FaC114: Schaefer Systems IntemaWrnW Inc Inspection [late: 041M015 tmpec thn Typo: Cmphance Evaluation Reason for Vielr Complaint Inspection Summary: Inspection was for a request to Rescind permit NCS 000526 and apply for coverage under the general permit NCO 0501 , This facility manufactures roll out containers for munidpaiities and also receives containers to be recycled. Prior to arrival for this inspection, the facility had a spill of approximately 50 gallons of paint. The paint spilled during the off loading of a roll out container sent to this facility to be recycled. This particular container had paint material in it which spilled into a stormwater inlet leading to the retention basin. At this time, the spill material had not reached the discharge point of the basin. The facility had implemented a spilt response and had already notified a remediation company as well as ordering immediate sampling of the outfall to ensure no trace elements of the containment entered the tributary. The facility will submit test results once they are returned. As for the request to rescind permit NCS 000526 and issue general permit coverage, due to facility history and curmnt conditions the request should be denied. As per our previous discussions, we are going to interpret this data set as indicating that the site fits our concept of a key attribute of a General Permit site: namely that we expect such sites to present little to no threat to water quality from stormwater discharges. I don't know whether it was the work done to re -vegetate bare yard areas, or whether it was the expansion and re -work of the detention pond, or whether Schaefer has improved on -site housekeeping, or whether some other factor is responsible for the improvement. I looked closely at the last two samples and noted that they were slightly off schedule, but we have already discussed that, and 1 have no problem with it since 1 don't think the (slightly) missed sampling periods are relevant to characterizing the site as a low -risk site, suitable for coverage under a General Permit. Please advise Schaefer that we will be receptive to an application for coverage under NCG05 in lieu of renewinp, NC5000526. Instructions and forms for applying for coverage can be found on our website. The fee is $100. We are not able to apply any fees assessed under NCS000526 to the new NCG05 application. Here's how I remember it now, and what my review today of the email correspondence indicates to me. Please let me know if I have overlooked any part relevant to our previous discussions on whether we would issue coverage under NCGOS to Schaefer. My historical summary: • The past problem of unauthorized discharge of wastewaters through the stormwater system has been resolved. Schaefer no longer dumps oily wash waters into the drainage grate. No further issues remain on this as ect as far as I remember. • That issue gave rise to the need for an individual permit (NCS000526) for this site as directed by the Mooresville Regional Office, rather than a General Permit. • Schaefer submitted a renewal application for NC5000526 in April, 2013, but we still have not assigned a reviewer for it. Our progress against our backlog of individual permit renewals has been improving, but still many permits remain unaddressed: it's not just Schaefer. • The key remaining issue as I recall it now is that coverage under NCGOS does not include monitoring for COD or TS5, for which Schaefer has had past benchmark exceedances. The sampling record that you provided in your January 2013 Stormwater Monitoring Report (tabulating data from 2009 through 2012) suggests an improving trend in monitoring results. That monitoring record ends with the December 20, 201Z sampling event, now almost two years old. • Please update the monitor in record th©ugh-the more recent same results by amending the tabulation previously i3royided. It would help me if you would include the all previously tabulated data, and just extend the current tabulation format to include all data on all parameters gathered since 2009. 1 like the presentation of it, it makes it easy to grasp the time frame and results. • As I indicated in previous emoils, we are amenable to coverage under NCGOS, if the sampling record supports that change. 1 mean, what is foremost in my mind is that NCGOS does not test far TSS and COD. Schaefer will need to show that the trend in the data has continued, and that TSS and COD performance are no longer an issue, and that no new issues with other parameters have arisen. On that basis we can switch to NCGO5. • Please note that while we still have Schaefer in the queue for processing of NCS000526, l can't give you a reliable estimate of when we can get to it. On the other hand, our current turn -around time for coverage under the General Permits, including NCGOS, is a matter of just a veryfew weeks. • If we move forward with NCGOS we will rescind coverage under NCS000526 concurrently with issuance of coverage under NCGOS. Sorry for the delayed response. It appears that our last prior communications were in April 2013. We were engaged together in considering the possibility and the timing of covering Schaefer under our General Permit NCG05 instead of the current individual permit, NCS000526. As indicated by the email string and as I think I recall now, at that time it seemed to us that Schaefer should instead apply for renewal of NC5000526, and should postpone their request for coverage under our General Permit NCG05, partially because of the timing of the pending permit expiration, and partially in response to our need for more sampling data in support of any request to switch coverage over to NCG05. I note that Schaefer indeed applied for renewal of NCS000526 in the fourth week of April 2013. However, our permits database shows that a permit reviewer has not yet been assigned: At the moment the DEML.R Stormwater Permitting Program (SPP) has a substantial backlog of past due permit renewals (like Schaefer) and aging new permit applications. We are holding the Schaefer renewal application until SPP staff become available to work on it. As of two months ago, we are in the middle of an expedited push on our aging permits backlog, but we haven't gotten to Schaefer, yet. o Federal NPDES rules provide that when a permittee submits a timely renewal application for an existing permit, the expired permit remains in effect until the agency can act on the renewal application. This means that while the face of NCS000526 has an expiration date of October 31, 2013, the permit still remains in effect today. This federal rule provision works to protect Schaefer from discharging without a permit due to our delay. They are not at risk because of the expired permit. That is, Schaefer is still authorized to discharge stormwater, in accordance with the provision of NCS000526. So just to further clarify Schaefer's permitting_ status and our jargon: I note your email from June 2 inquiring about, "the possibility of returning to on individual permit." I need to clarify that Schaefer doesn't need to "return" to an individual permit. The individual permit they already have is currently in effect. Today they should be abiding by ail the provisions of NCS000526. When a permit reviewer is assigned to Schaefer (probably me, but not necessarily), he will contact Schaefer to let them know to expect action on the pending renewal application, and whether any additional information is required to process the renewal. Until then, I can't provide a reliable estimate of when we will be finished with the renewal of NCS000526. Form 2F also asks for a Total Nitrogen and Total Phosphorus. Are these also required since they are not part of our IP? No. New, additional testing is not required fpr the renewal process. As I understand it, dumping of petroleum -laden wastewater has been stopped as a routine operating practice; a remedial dean -up action on the area with accumulated residuals has been accomplished; and renovations to the dry detention basin were accomplished in December 2010. o Three consecutive monthly sampling events were accomplished over the second half of 2012, which in accordance with the terms of the permit, allows the permittee to return to semi-annual monitoring for the last remaining monitoring period in this term of NCS000526 (May 1, 2013 — October 31, 2013.) o Absent an identified polluted stormwater discharge, this subcategory of industry would be eligible for coverage under our General Permit NCG05, based on the generally expected low potential for stormwater pollution at such industries. Note that our General Permit for this subcategory of industry, NCG05, contains no analytical monitoring requirements based on the main process activity. It is our general judgment that this should be a low -risk industry sub -sector. In consideration of these aspects, DWQ will consider an application for coverage under General Permit NCG05, provided that Schaefer can produce two more consecutive monitoring events (for a total of five consecutive over two years) in 2013 with all parameters within the benchmarks contained in the current permit. The background sample was stormwater collected in a stainless steel bowl decontaminated with isopropyl alcohol followed by distilled water. The results indicated the COD levels were present in the background sample (195 mg1Q at similar levels to the outfall sample (184 mg/L). We had been attempting to obtain a background sample previously however, the difficulty in obtaining a background sample was that there was not sufficient water to sample. Please refer to the discussion and recommendations section of the January 2011 report. After the April 2012 exceedance, the recommendation was still to try to obtain a background sample at the time of the outfall sample. However, it had been difficult to obtain sufficient water to sample. Many of the events sampled were light rainfall events and background COD samples were not collected, In addition to the recommendation of a background COD sample, AM EC recommended to continue stormwater management inspections of the facility, review storage practices and continue good housekeeping practices. We still attempted to collect background samples during events. During the August 29, 2012 sample, a background sample was taken. Both the background and outfall 001 sample were <25 mg/L. Please help me to understand the site circumstances a little more accurately, as I am unclear on your report of the source. I note your report last month, in your Jan 18, 2013 email to me below, that the oil discharge was from an employee "changing his oil in the parking lot against company policy", meaning that this may have been a one-time occurrence by a misbehaving employee? Our files record the opinion of the MCWQP inspectors that the amount of material present suggested that the discharge probably was much more substantial than that, and that it had been continuing for some considerable time. Our files also record that petroleum product 14 staining was observed three feet up on the trunks of trees. Further we have a record that the maintenance supervisor reported that employees on the third shift were routinely dumping petroleum -laden wash waters into a drainage grate at a rear door. Photos taken in December 2007 give the impression of an extensive spread of petroleum product, much more than would be anticipated from an oil change of 4 — 8 quarts per vehicle. In accordance with the permit, the stormwater sample (Outfall 001) was collected within the first 30 minutes of discharge from the detention pond and was submitted to Pace Analytical Services, Inc. (Pace) for analysis of Oil and Grease by EPA Method 1664A, TSS by SM 2540D, COD by SM 5220D, and BOD, 5 day, by SM 5210B. Pace is a North Carolina -certified analytical laboratory. A summary of analytical results for the February 9, 2015, sampling event is presented in Table 1 below. Results from previous stormwater samples collected for permit compliance are summarized in the Stormwater Discharge Outfall Monitoring Report DMR, which is attached. Results of sampling were recorded on the attached (DMR) form. A copy of the DMR needs to be signed by the permittee and sent to the North Carolina Department of Environment and Natural Resources (NCDENR). The qualitative monitoring was documented an the NCDENR Stormwater Discharge Outfall Qualitative Monitoring Report form which is attached. Copies of the DMR and Stormwater Discharge Outfall Qualitative Monitoring Report need to be maintained in the Stormwater Pollution Prevention Plan for three years. A subsequent inspection was conducted by a representative of the Mecklenburg County Storm Water Services Division and accompanied by Schaefer Systems and Amec Foster Wheeler personnel on February 20, 2015. The facility was deemed compliant in the resulting inspection report (dated March 2, 2015) and issued by the NCDENR Mooresville Regional Land Quality Section. Discussion The results from the February 2015 sampling event were below permit benchmark values. These sample results represent the third consecutive results below permit values since discussions with Ken Pickle of NCDENR. Amec Foster Wheeler will attempt to have the individual permit revoked and a general permit issued. This is all good. As per our previous discussions, we are going to interpret this data set as indicating that the site fits our concept of a key attribute of a General Permit site: namely that we expect such sites to present little to no threat to water quality from stormwater discharges. I don't know whether it was the work done to re -vegetate bare yard areas, or whether it was the expansion and re -work of the detention pond, or whether Schaefer has improved on -site housekeeping, or whether some other factor is responsible for the improvement. I looked closely at the last two samples and noted that they were slightly off schedule, but we have already discussed that, and I have no problem with it since I don't think the (slightly) missed sampling periods are relevant to characterizing the site as a low -risk site, suitable for coverage under a General Permit. Please advise Schaefer that we will be receptive to an application for coverage under NCG05 in lieu of renewing NCS000526. Instructions and forms for applying for coverage can be found on our website. The fee is $100. We are not able to apply any fees assessed under NCS000526 to the new NCG05 application. Here's how I remember it now, and what my review today of the email correspondence indicates to me. Please let me know if I have overlooked any part relevant to our previous discussions on whether we would issue coverage under NCG05 to Schaefer. My historical summary: • The past problem of unauthorized discharge of wastewaters through the stormwater system has been resolved. Schaefer no longer dumps oily wash waters into the drainage grate. No further issues remain on this aspect, as far as I remember. • That issue gave rise to the need for an individual permit (NCS000526) for this site as directed by the Mooresville Regional Office, rather than a General Permit. • Schaefer submitted a renewal application for NCS000526 in April, 2013, but we still have not assigned a reviewer for it. Our progress against our backlog of individual permit renewals has been improving, but still many permits remain unaddressed: it's not just Schaefer. • The key remaining issue as I recall it now is that coverage under NCG05 does not include monitoring for COD or TSS, for which Schaefer has had past benchmark exceedances. The sampling record that you provided in your January 2013 Stormwater Monitoring Report (tabulating data from 2009 through 2012) suggests an improving trend in monitoring results. event, now almost two years old. Please`uodate the monitorine �ecord.t That monitoring record ends with the December 20, 2012 sampling p6&6usIV provided. It would help me if you would include the all previously tabulated data, and just extend the current tabulation format to include all data on all parameters gathered since 2009. l like the presentation of it, it makes it easy to grasp the time frame and results. • As I indicated in previous emails, we are amenable to coverage under NCGOS, if the sampling record supports that change. I mean, what is foremost in my mind is that NCGOS does not test for TSS and COD. Schaefer will need to show that the trend in the data has continued, and that TSS and COD performance are no longer an issue, and that no new issues with other parameters have arisen. On that basis we can switch to NCG05. • Please note that while we still have Schaefer in the queue for processing of NCS000526, I can't give you a reliable estimate of when we con get to it. On the other hand, our current turn --around time for coverage under the General Permits, including NCG05, is a matter of just a veryfew weeks. • If we move forward with NCGOS we will rescind coverage under NCS000526 concurrently with issuance of coverage under NCG05. Sorry for the delayed response. It appears that our last prior communications were in April 2013. We were engaged together in considering the possibility and the timing of covering Schaefer under our General Permit NCG05 instead of the current individual permit, NCS000526. As indicated by the email string and as I think I retail now, at that time it seemed to us that Schaefer should instead apply for renewal of NCS000526, and should postpone their request for coverage under our General Permit NCG05, partially because of the timing of the pending permit expiration, and partially in response to our need for more sampling data in support of any request to switch coverage over to NCG05. I note that Schaefer indeed applied for renewal of NCS000526 in the fourth week of April 2013. However, our permits database shows that a permit reviewer has not yet been assigned: At the moment the DEMLR Stormwater Permitting Program (SPP) has a substantial backlog of past due permit renewals (like Schaefer) and aging new permit applications. We are holding the Schaefer renewal application until SPP staff become available to work on it. As of two months ago, we are in the middle of an expedited push on our aging permits backlog, but we haven't gotten to Schaefer, yet. o Federal NPDES rules provide that when a permittee submits a timely renewal application for an existing permit, the expired permit remains in effect until the agency can act on the renewal application. This means that while the face of NCS000526 has an expiration date of October 31, 2013, the permit still remains in effect today. This federal rule provision works to protect Schaefer from discharging without a permit due to our delay. They are not at risk because of the expired permit. That is, Schaefer is still authorized to discharge stormwater, in accordance with the provision of NC5000526. So just to further clarify Schaefer's permitting status and our (argon: 1 note your email from June 2 inquiring about, "the possibility of returning to an individual permit." I need to clarify that Schaefer doesn't need to "return" to an individual permit. The individual permit they already have is currently in effect. Today they should be abiding by all the provisions of NCS000526. • When a permit reviewer is assigned to Schaefer (probably me, but not necessarily), he will contact Schaefer to let them know to expect action on the pending renewal application, and whether any additional information is required to process the renewal. Until then, I can't provide a reliable estimate of when we will be finished with the renewal of NCS000526. As of today, DWQ is not yet ready to entertain Schaefer's application for coverage under the stormwater General Permit NCGO5, in lieu of coverage under the current individual stormwater permit, NC5000526. However, we note the following favorable circumstances in support of your inquiry as to when Schaefer might obtain coverage under a General Permit: o The accumulated data over four years establishes that the original problem of oil and grease discharges has been effectively addressed by Schaefer. As I understand it, dumping of petroleum -laden wastewater has been stopped as a routine operating practice; a remedial clean-up action on the area with accumulated residuals has been accomplished; and renovations to the dry detention basin were accomplished in December 2010. o Three consecutive monthly sampling events were accomplished over the second half of 2012, which in accordance with the terms of the permit, allows the permittee to return to semi-annual monitoring for the last remaining monitoring period in this term of NCS000526 ( May 1, 2013 — October 31, 2013-) o Absent an identified polluted stormwater discharge, this subcategory of industry would be eligible for coverage under our General Permit NCG05, based on the generally expected low potential for stormwater pollution at such industries. Note that our General Permit for this subcategory of industry, NCG05, contains no analytical monitoring requirements based on the main process activity. It is our general judgment that this should be a low -risk industry sub -sector. In consideration of these aspects, DWQ will consider an application for coverage under General Permit NCGOS, provided that Schaefer can produce two more consecutive monitoring events (for a total of five consecutive over two years) in 2013 with all parameters within the benchmarks contained in the current permit. Given that the current permit will expire on October 31, 2013, this indicates to me that you cannot wait to take samples on a semi-annual schedule, but must instead adopt a schedule somewhat similar to the monthly schedule that you have been on over the last three years. We can also agree to forgive any late submittal of the renewal application for NCS000526, up to a point. The background sample was stormwater collected in a stainless steel bowl decontaminated with isopropyl alcohol followed by distilled water. The results indicated the COD levels were present in the background sample (195 mg/L) at similar levels to the outfall sample (184 mg/L). We had been attempting to obtain a background sample previously however, the difficulty in obtaining a background sample was that there was not sufficient water to sample. Please refer to the discussion and recommendations section of the January 2011 report. After the April 2012 exceedance, the recommendation was still to try to obtain a background sample at the time of the outfall sample. However, it had been difficult to obtain sufficient water to sample. Many of the events sampled were light rainfall events and background COD samples were not collected. in addition to the recommendation of a background COD sample, AMEC recommended to continue stormwater management inspections of the facility, review storage practices and continue good housekeeping practices. We still attempted to collect background samples during events. During the August 29, 2012 sample, a background sample was taken. Both the background and outfall 001 sample were <25 mg/L. At the moment, I see the relevant aspects like this: FOR GENERAL PERMIT COVERAGE: The original problem, the O&G, has essentially gone away, that's good. AGAINST: Three out of eight reporting results show COD exceedances over the 120 mg/L benchmark: 245 mg/L, 373 mg/L, and the last one of 147 mg/L in April 2012. The last three sample events in 2012 show COD less than the benchmark for COD. What if the future progresses like the past, I mean what if three out of every eight discharges are high in COD? How will the site manager ever know that he has a problem if he is not sampling for it under NCG05? On what Basis would he ever act to correct that pollutant discharge? I was not working with on this project at the time of the incident and I was only going off memory and hearsay from 2009 when I began to perform Stormwater inspections at the site. In my conversation with Marcia on 2/25/13, she recalled a similar circumstance to what you provided and I found some hand written notes from 2008 that identified mop bucket dumping as a potential source of oil. My apologies for the bad information. Marcia may have more details on the incident as I am not seeing much in our 13 files. I did find a summary from HEPACO about the cleanup process after the incident was reported indicating a significant cleanup effort including removal of contaminated soil from the pond and jet rod cleaning of the stormwater pipes . Further discussion: OK, now that I know which site we're talking about I went back and reviewed the files for Schaefer. Please help me to understand the site circumstances a little more accurately, as I am unclear on your report of the source. I note your report last month, in your Jan 18, 2013 email to me below, that the oil discharge was from an employee "changing his oil in the parking lot against company policy'; meaning that this may have been a one-time occurrence by a misbehaving employee? Our files record the opinion of the MCWCQP inspectors that the amount of material present suggested that the discharge probably was much more substantial than that, and that it had been continuing for some considerable time. Our files also record that petroleum product 14 staining was observed three feet up on the trunks of trees. Further we have a record that the maintenance supervisor reported that employees on the third shift were routinely dumping petroleum -laden wash waters into a drainage grate at a rear door. Photos taken in December 2007 give the impression of an extensive spread of petroleum product, much more than would be anticipated from an oil change of 4 — 8 quarts per vehicle. OK, general guidance, not site specific (since 1 don't know what site we are talking about): • Unless DWQ`s initial direction specified a five-year period of coverage under the individual permit, the facility can apply for a General Permit at any time. I mean, unless DWQ has provided prior contrary instructions, the facility doesn't have to wait until the current permit expires to apply for coverage under a General Permit. • It is not certain that DWQ will issue coverage under a General Permit when you apply for it. Presumably the individual permit contained monitoring obligations. DWQ may ask the permittee to submit in summary form the monitoring data accumulated over the last 4+ years, and we would evaluate it for whether it suggests that coverage under a General Permit will be protective of the receiving water. • In these special circumstances, the requested conversion from an individual permit over to a General Permit will be reviewed both by the DWQ Stormwater Permitting Unit, and the DWQ Regional Office Surface Water Protection staff. • Our General Permits are shown on our website. The applicable General Permit will depend on which one of our 20+ permits covers the industrial sector for this permittee.
