On August 21, 2015, the Division of Energy, Mineral and Land Resources received your request to rescind
your coverage under Certificate of Coverage Number NCG030570. In accordance with your request,
Certificate of Coverage Number NCG030570 is rescinded effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters
of the State without valid coverage under an NPDES permit is against federal and state laws and could result
in fines. If something changes and your facility would again require stonmwater or wastewater discharge
permit coverage, you should notify this office immediately. We will be happy to assist you in assuring the
proper permit coverage.
If the facility is in the process of being sold, you will be performing a public service if you would inform the
new or prospective owners of their potential need for NPDES permit coverage.

Our records indicate that you have been issued the subject Certificate of Coverage (COC)
under General Permit (GP) No. NCG030000 from the North Carolina Division of Water Quality to
discharge stormwater (SW) associated with industrial activities performed at your facility. The
purpose of this letter is to advise you of the importance of the GP and the liabilities in the event of
failure to comply with the terms and conditions of the GP. If you have not already done so, it is
suggested that you thoroughly read the GP. Of particular importance are Part 11 and Part III,
Sections A & B.
Part II is titled "MONITORING, CONTROLS, AND LIMITATIONS FOR PERMITTED
DISCHARGERS". Part 11, Section A discusses the need to develop a Stormwater Pollution
Prevention Plan (SPPP), which includes, but is not limited to the following components: a site plan,
a SW management plan, and a spill prevention and response plan. Specific guidance as to the
information to be included in each plan is also listed in this Section. Part II, Sections B and. C
establishes any qualitative and/or analytical monitoring that may be required by your GP. If you
haven't already done so, please note that any analytical and/or qualitative monitoring as required by
this GP should begin upon commencement of your SW discharge as a result of a representative
storm event. The GP requires that this monitoring data be retained by the permittee for a period of
three (3) years and made available to a Division representative upon request. If you have vehicle
maintenance activities onsite and use more than 55 gallons of new motor oil per month (averaged
over the calendar year), you must perform the analytical monitoring set forth in Section D, Table 4.
This monitoring shall be performed at all outfalls, which discharge SW runoff from the vehicle
maintenance areas. The GP requires that this monitoring data be retained by the permittee for a
period of three (3) years and made available to a Division representative upon request.

Part III of the GP consists of general conditions and definitions consistent with all GPs,
which are applicable to your SW discharge. These conditions also include special reporting
requirements in the event of noncompliance, by-passing of treatment works (if applicable), and other
conditions that pertain to your stormwater discharge. In Part III, Section B (2), please note that GPs
are not transferable. If you, as the permittee, cease to need this COC (for example: your facility has
closed), then you should request that the COC be rescinded.
Failure to comply with the terms and conditions of any NPDES Permit may subject the
permittee to enforcement action pursuant to Section 143-215.6 of the North Carolina General
Statutes in the form of civil penalties of up to $25,000 per violation. Criminal penalties may also be
recommended for violations determined to be intentional or willful. If you find that you are unable
to comply with the terms and conditions of the GP, you should contact this Office immediately.
Lastly, when representatives from this Office contact you for the purposes of conducting an
inspection of your facility, you should be prepared to demonstrate compliance with all terms and
conditions included in the GP. If an inspection is scheduled at your facility, the inspection will
focus on evaluating the following: Stormwater Pollution Prevention Plan, stormwater outfall
locations, a review of any qualitative and/or analytical monitoring data required by the GP, and any
other activities that may be required by the GP that are unique to your discharge. This information
should be readily available if requested by a Division representative.

We received a Notice of Intent (NOI) for Ardee Lighting on May 8, 2008. After contacting you at your
facility, we were notified that there are three light manufacturers (separate companies) operating at the
same address: Ardee Lighting, Inc., Specialty Lighting, and Translite Sonoma. We were also notified
that the building (located at 639 Washburn Switch Road, Shelby, NC 28150), Ardee Lighting, Inc., and
Specialty Lighting are wholly owned by JJI Lighting Group. We were informed that Translite Sonoma
is owned by Lightolier. Royal Philips Electronics owns Lightolier and JJI Lighting Group. However,
neither Translite Sonoma, Lightolier, nor Royal Philips Electronics appears to be registered as a
company with the North Carolina Department of the Secretary of State.
As discharges cannot be separated easily when three facilities' property and manufacturing spaces are
co -housed, we would prefer to issue one permit to the company that owns all three companies and the
building. Similarly, you also requested a joint permit for all facilities. As Royal Philips Electronics is
not registered with the North Carolina Department of the Secretary of State, we are advising that JJI
Lighting Group applies for an NCG030000 as it owns Specialty Lighting, Ardee Lighting, Inc. and the
manufacturing building.
Please have JJI Lighting Group fill out a new NOI and send to the NC Division of Water Quality, to my
attention. The requested information should be submitted by Friday, July 18a', 2008, or the application
will be returned as incomplete.
If you need additional time to submit the information, please mail or fax your request for a time
extension to the Division at the address and fax number at the bottom of this letter. The request must
indicate the date by which you expect to submit the required information.
