documented (berm around the vehicle wash
area and street sweeping to reduce TSS in stormwater discharges. The SPRP and
SPPP should spell out the responsibilities of Mecklenburg County (including LUESA)
and City of Charlotte personnel in implementing the SPPP (spill response, training,
sampling, plan updates, etc.). The plan currently notes only the responsibilities of Mr.
Leon Miller who no longer is employed at the facility. Training documentation reviewed

Comment: Analytical monitoring was last completed in April 2009. Sampling in
October 2008 (Outfalls 3, 4, and 5) and December 2008 (Outfalls 1 and 2) resulted in an
exceedance of a benchmark concentration. Outfall 2 had elevated TSS results (190
mg/L) compared with the general permit benchmark concentration of 100 mg/L.
Corrective actions of sweeping the parking lot brought the concentration below
benchmarks in April 2009, However, Outfall 3 was slightly above the benchmarks in
April 2009. The permittee should explore vegetating all outfalls which currently have
soil/sediment bottoms and pooling water with sand bags to avoid entraining sediment in
future analytical samples.

all permit required documentation (DMRs, illicit discharge evaluations, annual updates,
etc.) and this delegation of signature authority from the County Board of Commissioners
is documented in the SPPP.
The permittee had identified five outfalls at the facility but an additional outfall was
identified during the inspection due to the proximity of surface waters. The inspector
had discussed with Mr. Martin and Mr. Farmer only conducting analytical monitoring at
"Vehicle Maintenance" outfalls (#1, 2, 3, and newly identified outfall). However, a

requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983,
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Permit NCG080000
• A copy of a Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obfigations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all
the changes in the reissued permit.
The more significant changes in the General Permit since your last Certificate of Coverage include the following:
• Part I Section A - A new notation that the No Exposure Exclusion from permitting option may be available to the
permittee.
• Part I Section A - A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL,
may not be eligible for renewed coverage under the General Permit.
• Part 11 Section B Table 1 - An increased sampling frequency from once per year to twice per year.
• Part II Section B Table 3 - Benchmark concentrations now replace cutoff concentrations; the elimination of the option to
avoid sampling based on cutoff concentrations.
• Part 11 Section B - New provisions requiring the permittee to execute Tier One and Tier Two response actions, based on
the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two
requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive
monitoring events show no benchmark exceedences.
• Part 11 Section B - A new provision that four exceedences of any particular benchmark will trigger increased DWQ
involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for
an individual permit, or may direct the implementation or installation of specific stormwater control measures.
DWQ received a number of comments on a series of general permits similar to this one. A full response to comments can be
found at http://ncwaterquality.org/su/industriaigpinio.him. Some comments resulted in permit modifications, others are
addressed in the response document or Fact Sheet. A few specific requests for clarification are addressed below.
1. What is the deadline for having a revised SPPP that reflects the provisions of the new General Permit? DWQ will require
that the permittee have a revised, complete SPPP no later than six months after the date of issue of that permittee's new
Certificate of Coverage.
2. Must analytical results be by a certified lab? What about phi measurements? All analytical results obtained to satisfy
NPDES permit requirements must be certified, as directed in North Carolina regulations at 15A NCAC 2H .0800, and as
administered by DWQ's Laboratory Section Certification Branch. This includes field pH measurements.

The fleet management facility located at 900 West 121h Street in Charlotte, NC currently
has Certificate of Coverage # NCGO80063 for NPDES General Stormwater Permit
NCG080000. The City of Charlotte took over management and operation of that facility
from Mecklenburg County in duly 2008 of this year. We have continued to operate in
compliance with the general permit.
As the person who manages municipal stormwater pollution prevention and good
housekeeping for the City of Charlotte, I am writing on behalf of the 12`h Street facility
and the City of Charlotte to request that the Certificate of Coverage be rescinded. First of
all, I believe the facility did not originally fall under the general permit it was issued
since its SIC code is not one of those listed in the permit (40, 41, 42). Rather, it is a
vehicle maintenance facility, which generally falls under SIC Major Group 75. Under
Major Group 75, the following direction is provided: Similar facilities owned and
operated by concerns for their own use and not for the general public are treated as
auxiliary establishments. According to the SIC system, auxiliary establishments are
treated as follows: those establishments primarily serving other establishments of the
same enterprise are classified in the industry of the establishments served. Since the fleet
management facility services and maintains government vehicles for "our own use and
not the general public" and services other establishments (i.e., other departments) of the
same enterprise (i.e., all local government), then it clearly is an auxiliary establishment.
The facility services mainly light -duty vehicles. The "industry of the establishments
served" varies, and includes, but is not limited to, the following SIC codes. None of the
SIC codes require an NPDES General Stormwater permit:

MS4 permit. One of the required permit programs is Municipal Pollution Prevention and

benchmarrk concentration of 100 mWL. Corrective actions of sweeping the parking lot brought
the concentration below benchmarks in April 2009. However, Outfall 3 was slightly above the
benchmarks in April 2009. The permittee should explore vegetating all outfalls which currently
have soil/sediment bottoms_ and -goofing water with sand bags to avoid entraining sediment in
future analytical samples.

on August 31, 2002. The Division staff is currently in the process of' rewriting this Permit and is scheduled 10 have

continued coverage under the reissued Permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water

Your facility is currently covered for storntwater discharge under General Permit NCG080000. This permit expires
on August 31, 2002. The Division staff is currently in the Process of rewriting this permit and is scheduled to have
[lie permit reissued by late summer of 2(H)2, Once the permit is reissued, your facility would he cligihlc for
continued coverage under the reissued permit.
In order io assure your continued coverage under the general permit, you must apply to the Division of Water
Qualily (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will he expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must he completed and relurned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within [his time period may result in a civil assessment of al least $250.00. Larger
penalties may he assessed depending on the delinquency of the request. Discharge of su}rntwater from your facility
without coverage under a valid storrttwaler NPDES permit would constitute a violation ctf NCGS 143-215.1 and
could result in assessments cif' civil penalties of up to $10,0 fit} per day.
Please note that recent Icderal legislation has exlended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "storm water discharges associated with industrial activity," (except

unacceptable to you, you have the right to request an individual permit by submitting an individual permit
