On December 20, 2011, Ms. Marcia Allocco from the Mooresville Regional Office of the Division of Water
Quality (DWQ) conducted a site inspection of the AlphaGary facility. The site drains to an unnamed tributary to
Sugar Creek, Class C waters located in the Catawba River Basin. The site visit and file review revealed that
the subject facility is covered by NPDES General Stormwater Permit — NCG050000.
Accordingly, the following observations were noted during the DWQ inspection (please see the attached
addendum for information about your permit):
1) Stormwater Pollution Prevention Plan (SPPP1

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean WaterAct and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
stormwater pollution prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge in stormwater
runoff.

The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting issues, process, and condition requirements of your permit. Please see the
abovementioned website to obtain a copy of the permit so you may fully comply with the conditions therein.
Failure to properly comply with conditions of the permit, fike those bulleted below, constitutes permit
violations and is subject to civil penalty assessment of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by the fling of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted.and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine-
dewatering (pursuant to the type of General Permit) until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):
o Development and compliance with the Stormwater Pollution Prevention Plan
o Collection, reporting, and recording of Analytical Monitoring
o Collection, reporting, and recording of Qualitative Monitoring

o Collection, reporting, and recording of Vehicle Maintenance Monitoring
o Records - Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration - The permittee is not authorized to discharge after the expiration date of the general
permit_ In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to expiration date. Any permittee that has not requested renewal at
least 180 days prior to expiration, or any permittee that does not have a permit after the
expiration and has not requested renewal at least 180 days prior to expiration, will be subject to
enforcement. Failure to renew your permit is a violation.
o Transfer - The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director of the Division of
Water Quality. The Director may require modification or revocation and reissuance of the
Certificate of Coverage to change the name and incorporate such other requirements as may be
necessary under the Clean Water Act_ The Permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change - The permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit_ Name and ownership changes required you to complete
a Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

The facility is a synthetic minor under the CAA and is permitted by Mecklenburg County (#11-032-029, last inspection
8/30/11), a RCRA small quantity generator (last inspection 11129/06), and reports to the EPA through the TRt system.

Comment: The permittee had a well -developed and implemented Stormwater
Pollution Prevention Plan (SPPP). However, the SPPP did not contain documentation
that inspections of the stormwater facilities had been completed. Please start
documenting these inspections required by Part II, paragraph 8 of the general permit.
The Spill Response Team is trained in the stormwater permit and impacts to stormwater
runoff as well as all new employees. Training covers employees on all shifts at the
facility since production is conducted 24/7.
There have been no spills in the last three years. A spill of diesel fuel from a third -party
transporter was reported to DWQ through Incident 200802905.

Comment: Permittee had noted 4 outfalls in the Stormwater Pollution Prevention
Plan. However, during the site inspection it was determined that an additional outfall
should be designated (outfall 005).
There was a large amount of accumulated sediment in the drop inlet liners for catch
basins that drain to outfall 004. There was also an oily sheen on the water accumulated
in the corner of this area that should be absorbed and disposed of properly_ Some of
the outfall structures/pipes have begun to be impacted by accumulated sediment/resin.
The permittee should perform the required maintenance to ensure these structures
perform as designed as required by Part III, Section C, paragraph #1.

In response to your renewal application for continued coverage under stormwater General Permit NCGO50000 the Division of
Water (.Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the stale of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.)
She following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Permit NCG050000
• A copy of a Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all
the changes in the reissued permit.
The more significant changes in the General Permit since your last Certificate of Coverage include the following:
• Permit cover page - Coverage is expanded to include industrial activities similar to the categorically identified industries.
• Part I Section A -- This part explains that the No Exposure Eaclusion from permitting option may be available to the
permittee.
• Part II Section A - Several minor expansions and clarifications of the required content of the Stormwater Pollution
Prevention Plan have been added. Please be sure that your plan is updated to comply with the new requirements.
• Part II Section B -- Qualitative monitoring must now be conducted during a representative storm event.
• Part II Section B - The permittee is required to keep a written record of his response to problems identified by his
qualitative monitoring observations.
• Part II Section C - For facilities with vehicle maintenance activities using more than 55 gallons of new motor oil per month,
new provisions require that discharges from the vehicle maintenance areas be sampled twice per year, and that the
sampling results be compared to new numerical benchmark values. (The previous cutoff concentrations have been
eliminated.)
• Part II Section C - For facilities with vehicle maintenance activities using more than 55 gallons of new motor oil per month,
new provisions require the permittee to execute Tier One and Tier Two response actions, based on the first benchmark
exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the
permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive monitoring events
show no benchmark exceedences.
• Part Il Section C - This part contains a new provision that four exceedences of any particular benchmark will trigger
increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct the
permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control
measures.

The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all
the changes in the reissued permit.
The more significant changes in the General Permit since your last Certificate of Coverage include the following:
• Permit cover page - Coverage is expanded to include industrial activities similar to the categorically identified industries.
• Part I Section A - This part explains that the No Exposure Exclusion from permitting option may be available to the
permittee.
• Part II Section A - Several minor expansions and clarifications of the required content of the Stormwater Pollution
Prevention Plan have been added. Please be sure that your plan is updated to comply with the new requirements.
• Part II Section B - Qualitative monitoring must now be conducted during a representative storm event.
Part 11 Section B - The permittee is required to keep a written record of his response to problems identified by his
qualitative monitoring observations.
• Part II Section C - For facilities with vehicle maintenance activities using more than 55 gallons of new motor oil per month,
new provisions require that discharges from the vehicle maintenance areas be sampled twice per year, and that the
sampling results be compared to new numerical benchmark values. (The previous cutoff concentrations have been
eliminated.)
• Part 11 Section C - For facilities with vehicle maintenance activities using more than 55 gallons of new motor oil per month,
new provisions require the permittee to execute Tier One and Tier Two response actions, based on the first benchmark.

1 am writing this letter to follow up on my telephone call to you last Friday, October 10', in which I
reported a diesel fuel spill from a Fed -Ex delivery truck that discharged onto our property and into a storm
drain. The Fed -Ex truck was bringing a delivery to our facility and the driver arrived late in the evening on
Thursday, October 4'h, parking outside one of our locked gates on a public right-of-way. Sometime during
the night, as evidenced by the attached photos taken by our security cameras, a leak occurred from the
truck's fuel tank, flowing onto our driveway and into the storm drain. By about 7 a.m., the truck had been
driven to the other end of our property where the delivery was made. The driver did not mention the spill
to us. Because our plant operations were shut down on Friday and there was a reduced staff on -site, the
spill was not discovered until approximately mid -day Friday. The spill entered a storm drain that feeds into
a settling pond on our property, which happened to be dry at the time of the incident. A copy of a portion
of our stormwater pollution prevention plan (SWPPP) site plan is included with this letter to diagram the
spill. Our SWPPP was developed in accordance with the requirements of our stormwater permit,
(, CGO50 52 -it will be updated to include a narrative for this spill. The spill was cleaned up by a
hazardous material cleanup crew on Friday afternoon. In addition to cleaning the driveway, the crew
released approximately 150 gallons of water into the storm drain and suctioned the discharge at the point
where it drained into the settling pond. Several absorbent booms were also placed at the discharge point to
capture any potential residual fuel. We have inspected the settling pond several times since the cleanup and
there is no evidence that any fuel traveled beyond it. The spill appears to have been contained and cleaned.
The cleanup personnel estimated that approximately 30 gallons of fuel were released from the truck onto
our property, based on losses reported by the truck driver.

on March 31.2003. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by early spring of 2003. Once the permit is reissued. your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the ;general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit coverage will he expiring. Enclosed you will find a Permit Coverage Renewal
Application Form. The application must be completed and returned by October 2.2002 in order to assure
continued coverage under the general permit. Due to staff and budget constraints. letters confirming our receipt of
the completed application will not be sent.
Failure to request renewal within the time period specified, may result in a civil assessment of at least $250.00
Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your
facility without covera�,e under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1
and could result in assessments of civil penalties of up to $10.000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "storm water discharges associated with industrial activity." (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facility industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional
