A site visit was conducted on June 10, 2011 to complete the follow-up evaluation. The follow-up evaluation was conducted as part of a cooperative working agreement between Mecklenburg County and the Division of Water Quality. In addition, the inspection was conducted on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part II Section H. The follow-up compliance evaluation found that the UPS Ground Freight Inc. has implemented corrective actions to address the deficiencies noted in the original inspection including: • Submittal of paperwork documenting an evaluation of outfalls for non-stormwater discharges. • Submittal of paperwork documenting employee training. • Maintaining the permit and certificate of coverage in the SPPP. • Removal of sediment from stormwater outfall # 2. Thank you for the assistance and cooperation following the original inspection. As noted above and in the enclosed report, the facility has corrected deficiencies and has satisfied the conditions of the Notice of Deficiency. The facility has developed and implemented a Stormwater program and this Office commends the permittee's efforts to ensure compliance with your NPDES permit. Follow up letter Page 2 April 10, 2012 ADDENDUM The National Pollutant Discharge Elimination System (NPDES) program was established under the federal Clean Water Act and then delegated to the Division of Water Quality for implementation in North Carolina. The NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and operations planning to reduce pollutant sources. Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the facility. There are currently 19 active general stormwater permits in North Carolina. One condition that is applicable to both the general permits and individual stormwater permits is the requirement to develop and implement site -specific comprehensive Stormwater Pollution Prevention plans (SPPP). These plans are required to include a comprehensive evaluation of the site and operations to reduce pollutant sources and prevent pollutant discharge. Copies of the general permits and accompanying documents can be accessed from the following webpage: hftp://h2o.enr.state.nc.us/su/Forms—Documents.htm. Permit text, technical bulletins, discharge monitoring forms, and a Notice of Intent [which is the application for coverage under a NPDES General Stormwater Permit] can be found on this website. The following items are a subset of permit requirements and are listed to assist you and help bring your attention to certain permitting issues, process and condition requirements of your permit. Please see the above mentioned website to obtain a copy of the permit so you may fully comply with all the conditions therein. Failure to properly comply with conditions of the permit, like those bulleted below, is a violation(s) of the permit and subject to civil penalty assessment(s) of up to $25,000.00 per day. • Industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general NPDES stormwater permit or an individual NPDES stormwater permit • All persons desiring to have facilities covered by a General Permit must register_ with the Division of Water Quality (DWQ) by filing of a Notice of Intent (NOI) and Applicable Fees. • This Notice of Intent (NOI) must be submitted and a Certificate of Coverage issued prior to any discharge of stormwater associated with the industrial activity, process wastewater, and/or mine dewatering. • Once the Notice of Intent is received, DWQ will review and determine whether a Certificate of Coverage (COC) may be issued. If this Certificate of Coverage is issued the facility is covered by the General Permit. That is, the permittee is authorized to discharge stormwater, process wastewater, and/or mine dewatering pursuant to the type of General Permit until the permit expires or is modified or revoked. • Any other point -source discharge to surface waters of the state is prohibited unless it is an allowable non-stormwater discharge or is covered by another permit, authorization, or approval. • There are currently 19 active general permits. Follow up letter, Page 3 April 10, 2012 o Collection, reporting, and recording of Vehicle Maintenance Monitoring (if applicable) o Records — Visual monitoring shall be documented and records maintained at the facility along with the Stormwater Pollution Prevention Plan. Copies of the analytical monitoring results shall also be maintained on site. The Permittee shall retain records of all monitoring information, including all calibration and maintenance records and all original strip -chart recordings for continuous monitoring instrumentation, and copies of all reports required by this general permit for a period of at least 5 years from the date of the sample measurement, report, or application. o Expiration — The permittee is not authorized to discharge after the expiration date of the general permit. In order to receive automatic authorization to discharge beyond the expiration date, the permittee shall submit forms and fees as are required by the agency authorized to issue permits no later than 180-days prior to the expiration date. Any permittee that has not requested renewal at least 180 days prior to expiration, or any permittee that does not have a permit after the expiration and has not requested renewal at least 180 days prior to expiration, will be subject to enforcement. Failure to renew your permit is a violation_ o Transfer — The Certificate of Coverage (COC) issued pursuant to this general permit is not transferable to any person expect after notice to and approval by the Director. The Director may require modification or revocation and reissuance of the Certificate of Coverage to change the name and incorporate such other requirements as may be necessary under the Clean Water Act. The Permit is NOT transferable. o Name Change, Closure, or Facility Ownership change — Permittee is required to notify the Division in writing in the event the permitted facility is sold or closed. The Division of Water Quality views changes of name or ownership as a modification that requires the Director's approval and reissuance of the permit. Name and ownership changes require you to complete a Name/Ownership Change Form from the Division and mail it back to the Division of Water Quality along with all appropriate information. o Proper Operation and Maintenance is a requirement of the permit. Almost all of the property is impermeable. The facility produces textile coatings. The permittee stores chemicals such as latex, ammonia, and calcium carbonate indoors. Empty plastic totes are stored outdoors. The permittee has locked valves on the facility's two stormwater drain inlets that discharge to two separate piped outfalls. The permittee inspects stormwater before opening the valve to discharge stormwater. Compliance History: A file review found that a Compliance Evaluation Inspection was conducted at the Textile Rubber & Chemical Co., Inc. . facility on April 11, 2008, by Charlotte -Mecklenburg Storm Water Services (CMSWS) personnel. The NPDES permitting program for stormwater discharges was established in 1990. Phase I focuses on site and operations planning to reduce pollutant sources. Through the NPDES permitting program industrial facilities that fall into one of the subject ten categories are required to obtain permit coverage under a general permit or an individual permit, depending upon the facilities SIC code and the industrial activity occurring at the facility. All of the manufacturing processes of the plant are inside the facility under cover. The facility uses latex, ammonia, and calcium carbonate in its business processes. The facility has two large tanks on the rear of the parcel that were used at one point to store large volumes of latex. These tanks were reported as empty and unused at the time of inspection. The facility has a calcium carbonate storage silo which is exposed to stormwater. The facility also stores plastic totes outside. No totes were found to be open or leaking at the time of inspection. No other portions of plant operations are directly exposed to stormwater_ All other storage and processes are located inside the facility. Compliance History: This permittee was inspected by Charlotte -Mecklenburg stormwater Services (CMSWS) on March 11, 2005, as part of their industrial inspection program. The permittee was issued a Notice of Violation (NOV) by the Division of Water Quality for deficiencies in the Stormwater Pollution Prevention Plan, illicit discharges of latex at the stormwater outfalls, and an illicit discharge of -wastewater from the washing/loading area. CMSWS reports indicate that the deficiencies noted in the NOV were remedied as of August 8, 2005. The facility was sampled as part of the CMSWS stormwater industrial monitoring program. The stormwater sample taken from the facility contained elevated concentrations of zinc. Facility personnel noted that housekeeping steps have been taken to lower the zinc concentrations in discharged stormwater. Industrial Operations/City of Charlotte Stormwater Ordinance Review: Loading/Unloading Area - The facility has a loading/unloading area where some industrial washing is also performed. The loading/unloading area is exposed to stormwater. This area has a storm drain with a valve that can be closed. This valve is reported by facility staff to be closed when loadinglun loading or washing operations are performed at this area. Any spilled materials or commercial wastewaters are then recovered for disposal. The loading/unloading storm drain valve must be kept shut and locked as this area is functioning like a secondary containment area. Stormwater in this area must be evaluated for contamination prior to its release. A log of release events must be kept_ Spills and commercial wastewater discharges in this area must be recovered appropriately. No deficiencies with regard to the City of Charlotte Stormwater Ordinance with found during the inspection. Please continue to maintain a high level of housekeeping at this site. (currently, Textile Rubber & Crhemical Co. Inc.) on March 22, 1999. A response letter from General Latex and Chemical Corporation of N.C. dated March 19, 1999 indicated that MCWQP made several recommendations and conclusions in the report_ A Notice of Violation was not issued On March 25, 1999, MCWQP sampled the outfall and no action was required. PERMIT: Textile Rubber & Chemical Co. Inc., Charlotte Division holds a General NPDES Stormwater Permit, NCG050000, Certificate of Coverage NCG050013. The permit was renewed on May 1, 2003 and will expire on April 30, 2008. The Permit authorizes the permittee to discharge stormwater associated with rubber and miscellaneous products [SIC 30], which has been adequately treated and managed in accordance with the terms and conditions of this General Permit, to the surface waters of the North Carolina or separate storm sewer system. All discharges shall be in accordance with the conditions of this permit. RECORDSIREPORTS: Stormwater Pollution Prevention Plan (SPPP): As required by the permit, Textile Rubber & Chemical Co. Inc. developed a SPPP. A copy of the SPPP was made available prior to the inspection, but the SPPP was not current_ The plan was revised and updated, and the current copy of the SPPP was reviewed on -site. The SPPP has not been updated on an annual basis, as required by the permit. The signatory page of the permit was not signed by the SPPP coordinator. The updated SPPP was thorough and addressed most of the requirements of the permit; however, some deficiencies were noted in the implementation of the plan. Source Inspection Log: Records indicate that each pollutant source was inspected on a semi-annual basis from October 18, 1993 to December 4, 2001. Descriptions and the appearance of the sources and surrounding areas were documented. There was no description of the appearance of the stomnwater inlet. The records include dates and persons performing the inspections. The permit requires the permittee to maintain these records on site for a period of 5 years and to perform the inspections on a semi-annual basis. The last inspection documented was December 4, 2001. Preventative Maintenance and Good Housekeeping. - There were no available preventative maintenance records or regular cleaning schedules. A she plan / floor plan indicating employees who are assigned and responsible for housekeeping and maintenance was available, but not implemented in the SPPP. RECORDS/REPORTS (Cunt.): Employee Training Records: There. were no records of employee training. The SPPP indicates all new employees will be trained and a refresher course offered annually. Facility Inspection Records: These records were noted in the Stormwater Discharge Outfall (SDO) / Qualitative Monitoring Report and the Source Inspection Log. Stormwater Discharge Outfall (SDO) / Qualitative Monitoring Report: Records indicate a qualitative monitoring report has been maintained on a semi-annual basis from March 25, 1999 to November 18, 2004. Analytical Monitoring. - The Permit does not require analytical monitoring. The SPPP should state that the facility does not have any vehicle maintenance activity occurring on -site which uses more than 55 gallons of new motor oil per month when averaged over the calendar year. Rating: Unsatisfactory FACILITY SITE REVIEW: Textile Rubber & Chemical Co. Inc., Charlotte Division, is located new the intersection of North Davidson and Fast 27`h Street, approximately 2 miles north of downtown Charlotte, NC. There are two stormwater outfalls that discharge to an unnamed tributary leading to Little Sugar Creek, thence to the Catawba River. Textile Rubber's parking area has been graded such that all stormwater runoff from the rooftop and parking lots is directed via sheet flow to the unnamed tributary. One downspout discharges to a storm sewer owned and maintained by the City of Charlotte. The facility is located on a 1.933 acre site with approximately 90% of the drainage area as impervious surface. Mr. Les Davis, General Manager, gave the following description of the facility. The facility was built in 1958 under the ownership of General Latex & Chemical Corporation of N.C. and was bought out in April of 2001 by Textile Rubber & Chemical Co. Inc. The primary function of the facdity is to make fabric coatings for upholstery, carpet, mattresses, and other fabrics. The coatings provide strength, flexibility and fire protection. They produce natural latex and compounded natural and synthetic latex. They do use ammonia -based emulsifiers, but no longer use formaldehyde. They have a contract with Clean Harbors to dispose of approximately 5,000 gallons of waste every 2 weeks. The facility has approximately 30 storage tanks and a variety of mixers ranging from 5 gallon mixers to tanker trucks that carry 5,000 gallons. They process 40 million pounds of latex per year. There is a rail car spur to the rear of the facility, which is no longer in use, but could be reactivated if needed. They have 25 employees, 3 of which are truck drivers. FACILITY SITE REVIEW (Continued): The primary structure is constructed of concrete block walls and concrete floors. This part of the structure is in good condition overall, except for a pipe through the concrete block wall on the southwest side of the budding that is not permanently sealed and a door with a two imch gap at the bottom. Chemical residue was noted on the outside wall of both of these areas and is exposed to stormwater. The rear of the structure and part of the loading area is constructed of comigated metal walls and concrete floors. Over time, forklifts have pushed the corrugated metal walls out and chemical residue was noted on the outside walls. Les Davis stated that all floor drains inside the structure have been permanently sealed. The outdoor storage practices that are exposed to stormwater are as follows: There are no outside process areas. • There are two unlabeled supertanks to the rear of the building that are no longer in use. The secondary containment wall is damaged. • There is a tratila parking area where a small amount of overflow from the tankers was noted. • On the northeast side, there is a tank truck loading dock area and truck wash area with a secondary containment wall and an overhead canopy. Tank trucks make bulk deliveries of natural latex and synthetic rubber. This area has a floor drain with valve that is closed during loading and truck washing. Detergent is used to wash the outside of the tankers. The General Manager stated that the current practice is to open this valve allowing wastewater to discharge directly to the unnamed trrbutary. Latex residue was noted at the discharge pipe and on the creek bank. Accumulated wastewater from the cleaning of the inside of the tankers is pumped to drums and properly disposed of off site. • On the southwest side, there is a silo with a screw conveyor where whiting is transferred from tank trucks. There are _two 8 cubic yard trash boxes with covers that are kept closed. There is no secondary containment or overhead protection for either area. Calcium carbonate'and other dry chemicals were noted on the ground_ This area is swept once a week. There are two storm drains that could discharge to the creep one is permanently sealed and the other has a rubber cover that is used during loading and unloading operations. The General Manager stated this area is swept to clean spill material prior to drain seals being removed before a storm event Latex residue was noted at the discharge pipe and on the creek bank. • Replacement propane cylinders are stored on a rack along the outside wall on the southwest side of the building and were in good condition. Rating. Unsatisfactory EFFLUENTiRECE"G WATERS: This inspection was conducted during clear, dry -weather conditions. One dry -weather flow was observed at the fac&y during the inspection. The outfall is located along the creek bank between the two stormwater outfalls. There was no documentation that the outlet had been evaluated. EFFLUENT/RECE"G WATERS (Continued): The two stonmvAater outfi& were inspected for indicators of stormwater pollution. Each pipe had latex residue with no odor, foam, oil sheen or floating solids. A significant amount of accumulated grey residue was observed at each outlet. Actions should be taken to remove this material from the stream bed. The receiving stream, an unnamed tributary to Little Sugar Creek, was not turbid and the discoloration and residue appeared to be only on the creek bank. Little Sugar Creek was not evaluated during this inspection and no samples were collected. Radng: UnsaWadory SELF -MONITORING PROGRAM: The hcWs Permit requires that qualitative monitoring be conducted twice per year. Facility records were reviewed from March 1999 to November 2004. The records indicate that monitoring has been conducted as required by the permit. OPERATIONS & MAINTENANCE: The following is in violation of the North Carolina General Statute (G.S.) 143-215.1 and is not permitted under the General Permit: * Illicit discharge of wastewater at truck wash / loading area This discharge must be stopped immediately. The overall operation and maintenance strategy for this facility appears to be appropriate. Better housekeeping practices and maintenance were suggested during the inspection • Repair gap under the exterior door to prevent material from getting outside. • Label all drums (inside and outdoors). a Permanently seal pipe through exterior wail. • Repair exterior corrugated metal wall. • More aggressive maintenance and / or a new BMP at the silo and dumpsters where calcium carbonate and other dry chemicals were noted_ • Evaluate BMP's for management of stormwater runoff from the south side of the budding. • Clean the areas of contamination at the 2 discharge pipes. Rating: UnsaWadory STORMWATER POLLUTION PREVENTION: The Permit requim the Permittee to develop a Stormwater Pollution Prevention Plan, as detailed in Part II, Section A. Stormwater Pollution Prevention Plan. The Permittee has developed a Plan, however, components of the Plan were not implemented as specified below: STORMWATER POLLUTION PREVENTION (Continued): 1. Part 11, Section A. 1. Site'Plan : The SPPP contains a site plan; however, the following was not included: (b) "A narrative description of waste disposal practices, ..." (c) The site map should contain "storage of materials, disposal areas, and activities occurring in the drainage area, all existing BWs and impervious surfaces For each outfall, a narrative description of the potential pollutants which could be expected to be present in the stormwater discharge. " (e) "Certification that the stormwater outfalls have been evaluated for the presence of non-stormwater discharges. " The responsible officer did not sign the certification. 2. Part II, Section A. 2. Stormwater Management Plan: The SPPP contains a stormwater management plan; however, the following was not incorporated: (a) Feasibility Study. "A review of the technical and economic feasibility of changing the methods of operations and/or storage practices to eliminate or reduce exposure of materials and processes to stomwater. " Not all BMPs were shown on the site plan or described in the Stortnwater management plan- Acdditionai measures should be impiemented to IWU(X stormwater exposure. Facility housekeeping schedule should be more aggressive. (b) Secondary Containment Schedule. The Permit requires the perm ittee to inspect accumaulated stormwater before it is released; the SPPP does not state if it is inspected before releasing. (c) BMP Summary. The SPPP does not list all BMPs. The truck wash / loading area BMP should be evaluated to address the illicit discharge. 3. Part II, Section A. 7. Plan Amendment: The Permit recluses the permittee to review and update the SPPP on an annual basis. The SPPP was updated on March 2005; the original copy was dated April 1993. 4.
