We have received your letter dated October 10, 2016 and received in our office on October 12,,2016 regarding
representative outfall status at the Tyson Farms facility located in Monroe, North Carolina. This letter requests permission
for outfall 7 to represent outfalls 1, 2, 3, 4, 5, and 6, outfall 9 to represent outfall 8, and outfall 10 to represent outfall 11.
The Mooresville Regional Office staff inspected the subject facility on September 28, 2016 and met with Mr. Chris
Harrington, the Complex Environmental Manager. During the site visit we viewed all outfalis on site and determined that
outfalls 7, 9, and 10 most effectively captured stormwater representative of all activities on site. Please use these outfalis as
sampling points for analytical monitoring per the permit requirements.
Please retain a copy of this letter in the Stormwater Pollution Prevention Plan for your records. If you have any questions or

Inspection Summary:
This inspection was conducted per request by Chris Harrington, Environmental Manager, for technical assistance regarding
representative outfall status on site. Chris Harrington found during an annual audit that this facillity did not have documented
permission to sample outfalls 7, 9, and 10 as representative outfalls for the site. He also informed us that outfall 11 has not
been monitored because it was unkown until recently. During our inspection, We found that outfalls 7, 9, and 10 are
appropriate locations -for analytical monitoring to represent the entire facility. Representative outfall status and reasoning
must be formally requested from our Raleigh Central Office.
All other aspects of this facility are in compliance with the NCGO60000 general permit. There have been few sporatic
benchmark exceedances for TSS which may have been a result of sampling methods.

We received a request for technical assistance from Mr. Chris Harrington, the Complex Environmental Manager, regarding site outfalls
and potential for representative outfall status. Our department conducted an inspection at the subject facility on September 28, 2016 by staff
of this office accompanied by Mr. Harrington.
During this inspection, we discussed outfall locations and sampling locations for analytical monitoring. There are 11 outfalls identified
on site. Outfall 11 was previously unknown and must be incorporated into the site's monitoring plans for both analytical and qualitative
monitoring.

Doug,
You are welcome. And just to put on paper what we discussed. The city would like for you to run your pump, which is
set up to automatically pump the discharge from your storm water system of this one outfall, for the first 2 hours of
storm discharge into your sanitary treatment system. From there, the discharge from your treatment system would go
into the city sanitary sewer system. Your question was if there was any problem according to your coverage under
NCG060000 concerning sampling. After discussing the situation with Ken Pickle, of our office, we decided that
NCDEMLR did not have any problem with that proposal. The following is a summary of possible sampling:
• If during the monitoring period, you have no stormwater discharge from this outfall because of using the above
method, then just record "No flow" on your DMR.
• If during a monitoring period, you still have a discharge after the 2 hour pumping, then sample that discharge
and flow normal sampling procedure.
• Or if the automatic pump does not work for some reason during discharge event, then follow normal sampling
protocol.
Let me know if anything is different than discussed or if you have any further questions. I will include a copy of this
email in the file.

In response to your renewal application for continued coverage under stormwater General Permit NCG060000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:

• Two copies of the Discharge Monitoring Report (DMR) Form

Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of SO mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C. The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other

• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.

Maintenance obligations, and Definitions. Please note that all samples analyzed in accordance with the terms

The more significant changes in the General Permit since your last Certificate of Coverage include the following:
• Part I Section A — A new notation that the No Exposure Exclusion from permitting option may be available to the
permittee.
• Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL,
may not be eligible for renewed coverage under the General Permit.
• Part 11 Section B Table 1 — An increased sampling frequency from once per year to twice per year -
Part II Section B Table 3 — Benchmark concentrations now replace cutoff concentrations; the elimination of the option to
avoid sampling based on cutoff concentrations.
• Part II Section B — New provisions requiring the permittee to execute Tier One and Tier Two response actions, based on
the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two
requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive
monitoring events show no benchmark exceedences.
• Part II Section B — A new provision that four exceedences of any particular benchmark will trigger increased DWQ
involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for
an individual permit, or may direct the implementation or installation of specific stormwater control measures-
DWQ received a number of comments on a series of general permits similar to this one- A full response to comments can be
found at httpJ/ncwalerquality.org/su/industriaigpinfo.htm. Some comments resulted in permit modifications, others are
addressed in the response document or Fact Sheet. A few specific requests for clarification are addressed below.
1. What is the deadline for having a revised SPPP that reflects the provisions of the new General Permit? DWQ will require
that the permittee have a revised, complete SPPP no later than six months after the date of issue of that permittee's new
Certificate of Coverage.
2. Must analytical results be by a certified lab? What about pH measurements? All analytical results obtained to satisfy
NPDES permit requirements must be certified, as directed in North Carolina regulations at 15A NCAC 2H .0800, and as
administered by DWQ's Laboratory Section Certification Branch. This includes field pH measurements.

This letter is to provide a written summary of the events at the Monroe, NC Complex (Hatchery) of
Tyson Foods, Inc. On Friday, April 20, 2007 (approximately 7:30 am), a check valve that connects the
hatchery drain and line from the processing plant going to the wastewater treatment plant failed. This
caused the sump to overflow into a truck bay at the Hatchery. Some of the water flowed outside the truck
bay across the parking lot and into a grassy area on the Hatchery parking lot. Approximately 50 gallons
did flow into a storm water drain which leads to an unnamed tributary of Richardson Creek. The storm
water drained was covered as soon as it was realized that water was flowing into it. All flow was stopped
and contained by 8:30 am. A pH reading was taken of the water in the affected area of the tributary. The
pH was 7.2. The affected area of the tributary did not show any evidence of fish kill. The affected area
of the tributary was contained and cleaned at this time also. Ms. Marcia Allocco (NCDENR — Surface
Water Protection) was contacted and notified of the incident at approximately 8:30 am. The water in the
sump was pumped to the wastewater treatment plant and the check valve was replaced.
An inflow cover for the grate style manhole cover is being ordered. This should prevent a majority of the
water from entering the unnamed tributary should a similar situation occur. Most of the water would
flow into the grassy area on the Hatchery property. The hatchery employees have also been retrained to
contact management should there be an alarm at the sump indicating a high level condition. They have
also been instructed to berm the storm water drain area to further prevent water from entering the drain
should there be a release.

to receiving waters designated as a UT to Richardson Creek, a class C stream, in the Yadkin - Pee Dee River Basin
in accordance with the effluent limitations, monitoring requirements, and other conditions set forth in Parts 1, II, III,
IV, V, and VI of General Permit No. NCGO60000 as attached.
This certificate of coverage shall become effective September 1, 2002.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.

Your facility is currently covered for stormwater discharge under General Permit NCG060000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting, this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would he eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the ocneral permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00_ Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215. f and
could result in assessments of civil penalties of up to $10.000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I 1 categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional
information contact the Central Office Stormwater Staff member listed below or check the Stormwater & General
Permits Unit Web Site at http://112o.enr.state.nc.us/su/stormwater.htm]
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form_ Mailing instructions are listed on the bottom of the form. You will be notified when the
rescission process has been completed.

In accordance with your application for discharge permit received on September 28, 1992, we are
forwarding herewith the subject certificate of coverage to discharge under the subject state - NPDES general
permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the US Environmental Protection agency dated
December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, this certificate of coverage shall be final and binding.
Please take notice that this certificate of coverage is not transferable except after notice to the Division
of Environmental Management. The Division of Environmental Management may require modification or
revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by the
Division of Environmental Management or permits required by the Division of Land Resources, Coastal Area
Management Act or any other Federal or Local governmental permit that may be required.
