Sent: Monday, May 18, 2009 12:19 PM To: Krebs, Rob; Allocco, Marcia Cc: Jones, Jennifer M. Subject: NCG070183 DH Griffin Grading - June 18, 2009 Hi Marcia and Rob, We've received an NOI from DH Griffin Grading & Crushing, LLC for their facility in Charlotte (Mecklenburg County) for coverage of their concrete grading and crushing site under NCG07. The site discharges stormwater (and perhaps WW?) into a UT to Dixon Branch Creek (C). The NOI is attached. This is a site that crushes concrete and brick to re -use it They have large chunks of concrete on site and sometimes brick. They crush it and put it on their aggregate pile. They don't mine and they are not making ready -mix concrete on site. They do wet the aggregate pile - and this is considered a wastewater. They say they have a stormwater retention pond but I don't have any specs for that If you think it's a problem I can ask for it They are not draining to a water supply so that's good. As far as vehicle maintenance goes - they are doing it They have marked on their NOI that they don't have haz waste but I assume they have oil? - but they haven't said anything about that. From what Susan Land (their consultant) said they have put things inside and in secondary containment Susan's phone number is 803-400- 0056. Jeff Pitzer - the onsite manager's phone number is 704-598-6969. I think this facility did not have a permit before - DH Griffin has just bought it and is trying to get all the necessary permits. Could someone at the MRO do a site inspection? I would like, if possible, for someone to check out the aggregate piles they are wetting and the oil storage and disposal scheme, and let me know if they thinkwater from the aggregate piles is going to be a problem. Does the Mooresville Regional Office have any concerns about issuing this facility a COC for this general permit? If we don't receive any objections, we'll issue the COC in 30 days. Thanks guys! Should note in permit letter that wastewater generated from wetting down of aggregate is not covered under this permit. I just want to communicate one little bit more to be sure we will have you in the correct permit. Your description of on -site activities looks somewhat similar to others that we have determined should be covered under NCG020000 rather than NCG070000. I want to be sure of the proper coverage for your industrial activity. 0 The key thing in this determination is: Do you have, or will you have, a mining permit from the Division of Land Resources for this operation in Charlotte? If it does, we issue NCG02, rather than NCG07 that you have applied for. We have issued NCG02 even when there is no actual excavation or stripping going on at the site, contrary to what we might expect in the usual conception of "mining". I note also that the SIC category that your report on the application, SIC *429, is part of Major Group 14, "Mining and Quarrying of Nonmetallic Minerals, Except Fuels." We typically expect to sue NCG02, not NCG07, for industries in Major Group 14. Please respond to this email, or voice -to -voice at (919) 807-6376.
