Per our conversation today, I am forwarding you a copy of the test results from Pace Laboratory on the water from our
dike area that was contaminated with Black Beauty, the abrasive material used to remove the exterior paint from the
bottom 2 feet of one of our storage tanks. Residual sludge of the abrasive material was packaged in (2) 55 gallon steel
drums and will be disposed of through our Transportation, Storage and Disposal facility. The dike area contained water
from the Christmas snow event and was pressure washed with potable water obtained from our on -site county water
supply, We have approximately 11,500 gallons of water currently being stored in a frac tank on -site that I would like to
obtain permission to discharge to our retention pond. As you can see from the test results, the water was determined to
be non -hazardous and the MSDS shows that the abrasive material is eco-friendly carbon which is also used in fish
aquarium filters. Please let me know if you require additional information. Thank you in advance.

FACT: Boiler slag is formed when extremely hot, molten coal ash is
quenched with cold water creating a vitrified amorphous, solid,
glassy matrix.
FACT: Boiler slag is a vitrified material which is a very durable and
environmentally stable form that permanently immobilizes its
chemical constituents into the glassy amorphous structure, even
when broken into tiny fragments during blasting.

Product is nonflammable, non -explosive and stable under normal conditions of use, storage and transportation.
SECTION V — HEALTH HAZARD DATA
EXPOSURE LIMITS: Refer to Section II which highlights the Permissible Exposure Limit (PEL)_ This limit is
published and enforced by OSHA as a legal standard. Most PELs are expressed as eight hour average airborne
concentrations. The nuisance dust exposure standard should be followed if exceeded than the appropriate respiratory
protection equipment should be wom.
ACUTE and CHRONIC TOXICITY: Exposure to and contact from dust may irritate the respiratory system, eyes, or
skin. Coal slag is not listed on the NTP, IARC, or OSHA list of carcinogens. If ingested it may cause nausea and
vomiting.

1. Eye Contact — Immediately flush eyes thoroughly with water or an ophthalmic saline solution.*
2. Skin Contact — Wash skin with soap and water if irritation occurs.'
3. Inhalation — Remove affected person(s) to fresh air source.*

*Note: if symptoms persist, contact a physician or other medical personnel.
SECTION VI — CONTROL MEASURES
RESPIRATOR PROTECTION: If airborne concentrations exceed recommended exposure limits, a suitable
NIOSH/MSHA approved filter respirator should be worn. General ventilation or local exhaust is normally adequate to
control dust emissions, if not engineering controls should be utilized.
EYE: Safety glasses with side shields should be worn as minimum protection from impact. Dust goggles should be
worn when excessively dusty conditions are present or anticipated.
GENERAL: The use of hard hats and hard toe shoes is recommended. Gloves may be worn to protect from abrasion as
well as long sleeve shirts to minimize dermal exposure and potential skin irritation.
SECTION VII — SPILL, LEAK, AND DISPOSAL PROCEDURES
No special procedures required for clean-up, but k is recommended that this is done mechanically or through the use of
hand tools. Wetting with water will reduce any airborne dust. Uncontaminated product does not exceed Toxicity

waste landfill according to applicable Federal, State and Local regulations.

Vill. Silicosis Warning A WARNING Breathing dust containing silica could cause silicosis, a fatal lung disease.
Breathing dust during blasting operations, post -blast cleaning operations, and/
or servicing equipment within the blasting area may expose an individual to conditions that could
cause asbestosis, lead poisoning and/or other serious or fatal diseases. Harmful dust containing
toxic material from abrasives or surfaces being blasted can remain suspended in the air for long
periods of time after blasting has ceased. A NIDSH-approved, welt -maintained, respirator designed
for the specific operation being performed must be used by anyone blasting, handling or using the
abrasive, and anyone in the area of the dust. Failure to comply with the above warning could result
in death or serious injury.
A WARNING You must comply with all OSHA, local, City, State, Province, Country and
jurisdiction regulations, ordinances and standards, related to your particular
work area and environment. Keep unprotected individuals out of the work area. Failure to comply
with the above warning could result in death or serious injury.

On December 15, 2010, Ms. Marcia Allocco from the Mooresville Regional Office of the Division of Water
Quality (DWQ) conducted a site inspection of the Foamex Innovations, Inc. facility located at 18801 Old
Statesville Road in Cornelius, Mecklenburg County, North Carolina. The site drains to an unnamed tributary to
Caldwell Station Creek, Class C waters located in the Catawba River Basin. The site visit and file review
revealed that the subject facility is covered by NPDES General Stormwater Permit — NCG050000.
Accordingly, the following observations were rioted during the DWQ inspection (please see the attached
addendum for information about your permit):
1) Stormwater Pollution Prevention Plan (SPPP)

4) Permit and Outfalls
Please follow-up on the catch basin near the maintenance shop since it was not clear to where it drains
stormwater. You may send me an e-mail detailing the final resolution (dye tracing or closure of catch basin).
Mecklenburg County personnel should be following -up with Ms. Biake to help determine if there is any risk to
the Foamex Innovations, Inc. stormwater pond due to the incision with the UT to Caldwell Station Creek.

ADDENDUM
The National Pollutant Discharge Elimination System (NPDES) program was established under the federal
Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The
NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and
operations planning to reduce pollutant sources.
Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are
required to obtain permit coverage under a general permit or an individual permit, depending upon the
facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general
stormwater permits in North Carolina. One condition that is applicable to both the general permits and
individual stormwater permits is the requirement to develop and implement site -specific comprehensive
stormwater pollution prevention plans (SPPP). These plans are required to include a comprehensive
evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge in stormwater
runoff,

The following items are a subset of permit requirements and are listed to assist you and help bring your
attention to certain permitting.issues, process, and condition requirements of your permit. Please see the
abovementioned website to obtain a copy of the permit so you may fully comply with the conditions therein.
Failure to properly comply with conditions of the permit, like those bulleted below, constitutes permit
violations and is subject to civil penalty assessment of up to $25,000.00 per day.
• Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage
under a general NPDES stormwater permit or an individual NPDES stormwater permit
• All persons desiring to have facilities covered by a General Permit must register with the Division of
Water Quality (DWQ) by the filing of a Notice of Intent (NOI) and Applicable Fees.
• This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any
discharge of stormwater associated with the industrial activity, process wastewater, and/or mine
dewatering.
• Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage
(COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General
Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine
dewatering (pursuant to the type of General Permit) until the permit expires or is modified or revoked.
• Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable
non-stormwater discharge or is covered by another permit, authorization, or approval.
• There are currently 19 active general permits. Permit conditions vary accordingly; however, most of the
permits have the following condition requirements (you must read your entire permit to ensure full
compliance):

o Collection, reporting, and recording of Qualitative Monitoring
o Collection, reporting, and recording of Vehicle Maintenance Monitoring
o Records -- Visual monitoring shall be documented and records maintained at the facility along
with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall
also be maintained on site. The Permittee shall retain records of all monitoring information,
including all calibration and maintenance records and all original strip -chart recordings for
continuous monitoring instrumentation, and copies of all reports required by this general permit
for a period of at least 5 years from the date of the sample measurement, report, or application.
o Expiration — The permittee is not authorized to discharge after the expiration date of the general
permit. In order to receive automatic authorization to discharge beyond the expiration date, the
permittee shall submit forms and fees as are required by the agency authorized to issue permits
no later than 180-days prior to expiration date, Any permittee that has not requested renewal at
least 180 days prior to expiration, or any permittee that does not have a permit after the
expiration and has not requested renewal at least 180 days prior to expiration, will be subject to
enforcement. Failure to renew your permit is a violation.
o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not
transferable to any person expect after notice to and approval by the Director of the Division of
Water Quality. The Director may require modification or revocation and reissuance of the
Certificate of Coverage to change the name and incorporate such other requirements as may be
necessary under the Clean Water Act. The permit is NOT transferable.
o Name Change, Closure, or Facility Ownership change — The permittee is required to notify the
Division in writing in the event the permitted facility is sold or closed. The Division of Water
Quality views changes of name or ownership as a modification that requires the Director's
approval and reissuance of the permit. Name and ownership changes required you to complete
a Name/Ownership Change Form from the Division and mail it back to the Division of Water
Quality along with all appropriate information.
o Proper Operation and Maintenance is a requirement of the permit.

This is the first inspection of NCG050218. No other spills of water quality incidents are on record for the facility.
Stormwater Qutfalls (cont'd):
Most of the stormwater at the site is discharged into the on -site pond- The pond also serves as a supply of fire
suppression water. The pond does not appear to be dammed and flows over a riprap channel before entering an
unnamed tributary (UT) to Caldwell Station Creek; a small tributary to McDowell Creek. The receiving stream (flowing
water was noted) for the pond's discharge was heavily incised (deeply cut) and appeared to be working its way toward the
pond.
A call was made to Mecklenburg County personnel to determine if this stream segment was reviewed during the
development of the stormwater management plan for McDowell Creek. The County shows the UT terminating before it
reaches the Foamex Innovations (FXI) pond. Mr. David Kroening with Mecklenburg County ((704) 336-54481 stated that
the County would conduct a stream assessment to determine if there is still active incision in the UT, which may pose a
threat to the FXI pond. He stated Ms. Blake with FXI would be contacted and site access would be coordinated with Ms.
Blake since part of the UT resides on FXI property.
A copy of a 1970 USGS map has been included with this inspection report to show the link between the pond and surface
waters.

Comment: There is a detailed SPPP for the facility (combined with the emergency
response and SPCC requirements). The SPPP contains a general location map but it
contained minimal information. Most of the required information for the general location
map was noted on the site map. Please add the name of the receiving stream (UT to
Caldwell Creek), accurate lat. and long. coordinates for the point of discharge, and
information on stream -impairment/TMDL development to the site map (space available).
The SPPP is updated annually (last update 1/29110) but did not contain a Feasibility
study; please add this section to the plan. Employee training (combined spill, SPPP,

Comment- The permittee has designated one outfall on site, discharge from the FXI
pond. A second outfall was observed, which collect roof drain water from the foam
storage building and directs it to a ditch along Bailey Road on the south side of the
facility. There are no roof vents on the storage building so this water is not exposed to
industrial activities and does not need to be added to the SPPP as an outfall.
During the inspection a stormwater catch basin was discovered next to the maintenance
building which does not appear on the SPPP site map. Stormwater flow from this catch
basin appeared to be away from the main facility and not towards the stormwater pond.
The permittee shall investigate to where this catch basin drains stormwater or FXI may
choose to permanently sea] it since it does not appear to drain a large volume of water
(permittee's choice).

between the Foamex pond and the UT to Caldwell Station, It
shows a I O-ft drop-off (each topo line= 10 ft) from the pond
but as I stated in the inspection the channel is incised (has

on March 31. 2003. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by early spring of 2003. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit_
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit coverage will be expiring. Enclosed you will find a Permit Coverage Renewal
Application Form. The application must be completed and returned by October 2, 2002 in order to assure
continued coverage under the general permit. Due to staff and budget constraints. letters confirming our receipt of
the completed application will not be sent.
Failure to request renewal within the time period specified, may result in a civil assessment of al least $250.00,
Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your
facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1
and could result in assessments of civil penalties of up to $10.000 per day.
Please note that recent Rderal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I l categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure". i.e. the facility industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

If the subject stormwater discharge to waters of the state has been terminated. please complete the enclosed
Rescission Request Form- Mailing instructions are listed on the bottom of the form. You will be notified when the
rescission process has been completed.

A copy of a Technical Bulletin on the stormwater program which outlines program components
and addresses frequently asked questions.
■ A corrected Certificate of Coverage if you indicated a name or address change on the Renewal
Form returned to the Division.
Your certificate of coverage is not transferable except after notice to DWQ. The Division of Water
Quality may require modification or revocation and reissuance of the certificate of coverage.
This permit does not affect the legal requirements to obtain other permits which may be required by
DWQ or permits required by the Division. of Land Resources, Division of Air Quality, Coastal Area
Management Act or any other Federal or Local governmental permits that may be required.
