Box 3511 Greenville, SC 29608 Dear Mr. Bates: You have our approval to place fill material in 0.25 acres including the previous impact of 0.06 acres (total 0.31 acres) of wetlands or waters for the purpose of constructing the South Point Business Park, as you described in your application dated 6 September 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This certification replaces the one issued on 7 October 1996. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Wetland and waterway areas on the property have been delineated and verified by the USAGE on June 20, 1996. A total of 0.50 acre of wetlands and 1.06 acres of waterways were determined to be present on 100.6 acres in four separate parcels. A separate 5.28 acre parcel containing a 0.10 acre waterway was also included in the original delineation. That property is owned by a third party not involved in the current development plan. Additionally, 0.75 acre of the 1.06 acres of waterway area is associated with the bed and bank of Steel Creek. The purpose of this letter is to request concurrence that impacts associated with future development of the property will be authorized under Nationwide Permit No. 26 (NWP No. 26) and that no additional information (i.e., pre-construction notification) is required. American Trading Real Estate proposes to develop the four parcels for commercial/industrial usage. The development will require the relocation and piping of three small drainage ditches (Waterway No.s 1, 4 and 5 identified in the Jurisdictional Delineation Report) and the deposition of fill material in an isolated wetland area (Wetland No. 1 in the report). Impacts associated with the proposed development will comprise 0.22 acre of waterways and 0.03 acre wetlands for a total of 0.25 acre. None of these areas are located within 50 feet of Steel Creek. In accordance with the property sub-division requirements of NWP No. 26, we determined an estimate of previous (since October 1984) wetland and waterway impacts on the property. Approximately 0.06 acre of waterway area was determined to have been P.O. The waterway was impounded and now comprises three small ponds along South Point Boulevard near the intersection with Carowinds Boulevard. The area estimate was determined by reviewing pre-development topographic quadrangle maps and measuring the length and average width of the undisturbed creek. The original creek was determined to comprise approximately 800 linear feet with an average width of 3 feet (or 0.06 acre). A summary of the impacts associated with the proposed development and impacts from past development activity is provided in the table below.
