Dear Mr. Yates:
On May 22, 2013 Andrew Martin from Charlotte -Mecklenburg Stormwater Services (CMSWS), conducted a
site inspection of the Yates Wilbert Vault Company facility located at 2839 Rosemont Street in Charlotte,
Mecklenburg County, North Carolina_ The site drains to Taggart Creek, Class C waters located in the Catawba
River Basin. The site visit and file review revealed that the subject facility is covered by NPDES General
Stormwater Permit — NCG070000
This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and
the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part 11 Section H. The following observations were
noted during the Charlotte -Mecklenburg Stormwater Services inspection (please see the attached addendum
for information about your permit):
1) Stormwater Pollution Prevention Plan (SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has been developed, recorded, and properly implemented.

was well developed and implemented and this Office commends the permittee's efforts to ensure compliance
with your NPDES permit -
However, as noted above and in the enclosed report, deficiencies were noted during the inspection and it is
requested that a written response be submitted to this Office by July 26, 2013, addressing these deficiencies.
In responding to the violations, please address your comments to the attention of Ms. Allocco at the letterhead
address.
A follow-up evaluation will be conducted by CMSWS after September 24, 2013, to ensure compliance with the
facility's Stormwater Permit and/or compliance with the City of Charlotte Stormwater Ordinance.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina, The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge.

discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES
General Stormwater Permit] can be found on this website.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. Please see the
above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of
the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day.
• Industrial facilities that fall into one of the. subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):

o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable)
o Records -- Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan_ Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration elate of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to the expiration date. Any permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the expiration and has not requested renewal at least 180 days prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation.
o Transfer --- The Certificate of Coverage (COG) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary Lander the Clean Water
Act. The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes require you to complete a
Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

Inspection Summary:
Facility Description:
Yates Wilbert Vault Company manufactures vaults and delivers the finished product to cemeteries. The vaults are
manufactured indoors and not exposed to stormwater.
Compliance History:
The facility was last inspected by Charlotte -Mecklenburg Stormwater Services (CMSWS) on May 2, 2008. The report was
issued as a Notice of Violation by the Division. A follow-up inspection found the facility to be in compliance.
Industrial Operations/City of Charlotte Stormwater Ordinance Review:
Illicit discharges/connections —
During the inspection oil was observed on the ground at the front of the manufacturing building near the mixing machine.
The spill is not in an area that can impact stormwater. The discharge of oil onto the ground surface is prohibited under the
City of Charlotte Stormwater Ordinance and should cease immediately. The perrnittee should restore the affected area to
pre -discharge conditions and educate employees on proper disposal techniques.
Aboveground storage tank(s) —
A 500-gallon diesel tank with double walled secondary containment is located on site. The tank is not properly labeled.
Please properly label the tank with its contents.
Outdoor material storage area(s) —
Sand and gravel used for making concrete are stored outdoors until its ready to be used. The stockpiles are not covered
and are exposed to stormwater. It is recommended that the piles be covered with a tarp when not in use to prevent
exposure to stormwater. Freshly sealed concrete vaults are also stored outside until the paint is dried.
Vehicle/equipment area(s) -.
A tractor and other diesel vehicles are fueled on site at the diesel fuel tank Vehicles and equipment are maintained and
washed at an off -site location.
Indoor Material storage area(s) --
A 350-gallon tote of form oil and several 55-gallon drums of sealant are stored in a material storage room. The drums
were stored on the ground surface which can be subject to flooding during heavy rains. It is recommended that the drums
be placed on spill pallets to prevent leaks and spills from interacting with the stormwater and to elevate the drums off the
ground to prevent contact with water,
Indoor processing areas --
Vaults are formed, cured, sealed and painted indoors.
Floor drains —
The facility has a sump area that collects the water used in the concrete mixing process. The collected water is then
reused in the manufacturing process.

discharges via three outfalls, no problems were detected. The non-stormwater

RE: Stormwater Sample Results Provided September 17, 2008
Dear Ms. Allocco:
The purpose of this letter is to respond to your September 17, 2008 correspondence to Yates Wilbert Vault
Company (NPDES stor nwater permit: NGG070082). A copy of this correspondence is enclosed for
reference. We have several concerns regarding North Carolina Division of Water Quality (DWQ) findings.
Stormwater Sampling
We believe that the monitoring results obtained are not representative of conditions at the facility. The
location where the grab samples were collected receives significant run-on from the street and industrial
facilities located up -slope (please refer to the attached map: Local Drainage Features). Several of these
facilities are known hazardous waste sites. Additionally, it is also our understanding from the plant owner
who was present at the time of sampling that the grab samples were not collected using standard protocol
(i-e., sampling bottles were dragged across the ground surface when being filled).
Receiving Waters
We also believe that the waterbody receiving discharges from the facility is not Sugar Creek. Upon review
of topography and municipal separate storm sewer system (MS4) data it would appear that the facility
discharges to an unnamed tributary of Taggart Creek (please refer to the attached maps: Regional
Drainage Features, Regional Waterbodies).
I am concerned that the conditions noted in your letter inaccurately categorize the facility and may
undeservedly obligate it to comply with additional procedures and requirements or apply for coverage under
an individual storm water permit- To prevent this from happening, I ask that DWQ and the MS4 operators
review records to identify and correct any possible actions that may be triggered by these inaccuracies. I
also ask that DWQ clarify which stream (Taggart Creek or Sugar Creek) it considers to be the ultimate
receiving water for discharges from the facility to provide guidance for TMDL compliance.

Enclosed are the monitoring results fmm the laboratory analyses performed on the
discharge from Stormwater Outfall 001 at the subject facility_ The samples analyzed were grab
samples collected during the sampling investigation performed on .July 8, 2008, by Ms. Aliyah
Turner and Ms. Erin Hall of Charlotte -Mecklenburg Storm Water Services (CMSWS). This
sampling investigation was conducted as part of a cooperative working agreement between
Mecklenburg County and the Division of Water Quality. In addition, the sampling investigation
was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit,
NCS000240, Part ll Section H.
The enclosed monitoring results indicate that the stormwaTer discharged on July 8, 2008,
contained elevated concentrations of total suspended solids, oil and grease, and pWcompared
with the benchnwk values contained in Stormwater General Permit NCO070000 and your
Certificate of Coverage under this permit_ In addition, there were elevated concentrations of
turbidity, chemical oxygen demand, lead, and zinc in the stormwater discharged from your
facility into Sugar Creek.
Sugar Creek is currently listed on the North Carolina 303(d) list of impaired waters and
has T_MDLs in place for fecal coliform, dissolved oxygen, and turbidity_ As noted in fart I of
your general permit, facilities which discharge stormwater into 303(d) impaired waters may be
required to demonstrate at permit renewal that they do not have a reasonable potential to violate
applicable water quality standards for such pollutants due to the stormwater discharge(s) on site.
Through the development and implementation of stormwat.er management programs it is the
Division of Water Quality's expectation that tine stormwater discharges at industrial sites covered
by NPDES starmwater permits do not impact receiving waters.
Please review the requirements of your starmwater permit and take the required
steps/actions to reduce the concentration of the aforementioned pollutants leaving your site_

Enclosed are the monitoring results from the laboratory analyses performed on the
discharge from Stormwater Outfall 001 at the subject facility. The samples analyzed were grab
samples collected during the sampling investigation performed on July 8, 2008, by Ms. Aliyah
Turner and Ms. Erin Hall of Charlotte -Mecklenburg Storm Water Services (CMSWS). This
sampling investigation was conducted as part of a cooperative working agreement between
Mecklenburg County and the Division of Water Quality. In addition, the sampling investigation
was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit,
NCS000240, Part II Section H.
The enclosed monitoring results indicate that the stormwater discharged on July 8, 2008,
contained elevated concentrations of total suspended solids, oil and grease, and pH,compared
with. the benthmark values contained in Stormwater General Permit NCG070000 and your
Certibcate of Coverage under this permit. In addition, there were elevated concentrations of
turbidity, chemical oxygen demand, lead, and zinc in the stormwater discharged from your
facility, into Sugar, Creek.
`-~ Sugar Creek is currently listed on the North Carolina 303(d) list of impaired waters and
�to)TMDLs m"" lace for fecal coliform, dissolved oxygen, and turbidity. As noted in Part I of
yggt��general.permit, facilities which discharge stormwater into 303(d) impaired waters may be
required to demonstrate at permit renewal that they do not have a reasonable potential to violate
applicable water quality standards for such pollutants due to the stormwater discharge(s) on site.
Through the development and implementation of stormwater management programs it is the
Division of Water Quality's expectation that the stormwater discharges at industrial sites covered
by NPDES stormwater permits do not impact receiving waters.
Please review the requirements of your stormwater permit and take the required
steps/actions to reduce the concentration of the aforementioned pollutants leaving your site.

Enclosed is a copy of the Follow-up Compliance Evaluation Inspection (CEI) report for
the inspection conducted at the subject facility on July 22, 2008, by Ms. Aliyah Turner. of
Charlotte -Mecklenburg Storm Water Services. This inspection was conducted as part of a
cooperative working agreement between Mecklenburg County and the Division of Water
[duality. In addition, the inspection was conducted on behalf of the City of Charlotte in
compliance with the City's NPDES Permit, NCS000240, Part H Section H. Thank you for your
assistance and cooperation during the follow-up inspection.
The follow-up inspection found that Yates Wilbert Vault Company has implemented the
corrective actions as stated in the subject facility's response letter dated June 11, 2008. The
corrective actions include:
• Construction of an easement in front of the manufacturing building to minimize
stormwater from entering the building,
• Ceasing the discharge of paintbrush washwater on the ground,
• Excavation and restoration of the oil impacted area outside the manufacturing
building,
• Proper labeling of the form oil tank,
• Creation and implementation of the Stormwater Pollution Prevention Plan (as of
September 2008), and
• Providing cover (canopy) and staging absorbent material near the air compressor
(leaky head gasket) to immediately abate any oil released.

Inspection Summary:
Facility Description:
Yates Wilbert Vault Company manufactures vaults and delivers the finished product to cemeteries. The vaults are
manufactured indoors and not exposed to stormwater. The facility also conducts painting, steel cutting, concrete mixing
and pouring, and vehicle washing on site. The facility has a water recycling system on site.
Compliance history:
The Yates Wilbert Vault facility was inspected by Ms. Aliyah Turner and Ms. Heather Sorenson of Charlotte -Mecklenburg
Storm Water Services (CMSWS) on May 2, 2008. A Notice of Violation was issued by the Division of Water Quality on
June 20, 2008.
The following information was found in the Charlotte -Mecklenburg Storm Water Services (CMSWS) files.
In August 2003, CMSWS personnel conducted an on -site investigation at Yates Wilbert Vault Company of the discharge
of residual concrete from molds and equipment into a ditch at the rear of the facility. The facility installed a water reuse
system to correct the problem.
Industrial Operations/City of Charlotte Stormwater Ordinance Review:
The initial stormwater inspection conducted on May 2, 2008 by Ms. Aliyah Turner and Ms. Heather Sorenson of CMSWS
identified several issues. Two prohibited discharges were observed during the inspection including oil on the ground
outside the manufacturing building and a water/paint puddle from the cleaning of paintbrushes. It was advised by
CMSWS staff that the facility should immediately cease all prohibited discharges and restore the affected areas.
Several areas with an increased potential to contaminate stormwater were observed during the inspection including an
uncovered paint bucket, oil leaking from the facility's air compressor, and stagnant water in the manufacturing building
(near paint/adhesive storage). It was advised by CMSWS staff that all chemicals should be properly stored and the
permittee should explore options to minimize the potential for stormwater contamination.
The follow-up stormwater inspection conducted on July 22, 2008, by Ms. Aliyah Turner of CMSWS found that the
permittee has rectified the housekeeping issues sited in the initial inspection report under prohibited discharges. The oil
staining on the ground outside of the manufacturing building has been excavated and restored with dirt and the permittee
immediately ceased the cleaning of paintbrushes outside. In addition, the permittee has constructed an easement to
restrict stormwater from entering the manufacturing building.
The head gasket has not been fixed on the facility's air compressor but the leakage of oil is nominal and has not reached
the ground surface. However, the facility should fix the head gasket to prevent a significant leak from occurring and
possibly contaminating stormwater.

Certificate of Coverage under this permit. In addition, there were elevated concentrations of
turbidity, chemical oxygen demand, lead, and zinc in the stormwater discharged from your
facility into Sugar Creek.
Sugar Creek is currently listed on the North Carolina 303(d) list of impaired waters and
has TMDLs in place for fecal coliform, dissolved oxygen, and turbidity. As noted in Part I of
your general permit, facilities which discharge stormwater into 303(d) impaired waters may be
required to demonstrate at permit renewal that they do not have a reasonable potential to violate
applicable water quality standards for such pollutants due to the stormwater discharge(s) on site.
Through the development and implementation of stormwater management programs it is the
Division of Water Quality's expectation that the stormwater discharges at industrial sites covered
by NPDES stormwater permits do not impact receiving waters.
Please review the requirements of your stormwater permit and take the required
steps/actions to reduce the concentration of the aforementioned pollutants leaving your site.

Enclosed is a copy of the Compliance Evaluation Inspection (CEI) report for the :.
inspection conducted at the subject facility on May 2, 2008, by Ms. Aliyah Turner and Ms.
Heather Sorenson of Charlotte -Mecklenburg Storm Water Services. This inspection was
conducted as part of a cooperative working agreement between Mecklenburg County and the
Division of Water Quality. In addition, the inspection was conducted on behalf of the City of
Charlotte in compliance with the City's NPDES Permit, NCS000240, Part 11 Section H. Thank
you for your assistance and cooperation during the inspection.
This report is being issued as a Notice of Violation (NOV) due to the permittee's failure
to properly develop and implement the required Stormwater Pollution Prevention Plan in
violation of the subject Stormwater Permit and North Carolina General Statute (G.S.) 143-215.1,
as detailed in the Stormwater Pollution Prevention Plan, Permit and Outfalls, and Industrial
Operations/City of Charlotte Stormwater Ordinance Review sections of the enclosed report.
Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars
($25,000.00) may be assessed against any person who violates or fails to act in accordance with
the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1.
It is requested that a written response be submitted to this Office by July 11, 2008,
addressing the above -noted violations in the enclosed report. In responding to the violations,
please address your comments to the attention of Ms. Marcia Allocco at the letterhead address.

Inspection Summary:
Facility Description:
Yates Wilbert Vault Company manufactures vaults and delivers the finished product to cemeteries_ The vaults are
manufactured indoors and not exposed to storrnwater. The facility also conducts painting, steel cutting, concrete mixing
and pouring, and vehicle washing on site. The facility has a water recycling system on site.
Compliance history:
The permittee/facility does not have any prior compliance issues with the NC Division of Water Quality and the following
information was found in the Charlotte -Mecklenburg Storm Water Services (CMSWS) files.
In August 2003, CMSWS personnel conducted an on -site investigation at Yates Wilbert Vault Company of the discharge
of residual concrete from molds and equipment into a ditch at the rear of the facility. The facility installed a water reuse
system to correct the problem_
Industrial Operations/City of Charlotte Stormwater Ordinance Review
Air Compressors —
The facility's air compressor was located outdoors under canopy. According to facility personnel, the facility's air
compressor had a blown head gasket causing the compressor to leak oil. The facility should explore options to ensure
leakages of oil do not reach surface waters.
Prohibited Discharge -
During the inspection, a puddle of water and paint was observed. According to Mr. Dan Yates, employees at the facility
purposely made a puddle of water on the ground surface to clean out paint brushes. This is a prohibited discharge and
should be discontinued immediately.
Manufacturing Building -
During the inspection oil was observed on the ground outside a door in the back of the manufacturing building. This
location is also documented as an outfall by the facility_
The facility MUST immediately stop all petroleum discharges, which are in violation of G.S. 143-215.75 - Oil Pollution and
Hazardous Substances Control Act'of 1978, The facility MUST evaluate and implement measures to prevent oil and
other pollutants from discharging to the ground and surface waters through stormwater discharges. The permittee shall
restore the petroleum contaminated areas.
Stormwater Flooding -
Stormwater flows into the buildings at the facility in the past. Stagnant water was observed around drums containing
paints and adhesives. According to facility personnel the water is not pumped out of the building_ The facility should
consider monitoring of this area for corrosion and leaks of drums.
Form Oil Tank -
A 500-gallon lank of form oil located outdoors was observed during the inspection. The tank was not labeled and did not
have secondary containment. Labeling should be clearly placed on all tanks.
Paint Bucket - A paint bucket was left outside without cover. The permittee should store all paints in areas that are not
exposed to stormwater.

The purpose of this letter is to respond to the written response request inciuded in NOV-2008-PC-0439 (enclosed) for
Yates Wilbert Vault Company of Charlotte, North Carolina.
Comments are as follows:
Air Compressors - The air compressor does have a leaky head -gasket, however the amount of oil being discharged is
nominal. Dust accumulates around the leak and no oil is being deposited on the ground below.
Prohibited Discharge - At the time of the inspection, an employee had washed out a paint brush in the identified puddle
(the paint in use is water-soluble latex). This was a one-time occurrence, employees have been advised on the correct
procedure for cleaning paint brushes -
Manufacture Building - The material observed on the ground outside the manufacturing building was oil -entrained
sweepings from the manufacturing area (form oil is sprayed on product forms and is absorbed by dust on the floor).
Employees had mistakenly swept the oil -entrained dust out the door in the back of the manufacturing building, This
accumulated material has been removed and disposed of properly; employees have also been instructed in the correct
procedure for disposing of swept materials.
Stormwater Flooding-Stonnwater flows do enter the front door of the building during major storm events. The area in
front of the building will be regraded to correct the problem. Material storage drums are not located in this section of the
building. Rainwater does accumulate on drums stored outdoors but these drums are sealed and located outdoors for
maximum of two (2) months.
Form Oil Tank - The form oil tank is in the process of being removed from the facility; this wilt occur during the next three
(3) months. In the meantime, the permittee will label the tank with content and hazard information
Paint Bucket -- The facility uses water -based latex paint outdoors (it is applied to the exterior of manufactured products);
uncovered paint application buckets are not stored outside. The bucket observed by the inspector was used that morning
and had not been put away yet.
The pefmittee will continue to take all reasonable steps to minimize or prevent any discharge in violation of the general
permit. Additionally, the Storm Water Pollution Prevention Plan (SWPPP) for the facility is being updated to include the
additional outfall requested by NCDWQ. The updated SWPPP will be available for review at the facility after
approximately August 1, 2008

This letter is in response to the Notice of Violation at Yates
Wilbert Vault Company.
We have changed our practice with the wash down of our
concrete mixer. We no longer discharge any water outside from our
clean up process. The water is filtered and caught in a catch basin,
buried in the floor of our Production Department. The water is then
pumped back in to the concrete mix the following day. This recycling
process eliminates the wastewater that was the cause of this violation.

Chapter 143, Article 21 of the North Carolina General Statutes (G.S.) authorizes and
directs the Environmental Management Commission of this Department to protect and preserve
the water resources of the State. The Division of Water Quality has the delegated authority to
enforce adopted pollution control rules and regulations_
On August 18, 2003, Mark Popinchalk and Jeff Price of the Mecklenburg County Water
Quality Program (MCWQP) conducted an investigation of the Yates Wilbert Vault Co. facility
property located at 2839 Rosemont Street in Charlotte, N.C. This investigation was conducted as
part of a cooperative working agreement between Mecklenburg County and the Division of
Water Quality. As a result of this investigation, the following condition was found on the
property in violation of G.S. 143-215.1(a):
Discharge of process wastewater and solids to the ground.
Be advised that G.S.143-215.6A provides for a civil penalty assessment of not more than
twenty-five thousand dollars ($25,000.00), or twenty-five thousand dollars ($25,000.00) per day
when the violation is of continuing nature, against any person who is required but fails to apply for
or to secure a permit required by G.S. 143-215.1. Penalties may also be assessed for any damage to
the surface waters of the State that may result from the unpermitted discharge. You will be advised
of any enforcement recommendation.

Jeff Price and I, Mark Popinchalk, of the MCWQP, investigated the Yates Wilbert Vault Co. We spoke with Mr. Robert Yates,
Vice President, and informed him that we received an anonymous complaint that the Yates Wllburt Vault Co. was discharging
a white liquid from the facility. Mr_ Yates showed us a discharge and stated that the Company had a permit to discharge the
wastewater. The discharge resulted from washing residual concrete from molds and equipment. The wastewater was being
discharged onto the ground into a ditch at the rear of the facility. There was an accumulation of concrete solids in the ditch. I
informed Mr. Yates that I would like to have a copy of the permit. Mr. Yates said that he would fax me the permit.

did not cover the wastewater discharge from the Company.

1 contacted Mr. Dan Yates, President of the Company and explained to him that the NPDES general permit did not allow the
Company to discharge wastewater and that the discharge was illicit. I explained to him that in order to discharge the
wastewater, he would have to obtain an individual permit for the facility. I told Mr. Dan Yates to call Mike Parker of the MRO
for more information.

on March 31, 2003. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by early spring of 2003. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit coverage will be expiring. Enclosed you will find a Permit Coverage Renewal
Application Form. The application must be completed and returned by October 2, 2002 in order to assure
continued coverage under the general permit. Due to staff and budget constraints, letters confirming our receipt of
the completed application will not be sent.
Failure to request renewal within the time period specified, may result in a civil assessment of at least $250.00,
Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your
facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1
and could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "storm water discharges associated with industrial activity," (except
construction activities). ff you feel your facility can certify a condition of "no exposure", i.e. the facility industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional
