The Spill Prevention and Response Plan (SPRP) requires that a resO�psible person shall be on site at all times. Please update the SPRP to include the reonsible employees during all shifts along with the section of the SPPP that lists Responsible parties for the SPPP. The SPPP was last updated in 2006 and is reviewed annually. Qualitative Monitoring. Has the facility conducted its Qualitative Monitoring semi-annually? AT Comment: The.permittee could not provide documentation that the required semi-annual qualitative monitoring had been completed during the last 5-year permit term (some recent monitoring records were available). Please ensure going forward that the semi-annual monitoring is completed at Outfall 001 and the documentation is included in the SPPP. Please review this requirement and update the SPPP as appropriate. There was evidence that carbon black used onsite (fine particulate) has been entrained in stormwater runoff on site. However, the carbon black is captured in the on site stormwater retention pond and has not impacted stormwater discharges that leave the site through Outfall 001 at the front of the property. The complaint was investigated by Wes Bell and Roberto Scheller of this office on February 2, 2000. ARC is a manufacturer of rubber products for non -tire automotive applications. ARC was issued Stormwater Permit No. NCG050270 by the Division on May 1, 1998 for the discharge of stormwater to Beaver Creek._ The inspectors from this office met with Mr. Satterley to investigate the stormwater collection basin and compliance status with Stormwater Permit No. NCG050270. The stormwater collection basin contained a black sludge that had settled to the bottom. The rocks along the banks were also stained. Mr. Satterley confirmed that the black sludge was a carbon black powder used in ARC's manufacturing process. According to Mr. Satterley (and later confirmed by the inspectors), the carbon black powder is unloaded from a hopper type trailer into a temporary underground container. The contents are then pumped into several above ground silos. Minor spillages occur during the unloading process. During rainfall events, the spilled carbon black powder intermixes with stormwater and discharges into the stormwater collection basin. At the time of the investigation, the basin was discharging clear water. The receiving stream, Beaver Creek, was observed to contain no carbon black powder from the basin discharge. Complaint Investigation Page Two The Material Safety Data Sheet (MSDS) for the carbon black powder was reviewed by Mr. Satterley and the inspectors. The substance is nonhazardous and insoluble in water. In addition, it was determined that the stormwater collection basin was not located on ARC's property. Mr. Satterley was informed that although no carbon black powder was detected in the receiving stream, the facility is liable for any stormwater discharges containing the carbon black powder. In addition to the inspection of the stormwater collection basin, the compliance status with the Stormwater Permit No. NCGO50270 was reviewed. The facility failed to maintain the appropriate documentation such as: A stormwater pollution prevention plan, a stormwater management plan, a spill prevention and response plan, a preventative maintenance and good housekeeping program, employee training schedule, identification of the responsible party(s), and a facility inspection plan. The facility had also failed to perform the required qualitative monitoring for the entire years of 1998.and 1999. Mr. Satterley indicated that a consultant was recently hired to assist the facility in becoming compliant with all permit conditions. Mr. Satterley was informed that the documentation -should have been maintained once the permit was issued and that the failure to maintain the documentation was a violation of permit conditions. Mr. Satterley was courteous and very helpful throughout the investigation. A follow-up may be necessary to verify compliance with the conditions of Stormwater Permit No. NCG050270.
