After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3022. This certification allows you to use Nationwide Permit Number 12 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application, For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Off1ce of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Wetlands were avoided as much as possible, antiseep collars and construction practices per 401 certification and permit. Hazen and Sawyer 2 Parkway Plaza, Suite 170 Charlotte, North Carolina 28217 Dear Mr, Rhyne: Subject: Proposed installation of water and sewer lines in the Mint Hill area. Mecklenburg County. North Carolina In your letter of February 14, 1996 (received on February 21, 1996), you requested information on federally listed endangered and threatened species that may occur within the subject project area. The following comments are provided in accordance with the provisions of Section 7 of the Endangered Species Act of 1973, as amended (16 U,S,C. 1531-1543) (Act) . The Service has no record of any federally listed endangered or threatened species in the area of the proposed water and sewer lines (according to the map you provided). However, one federally endangered plant species. the Schweinitz's sunflower (He1ianthus schweinitzii), and several other Federal plant species of concern are known to occur in and around the Charlotte area in Mecklenburg County. Since thorough surveys have not been conducted for the entire county for these rare species. it is possible that these species may occur within the project area. He1ianthus schweinitzii is endemic to the upper piedmont of the Carolinas, with all 22 known occurrences centered around Charlotte, North Carolina, and Rock Hill. South Carolina. This species occurs in relatively open habitats--ear1y successional fields, forest ecotona1 margins, or forest clearings. It thrives in full sun but also grows in the light shade of open stands of oak-pine-hickory. He1ianthus schweinitzii generally occurs on soils characterized as moist to dryish clays, c1ay-1oams, or sandy-clay loams that often have a high gravel content. The draft recovery plan for this species points out the importance of soi1s--"The geology and soils of this area appear to be an important determining factor in the occurrence of Schweinitz's sunflower." He1ianthus schweinitzii is known from a variety of soil types, including Iredel1 (Fine, Montmori11onitic. Thermic Typic Hap1uduff), Enon (Fine, Mixed, Thermic U1tic Hapluda1f), and Cecil (Clayey, Kaolinitic, Thermic Typic Hapludult). There are two known (' populations of Helianthus schweinitzii--along McCoy Road and along Beatties Ford Road--relatively close to the project area, In accordance with the Act it is the responsibility of the appropriate Federal regulatory agency (e.g., the U.S. Army Corps of Engineers) to review its activities or programs and to identify any such activities or programs that may affect endangered or threatened species or their habitats. If it is determined that these proposed activities may adversely affect any species federally listed as endangered or threatened, formal consultation with this office must be initiated. Thus. the Service recommends that if appropriate habitat is available. surveys should be conducted to determine the presence of Helianthus schweinitzii in the project impact area (this species blooms in late summer, September to October). . There are also several plant species known to occur in Mecklenburg County that are Federal species of concern--Georgia aster (Aster qeorqianus) , Heller's trefoil (Lotus helleri), Nestronia (Nestronia umbellula), and tall larkspur (DelPhTnTum exaltatum). The first three species are found in similar habitats--Aster qeorqianus is a perennial that occurs in dry open woods along roadsides, woodland borders, old fields, and pastures; Lotus helleri is an annual that occurs in dry open woods, roadsides and clearings over clay soils: and Nestronia umbellula is a root parasite frequently associated with pines and occurs in upland forests and along wooded streams from the sandy margins onto the adjacent slopes. Delphinium exaltatum occurs mostly over mafic rock on grassy balds. glades, and rich woodlands. Please note that Federal species of concern are not legally protected under the Act and are not subject to any of its provisions, including Section 7, unless they are formally proposed or listed as endangered or threatened. We are including these species in our response to give you advance notification and to request your assistance in protecting them, If you do conduct surveys for Helianthus schweinitzii, we would appreciate it if you would also include the above-mentioned species. One additional speciescof concern: a fresh water mussel living in Goose Creek, of which Stevens Creek is a tribuatory. Need careful attention to sedimentation and erosion control and a buffer area between creek and line if possible. Note: These creeks are on the opposite side of Hwy. 51 and are in another (Pee Dee . River) drainage basin. In response for requests for comment on endangered species in the Mint Hill sewer project area, the following comments were received: The U,S, Fish and Wildlife Service indicated that one federally endangered plant species, the Schweinitz's sunflower (Helianthus schweinitzii), is know to occur in and around the Charlotte area in Mecklenburg County, As thorough surveys have not been conducted for the entire county, Fish and Wildlife indicated it is possible that these species may occur within the project area. Their letter further states that "there are two known populations,.. --along McCoy Rd and along Beatties Ford Rd--relatively close to the project." The Service "recommends that if appropriate habitat is available, surveys should be conducted to determine the presence of Helianthus schweinitzii in the project impact area." A plan to remove the plant from the federal endangered species list was prepared by the Natural Heritage Program and a Winthrope College Botanist for the US Fish and Wildlife service. The draft plan recommended increasing the number of self sustaining colonies through a combination of land purchases, management agreements with landowners and reintroduction of the plants. US Fish and Wildlife stated that the "draft recovery plan for this species point out the importance the geology and soils as an important determining factor in the occurrence of Schweinitz's sunflower", We feel a survey to locate individual plant specimens is unnecessary as: ~ Only about 9% of the total line length crosses open fields with sandy clay loam soils in which Helianthus thrives and therefore the possibility of finding a specimen is remote. ~ The NC Heritage Program has no record of any known rare species, high quality natural communities or significant natural areas occurring at or within a 1-mlle radius of the Mint Hill project area. The Heritage Program's assessment includes information from a 1993-94 survey to find and catalogue unique, endangered and significant plants and animals of Mecklenburg county, ~ Helianthus schweinitzii occurs in relatively open habitats, early successional fields, forest ecotonal margins or forest clearings, Most of the existing known colonies of Schweinitz's sunflower are found along roadsides or under power lines where trees can't shade the plants which prefer sun. The introduction of a 15' right of way, kept clear of trees by the Utility, will actually increase incidence the preferred habitat of Schweinitz's sunflower. ~r~ --....~ North Carolina Department of Cultural Resources James B. One site (31 MK203) has not been evaluated for National Register of Historic Places significance, The remainder (31 MK377-31 MK381, 31 MK385, 31 MK386) have been recommended for no further work, This area of Mecklenburg County is known to have a high density of both historic and prehistoric archaeological sites, The project area has not been systematically surveyed to determine the location and significance of archaeological resources, Within the proposed study area existing rights-of-way along highways and in previously disturbed areas are not recommended for additional investigation. However, within new rights-of-way, corridors and easements we recommend that a comprehensive survey be conducted by an experienced archaeologist to identify the presence and significance of archaeological remains that may be damaged or destroyed by the proposed project. Potential effects on unknown resources should be assessed prior to the initiation of construction activities, Enclosed is a list of archaeological consultants who have conducted or expressed an interest in conducting contract work in North Carolina, Individual files providing additional information on the consultants may be examined at the State Historic Preservation Office's Office of State Archaeology, 421 North Blount Street, Raleigh. If additional names are desired, you may consult the current listing of the members of the Society of Professional Archaeologists, or contact the society's current secretary/treasurer, David L. Carlson, Department of Anthropology, Texas A&M University, College Station, Texas 77843-4352, telephone 409/845-4044, Any of the above persons, or any other experienced archaeologist, may be contacted to conduct the recommended investigation. Based on the results of this review, Secretary Kat ie G. Dorset t issued a Apri 1 28, 1993 let ter (copy attached) stating that the EA/rONSI for the subject project has met the requirements of the NC Environmental Policy Act (NCEPA) and that no further environmental review action under NCEPA is required. However, a memorandum was received by OEM from the Department of Cultural Resources which requested the completion of a archaeological survey of the project area to assess potential project impacts on cultural resources (see attached) , Based on subsequent conversations with Renee Gledhill-Earley, environmental review coordinator for the Department of Cultural Resources, it is my understanding that underta]cings subject to Section 106 review (as defined in the 1992 Amendments to the National Historic Preservation Act) include "those subject to State or local regulation administered pursuant to a delegation or approval by a federal agency". Therefore, although our NPDES permitting program (a delegated federal program) is subject to the requirements of Section 106 of the Historic Preservation Act, the State's nondischarge program would not be subject to the 1992 amendments. I will be preparing a letter in the near future for the Department of Cultural Resources which explains our permitting programs and authorities and would appreciate your input on this, Therefore, in light of Secretary Dorsett's letter, permit processing and issuance for the Four Mile Creek Outfall and Pump Station, if appropriate may proceed, Please do not hesitate to contact me if you have any questions.
