Chapter 143, Article 21 of the North Carolina General Starutes (G.S.) authorizes and directs the
Environmental Management Commission of the Department of Environment & Natural Resources to
protect and preserve the water resources of the State. The Division of Water Quality (DWQ) has the
delegated authority to enforce adopted pollution control rules and regulations.
Enclosed please find a copy of the Compliance Evaluation inspection Report for the inspection conducted at
the subject facility on December 29, 2010 by Ms. Donna Hood of this Office.
This report is being issued as a Notice of Violation (NOV) because of the violations of the subject NPDES
permit ana North Carolina General Statute (G.S.) 143-215.1 as detailed in the Stormwater Pollution
Prevention and Permit Sections of the attached report. Pursuant to G.S. 143-215.6A, a civil penalty of not
more than twenty' five -thousand dollars ($25,000.00) per violation per day may be assessed against any person
who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued
pursuant to G.S. 143-215"1.
It is requested that a written response be submitted to this Office by January 28, 2011, addressing the
above -noted violations in the attached report. In responding, please address your comments to the attention of
Ms. Marcia Allocco.
This purpose of this letter is also to notify you that this Office is considering sending a
Recommendation for Enforcement to the Director of the Division for the violations of GS. 143.215.1 and the
NPDES General Stormwater Permit COC No. NCG050180. If you have an explanation for the violation
that you wish to present, please include it in the requested response. Your explanation will be reviewed

UCS. Inc was last inspected en January 22, 2010. The facility receives a Notice of Violation (NOV-2010-PC-0085) for
that inspection based on conditions at the site. The :aciliti's res'ense tc NOV-2010-PC-008E stated that a Stormwater
Pollution Prevention Plan would be developed and required monitoring would be per -formed. As of this inspection the
permittee has nct implemented any part of the stormwater permit nor performed any cf the actions stated in his response
letter. (See attached) The permit has been in effect since 06I01f2008 with the permit application received on 01i31i2008.

In response to the notice of violation for providing a Storm Water Pollution Prevention Plan and
Qualitative Monitoring Sections; UCS Inc and it's facility personal responsible for Storm Water Pollution
and Prevention have taken the following steps;
As of February 28� 2010 a Storm Water Pollution Prevention Plan (SPPP) will be completed and
implemented. It will be submitted to Nlr. Bell and his office for review and record.
All "blasting -type' material has been collected and properly discharged in a sealed container to
prevent future leaks of the material. All future disposal will be made in a similar container prior to be
placed in the dumpster for collection.
Visual monitoring has been performed and will continue to be performed on a monthly basis. A
schedule for the qualitative and visual inspection will be detailed in the forthcoming (SPPP) report. The
future scheduled will meet the required bi-annual inspection with a 60 day separation between
inspections. Qualitative monitoring results will be recorded on the sheet provided by Mr. Bell for future
reference.
As of February 28`', 2010 UCS Inc. will be in compliance with the analytical monitoring required
by it's permits conditions.
A copy of the certificate of coverage will be kept on file on -site for future inspections.

and implemented. Blasting -type material was observed adjacent to a dumpster and the
material's recovery system. The facility staff must ensure to incorporate good
housekeeping/preventive maintenance at these areas to prevent exposures to
stormwater runoff.

Comment: The facility has two stormwater outfalls. Only one stormwater outfall was
observed discharging at the time of the inspection. The stormwater appeared clear with
no sheens. A copy of the Permit was given to the facility staff during the inspection;
however, the facility staff must also ensure a copy Certificate of Coverage is kept on -site.

In response to your renewal application for continued coverage under stormwater General Permit NCG050000 the Division of
Water Quality (DWQ) is forwarding herewith the reissued stormwater General Permit. This permit is reissued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between the state of North
Carolina and the U.S. Environmental Protection Agency, dated October 15, 2007 (or as subsequently amended.)
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of stormwater General Permit NCG050000
• A copy of a Technical Bulletin for the General Permit
• Five copies of the Discharge Monitoring Report (DMR) Form
• Five copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater only, and it specifies your obligations with respect to stormwater
discharge controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself with all
the changes in the reissued permit.
The more significant changes in the General Permit since the your last Certificate of Coverage include the following:
• Permit cover page — Coverage is expanded to include industrial activities similar to the categorically identified industries.
• Part I Section A — This part explains that the No Exposure Exclusion from permitting option may be available to the
permittee.
• Part II Section A — Several minor expansions and clarifications of the required content of the Stormwater Pollution
Prevention Plan have been added. Please be sure that your plan is updated to comply with the new requirements.
• Part li Section B -- Qualitative monitoring must now be conducted during a representative storm event.
• Part ii Section B — The permittee is required to keep a written record of his response to problems identified by his
qualitative monitoring observations.
• Part II Section C - For facilities with vehicle maintenance activities using more than 55 gallons of new motor oil per month,
new provisions require that discharges from the vehicle maintenance areas be sampled twice per year, and that the
sampling results be compared to new numerical benchmark values. (The previous cutoff concentrations have been
eliminated.)
• Part II Section C — For facilities with vehicle maintenance activities using more than 55 gallons of new motor oil per month,
new provisions require the permittee to execute -tier One and Tier Two response actions, based on the first benchmark
exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the
permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive monitoring events
show no benchmark exceedences.
• Part li Section C — This part contains a new provision that four exceedences of any particular benchmark will trigger
increased DWQ involvement in the permittee's stormwater management and control actions. DWO may direct the
permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control
measures.

Your facility is currently covered for stormwater discharge under General Permit NCG050000. This permit expires
on March 31. 2003. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by early spring of 2003. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit coverage will be expiring. Enclosed you will find a Permit Coverage Renewal
Application Form. The application must be completed and returned by October 2, 2002 in order to assure
continued coverage under the general permit. Due to staff and budget constraints, letters confirming our receipt of
the completed application will not be sent.
Failure to request renewal within the time period specified, may result in a civil assessment of at least $250.00_
Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your
facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1
and could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facility industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

Permits Unit Web Site at http://h2o.enr.state.nc.us/su/stormwater.htmI
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom of the form_ You will be notified when the
rescission process has been completed.
