W T Harris Blvd, Charlotte, NC Mecklenburg County Chapter 143, Article 21 of the North Carolina General Statutes (G.S.) authorizes and directs the Environmental Management Commission of the Department of Environment & Natural Resources to protect and preserve the water resources of the State. The Division of Water Quality (DWQ) has the delegated authority to enforce adopted pollution control rules and regulations. On April 15, 2010, our Office received a copy of an Industrial Facility Inspection conducted on March 29, 2010, at the Ward Tank and Heat Exchanger Corporation facility site by staff from Charlotte -Mecklenburg Stormwater Services (CMSWS). The inspection report states that stormwater runoff from the site drains to an unnamed tributary of. Campbell Creek, a Class C water located in the Catawba River Basin. The site inspection also noted that the Standard Industrial Classification (SIC) for Ward Tank and Heat Exchanger Corporation is 3443, Fabricated Plate Work (Boiler Shops). As a result of the CMSWS site inspection the following violations, detailed below, are noted: Operating a metal fabrication facility without an NPDES stormwater permit Operating a facility without a stormwater Permit G.S. 143-215.1 requires that certain industrial facilities must obtain and operate under an NPDES permit for stormwater discharges. NPDES general permit NCG030000 has been established pursuant to G.S. 143-215.1(b) for discharges of stormwater to surface waters. Fourth Street Charlotte, NC 28202 Fax 704.336.6586 APR 15 On March 29, 2010, Andrew Martin and Heather Sorensen of Charlotte - Mecklenburg Storm Water Services conducted an inspection of the above referenced facility under authority granted by Charlotte City Code Chapter 18, Article III, Section 18-82. As a result of findings during the inspection, Ward Tank & Heat Exchanger Corporation is being issued a Notice of Violation for violating the City of Charlotte Storm Water Pollution Control Ordinance, Section 18-80(a), Illicit Discharge and Disposal and section 18-80(b) Illicit Connection. The purpose was to identify potential storm water pollution problems associated with this facility. Inspections are also conducted to review maintenance, storm water and training records to ensure the site is in compliance with all applicable local, state and federal storm water regulations. Background: On March 29, 2010 at 1:30 PM, Andrew Martin and Heather Sorensen of Charlotte -Mecklenburg Storm Water Services (CMSWS) conducted the following activities as part of the inspection: • Inspected the interior and exterior of buildings • Inspected the grounds, including material storage areas, the storm drain system, outfalls and fence line • Reviewed written records and documentation • Collected photo documentation of the facility Ward Tank and Heat Exchanger Corporation, at 6670 E. W T Harris Boulevard in Charlotte, NC, is located on approximately 4.9 acres of property and has three buildings that consist of manufacturing and office space. Total impervious (parking lots, buildings, roadways, etc.) area of the site is estimated at 95 percent of the total site area. Facility operations typically occur between the hours of 6:00 AM to 10:00 PM, Monday through Friday. The facility manufactures metal tanks such as pressure vessels, reactors, heat exchangers and other metal products for industrial applications. Robert Besh, Vice President of Operations, accompanied CMSWS personnel during the inspection. Records: A records review revealed the following: • Storm water runoff from the Ward Tank & Heat Exchanger facility discharges into a unnamed tributary of Campbell Creek, a class C water in the Catawba River Basin. • The facility has a Standard Industrial Code (SIC) of 3443, Fabricated Plate Work (Boiler Shops). Facility: Ward Tank & Heat Exchanger Corporation Inspection Date: March, 29, 20I0 • The facility does not have a National Pollution Discharge Elimination System (NPDES) storm water permit. • The facility is listed as a Toxic Release Inventory (TRI) with the EPA. • No history for Ward Tank & Heat Exchanger was available from the Mecklenburg County Water Quality Program (MCWQP) files. On -Site Inspection: Ward Tank & Heat Exchanger facility consists of a main office building, two manufacturing buildings, and outside storage areas. The facility manufactures tanks from various metals; such as pressure .vessels, reactors, heat exchangers and other metal products for industrial applications. The majority of the operation occurs indoors and under cover. The facility performs plasma cutting, lathing, machining, painting, abrasive blasting of metal and hydrostatic testing of new tanks onsite. Scrap waste metal from the manufacturing process is stored in large covered bins outside. Paint and painting supplies are stored in a small shed in the rear of the property. The total area of the property is approximately 49 acres. The storm water drainage system at the site consists of several drop inlets and floor drains within the main manufacturing building with associated piping that discharges from three outfalls into an unnamed tributary to Campbell Creek. The rest of the facility's site consists of gravel with a small natural vegetated buffer along the fence line. The inspection was conducted after a large rain event and the facility was discharging turbid water from the outfalls during the inspection. Four floor drains were observed inside the main manufacturing building. One was a large trough that extended the length of the building. Another floor drain is used to discharge water that has been utilized in hydrostatic testing of new tanks. All floor drains are connected to the storm drain system. Facility personnel indicate that the floor drains are there to catch storm water that enters the building. Water entering the floor drains come into contact with processing and manufacturing areas. The facility performs outdoor abrasive blasting of new tanks with StarbIast media manufactured by DuPont. The used material is not collected and disposed of Used Starblast was pushed into piles on the edge of the property and was present in thick layers on the ground surface. Used Starblast has been carried offsite by storm water in one area. The facility will also utilize other types of abrasive material depending on the job specifications. Five unlabeled plastic 55-gallon drums of water soluble used oil were stored outside with only a plywood sheet for a lid. There was evidence of spillage around the containers. The oil is taken to the Hickory Grove Recycling Center for disposal. There were also two other areas on the property that had small areas of petroleum staining on the ground beneath wooden pallets and near a garage door. Facility: Ward Tank & Heat Exchanger Corporation Inspection Date: March 29, 2010 There are two waste dumpsters and two large scrap metal bins located at the site. The scrap metal dumpsters are covered by lids. One of the waste dumpsters had a large blue spot where fresh paint had been dumped, but missed the waste receptacle. The paint material was still wet. This dumpster also appeared to have a leak from the bottom as well as malfunctioning lids. The facility uses Weld Flux to aid in welding seams on the metal tanks. The used material is then disposed of to the ground surface outside the building. A 55-gallon steel drum is located next to the small shed that contains paint supplies. The drum is used for disposing of unused paint and is elevated off the ground with a pallet. The labeling on the container is faded and unreadable. Conclusions/Recommendations: Based upon the exposure of significant materials to storm water runoff at the site and the facility's SIC code, it is recommended that Ward Tank & Heat Exchanger apply for an NPDES Storm Water Permit with the North Carolina Division of Water Quality. The floor drains located inside the manufacturing areas should be sealed or re- routed to the sanitary sewer system with Charlotte -Mecklenburg Utilities approval to prevent discharging industrial wastewater to surface waters. Once any source of water comes into contact with the manufacturing area or is used on a manufacturing process, it then becomes an industrial process wastewater and discharging it to the storm drain system violates the Charlotte Storm Water Pollution Control Ordinance, Section 18- 80(a), Illicit Discharge and Disposal. Currently having the floor drains connected to the storm drain system is a violation Charlotte Storm Water Pollution Control Ordinance, Section 18-80(b), Illicit Connection. CMS WS requests that the water used in the hydrostatic testing of new tanks be tested for pH, metals and oil & grease prior to future discharge from the testing of new tanks to the stormdrain system. All areas with used Starblast and Weld Flux material should be cleaned up and properly disposed of. The used materials could contain elevated levels of metals since they were used in abrasive blasting and welding activities. The Material Safety Data Sheet (MSDS) for the materials state that the products should be disposed of in a environmentally acceptable manner according to Federal, State and Local Regulations. The drums of water soluble used oil stored outside should be properly labeled and sealed to prevent exposure to stormwater. When full, these containers must be properly disposed, instead of taken to the Hickory Grove Recycling facility. The Hickory Grove facility is for household waste only. There was also an area in the rear of the facility where oil had leaked onto the ground beneath a pallet. All containers should be properly labeled with their contents. The paint spill next to the dumpster should be cleaned up and properly disposed of. The dumpster itself should be inspected for leaks and replaced if necessary. The facility should review material handling procedures, as well as spill prevention and spill response procedures, and ensure that all facility personnel are implementing these procedures. The owner/ operator of the subject facility were not aware that such a permit existed until the site inspection conducted by personnel from the Charlotte/ Mecklenburg Storm Water Services. • The owner will submit the completed Notice -of -Intent for General Permit NCG030000 to the Stormwater Permitting Unit on May 14 2010. We expect to receive a Certificate -of - Coverage within 30 days. • The owner has contracted with this Consultant to assist with Permit compliance. o A SWPPP is under development and will be completed by May 30 2010. o SWPPP implementation will commence on June 1 2010 and all required Permit tasks and items indicated in the Charlotte/ Mecklenburg Storm Water Service's letter dated April 13 2010 will be resolved by May 30 2011. o Stormwater discharge samples will be collected at the appropriate outfalls by June 30 2010, and the data submitted to NCDWQ upon receipt from the laboratory. 2. On behalf of my client, I will address each item in the Conclusions/ Recommendations Section: Interior Floor Drains The interior floor drains within the manufacturing and assembly areas will be plugged by May 30 2011 if such plugging does not interfere with the manufacturing processes. These floor drains currently allow for condensation and foundation seepage to exit the building. Before these drains can be plugged, the seepage problem will have to be remedied. All employees have been instructed to cease and prevent discharges of process wastewater and non-stormwater into these drains. The trench drain will be covered, but it cannot be plugged as it conveys stormwater through the property. This trench drain also carries stormwater that flows off Harris Blvd, a public street. Regarding the hydrostatic testing of the finished tanks, this discharge is allowable under NPDES General Permit NCG030000 and Chapter 18 of the Charlotte City Code as it is uncontaminated potable water. The NCDWQ has already considered this type of discharge at another metal tank manufacturer and has determined that it is an allowable discharge. We will analyze the water discharged after tank testing for pH, Iron, Chromium, Nickel, Manganese, and Oil & Grease, and submit the results to you by June 30 2010. StarBlast and Weld Flux Material All of the weld flux material has been cleaned and disposed properly as of April 30 2010. We are considering improved methods to temporarily store the starblast material. The current practice is to store the used blast media in piles, and when a sufficient quantity is accumulated, a vendor is used to haul off the media in dump trucks. Ward Tank & Heat Exchange, Page 2 r May 13 2010 SwSG Improved handling methods we are considering include more frequent removal from the site, diversion berms around the pile, containment berm to eliminate runoff, tarps or other covering, or placing into covered bins. A feasible solution will be implemented by October 30 2010_ Paint Spill at Dumpster The paint spill at the dumpster was cleaned by removing and properly disposing the soil on April 30 2010. New dumpsters with closable lids were obtained from the trash hauler on May 1 2010. Material Handling Procedures The owner/ operator is developing a Stormwater Pollution Prevention Plan in accordance with NPDES General Permit NCG030000 which will address improved material handling procedures, spill prevention & response, good housekeeping, employee training, and other appropriate best management practices. This SWPPP will be completed by May 30 2010. Other items The oily soil near the sand blast area was removed and properly disposed on April 30 2010. The five drums containing used oil were removed from the site by a vendor on April 30 2010. All active drums will be affixed with legible and appropriate labels by October 30 2010. Other exterior areas showing oil stains during your initial inspection were cleaned with the oily residue properly disposed on April 30 2010, Ward Tank submitted the NOI for coverage under NPDES General Permit NCG030000 on May 14 2010.
