Box 273 Clayton, NC 27520 Dear Mr. Godwin: You have our approval to place fill material in 1.18 acres of wetlands or waters for the purpose of residential development at Glenhaven subdivision, as you described in your application dated 15 October 1996. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 3022, 2732, 2733 and 2671. These certifications allow you to use Nationwide Permit Numbers 12, 14, 18 and 26 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Deed restrictions shall be added to all lots with remaining jurisdictional wetlands to prevent future wetland fill. Specifically lots 11, 12, 31, 32, 45, 46, 47, 50 and 51 need deed restrictions. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non- Discharge and Water Supply Watershed regulations. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. C) F= FR August 6, 1996 Johnston County DWQ Project # 960680 Upon initial review of your request to fill 0.33 acres of wetlands for a road crossing at your proposed Glenhaven subdivision off SR 1555 near Clayton, the Division is unable issue a 401 Water Quality Certification due to inadequate information. A complete review and issuance will require a revised application and larger scale plats showing all wetland and stream impacts. In the application dated July 11, 1996 you requested authorization for a road crossing under the US Army Corps of Engineer's Nationwide Permit number 14. The application also references lot fill to "maximize lot count" for the subdivision but no specifics are given on the plat or in the application. When I contacted your design engineer, Mr. Steven Sanderson with Southwind Surveying and Engineering, he indicated that the lot fill would be less than 1/3 acre (which does not require written authorization under Nationwide Permit number 26) and that the request was just for the road crossing. As I discussed with you on our August 1, 1996 site visit, the Division considers the wetlands on your property as being of very high value in protecting the water quality of the adjacent stream. The wetlands have significant uses in water storage, pollutant removal, bank stabilization, and aquatic habitat functions. We would like to see these wetlands preserved to continue to protect the water quality in the stream as its watershed continues to be built upon. In order for the Division to accomplish this goal and at the same time assist you in minimizing the wetland impacts from your project, we need to know where all of those impacts are. Our 401 Water Quality Certification, when issued, will include a condition requiring deed restrictions on all lots with wetlands to prevent future fill not authorized by this certification. We are concerned that some of the lots at the ends of the cul-de-sacs which are predominately wetlands will not be able to be built upon without significant amounts of fill placed in wetlands. It would be much easier work with design alternatives for those cul-de-sacs and sort out this issue now before construction begins. If you wish to apply only for the road crossing as Mr. Sanderson insists, then we will need a revised application referring only to the road crossing. Since the crossing is greater than 200 feet in length it will require additional authorization under a different Nationwide Permit as I have discussed with Mr. Sanderson. The Division also requests a project plat showing all wetland impacts with a larger scale to make it easier to read and easier for us to monitor the project. The new application requests the road crossing under the US Army Corps of Engineer's Nationwide Permit numbers 14 and 18 and does not mention any lot fill. The plat enclosed with the application was the same as the plat that was submitted before. On August 15, 1996 we received a large scale plat of just the road crossing area showing the use of the above mentioned Nationwide Permits. As expressed in my August 6, 1996 letter to you, the Division still has concerns about the amount of fill that may be needed to successfully develop some of the lots at the end of the cul-de-sacs. You are allowed to fill up to 1/3 acre of wetlands under Nationwide Permit number 26 and WQC 2671. If more than 1/3 acre of lot fill is needed we will need to review those impacts before the Division can issue your WQC. Regardless of size the all proposed fill needs to be shown on your plats. Once identified, we will include the lot fill (even if its less than 1/3 acre) impacts in our authorization along with the WQC for the road crossing. The WQC will contain a condition requiring deed restrictions on all lots with remaining wetlands to prevent future fill.
