The site drains to Steele Creek, Class C waters located in the Catawba River Basin. The site visit and file review revealed that the subject facility is covered by NPDES General Stormwater Permit — NCG050129. This inspection was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part II Section H. As noted above and in the enclosed report, permit and/or City of Charlotte Stormwater Ordinance deficiencies were noted during the inspection. It is requested that a written response be submitted to this Office by August 2, 2013, addressing these violations. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1. The NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and operations planning to reduce pollutant sources. Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general stormwater permits in North Carolina. One condition that is applicable to both the general permits and individual stormwater permits is the requirement to develop and implement site -speck comprehensive Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge. Copies of the general permits and accompanying documents can be accessed from the following webpage: hitp://portal.ncdenr.org/web/wq/ws/su/npdessw#General_Per-mits_NPDES. Permit text, technical bulletins, discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES- General Stormwater Permit] can be found on this website. The following items are a subset of permit requirements and are listed to assist you and help bring your attention to certain permitting issues, process and condition requirements of your permit. Please see the' above mentioned website to obtain a copy of the permit so. you may fully comply with all the conditions therein. Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day.. • Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general NPDES stormwater permit or an individual NPDES stormwater permit • All persons desiring to'have facilities covered by a General Permit must register with the Division of Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees. • This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any discharge of stormwater associated with the industrial activity, process wastewater, and/or mine dewatering. • Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage (COG) may be issued.. If this Certificate of Coverage is issued the facility is covered by the General Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked. • Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable non-stormwater discharge or is covered by another permit, authorization, or approval_ • There are currently 19 active general permits. Copies of the analytical monitoring results shall also be maintained on site. The Permittee shall retain records of all monitoring information, including all calibration and maintenance records and all original strip -chart recordings for continuous monitoring instrumentation, and copies of all reports required by this general permit for a period of at least 5 years from the date of the sample measurement, report, or application. o Expiration — The permittee is not authorized to discharge after the expiration date of the general permit. In order to receive automatic authorization to discharge beyond the expiration date, the permittee shall submit forms and fees as are required by the agency authorized to issue permits no later than 180-days prior to the expiration date. Any permittee that has not requested renewal at least 180 days prior to expiration, or any permittee that does not have a permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subject to enforcement. Failure to renew your permit is a violation_ o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not transferable to any person expect after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the Certificate of Coverage to change the name and incorporate such other requirements as may be necessary under the Clean Water Act. The Permit is NOT transferable. o Name Change, Closure,'or Facility Ownership change--'Permittee is required to'notify the Division in writing in the event the permitted facility is sold or closed. The Division of Water Quality views changes of name or ownership as a modification that requires the Director's approval and reissuance of the permit. Forbo Movement Systems manufactures and distributes conveyor belts. Compliance History: The facility was inspected on April 7, 2008, by Charlotte -Mecklenburg Storm Water Services (CMSWS) under previous ownership (Scandura, Inc./Fenner Dunlop). The Division of Water Quality issued a Notice of Deficiency as a result of the inspection. The facility was compliant during the follow-up inspection on July 11, 2008. Industrial Operations/City of Charlotte Stormwater Ordinance Review: Illicit discharges/connections — An emergency eye wash station and a pipe from a boiler are plumbed to the outside. The illicit connections should be removed. A petroleum substance was observed on the ground below two of the facility's Smog -Hog units. The permittee needs to prevent the discharge of the petroleum substance to the ground. It was observed the other Smog -Hog units had pans under the them to capture any discharges. The facility makes paste on site used for manufacturing the conveyor belts. Dry and liquid chemicals are delivered to the plant and are unloaded in covered areas. The facility operates from Monday thru Saturday, twenty-four hours a day. All process activities are conducted indoors and are not exposed to stormwater. Compliance History: The permitteelfacility does not have any prior compliance issues with the NC Division of Water Quality or Charlotte -Mecklenburg Storm Water Services (CMSWS). Industrial Operations/City of Charlotte Stormwater Ordinance Review: Oil Spills - Oil staining was observed on the ground, gravel, and walls of the production building on site. The oil appeared to be leaking from pipes extending from the top of the production building. The facility should investigate the cause of the illicit discharges and cease the discharge. According to facility personnel Hepaco is being contracted to clean up the oil spills and restore the affected area. During a follow up visit of the facility on April 21, 2008, by CMSWS personnel one of the oil stains was cleaned up by Hepaco. The facility is waiting for Hepaco to complete the restoration of the other affected areas. Air Filter - Dust is collected through a filter system at the facility. The buildup of dust was observed at the base of the filter. The dust should be properly disposed of in the trash to avoid contact with stormwater. Emergency Eye Wash - The emergency eyewash discharge pipe extends from inside the building to the ground. This is an illicit connection and should be piped to the sanitary sewer system. Boiler — The boiler discharge pipe drains outside onto the pavement. This is an illicit discharge and should be piped to the sanitary sewer system. Water Softener Device - The facility's water softener device treats potable water before it enters the facility's boiler. In the event of an overflow of the boiler, a pipe extends from the water softener device allowing treated water to be discharged to the ground. This is an illicit connection and should be piped to the sanitary sewer system. Hydraulic fluid is drained from maintenance equipment on site_ The facility is a small quantity generator of hazardous waste, primarily mineral spirits. This facility covers Norfolk Southern's Piedmont Division and operates 24 hours a day, 7 days a week. The on -site wastewater pretreatment plant (including the oil/water separator) is permitted to discharge to Charlotte Mecklenburg Utilities sanitary sewer system. Haz-Mat Transportation and Disposal collects and disposes of used oil and antifreeze. Compliance History: The permitteelfacility does not have any prior compliance issues with the NC Division of Water Quality and the following information was found in the Charlotte -Mecklenburg Storm Water Services (CMSWS) files. On January 2, 2004, CMSWS investigated a 5,000-gallon wastewater spill at the facility that reached an unnamed tributary to Little Sugar Creek. Industrial OperationslCityof Charlotte Stormwater Ordinance Review: Heavy Repair Shop - This shop is the area where large track maintenance equipment is refurbished. Trench drains are located along overhead doors. Floor drains are located in the shop_ Staff noted that these drains are plumbed to the on -site wastewater treatment plant. Two 55-gallon parts washer fluid barrels were located in the shop. One 169-gallon used oil tank and one 250-gallon mobile reclaimed hydraulic oil tank were located in the shop. A spill kit was available in the shop. The shop appeared to be in good condition. Staging Area - Large track maintenance equipment waiting for reconditioning is staged in this area, outside and exposed to stormwater. The area is paved with a series of storm drain inlets. Staff noted that all storm drain inlets draining this area are plumbed to the on -site wastewater treatment plant. Oil staining and absorbent material were observed on the pavement beneath the equipment. Staff noted the Staging Area is pressure washed once or twice a year. The area appeared to be in good condition. Equipment Wash Bay - This room is also known as the "Steam Track." Large track maintenance equipment and smaller equipment are washed in this enclosed wash bay. A trench drain was located along the overhead bay door and the middle of the wash bay. One 500-gallon detergent tote was located inside the bay. Staff noted that the trench drains are plumbed to the on -site wastewater treatment plant and once or twice a year the sludge is removed from the floor drain by Zebra, HEPACO, or Haz-Mat Transportation and Disposal. During the inspection a hot water condensation line was observed plumbed outside to the down spout storm drain fine that discharges to the on -site stormwater detention area. Staff explained that boiler water (at -2500) and steam are discharged from this line. Norfolk Southern shall remove all illicit connections and immediately discontinue illegal discharges to the storm drain system. Paint Room - Equipment is painted in this enclosed room. Trench drains are located along the overhead bay doors. There were no floor drains in this room. Staff noted that these drains lead to the on -site wastewater treatment plant. The Paint Room appeared to be in good condition. The concreted floor of the transfer table is used as a storage area for large equipment pieces. There were no drains observed inside this area. The transfer table appeared to be in good condition. Heavy Repair Shop -- Large track maintenance equipment is repaired in this shop. Trench drains were located along overhead bay doors and floor drains were located throughout the shop. Staff noted that trench and floor drains are plumbed to the on -site wastewater treatment plant. One 160-gallon used oil tank was located in the shop. The Heavy Repair Shop appeared to be in good condition. Battery Storage — New and used batteries are stored outside, behind the Heavy Repair Shop, in a partially covered container, above ground level. The used batteries are partially exposed to stormwater. Norfolk Southern should consider storing used batteries in a location not exposed to stormwater. Hazardous Waste Collection Area — Hazardous waste is staged in barrels outside in a concreted area. Barrels are stored on pallets inside a locked fence and exposed to stormwater while awaiting disposal. During the inspection there was one 55-gallon barrel of oily rags in the Hazardous Waste Collection Area. This area appeared to be in good condition. Wastewater Tanks — Two 10,000-gallon aboveground wastewater tanks are stored outside and exposed to stormwater. The tanks are double -walled and appeared to be in good condition. Collection Hoppers — Small covered waste collection containers, also known as "Collection Hoppers" are stared outside on a gravel lot, exposed to stormwater. The waste is collected by Haz-Mat Transportation and Disposal. These containers appeared to be in good condition. Wastewater Pretreatment Plant — The on -site wastewater pretreatment plant discharges to the Charlotte Mecklenburg Utilities sanitary sewer system, where wastewater is treated. The on -site plant treats on average 2,000 to 2,500 gallons a day. During storm events the wastewater plant treats on average 6,000 to 8,000 gallons a day. Three 55-gallon barrels of flocculent were stored outside on pallets in a gravel lot and exposed to stormwater. Staff noted that sludge is removed from the plant three times a year. The wastewater pretreatment plant appeared to be in good condition. Empty_ Barrels — Four 55-gallon barrels were observed in a gravel lot near the wastewater treatment plant during the inspection. The barrels were located outside and exposed to stormwater above ground level. The barrels were upside down with the tops removed. It was unclear if the barrels had been washed out. Staff noted that it is not a facility practice to.store empty barrels in this manner. Norfolk Southern should implement procedures for proper storage of empty barrels to prevent pollution discharges. Large Scrap Metal Bin — One large scrap metal bin was located outside, uncovered, and exposed to stormwater. The bin appeared to be in good condition. During the inspection rust was observed on the supply line of the tank. Norfolk Southern should conduct proper maintenance on storage tanks to prevent potential pollution discharges. Material Storage Area — Immediately to the west and north of the on -site stormwater detention basin is a large material storage area that is located outside on both concrete and gravel surfaces. Large and small equipment, including engines and engine parts, are stored outside and exposed to stormwater in this area. During the inspection dark staining and dead grass was observed around stored equipment. Dark staining, standing oil, and absorbent materials were observed on the gravel and concrete beneath the stored engines and engine parts. Stormwater in this area flows across the storage area and into the detention basin by sheet flow. Norfolk Southern should conduct regular inspections of the Material Storage Area and immediately remove all spills. Material Storage Area — To the east of the machine shop is an outside material storage area that is exposed to stormwater. Machine parts, including hydraulic cylinders, are stored on a concrete surface in this area. During the inspection new and used hydraulic cylinders were observed stored on carts and shelving above ground -level. Heavy staining and standing product was observed on the concrete beneath the stored hydraulic cylinders. Storm drains that drain to the on -site detention basin are located in this area. New batteries were stored in a covered container in this area. Norfolk Southern shall property remove all spills and impacted soils as per the Oil Pollution and Hazardous Substances Control Act of 1978 (NC G. S. 143-215.75). The facility should consider covered storage with spill containment for leaking hydraulic cylinders. Mobile Tanks — Immediately west of the Cleaning/Oil Storage Building portable aboveground storage tanks are stored outside on a concrete surface, exposed to stormwater. All tanks are double walled. Storm drains in this area are plumbed to the on -site wastewater pretreatment plant. The following aboveground mobile tanks were observed during the inspection appeared to be in good condition: • Three 55-gallon new hydraulic oil tank One 500-gallon used oil tank • Two 250-gallon diesel fuel tank 0 One 500-gallon reclaimed diesel fuel tank • Three 250-gallon reclaimed hydraulic oil tank 0 One 250-gallon used antifreeze tank. Oil Storage Building — Petroleum products and spill kits are stored in this building. One 169-gallon aboveground used oil tank was located in this building. During the inspection absorbent pads were observed on the ground beneath the used oil tank. Staff noted the floor drains in the building are plumbed to the on -site wastewater pretreatment plant. Fifteen 55-gallon barrels containing new oil and hydraulic fluid were located on spill carts were also located in this building. Boiler Room — One large boiler is located inside an enclosed building. During the inspection two lines were observed piped outside from the boiler. Staff explained that these lines were boiler vents that could potential release steam or hot water. Staff noted that the entire boiler system is to be replaced before the end of 2008. Blacksmith Shop — Metal is cut and bent in this shop. One 55-gallon parts washer barrel was observed in the shop. This shop appeared to be in good condition. Machine Sho — This building consists of closed system metal cutting machines. There were no floor drains inside the shop. One 55- gallon barrel of metal working fluid was located in the shop. This shop appeared to be in good condition. Scale House — Large equipment and materials are weighed in this enclosed building. During the inspection the building was locked and inaccessible. A pipe was observed coming out of the scale house and plumbed to the adjacent storm drain system. Staff explained that this line is a boiler vent that could potentially release steam or hot water. Staff noted that the entire boiler system is to be replaced before the end of 2008. Norfolk Southern shall remove all illicit connections and discontinue all illegal discharges to the storm drain system. Material Storage — South of the Storehouse Building, large and small equipment parts are stored outside and exposed to stormwater. Items stored include alternators and starters. Minor spills were observed on the pavement beneath the stored materials. Staining was observed in the trench drain behind the stored containers. Oil dry was observed on the ground to this area. One metal bin with metal parts containing oily residue was stored exposed to stormwater. We have a coating process and a mixing process that attributed to these two areas of contamination of the gravel and ground at the side of our building. We have made mechanical adjustments to these processes that we feel will eliminate this issue and will continue to monitor. The oil that was in place at the time of the inspection has been removed by Hepaco (one of the stains had been completed as noted in the report) but I have not yet received the final remediation report from Hepaco. When available 1 will forward a copy to your attention. 2) Air Filter Dust — This dust is material that is removed from the back of the belting during the manufacturing process. We tolled the dust into a hopper and then empty it into gaylord boxes for disposal. The condition of the hopper is monitored weekly by the maintenance department as part of their preventive maintenance program. We believe the dust was overflow from the emptying of the hopper. I had the area cleaned by one of our operators immediately after the inspection and will monitor the area after the next collection process which occurs about once per quarter. All operators involved in this process will be informed of the importance of housekeeping and cleanup after emptying the hopper. 3) Emergency Eye Wash discharge — This issue is not yet complete we are collecting quotes from plumbing companies to address this issue. This will require a pumping system to move material across our facility to a sanitary sewer and therefore this project is more than our maintenance crew can address at this time. Expected completion July 11, 2008. 4) Boiler Emergency discharge — The correction of this issue is complete, this pipe has been closed off and the bypass routed to sanitary sewer. 5) Water Softener Device overflow — The correction of this issue is complete, this overflow has been routed to sanitary sewer. 6) Stormwater Pollution Prevention Plan — We have contracted with Trigon 1 Kleinfelder Engineering to update this plan (Trigon completed the original evaluation and plan). After speaking with Mike Sussman at Trigon earlier this week concerning the scope of this project he felt confident that we could have the plan in place in late July. Oil staining was observed on the ground, gravel, and walls of the production building. The oil appeared to be leaking from pipes extending from the top of the building. Secondly, the build up of air filter dust was observed on the ground surface, exposed to stormwater. Lastly, the facility's boiler, water softener device, and the emergency eye wash were piped to discharge to the ground surface and possibly enter into the storm sewer system. It was requested by the CMSWS inspector that the aforementioned issues be addressed because of the potential to contaminate stormwater. A follow up inspection of the facility conducted on July 11, 2008, found that the permittee has corrected the aforementioned issues. The facility provided documentation from HEPACO for the excavation and restoration of the oil staining areas on the ground. Secondly, a minimal amount of air filter dust was on the ground during the follow-up inspection. According to facility personnel, the staff performs more frequent cleaning of the air filter area. Lastly, the permittee has piped all discharges from the boiler, water softener device, and emergency eye wash station to :he sanitary sewer system. Historically we had two permits under our previous company name of Scandura, wNCG050131)4or our location at 1801 N. In December of 2005 1 sent the attached letter to your attention indicating that Fenner Dunlop had sold our property at 1801 N. Tryon Street to another company and noted that we no longer needed the sormwater permit for that location. Since that time we have received two billings addressed to 10125 South Tryon street for annual permit fees, however the account listed on the invoice is NCG050130. This issue was not recognized on our end due to the correct address and the credits have been applied to the 1801 North Tryon location that we no longer own. As we are in the process of reapplication for our permit coverage this issue was noticed and brought to our attention in that our current permit NCG050129 appears to be delinquent. I have discussed this issue with Ken Pickle and we believe the following actions will correct and clarify this situation_ 1) Debit account for permit # NCG050130 (1801 North Tryon Street Charlotte) for $160.00 and apply that balance to the account for permit # NCG050129 (10125 South Tryon Street Charlotte).
