After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2732. This certification allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you, receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The applicant proposes the crossing of a single minor un-named intermittent tributary which occurs between neighborhoods within the development. The crossing is necessary to provide vehicular access between these portions of the development. The proposed crossing has been located at a point on the channel which contains no sidestream wetlands and avoids or minimizes unnecessary wetland impacts. Culverts will be placed at the point of crossing to provide free passage of surface water flow. Impacts to wetland areas occurring upstream and downstream of the crossing will be avoided. Incedental adverse impacts to downstream water resources will be prevented during construction by providing on-site sediment and erosion control measures per an approved grading plan. The crossings will occur on minor un-named intermittent tributaries on the site which have not been crossed before under a NWP 14. Only one crossing is proposed for each tributary. Neither tributary has been crossed before. All areas of the site which are to be affected by the proposed activities are located above the headwaters to Clarke Creek and have been assigned a water quality classification of "C". The total of impacts resulting from all proposed activities including filling, dredging or other modification, is approximately 0.02 acres for each of two crossings. Impacts will occur only within the OHWM of each channel and will not impact sidestream wetlands. Normal stream flows will not be interrupted and will be maintained by providing culverts. Every effort will be made to minimize impacts to natural downstream functions and values. It is the intent of the developer to avoid development impacts to other areas delineated as wetland in this report and to preserve them as common open space, however portions of the remaining study area are being reviewed as possible mitigation sites. This project has recieved 401 certification for activities in the past for previous development phases as indicated on the enclosed correspondence. One copy of the enclosed application and delineation are being provided to Steve Lund, U.S. Army Corps, for wetland boundary verification and NWP 14 authorization. Could you please review the enclosed information for consistency with the General 401 Water Quality Certification which has been issued for Nationwide Permit 14. It is our understanding that this activity can proceed under the General Certification provided that all conditions are satisfied. Stone, Jr. and Associates Affiliate Site Location The Highland Creek Project is located in Mecklenburg and Cabarrus Counties, NC and ' consists of approximately 1277 acres of land within Mecklenburg County and approximately 700 acres within Cabarrus County. The entrance to the project is located on the north side of Ridge Road (S.R. 2601) approximately 3500 feet west of its intersection with Prosperity Church Road (N.C. 2459). Access to the project is gained by taking the Mallard Creek Church Road West exit from I-85 and following Mallard Creek Church Road until it becomes Prosperity Church Road, then following this road to its intersection ' with Ridge Road. The project site is located within the Cornelius, Harrisburg, Kannapolis, and Derita NC USGS Quadrangles and within the watershed of Clarke Creek (NC stream index 13-17-4) which is tributary to Rocky River within the Yadkin-Pee Dee River Basin. Study Areas Location ' The portions of the site which are included within the study area of this report consist of two minor un-named intermittent tributaries which occur downstream of existing farm pond ' impoundments. The area studied for each tributary begins at the downtstream point where the stream crosses golf course boundary and extended upstream to the furthest extent of positive wetland indications or evidence of a normal Ordinary High Water Mark (OHWM). ' The first tributary system has been identified as T-1. This system begins at the golf gourse boundary on the north side of Tee #16 and extends upstream for approximately 1800 feet. This study area includes an abandoned farm pond impoundment which had been breached ' at some time prior to this investigation. The documented transect within this study area has been identified as Transect A. ' The second tributary system has been identified as T-2 and begins at the golf course boundary on the southeast end of the Practice Range and extends upstream for approximately 1200 feet. This study area includes an existing farm pond impoundment which is intact. The documented transect within this study has been identified as Transect B. AG Land Associates, LLC Charlotte, NC Charlotte, NC I PROJECT LOCATION source: usGS 7-1/2' Quadsl ?ornelius, Kannapolis, Harrisburg, & Derita, NC ' General Site Description ' The Highland Creek project site contains one major named stream, Clarke Creek, which forms its eastern boundary and is located below headwaters. Other waterways on the site consist of three un-named primary perennial tributaries to Clarke Creek identified for the purposes of this report as Tributaries to Clarke Creek (TCC-1, TCC-2, and TCC-3) and ' and numerous smaller secondary or tertiary intermittent tributary channels. With the exception of Clarke Creek, all tributaries on this site are located above headwaters. All of the ' secondary and tertiary drainageways were observed to have very small contributing basins and carry flow only for a short duration immediately following storm events. Due to the relatively steep topography the smallest channels drain quickly and do not carry permanent flow. t A significant part of the Mecklenburg County portion of this site has already been developed into golf course community as indicated on the Project Location Map. A project- wide routine wetland determination had been conducted by Oldham Planning and Design Associates, Inc. and Sabine & Waters Environmental Land Management Consultants during 1989-1990 as a part of the planning for the development. t The portions of the site which are included within this delineation include two secondary, intermittent tributaries (T-1 and T-2). These channels flow into a confluent un-named perennial tributary of Clarke Creek (TCC-1). The study areas have been identified as T-1 which relates to a proposed road crossing for Heathercrest Drive and T-2 which relates to a proposed road crossing for Cambridge Bay Drive. Areas upstream and downstream of the proposed crossing locations have been included within the delineation. The perennial ' tributary has not been included within the study area for this application. r? 1 u 1 11 Wetland Determination Methodology For the purposes of this delineation, only two of the minor un-named tributaries on the site have been studied. It is the intent of the owner to have a re-delineation conducted for the remaining un-developed portions of the site in the near future. This delineation was conducted to specifically review two areas for which an application will be made for road crossings under NWP 14 and to review two potential mitigation sites. Those portions of the site which have been identified (in a preliminary manner) as jurisdictional under Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act include the channel of minor tributaries to the line of ordinary high water, and wetland areas which satisfy the definition of a wetland in the "Corps of Engineers Wetlands Delineation Manual, Technical Report Y-87-1", January 1987, U.S. Army Corps Environmental Laboratory. A routine on-site determination method utilizing the multi-parameter approach was implemented to identify the upper wetland boundary of all areas which satisfy the three parameters as described in the manual: 1. Hydrophytic Vegetation 2. Hydric Soils 3. Wetland Hydrology The methodology was utilized to make the determination: 1. Preliminary data gathering and synthesis. Data sources USGS Quadrangle Map ( 7-1/2 minute quad) USFWS National Wetlands Inventory Maps USDA-SCS Soil Survey of Mecklenburg County Applicant provided topography, boundary survey, previous wetland delineations and development plans.. Identification of Plant Community Types Each study area was divided into its major vegetation communities for charactization. 4. Transects were established approximately perpendicular to each major water course for location of sample observation points. 5. Observation points were located along transects within each major vegetation community to observe and record the characteristics of hydrophytic vegetaion, hydric soils and wetland hydrology. Each sample observation point (sample plot) consisted of one or more 18-24" deep test pits dug with a spade to characterize soils and hydrology, and a thirty foot radius area to characterize tree and woody vine species, and a five foot radius area to characterize a representative sample of the sapling, shrub, and herbaceous plant species. All observed data was recorded on an appropriate Data Form as well as notation of Atypical Conditions and Normal Environmental Conditions. A determination was made whether or not the sample plot was a wetland based upon available and observed data. Each recorded sample plot has been marked in the field with labelled surveyors flagging. 1 When a wetland/non-wetland determination had been made at all sample plots, an upper wetland boundary was assumed to occur between wetland plots and non-wetland plots. Numerous additional test pits were dug along each transect to identify the boundary ' location. These test pits have been marked in the field with blue and white striped flagging. Once boundaries had been located along each transect, the characteristics at this point were utilized to determine the boundary location between transects until the entire site had been divided into wetland and non-wetland areas. This boundary was then confirmed and adjusted through the use of visual observation and additional test pits on either side of the line. All upper wetland boundaries and intermittent channel centerlines have been located in the field with numbered surveyors flagging. Each flag has been assigned a number and has ' been located on a topographic map of the site with a compass and field measurement. Stream channels which exhibited no sidestream wetlands were delineated to the line of ' ordinary high water (OHWM) by establishing cross sections at 100' intervals along the entire course of the channel and recording significant channel measurements including top width, bottom width, width at OHWM, depth, and other significant features unique to the section. All section locations have been photographed, sketched on plan and in section, and marked in the field with numbered surveyors flagging. A chart summarizing the dimensions recorded at each stream section for tributary T-1 and tributary T-2 is enclosed. 1 Soils ' The soils of the site have been mapped by the Mecklenburg County portion of the site have been mapped by the Mecklenburg office of the USDA Soil Conservation Service and are documented on sheets 2, 4, and 5 of the Mecklenburg County Soil Survey. Test pits throughout the site indicate that actual soil profiles observed are generally consistent with mapped series. Test pits within areas of hydric soils revealed low chroma matrix, gley, Mn or Fe concretions, mottling, oxidized rhizospheres, or other characteristics typically associated with hydric soils. All other test pits revealed high chroma soils with a typical matrix color and lack of ' other hydric indicators throughout the soil profile within the root zone. The portions of the site within the study areas contain primarily Mecklenburg (MeB & MeD) soils with smaller areas of Wilkes (WkB) or Iredell (IrB) soils at upper stream ' reaches and side slopes. The only soils within the study areas which were observed to be hydric were within stream channels, at pond edges, and in those areas along the channel which at one time had been impounded. ' A small area of the lower reaches of tributary T-2 appears to have been impounded at one time but was subsequently drained. This area occurs between channel sections T-2.5 and T- 2.6. A small seepage slope occurs near the toe of the dam below the existing pond at section ' T-2.9. The National Wetlands Inventory indicates that each of the two study areas contains an area of PUBHh (Palustrine, unconsolidated bottom, permanently flooded, diked/impounded). ' The area of tributary T-1 no longer exists, and the area of tributary T-2 represents the existing pond. ' The breached pond on tributary T-1 and the small breached impoundment on tributary T-2 do not appear on the National Wetland Inventory. ' The total contributing drainage area of tributary T-1 is approximately 33.6 acres. The total contributing drainage area of tributary T-2 is approximately 35.7 acres. These areas were mostly forested and were comprised of predominantly non-hydrophytic Oak-Hickory canopy with a sub-canopy of Red cedar, Dogwood, and Redbud. The ' herbaceous layer is dominated by Honeysuckle in most well drained areas and by Microstegium in areas which are subject to periodic surface flows. In those areas which border stream channels, the canopy included more hydrophytic canopy species of Maple, Sweet Gum, and Willow Oak and a sub-canopy which consists of saplings of the above ' species in addition to Privet, Deciduous holly, Paw-paw, and Cherry. Groundcovers near channels were dominated by Microstegium and Cardinal flower. ' Actual documented species which occur at the proposed crossing location within each study area are recorded on the enclosed data forms for both wetland and non-wetland sample plots. May 21, 1991 .Page two r These impact figures, as well as the attached maps, include all golf course impacts and residential lot fill, including that previously authorized under Nationwide Permit No. 26 (letter to Mr. David Wright from G. Wayne Wright, dated March 25, 1991). The only additional impacts on the site will be the minor roadcrossing previously authorized by Nationwide Permit Nos. 14 and 26. The total impact for the 12 minor roadcrossings, excluding Masters Hill Drive, is 1.9 acres. It is our opinion that the proposed project, as revised, provides the maximum practical impact avoidance and minimization. The resultant, unavoidable impacts ( total of 3.2 acres) will be mitigated by the creation of 5.5 acres of wetlands as described in our revised report dated May 21, 1991, and accompanying maps, for a ratio of 1.7 to 1.0 (1.7:1). ' The information submitted with Mr. Roark's letter indicates that your proposed work would involve 10 separate and distinct road crossings of minor tributaries to Clarke Creek together with additional road fill and lot development in headwater streams and their adjacent wetlands totaling ?. 0.9 acrss of adverse impact. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations ((",FR), Part 330, published in the Federal Register on November 13, 1986, lists nationwide permits. Authorization, was provided for minor road crossing fills including all attendant features, both temporary and permanent, that are part of a single and complete project for crossing of ' a non-tidal waterbody, provided that the crossing is culverted, bridged or otherwise designed to prevent the restriction of, and to withstand expected high flows and provided further that discharges into any wetlands adjacent to the waterbody do not extend beyond 100 feet on either side of the ordinary ' high water mark of that waterbody. Authorization was also provided for discharges of dredged or ;fill material into non-tidal rivers, streams, and their lakss and impoundments, including adjacent wetlands, that are located above the headwaters and other non-tidal waters of the United States, ?_. including adjacent wetlands, that ars not a part of a surface tributary system to interstate waters or navigable waters of the United States. This general authorization is valid only for work that causes the loss or substantial adverse modification of less than 1 acre of wetlands. Your work is authorized by nationwide permit provided it is accomplished in strict accordance with the, enclosed conditions. Please be aware that this t authorization does not relieve you of the responsibility to obtain any required State or local approval. 1 I .2. This verification will be valid until the ;nationwide pe,-mit is modified, reissued, or revoked. -All the nationwide pe=Lts are scheduled to be modified, reissued, or revoked prior to January 13, 1992.
