Your facility is currently covered for stormwater discharge under General Permit NCG060000. This permit expires
on August 31. 2002- The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued. your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier. we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2(H)2 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00- Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPD1=S permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the 1 1 categories of "storm water discharges associated with industrial activity." (except
construction activities). If you feel your facility can certify a condition of "no exposure". i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed

Enclosed is a copy of the Follow-up Compliance Evaluation Inspection (CEI) report regarding
the compliance documentation submitted to Ms. Erin Hall of Charlotte -Mecklenburg Storm Water
Services by the permittee on July 18, 2008, and July 24, 2008 which did not necessitate a follow-up
site inspection of the subject facility. This follow-up process was conducted as part of a cooperative
working agreement between Mecklenburg County and the Division of Water Quality. In addition, the
follow-up process was conducted on behalf of the City of Charlotte in compliance with the City's
NPDES Permit, NCS000240, Part I[ Section H. Thank you for your assistance and cooperation
during the follow-up compliance evaluation.
The follow-up compliance evaluation found that ADM Milling Co. has implemented the
corrective actions as stated in the permittee's response letter dated June 5, 2008. The corrected
actions include:
• Updating the Stormwater Pollution Prevention Plan (SPPP) USGS location map to
include all components as specified in the subject facility's permit,
• Updating the SPPP site map to include the percentage of each drainage area that is
impervious and a narrative description of the potential pollutants that might be present
in the stormwater discharge from each outfall.
• Documentation that the permittee has certified the evaluation of the stormwater
outfalls for the presence of non-stormwater discharges, and
• Documentation that the required qualitative and analytical monitoring for both outfalls
on site was conducted on June 20, 2008.

Inspection Summary:
Facility Description. -
ADM Milling Company is located at 520 West 10th Street, Charlotte, NC. It is in operation 24 hours per day Monday
through Saturday and occasionally operates on Sunday. ADM Milling receives wheat via railway and truck that is stored in
five storage areas onsite before it is processed. The finished flour is shipped as bulk and bagged product. The facility is
located on approximately 6 acres of property consisting of a parking area, a mill building and offices, a truck garage, a lab
building, a truck scale house, and five storage areas for grain. The facility property is 100% impervious consisting of
asphalt and gravel and the Norfolk Southern and CSX Railroads run through the middle of the facility's property_ The
facility conducts vehicle maintenance on a fleet of 17 tractor -trailers and no vehicle washing is conducted onsite.
Compliance History:
The permittee/facility does not have any prior compliance issues with the NC Division of Water Quality and the following
information was found in the Charlotte -Mecklenburg Storm Water Services (CMSWS) files.
On May 4, 2006, CMSWS personnel conducted an onsite investigation at ADM Milling concerning a wastewater discharge
to the parking lot. The investigation found that water used for dust suppression in the grain silos was being discharged.
Due to a pump failure the water could not be pumped to the municipal sanitary sewer system as is usually done and an
employee was pumping the wastewater to the parking lot and eventually a storm drain.
On November 12, 2007, CMSWS personnel conducted an onsite investigation at ADM Milling that found commercial
wastewater was being discharged to the storm drain system. On November 19, 2007, a Notice of Violation was issued to
ADM Milling Company.
ADM Milling was inspected on April 9, 2008 by Ms. Erin Hall and Mr. David Caldwell of the MCWQP. A Notice of Violation
was issued on May 12, 2008.

Comment: The inspection on April 9, 2008, found that the SPPP did not contain a
general location (USGS) map and that the site reap did not include the percentage of
each drainage area that is impervious. Also the SPPP contained documentation of
annual employee training in 2004 and 2008 (not annually as required). In- addition, the
inspection found that the permittee had not conducted the required semi-annual facility
inspections in 2003 and 2007. Finally, the SPPP was updated in 2008 but no other
documentation could be provided to show the SPPP received annual reviews before
2008_
The documentation submitted to CMSWS on July 18 and 24, 2008 confirmed that the
deficiencies with the SPPP had been corrected. In addition the response letter dated
June 5, 2008, from the permittee states that quarterly, semi-annual, and annual events
have been entered into the facility's Regulatory Management Information System so
that key personnel receive emails when an event is due.

inspection conducted at the subject facility on April 9, 2008, by Ms. Erin Hall and Mr. David
Caldwell of Charlotte -Mecklenburg Storm Water Services. This inspection was conducted as
part of a cooperative working agreement between Mecklenburg County and the Division of
Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in

The inspection found that ADM Milling Company has developed and partially
implemented a Stormwater program and this Office commends the permittee's efforts to ensure

Inspection Summary:
Facility Description:
ADM Milling Company is located at 620 West 10th Street, Charlotte, NC. It is in operation 24 hours per day Monday
through Saturday and occasionally operates on Sunday. ADM Milling receives wheat via railway and truck that is
stored in five storage areas onsite before it is processed. The finished flour is shipped as bulk and bagged product.
The facility is located on approximately 6 acres of property consisting of a parking area, a mill building and offices, a
truck garage, a lab building, a truck scale house, and five storage areas for grain. The facility property is 100%
impervious consisting of asphalt and gravel and the Norfolk Southern and CSX Railroads run through the middle of the
facility's property. The facility conducts vehicle maintenance on a fleet of 17 tractor -trailers and no vehicle washing is
conducted onsite.
Compliance History:
The permitteelfacility does not have any prior compliance issues with the NC Division of Water Quality and the
following information was found in the Charlotte -Mecklenburg Storm Water Services (CMSWS) files.
On May 4, 2006, CMSWS personnel conducted an onsite investigation at ADM Milling concerning a wastewater
discharge to the parking lot. The investigation found that water used for dust suppression in the grain silos was being
discharged. Due to a pump failure the water could not be pumped to the municipal sanitary sewer system as is usually
done and an employee was pumping the wastewater to the parking lot and eventually a storm drain.
On November 12, 2007, CMSWS personnel conducted an onsite investigation at ADM Milling that found commercial
wastewater was being discharged to the storm drain system. On November 19, 2007, a Notice of Violation was issued
to ADM Milling Company.
Industrial Operations/City of Charlotte Stormwater Ordinance Review:
Mill Building —
The mill building is located on one side of the main railway that runs through the property and is where wheat is
processed into flour. No floor drains are located inside the building. The building is split between offices (west side)
acid industrial processes (east side) including two grain storage areas, a bulk loadout area, and an oil room. Processed
flour is loaded as bulk or bagged product onto tractor -trailers in the bulk loadout area. Bagged products are only
loaded on 1 st shift. This area is covered and enclosed except in front for loading purposes and is swept daily. The oil
room is located adjacent to the bulk loadout area and contained approximately six 55-gallon drums of new and used
motor oil. This room is within the mill building, contained no floor drains, and is not exposed to stormwater. The oil,
which is stored on spill pallets, is used for facility equipment (gearboxes and blowers). Haz-Mat picks up the used oil
on average four to six times per year.
Hazardous Materials —
ADM Milling is required to submit a Toxics Release Inventory (TRI) since 2,400 lbs. of chlorine (used to bleach wheat)
is stored on site. Methyl Bromide is used onsite as a pest control agent (applied by outside contractor 3xlyear) but is
not stored on site. Methyl Bromide is applied after the buildings have been sealed and is not a threat to stormwater.
Truck Scale House --
A containment area (with no drains) is located under the truck scale to catch stormwater. Haz-Mat cleans the waste
from this area when needed. Minimal staining was observed in the scale area.
Equipment Storage —
Some of the facility's used equipment is stored outside at the back of the parking area. Large metal parts are stored on
wooden pallets. Per facility personnel, any fluids in the used equipment are drained before being stored outdoors.
Scrap metal is kept in a standard metal dumpster and is picked -up and disposed of through an off -site vendor. No
staining was observed in this area.

Truck Garage -
Preventative maintenance is performed on the facility's 17 fleet tractor -trailers in the truck garage, which is covered
and enclosed. A flammable liquid storage cabinet was observed in this area. Located inside the truck garage were:
one 250-gailon new motor oil AST, one 250-gallon used oil AST, and three 55-gallon drums containing various
petroleum products. None of the ASTs were double -walled and they appeared to be in good condition. Two floor drains
are located on each side of the truck garage, which drain to a 100-gallon capacity oillwater separator_ located outside
adjacent to the truck garage. The oil/water separator is connected to the sanitary sewer system. Per facility personnel
the oil/water separator has been pumped out once in the last 20 years. The facility would use Haz-Mat for future pump
outs and collection of waste from the oil/water separator. No staining was observed outside the truck garage.
Lab Building --
The lab building houses a small laboratory used for in-house product analyses and part of the building is used for
storage. No floor drains are located in this building.
ASTs/Diesel Unloading Area --
Two 6,000-gallon single -walled diesel fuel ASTs are located in the parking area within a concrete secondary
containment structure. The secondary containment area and the ASTs appeared to be in good condition. The
secondary containment does not have a valve but is equipped with a high-level alarm system. Haz-Mat pumps out and
collects accumulated stormwater on an as needed basis. Adjacent to the secondary containment is a bermed area
used for diesel unloading. This area has a low point where a drain is located and accumulated stormwater or product
in this drain is pumped into the secondary containment area. Nisbet Oil Company delivers diesel fuel twice per month
and minimal staining was observed within the diesel unloading area. A spill kit is provided for this area.

Outfall 001 — This outfall receives runoff from the half of the ADM Milling site that
contains the mill building and offices and is located within the municipal separate storm
sewer system (MS4) beneath a drop inlet. Flow was observed at this outfall during the
inspection and upon investigation a drop inlet was found clogged with gravel and grain,
which prevented stormwater from flowing freely through the collection system.
As per Part III, Section C, Item #1 of the permit is required to properly operate and
maintain all facilities and systems under the permit.
Outfall 002 — This outfall receives runoff from the half of the ADM Milling site that
contains the parking area, truck garage, lab building, and truck scale house. This outfall
is located within the MS4 beneath a drop inlet. No flow was observed at this location.

I am writing you in response to the ADM Milling Compliance Evaluation performed at
our facility on April 9, 2008 by Ms. Erin Hall and Mr. David Caldwell. We at ADM
Milling take the environmental requirements very seriously, and will do everything
necessary to insure compliance as we move forward. I will address several findings in
my following comments.
Many of the findings noted in the report, refer to lapses in our sampling, training, and
monitoring over the past few years. To remedy these lapses, we have entered all
quarterly, semi-annual and yearly events into RMIS (Regulatory Management
Information System) so three members of our team, as well as corporate management,
will be automatically notified by email when an event comes due. These items include
program reviews, training, inspections, monitoring, and evaluations.
We are currently in the process of revising our SWP3 program making recommended
changes. The only item we have left to correct is the USGS map. We have the map, and
but still need add all items required by our permit. Estimated completion of this task is
June 13, 2008. We recently completed the process of re -certifying our SPCC program.
We have completed training on all items for all employees in our facility, as well as
completed all the monitoring, inspections, and sampling possible for the first six month
period of 2008. The main item we still need to address is the analytical monitoring. We
have been working with a local lab, and have the sampling kits required to gather all the
information needed to comply with our permit. Since we have gotten the kits, we have
yet to have a qualifying rainfall where we could get the samples to the lab in the required
time for the results to be accurate. We are prepared to gather the samples the next time
we have a qualifying rainfall event.

site inspection of the ADM Milling facility located at 620 W. 10t' Street in Charlotte, Mecklenburg County, North

file review revealed that the subject facility is covered by NPDES General Stormwater Permit — NCG060000
This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and
the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits -and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge.
Copies of the general permits and accompanying documents can be -accessed from the following webpage:

discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES
General Stormwater Permit] can be found on this website.
The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process and condition requirements of your permit. Please see the
above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s). of
the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked_
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the

o Collection, reporting, and recording of Qualitative Monitoring
o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable)
o Records — Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to the expiration date. Any permittee that has not requested
renewal at least 180 days prior to expiration, or any permittee that does not have a permit after
the expiration and has not requested renewal at least 180 days prior to expiration, will be
subject to enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director. The Director may
require modification or revocation and reissuance of the Certificate of Coverage to change the
name and incorporate such other requirements as may be necessary under the Clean Water
Act. The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Directors
approval and reissuance of the permit. Name and ownership changes require you to complete a

Inspection Summary:
Facility Description:
The facility processes wheat into flour. The plant consists of grain elevators and a flour mill.
ADM Trucking also operates a truck maintenance shop and stages bulk trailers at this location.
Compliance History:
The facility was last inspected on April 9, 2008 by Charlotte -Mecklenburg Storm Water Services (CMSWS). The Division
of Water Quality issued a Notice of Violation as a result of the inspection. The facility was compliant during the follow-up
inspection on July 18, 2008.
Industrial Operations/City of Charlotte Stormwater Ordinance Review.
Aboveground Storage Tanks (ASTs) —
Two 6,000-gallon single walled, diesel storage tanks with secondary containment, two motor oil tanks, and one used oil
tank with a capacity of 250-gallons each are located on site. The three oil tanks do not have secondary containment, but
are located indoors.
Outdoor material storage area(s) —
Bulk trailers are stored outdoors. No problems were identified.
Loading and Unloading area(s) --
Wheat is received from rail cars and trucks in covered areas. The finished products and byproducts are also packaged
and loaded under covered areas. Loading and unloading areas are swept and cleaned daily.
Vehicle Equipment area(s) —
Tractor trailers are fueled on site at the diesel storage tanks. All truck maintenance occurs under cover in the
maintenance shop. Vehicle washing occurs at an off site location. The facility states that it uses less than 55 gallons of
motor oil per month when averaged over a calendar year.
Oil/water separator and/or pretreatment —
All floor drains in the maintenance area lead to an oil/water separator located at the back of the shop.
Waste storage/disposal areas (dumpsters, scrap metal bins, etc.) —
A trash compactor is used to dispose of trash at the facility_ A dumpster used for recycling was missing its drain plug.
Please have the dumpster provider install a new drain plug to prevent leaks to the environment.
Indoor Material storage Area(s) —
Lube oil is stored in 55-gallon drums in both the mill and the truck maintenance facility. The drums are stored on spill
pallets. A 270-gallon used oil tote is located in the tube room at the mill. Chlorine gas is stored in cylinders onsite in the
chlorine storage room. No problems were observed.

Comment: The SPPP includes a USGS map although the map is missing the name of
the receiving stream and a notation if it is impaired. II Section A of their permit and
update the USGS map with the required information. The SPPP also includes a site
map but it is missing several items as required by the NPDES stormwater permit. The
SPPP was lacking a feasibility study.
No spills were reported in the past three years. Secondary containment water is never
released; Haz-Mat Transportation and Disposal pumps off all secondary containment
water.
Employee training was performed as required in 2010, 2011, and 2012. Semi-annual
stormwater facility inspections were performed as required in 2011, 2012, and 2013.
The SPPP has been reviewed and updated annually as required.

the analysis for pH is not being performed within the
required 15-minute hold time; please see attached for guidance on this anlysis. The
inspector noted that non -detect is being placed on the DMRs for values less than the
detection limit. For values less than the laboratory detection limit please report the
minimum detectible limit with a "less than symbol" on the DMR.

PROCEDURE FOR THE ANALYSIS OF pH
This document provides an approved procedure for the analysis of pH per 15A NCAC 2H .0805 (a) (6) (F) and (g) (3).The
procedures in this document, in addition to all requirements of the EPA approved method found in 40 CFR Part 136.3, must be met.
HOLDING TIME:
• Samples must be analyzed within 15 minutes of collection (40 CFR Part 136 Table II).
METER CALIBRATION:
• Instruments are to be calibrated according to the manufacturers calibration procedure prior to analysis of samples each day
compliance monitoring is performed.
Use a pH meter accurate and reproducible to 0.1 pH unit (as demonstrated daily by acceptable performance of a check standard
buffer) with a range of 0 to 14 and equipped with temperature -compensation adjustment. The meter must be calibrated with at
least two buffers. In addition to the calibration buffers, the meter calibration must be verified with a third standard buffer solution.
The calibration and check standard buffers must bracket the range of the samples being analyzed. A portion of the buffer
solutions should not be used for more than one calibration. Discard any used buffer portions.
• The check standard buffer must read within t0.1 S.U. to be acceptable. If the meter verification does not read within t0.1 S.U.,
the meter must be recalibrated before any samples are analyzed.
• When performing analyses away from the certified laboratory's primary location, a post analysis calibration verification using the
check standard buffer must be analyzed at the end of the run. It is recommended that a midday check standard buffer be
analyzed when samples are analyzed over an extended period of time. The post analysis check standard buffer(s) must read
within t0.1 S.0 or corrective actions must be taken.
General Information:
• Samples shall be gently stirred during measurement. Steps must be taken to eliminate cross contamination between
measurements (e.g., rinsing and blotting the electrode dry, dipping the electrode in stream multiple times, etc.).
• The units of measure for pH analyses are Standard Units (S.U.). It is recommended that pH be read in one -hundredths (0.01).
Values must be reported in tenths (0.1). It should be noted that many proficiency testing (PT) providers require samples be
reported to one -hundredths.
DOCUMENTATION:
The following must be documented in indelible ink whenever sample analysis is performed.
1. Date and time of sample collection.
2. Date and time of sample analysis to verify the 15 minute holding time is met. Alternatively, onetime maybe documented
for collection and analysis with the notation that samples are measured in situ or immediately at the sample site.
3. Sample site including facility name and location, ID, etc.
4. Coilectors/analyst's name or initials..
5. Meter calibration and meter calibration time(s).
6. True values of buffers used for calibration.
7. True value for the check standard buffer.
8. Value obtained for the check standard buffer (verification of t 0.1 S.U.).
9. True value and value obtained for the post analysis calibration verification(s), where applicable.
10. Report all data values to the nearest 0.1 pH unit.
11. Traceability for chemicals, reagents, standards and oonsumables.
12. Instrument identification.
13. Parameter analyzed.
14. Data qualifier(s), when applicable.

The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge

permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January 1, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.

Some of the changes include:
Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C: The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it

Your facility is currently covered for stormwater discharge under General Permit NCG060(100. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002, Once the permit is reissued, your facility would he eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the g*eneral permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must he completed and returned by March 4. 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal letyislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the 1 1 catcoories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to Stormwater, you can apply for the no exposure exclusion. For additional
information contact the Central Office Stormwater Staff member listed below or check the Stormwater & General
Permits Unit Web Site at http://h2o.enr.state.nc.us/su/stormwater.hunl
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom of the form. You will be notified when the
rescission process has been completed.
