The Application provides adequate assurance that the discharge of fill material into the waters of a tributary of Sapony Creek in conjunction with the proposed Woodfield Section Two in Nash County will not result in a violation of applicable Water Quality Standards and discharge guidelines. Therefore, the State of North Carolina certifies that this activity will not violate Sections 301, 302, 303, 306, 307 of PL 92-500 and PL 95-217 if conducted in accordance with the application and conditions hereinafter set forth. Condition(s) of Certification: 1. That the activity be conducted in such a manner as to prevent significant increase in turbidity outside the area of construction or construction related discharge (increases such that the turbidity in the Stream is 25 NTU's or less are not considered significant). 2. Project design shall be as shown on your map (11/11/91 revision) and letter of 11 November 1991. 3. Stormwater shall be directed to sheetflow into existing wetlands on the site rather than directly discharged into the creek. Special design will be done to ensure that as much stormwater as possible enters the area of lots 3, 4, 5, 6, 18 and 20 (Section C). I cannot approve the design since significant wetland uses (primarily water quality protection and wildlife habitat) would be removed and practicable alternatives appear to exist to the design. In addition, plans for stormwater treatment on the site (i.e., curb and gutter with diversion via a stormwater sewer directly to the creek) will result in impairment of water quality in the WS-III stream. Therefore, if the design is not modified, I will recommend that the Director deny this 401 Certification. Modifications which can make this plan acceptable are: 1) Adequate treatment of stormwater to include sheet flow through the existing wetlands before reaching the creek, 2) Avoidance of fill in the bulb-shaped wetland area in the center of the property, immediately downstream of this area along the existing sanitary sewer alignment, and the area nearest SR 1700. The wetlands are low-value and narrow. It is felt that minimal impact will result. Recommend a 401 be issued. 2. Braswell Property- subdivision: this project proposes to impact 2.4 acres of wetlands. The wetlands are low-value and adjacent to an intermittent tributary of Cokey Swamp (class C- NSW). The design calls for a 50 foot buffer to be maintained in natural topography and vegetation. This should be an adequate water quality buffer given the flat topography in the area. The plat must call for deed restrictions along this line. The deed restriction shall not allow impervious surfaces or fill to occur in this area. In addition, the subdivision should be planned with no curb and gutter so that stormwater is not outletted to the drainageway. Stormwater must be dissipated slowly to the wetlands area or other suitable feature before discharge to the drainageway. The RRO recommends issuance of a 401 certification for this project with the above restrictions. 3. Woodfield Subdivision- The engineer sent two sketches of proposed wetlands impact. Sketch A has 5.2 acres of impacts. Sketch B has 2.9 acres of impact. The additional impacted area for sketch A consists of the more valuable wetlands on the property. Plan B was recommended to the engineer and the following comments are based on that plan. Most of the wetlands impact will be through the center of the subdivision and draining towards the southeast portion of the lot. 11 lots are projected to be filled. I recommended to the enginner to preserve as deed restricted wetlands the central portion of this area- which will be a lOa-foot wide strip surrounding ~ -- , the channel of the drainageway. This water will need to be piped under the proposed street and dissipated either slowly into the wetlands or into a stormwater detention system. This strip may narrow to about 50 feet wide at its intersection with the road. In addition, it is recommended to avoid curb and gutter design on the subdivision. The project will be approvable once plans are resubmitted showing the restricted use of this wetland area. I have contacted the engineer and pLans will be sent in to reflect these changes. NC 27803 Dear Mr. Stocks: You have our approval to place fill material in 0.29 acres of wetlands or waters for the purpose of constructing a residential development at Woodfield Subdivision, as you described in your application dated 20 August 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Applicant is urged to retain at least a 50 foot forested buffer along the stream/ditch at the property line and to sheetflow stormwater into that area. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. The total amount of site wetlands, pre-construction was 0.38 acres. An area of 0.02 (20' x 50') acres has already been disturbed which leaves an amount ot 0.36 acres. The area along the back portion of lot 22, behind the sewer/utility easement is not planned for disturbance, a total of 0.09 acres (4000 SF). Therefore, the total disturbed wetland area will equal 0.29 acres (0.38 - 0.09). Seeing that the total amount of disturbed wetland is less than 0.33 acres we are requesting your approval for site disturbance. Your prompt attention to this matters would be greatly appreciated.
