reviewed the subject Ilpplicntion with respect to anticipated project impacts on uquatic
habitats. Our cOlnments are provided in accordance with certain provisions of the Fish
and Wildlife Coordination Act (48 Stat. 401, as amended; 16 V.S.C. 661 et seq.), Ilnd
section 401(h) of the Cle~m Water Act of 1977 (1l8 amended)l and North Carolina General
Statutes (U.S. 113.131 et seq.).
The project involves the planned cunstruction and development of n business park
including ~everallarge buildings, parking areas, access roads, and stonnwater
mtumgement basins along W. T. Harris Boulevard in North Charlotte. The applicant
proposes to till 0.74 acres ofwetlandll, which includes 0.31 acre!l prevj(lUsly impacted.
An estimated 4.41 acre!) ofwcthmds are located on the project site. The document stutes
that the purpose of the proposed work will be to provide an additional access roud to
cmmect the site to IBM Drive across an unnamed tributary to Dohy Creek. The site is
planned to provide 8000 parking spaces with five points llf ingress and egres!l,
This project is located at the headwaters of a small tributary to Dohy Creek, a
small stream thut feeds Mallard Creek, before flowing to the R(lCky River in the Ylldkin-
Pea Dee River Basin. As proposed. the project will result in the loss of wetlands that arc
important to maintaining good water quality. We are concerned that stre,un
sedimcnlutioll and chemical runotlfrom the site may increase without adequate
storm water mBnagemeut and sedimentation control. Implemt'lntation of best management
pruciiccs und storm water management, including two permanent pool retention ponds, i1\
proposed to minimize di!;turbance to downstream waters and wetla.nds. Th~ applict\l1t has
offered no mitigatiun for wetland losses nor any plans to prot~ct wetlands ~mall1lng on-
site.
We CllCO\.\nlgc the npplicunt to make an additiona.l effort to redesign the project to
limit impacts to on-site wetlands by avoidance IU1d minimization. Unavoidable wetlands
should be mitigated by on-site creation using a l:ltandard 2:1 raUo (cr~ated:desLroyed).

We offer the folluwing recommendations to protect the wetlands and downstream
habitats:
1. Create a total of 1.48 acres of vegctnted wetland areas on-site to replace the 0.74
acres thut were or will be destroyed. The additional wetlands should be created
adjacent to existing wetland areas.
2. Retain or establish fl. 1 DO-foot natural vegetated buffer bc:sidc 5trcams (lml wetland
areas on the project site, where posliiblc. Native trees and shrubs should be
established nr maintained in the buffer.
3, Plucc deed restrictions on the property to prohibit future impacts to remaining
wetlands by currcnt or future owners.
4. Storm water should be Touted to wet detention ponds prior tu discharge tu surface
wutcrs. Sufficient water should be routed to remaining wetlands to maintain
hydrology; however. energy should be dissipated to prevent scouring.

12. The proposed work consists of the construction and development of a commercial
business park for certain consolidated financial operations of the First Union National
Bank (First Union). The development plan includes several large building and parking
footprints. access roads, storm water management basins. and ancillary facilities. The
development plan as proposed will impact a total of 0.74-acres of jurisdictional waters
and associated wetland areas on the subject site.
First Union has previously developed portions of the project site during earlier phases of
construction. These activities were primarily located in the upland portions of the site.
However. during the initial phases of development an estimated 0.3 I-acres jurisdictional
waters, including wetlands within the project site were tilled. (See Figure 3).
Current development plans for the First Union site require an additional access road to be
located in the eastern corner of the project site. The proposed access road will connect
the project site to the existing IBM Drive located to the east across an unnamed tributary
of Doby Creek, The proposed access road construction will require an additional 0.43-
acres of jurisdictional waters including wetlands. (See Figure 4).
As a result of First Union's traffic impact studies, it has been determined that the volume
of traffic now will be greater than the capacity of the current number and location of
existing ingress and egress points. The need for this access road will be critical once the
site has reached its potential capacity of 8.000 available parking slots. Currently there are
four points of ingress and egress on the project site. There are two points located on the
western side of the site (to the IBM Drive) and two located on the northern side (to West
W.T. Harris Boulevard). The current proposed work will provide an additional access
road to the east.
13. The purpose of the proposed work for this application will be to provide an
additional access road to complete the development plans for the required number of
ingress and egress points accessing the First Union site.

14. First Union has proposed an additional access road to connect the project site to
the existing IBM Drive located to the east across an unnamed tributary of Doby Creek.
The location of the proposed access road was the only available easement available to
First Union. First Union negotiated with IBM. the owner of the adjacent property to the
east. to obtain this easement. The location of the access road accounts for future
transportation access for the adjacent IBM property, as well as several large parking lots
and a major stormwater management basin on the First Union site. First Union's plan for
the proposed construction of the access road is the most economic and practicable option
available to facilitate the current and future project objectives.
First Union has avoided and minimized wetland impacts to the maximum extent
practicable during the initial phase of development as well as for the current proposed
phase of construction. The proposed fill in wetlands necessary to develop the entire
project site will require impacts to 0.74-acre of above-the-headwaters jurisdictional
waters including wetlands. The previously-impacted areas (0.31-acres) and the area
proposed to be impacted by the access road construction (0.43-acre) are unavoidable due
to the easement restrictions and existing sitc restrictions on the First Union site.
To protect water quality down-gradicnt from the site, adequate sedimentation and erosion
control measures have been implemented during the initial phases of the project
dcvelopment and will continue to bc implemented for the construction of the proposed
access road. In addition, First Union has implemented plans for two permanent pool,
stormwater retention ponds on the site. To minimize impacts, best management practices
(BMP's) will be employed for the construction of the proposed access road.
Implementation of BMP's and the stormwater management plan (attached), will
minimize disturbance to down-gradient waters and wetlands. The conditions of the NWP
No. 26 including the general conditions (33 CFR Part 330 Appendix A) will be adhered
to during construction and operation of the proposed activity.
