This permit is reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended). Please review the new permit to familiarize yourself with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the permit to update your current SPPP to reflect all new permit requirements. The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable, report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part 11 of your permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this permit and do not count prior exceedances. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections 6, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other analytical monitoring requirements. • Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in separate on -site records if your General Permit does not require an SPPP. The grab samples were collected during the sampling investigation performed by Jeff Mitchell of Charlotte -Mecklenburg Storm Water Services and included analyses required by your permit and additional analyses of interest in stormwater discharges. This sampling investigation was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part II Section H. The enclosed monitoring results indicate that the stormwater discharged on March 5, 2013, did not contain elevated concentrations (when compared with the corresponding benchmarks) of the parameters monitored in NCG060000. However, elevated concentrations of zinc were detected as compared with the Division's benchmarks developed for this parameter (usually contained in individual stormwater permits; zinc 67 pg/L). Through the development and implementation of stormwater management programs it is the Division of Water Quality's expectation that stormwater discharges at industrial sites covered by NPDES stormwater permits do not impact receiving waters. The NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and operations planning to reduce pollutant sources. Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general stormwater permits in North Carolina. One condition that is applicable to both the general permits and individual stormwater permits is the requirement to develop and implement site -specific comprehensive Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge. Copies of the general permits and accompanying documents can be accessed from the following webpage: http://portal.ncdenr.org/weblwq/ws/su/npdessw#General_Permits_NPDES. Permit text, technical bulletins, discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES General Stormwater Permit] can be found on this website. The following items are a subset of permit requirements and are listed to assist you and help bring your attention to certain permitting issues, process and condition requirements of your permit. Please see the above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein. Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day. • Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general NPDES stormwater permit or an individual NPDES stormwater permit • All persons desiring to have facilities covered by a General Permit must register with the Division of Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees. This Notice of Intent (NOI) must be submitted and a Cefficate of Coverage issued prior to any discharge of stormwater associated with the industrial activity, process wastewater, and/or mine dewatering. • Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked. • Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable non-stormwater discharge or is covered by another permit, authorization, or approval. • There are currently 19 active general permits. Copies of the analytical monitoring results shall also be maintained on site. The Permittee shall retain records of all monitoring information, including all calibration and maintenance records and all original strip -chart recordings for continuous monitoring instrumentation, and copies of all reports required by this general permit for a period of at least 5 years from the date of the sample measurement, report, or application. o Expiration — The permittee is not authorized to discharge after the expiration date of the general permit. In order to receive automatic authorization to discharge beyond the expiration date, the permittee shall submit forms and fees as are required by the agency authorized to issue permits no later than 180-days prior to the expiration date. Any permittee that has not requested renewal at least 180 days prior to expiration, or any permittee that does not have a permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subject to enforcement. Failure to renew your permit is a violation. o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not transferable to any person expect after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the Certificate of Coverage to change the name and incorporate such other requirements as may be necessary under the Clean Water Act. The Permit is NOT transferable. o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the Division in writing in the event the ,permitted facility is sold or closed. The. Division of Water Quality views changes of name or ownership as a modification that requires the Director's approval and reissuance of the permit. The following response includes the cited violations of the permit, and the actions taken to prevent a similar occurrence in the future. Erosion In addition to the erosion at Outfall #S, there was an eroded ditch on the opposite side of the fence adjacent to the wastewater treatment plant effluent. The facility is currently assessing all outfalls at the site for signs of erosion. The facility proposes to address the erosion concerns at Outfall #5 in a project which is scheduled to be completed by June 1, 2012. Housekeeping Issues A moderate oil stain was observed near the facility's wastewater treatment plant The origin of the oil stain is unknown. It is expected that the stain was generated by a service vehicle. The soil has been removed in this area and has been disposed of properly. White staining was observed on the facility's paved road According to facility personnel, a truck accidentally spilled flour onto the pavement and the spill was cleaned, however, residual flour remained on the pavement after the clean-up. Spyqer'slance_ All residual flour has been removed from this area_ In addition, facility personnel have been directed to clean-up all spills immediately and to notify their supervisors. Supervisors have been instructed to perform post clean-up inspections. Two, unopened 10-gallon gallon totes of petroleum were observed on the ground near Outfall #11. No product was observed on the ground surface. Facility personnel removed the totes immediately. This is not an appropriate disposal method The totes have been removed from the area. Employees have been trained to store all oil containers inside. There is no oil exposed to stormwater in this area. Oil staining was observed on the pavement in front of the vehicle maintenance area. The oil stain was removed using Oil-Dri and the contaminated Oil-Dri was disposed of properly. Employees have been trained to perform maintenance activities inside the garage area and not outside. In addition, employees have been instructed to clean up spills and leaks immediately. Illicit Discharges/Disposal A thick oily discharge was observed on the pavement adjacent to the potato scrap dumpster. Facility personnel stated that several old drums were recently moved from the area and the thick covering on the ground was an old tarp; however, afoul odor was present and the affected area had an oily appearance. Previous operating procedures at the Chip Plant included the storage of used oil bins outside in the area adjacent to the potato scrap dumpster. The used oil bins did not have a discharge. However, a small amount of oil residue could be seen on top of the containers. We presume the oil stain observed during the inspection was a result of improper housekeeping and storage of the used oil bins. The area was cleaned on March 16, 2012. Recently implemented procedures require used oil bins to be wiped down prior to storage. The used oil bins are now stored inside a truck located near the Chip Plant and are not exposed to stormwater. In addition, Snyder's-Lance has requested that used oil be removed from the facility on a more frequent schedule. Employees have been trained to store oil inside or in the used oil storage truck. With these new procedures, no used oil will be exposed to stormwater. The facility has established a routine inspection schedule of this used oil area. Snyder's-Lance has defined a long term solution to address the used oil generated at the Chip Plant. The facility proposes to add three 300-gallon used oil storage tanks. The tanks will be stored outside with proper secondary containment. The facility expects the capital project to be completed in three months. Snyders_Lance Page 3 The facility has several ASTs. The tanks appeared to be in good condition with the exception of one diesel tank observed to have a slow, steady leak from the piping. The discharge of diesel fuel to the ground is prohibited During the initial inspection on January 26, 2012, the diesel tank valve was seen with a few drips of fuel on it. While there was evidence of an oil stain on the ground, there was not a puddle formed underneath the valve. The cause of the drip was due to the valve being slightly loosened. The facility submitted a work order to repair the valve and the valve was tightened and retaped on February 1, 2012. Absorbent material was used to clean the area following the March 16, 2012 inspection. The facility has implemented good housekeeping practices including routine inspections to identify and correct findings in a timely manner. Totes of used oil were observed in the loading/unloading area. Oil staining was observed on the outside of the totes and on the pavement. The oil totes were immediately removed as a result of the January 26, 2012 inspection. The oil totes stored on the loading/unloading area did not have a discharge. However, an oil residue could be seen on the outside of the containers. We presume the oil stain observed during the inspection was a result of improper housekeeping and storage of the used oil totes. During the March 16, 2012 inspection, a new tote had been moved outside. The tote was clean and did not have a discharge. The facility has removed all totes stored in this area and has cleaned the oil stain with absorbent material. Employees have been trained to store all oil containers inside. No used oil will be exposed to stormwater. Recently implemented procedures require routine inspections of the used oil area. Snyder's-Lance has defined a long term solution to address the used oil generated at the Bakery. The facility proposes to add two 300-gallon used oil storage tanks. The tanks will be stored inside the Bakery with proper secondary containment. The facility expects the capital project to be completed in three months. The loading/unloading area for sugar andflour lrour was observed to have wet pavement. According to facility personnel, sugar and flour are washed off of the pavement as a routine practice. The sugar and flour discharge observed during the site inspections were from poor housekeeping procedures. The facility has removed all materials stored in this area and has cleaned stains on the pavement. Employees have been trained on proper housekeeping procedures including storage practices and the prohibition of washing down the pavement at the facility. Going forward, sugar and flour remnants are properly removed and disposed of in the trash, where they will not be exposed to stormwater. As required by the permit, the permittee shall implement and document annual employee training for all employees involved in facility operations that can affect stormwater discharges. Stormwater training was performed in 2010 and 2011. However, due to employee transitions the training records are not able to be located. Phase I focuses on site and operations planning to reduce pollutant sources. Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general stormwater permits in North Carolina. The facility operates 24 hours -a -day with three shifts. Compliance History: Charlotte -Mecklenburg Storm Water Services (CMSWS) and the Division of Water Quality (DWQ) personnel inspected the facility in February 2007 and ,tune 2008, which resulted in a Notice of Violation/Recommendation for Enforcement (NOWNRE) for both inspections. However, in each case enforcement was not pursued. In April 2008, CMSWS responded to a cooking oil spill to the storm drain system on site. Industrial Operations/Cfty of Charlotte Stormwater Ordinance Review: Erosion - In addition to the erosion at Outfall #5, there was an eroded ditch on the opposite side of the fence adjacent to the wastewater treatment plant effluent. Housekeeping Issues - • A moderate oil stain was observed near the facility's wastewater treatment plant. The pemrittee should implement good housekeeping practices to prevent spills. When spills occur, the spill should be cleaned using absorbent materials. • White staining was observed on the facility's paved road. According to facility personnel, a truck accidentally spilled flour onto the pavement and the spill was cleaned; however, residual flour remained on the pavement after the clean up. The facility should implement BMPs to ensure truck doors are locked before leaving the facility. • Two, unopened 10-gallon totes of petroleum were observed on the ground near outfall #11. No product was observed on the ground surface. Facility personnel removed the totes immediately. This is not an appropriate disposal method. The facility should properly dispose of totes to minimize the potential for pollutants to reach the stormwater conveyance system. • Oil staining was observed on the pavement in front of the vehicle maintenance area. The facility should clean spills immediately using absorbent materials and place pans underneath leaky vehicles. Illicit Discharges/Disposal - • A thick oily discharge was observed on the pavement adjacent to the potato scrap dumpster. Facility personnel stated that several old drums were recently moved from the area and the thick covering on the ground was an old tarp; however, a foul odor was present and the affected area had an oily appearance. The permittee should remove the old tarp, cease future oil discharges in the area, and properly clean up and dispose of the oil on the ground. • The facility has several ASTs. The tanks appeared to be in good condition with the exception of one diesel tank observed to have a slow, steady leak from the piping. The discharge of diesel fuel to the ground is prohibited. The facility should fix the leak. in addition, the facility should implement good housekeeping practices including regular inspections of the AS Ts to prevent prolonged leaks. • Totes of used oil were observed in the loading/unloading area. Oil staining was observed on the outside of the totes and on the pavement. The facility should implement BMPs to ensure that all used oil is properly stored and not exposed to stormwater. When spills occur, the spills should be cleaned using absorbent materials. • The loading/unloading area for sugar and flour was observed to have wet pavement. According to facility personnel, sugar and flour are washed off of the pavement as a routine practice. Communication was immediately established. Sam Hazzard was the only one on site at this point in time. He was able to locate and remove the manhole cover at approximately 01:05 and confirm the rising water. At approximately 01:11, the manhole began to overflow at a rate estimated of 10 GPM - 15 GPM. I arrived on site a few minutes after. Bakery manger was informed immediately to cease sanitation operations in the plant. Bionomics was contacted immediately to come on site and jet the line to relieve the flow. L&L and Hazmat were called to begin preparing suction trucks for mobilization. Ed Dalsing and I investigated ways to possibly dam the blockage. It was difficult to determine the path of the spillage due to the recent snow fall. As efforts were being made to obtain sand bags to contain the overflow, Bionomics arrived on site at approximately 01:50. At 02:15, the blockage was cleared and flow was reestablished in manhole 4. Sam noted a slug of dough and cracker meal released upstream of the blockage at manhole 5. The level sensors worked properly and informed us immediately of an overflow condition. Had the level sensor not been installed, I believe we would still be overflowing at this time. Mr. Ryan Spidel with Mecklenburg County Government arrived on site on 2/17/14 to investigate the incident. As the snow had begun to recede, it was evident the spill did not leave the property nor reach the stream. Barbara Sifford with NCDENR Mooresville office was briefed on this information. Summary of NOV Violations I was contacted by Ms. Moore on May 5, 2008 and asked that she and you be allowed to visit the Lance facility at 8600 South Blvd for the purpose of reviewing our Stormwater Permit and conducting a site review. This was accommodated that same afternoon. The permit was reviewed and you provided the following feedback as to deficiencies in the way our SPPP plan was written and implemented. 1. Number Outfalls on plan drawing. 2. Place updates (spill events, etc.) in a book with the plan instead of separate sheets. 3. Update Signature. 4. Include feasibility study for trouble areas. S. Include description of sanitation and maintenance program. 6. Document annual training/employee training. 7. Apply for Representative Outfall Status. I communicated that I would have our Environmental Consultant review these changes with me and I would have the changes made to the SPPP plan. This review has taken place and our consultant has begun the reevaluation and modification to our SPPP plan. In addition to #4 and #6 above now being violations on this NOV, you have identified the following additional violations: 8. Illicit discharge of potato water from the peel dumpster on the west side of the chip plant. (Noted on previous inspections) Requested analytical test result not provided to the inspector. 9. Qutfail receiving illicit discharge not identified or monitored in SPPP plan. 10. Housekeeping issue on paved area at the south end of the chip plant. (Noted on previous inspection) Quality. Snack Foods Since 1913 Response to NOV Violations #4 —As stated above and during our meeting, I recognize that our permit requires a feasibility study to be included for areas that may be a potential for surface water contamination. This process will be included in our SPPP plan revision. This plan revision review has taken place and we are currently working with our consultant to update the SPPP plan. The plan update will be completed in September. #6 — As stated in our meeting, we do provide job specific orientation training to employees involved with the handling and disposal of waste and waste oils. I understand this training must be extended to annual training and documentation of the training must be included in the SPPP plan. This will be included in the updated SPPP plan. #8 — We have changed the type of container here to one with no seal. The liquid inherent in this waste can no longer leak to the ground. It is stated in the NOV that analytical test results for this outfall were to be provided to the inspector. May and June produced no representative storm events. (Per NOAA Hourly Precipitation Tables for Charlotte Douglas International AP). Status is complete. #9 - I explained during our review that our current plan was written based on our assumption that we had Representative Outfall Status. Under our prior permit and our assumption of Representative Outfall Status, our SPPP plan stated that we are not required to perform qualitative test on the outfall that you reference in the NOV. This outfall, and any other not included in our SPPP plan will be added to the update and monitored as required. #10 —This area behind the chip plant has been noted on previous inspections as a potential exposure to surface water contamination. It must be noted here that great improvements have been made in this area. This comment was affirmed by Ms. Moore during the recent inspection. We realize that more improvement is necessary to prevent the exposure still present. There are conditions here that will always exist that will expose this area to oils and potato and food wastes. We do clean this area regularly (to be noted in SPPP) and we are striving to find better storage and handling of these wastes (to be noted in feasibility study of SPPP). This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and the North Carolina Division of Water Quality. PERMIT: Lance Inc. holds Certificate of Coverage No. NCG060148, which was issued on September 1, 2002, and will remain in effect for the duration of the Food and Kindred General Permit (NCG060000), expiring on August 31, 2007. The certificate of coverage authorizes the permittee to discharge stormwater associated with industrial activities, to the surface waters of the State or to the Municipal Separate Storm Sewer System, providing that the permittee treats, controls, limits, and monitors the discharge as specified in the permit. RECORDS/REPORTS: A file review was conducted prior to the Lance Inc. inspection. MCWQP performed a previous stormwater inspection of the Lance, Inc. facility on March 27, 2003. MCWQP had also responded to three separate incidents at the Lance facility since 2002. A review of the facility Stormwater Pollution Prevention Plan (SPPP) and related sub plans was conducted during the inspection. All documents maintained by Lance Inc. were well organized and readily available for inspection upon request. Qualitative monitoring reports were current. The Stormwater Pollution Prevention Plan shall be reviewed and updated on an annual basis. FACILITY SITE REVIEW: The facility manufactures snack food products for human consumption and has facilities for local and regional distribution. Lance uses vegetable oils in their production of their snack food products. The facility is located in the 8000 block of South Boulevard. All runoff from buildings and associated parking lots drains into Kings Branch (which is part of the Sugar Creek watershed), a Class C water in the Catawba River basin. Facilities at the site include the main manufacturing plant, potato chip plant, maintenance shop, truck wash, garage and fuel loading station, storage warehouses, and administrative offices. Lance operates an on -site wastewater pre-treatment system that discharges to Charlotte -Mecklenburg Utility's (CMU) sanitary sewer system. Stormwater on the site drains to two active outfalls which discharge to two unnamed tributaries to Kings Branch: Outfall 001: This outfall drains the northern portion of the facility and discharges to a stormwater ditch that ultimately drains to an unnamed tributary to Kings Branch. There was no discharge at the time of the inspection. The outfall appeared clean and in good working condition. Outfall 002: This outfall drains the southern portion of the facility and discharges to an unnamed tributary to Kings Branch. There was no discharge at the time of the inspection. Outfall 002 was designed and constructed to discharge at the top of a hill via a concrete slope drain flume. Over time, this concrete flume has broken up and is no longer functional. Consequently, stormwater draining from Outfall 002 has eroded a gully down the hillside. This represents a violation of Stormwater General Permit NCG060000, which states: • Part III Section C Paragraph 1: Proper Operation and Maintenance. The permittee shall at all times properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by the permittee to achieve compliance with the conditions of this general permit. A potato unloading area is located at the rear of the potato chip plant. A hydraulic lift system empties trailers of potatoes into the facility. Underneath the hydraulic lift platform is a chamber, which contains two hydraulic cylinders and their associated hosing. The two hydraulic cylinders support the lift platform and are anchored within the chamber (Figure 1). Additionally, the chamber contains a drain (Figure 2) that discharges to the storm drainage system as confirmed through recent dye testing by the facility. Hydraulic oil stained the length and concrete base of the cylinders and the floor of the chamber. Potatoes and dirt were observed littering the floor of the chamber. The permittee is required through the development and implementation of a Stormwater Pollution Prevention Plan to identify potential sources of pollution and to describe the methods by which the facility will reduce the amount of pollutants carried in the discharging stormwater to maintain compliance with the permit. NOV-2007-PC-0169 Mecklenburg County This represents a violation of Stormwater General Permit NCG060000, which states: • Part III Section C Paragraph 1: Proper Operation and Maintenance. The permittee shall at all times properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by the permittee to achieve compliance with the conditions of this general permit. The oil reservoir for the hydraulic lift platform is situated adjacent to the underground chamber (Figures 3 and 4). The ground around the base of the reservoir was stained with oil. During a previous site visit on November 10, 2006, Lance personnel were advised to remove the contaminated soil and backfill with clean material, and to repair any leaks causing the oil accumulation. On February 15, 2007, it appeared that no remediation had been performed and no documentation was present to indicate remediation had occurred. This represents violations of the Oil Pollution and Hazardous Substances Control Act, which states: • North Carolina General Statute 143-215.83(a) Unlawful Discharges. It shall be unlawful, except as otherwise provided in this Part, for any person to discharge, or cause to be discharged, oil or other hazardous substances into or upon any waters, tidal flats, beaches, or lands within this State, or into any sewer, surface water drain or other waters that drain into the waters of this State, regardless of the fault of the person having control over the oil or other hazardous substances, or regardless of whether the discharge was the result of intentional or negligent conduct, accident or other cause. • North Carolina General Statute 143-215.83(b) Removal of Prohibited Discharges. Any person having control over oil or other hazardous substances discharged in violation of this Article shall immediately undertake to collect and remove the discharge and to restore the area affected by the discharge as nearly as may be to the condition existing prior to the discharge. North Carolina General Statute 143-215.83 c Re uired Notice. Every person owning or having control over oil or other substances discharged, upon notice that such discharge has occurred, shall immediately notify the Department, of the nature, location and time of the discharge and of the measures which are being taken or are proposed to be taken to contain and remove the discharge. In the parking lot to the rear of the potato unloading area, multiple containers of oil and grease are stored outdoors. The containers are uncovered and exposed to rain and stormwater runoff. Grease was observed on the ground around the containers (Figures 5 and 6)- The permittee is required through the development and implementation of a Stormwater Pollution Prevention Plan to identify potential sources of pollution and to describe the methods by which the facility will reduce the amount of pollutants carried in the discharging stormwater to maintain compliance with the permit. This represents a violation of Stormwater General Permit NCG060000, which states: Page 4 of 7 Lance Inc. The permittee shall at all times properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by the permittee to achieve compliance with the conditions of this general permit. On the west side of the potato chip plant, waste potato shavings are collected in a dumpster, prior to disposal, which is stored on a paved area. At the time of the inspection, the dumpster was leaking a cloudy liquid (Figure 7). This liquid ran down the paved area and into a storm drain. Foamy liquid could be seen in a downstream storm drain inlet. Lance personnel were informed during the inspection that this was an illicit discharge to the storm drainage system that must be stopped immediately. On May 31, 2002, and August 31, 2006, MCWQP had addressed this same issue at the facility. During each incident, Lance personnel were informed that the discharge of this wastewater was not permitted_ This represents a violation of North Carolina General Statute 14,3.215.1 (a), which states: ._ , .. • No person shall do any of the following things or carry out any of the following activities unless that person has received a permit from the Commission and has complied with all conditions set forth in the permit: (1) Make any outlets into the waters of the State (6) Cause or permit any waste, directly or indirectly, to be discharged to or in any manner intermixed with the waters of the State in violation of the water quality standards A truck maintenance and fueling area is located in the western portion of the facility. Outside of the maintenance area, wheel rims are stored on a rack. In front of the rack, white staining was evident on the pavement (Figures 8 and 9). Lance personnel indicated that the rims were pressure washed and repainted in this area. The staining indicates that paint has been washed off onto the pavement, eventually draining to the storm drain. This represents a violation of North Carolina General Statute 143-215.1 (a) which states: • No person shall do any of the following things or carry out any of the following activities unless that person has received a permit from the Commission and has complied with all conditions set forth in the permit: (1) Make any outlets into the waters of the State (6) Cause or permit any waste, directly or indirectly, to be discharged to or in any manner intermixed with the waters of the State in violation of the water quality standards Requested Response This Office requests that you respond to this letter in writing by no later than April 20, 2007. This report is being issued as a Notice of Violation (NOV) and Recommendation for Enforcement due to the continuing illicit discharge to the stormwater collection system noted at the potato dumpster on the west side of the potato chip plant. This discharge was noted in NOV-2007- PC-0169 issued after the stormwater inspection conducted by MCWQP on February 15, 2007. Additionally, MCWQP had addressed this discharge at the facility on May 31, 2002, and August 31, 2006. During each investigation, MCWQP personnel informed Lance that the wastewater discharge was in violation of the subject General Stormwater Permit and North Carolina General Statute (G.S.) 143-215.1, as detailed in the Summary and Permit and Outfalls sections of the enclosed report. In addition, the stormwater outfall line which received the illicit discharge is not identified in the permittee's Stormwater Pollution Prevention Plan and has not been qualitatively or analytically monitored in violation of the subject General Stormwater Permit as detailed in the Qualitative Monitoring, Analytical Monitoring, and Summary sections of the enclosed report. Finally, there were potatoes, potato wastewater, and waste "cooking" oil noted on the paved drainage area for Outfall 2 on the west side of the potato chip plant exposing them to stormwater as noted in the Permit and Outfalls section of the enclosed report. Compliance History: Lance Incorporated had its stormwater program inspected in February 2007, by MCWQP personnel through the delegated program with the Division of Water Quality. A number of issues were identified and a Notice of Violation (NOV-2007-PC-0169) was issued. The Division recognizes the permittee's efforts to correct the noted issues and most have been resolved to the satisfaction of the inspector. However, the inspection revealed that issues still exist with the illicit discharge of potato wastewater at the west side of the plant (to additional stormwater outfall line identified during the inspection) and the housekeeping with the potatoes, potato wastewater, and waste "cooking" oil noted in the drainage area for Outfall 2. stormwater Pollution Prevention Plan (cont.) The SPPP contained general statements regarding preventative maintenance and housekeeping, which is inadequate. The SPPP must contain specifics steps taken by the permittee to prevent stormwater contamination from industrial activities on site. As per Part II, Section A, Item #4, "A preventative maintenance program shall be developed. The program shall document schedules of inspections and maintenance activities of stormwater control systems, plant equipment and systems. Inspection of material handling areas and regular cleaning schedules of these areas shall be incorporated into the program." Permit and Outfalls (cont.) Outfall 2 had been identified in a previous inspection as needing maintenance and repair. The outfall has been repaired and a new concrete discharge flume installed. This outfall was observed during the previously noted spill investigation and a wastewater fungus was noted in the pooled water at the base of the flume. There was no evidence of wastewater fungus on the day of the inspection. However, there were potatoes, potato wastewater, and waste "cooking" oil noted in the drainage area for Outfall 2. The permittee needs to improve the housekeeping in this area to prevent illicit discharges from entering the stormwater system. Required housekeeping activities should be coordinated with the on -site maintenance group and their role in preventing stormwater pollution documented in the SPPP. In addition, stormwater training must be given to those employees responsible for maintenance as required by the permit, An additional outfall line was discovered in the middle portion of the site during the inspection, which discharges on the western side of the site into Kings Branch. Neither qualitative nor analytical monitoring had been conducted for this outfall line. There was visual evidence that wastewater from a potato -waste dumpster had been discharged to the storm drain inlet in the bermed asphalt area in which the dumpster is stored. The asphalt in this area appeared to be degraded by past discharges and houseflies were witnessed on and around the storm drain inlet immediately downstream from the potato -waste dumpster area. This downstream inlet also contained a pipe, which appeared to collect rainwater from the roof of the adjacent manufacturing building. The roof housed vents that appeared to be associated with oil -based food production and could be a source of stormwater contamination. The stormwater program coordinator for Lance was directed to collect two analytical samples from the discharge pipes for the potato -waste dumpster and the roof drains in this downstream inlet and forward the results to the inspector. As of the date of this report no results have been received. This illicit discharge was identified in a previous inspection conducted by MCWQP. Coverage under General permit NCG060000 (Lance COC NCG060148) allows the permittee to discharge only clean stormwater and therefore, the permittee must immediately cease all illicit discharges to the stormwater collection system and surface waters of the State of North Carolina.
