Please keep in mind that benchmark exceedances are NOT limit violations or violations of permit conditions; however, you are obligated to follow the tiered response actions outlined in your permit. Prior to receipt of your letter, a Compliance Evaluation Inspection was conducted by Mike Lawyer of this office on October 31, 2013. At the time of the inspection, the facility was found to be in compliance with the tiered response actions and other conditions of the NGG030000 General Permit. During the inspection, it was relayed that some potential sources for the exceedances had been identified such as a large metal warehouse building adjacent to outfali 2, metal pallets stored outside and some scrap metal in open top dumpsters. A follow-up site visit was conducted by Mike Lawyer on June 3, 2014 to discuss.monthly monitoring results and any actions taken to address or account for the exceedances. As observed during the June 3, 2014 site visit and/or outlined in your letter; the metal pallets were relocated indoors, the scrap metal dumpsters were moved to the other side of the facility and sampling was conducted at two roof drains coming directly off the warehouse building, which resulted in benchmark exceedances for zinc. In addition to these actions, facility personnel confirmed that zinc is not used in any part of the manufacturing process. Based on the aforementioned items, we are granting regulatory relief in the form of a collapsed Tier 2 - Tier 3 response_ Upon receipt of this letter, Saab Barracuda LLC may resume the permit specified semi-annual analytical monitoring for the remainder of the current permit term. Your current permit is set to expire on October 31, 2017, This decision applies only to the copper and zinc benchmarks. A benchmark exceedance of any other parameter listed in your permit will trigger the tiered response actions as described in the general permit. You must notify this office, in writing, within five business days if you become aware of any significant source of copper or zinc at your facility that has the potential to be exposed to stormwater. The relief granted in this letter is contingent upon the current industrial practices at Saab Barracuda LLC. If industrial practices change and copper or zinc does become a significant stormwater exposure risk then this office reserves the right to withdraw this decision and reinstate the permit specified tiered response or other actions that may be warranted by the new set of circumstances. I am writing this letter with details of actions taken by Saab Barracuda LLC (SBLLC) and request that the required monthly monitoring be granted relief of testing Zinc in our Outfalls. Per permit NCG0300000 SBLLC is required to conduct analytical monitoring semi-annual on the following: pH, Total Suspended Solids, NP Oil and Grease, Copper, Lead, Zinc, TTO, and rain fall. During our normal testing conducted in January 2013 Zinc levels were found to be above bench mark values at Outfall 002 and 003. Permit requirements state that Tier One action be taken. The following actions were taken as of 2/28/13: • Met with Stacy Farrow (Esterline-Safety/Environmental Manager) and Jimmy Coleman (Saab Facility Maintenance Manager) and conducted a walk through to determine possible causes. • Scott Smith (Saab Technical Manager) and Stacy Farrow both submitted emails stating that Zinc is not used in the process of either facility. • Identified that the facility has metal warehouses, metal containers, metal carts, trailers, dumpsters for metal and other waste, and metal pallets that have a galvanized coating. • Metal galvanized pallets were moved to inside warehouse. In September 2013 Outfall 002 exceeded the bench mark value for Zinc. On 10/31/13 you visited the facility to conduct a site inspection. Your report found SBBLC to be in compliance with permit requirements. You made some suggestions to help us determine possibly why Zinc levels are above bench mark. The bullets below describe actions taken by SBLLC since NCDENR visit as of date 6/10/14. • Upstream and Downstream sampling- testing conducted in December. Zinc was present however, lower than bench mark. • Also at your visit it was decided that SBLLC would begin monthly monitoring of Zinc per permit Tier 2 requirements. • November 2013 there was not a significant rain event therefore no testing was conducted. • December 2013 Zinc level was below the bench mark. • January 2014 Outfall 002 exceeded bench mark values. • Open top metal containers and open top dumpsters were moved in February 2014 to the other side of facility to determine if Zinc levels would fall below bench mark. • Sampling at drains running off from warehouse- Conducted in February 2014. One of the two drains exceed the bench mark and the other was barely below. • Zinc levels were below bench mark at Outfall 002 in February. • March 2014 had no significant rain event. • April 2014 sampling was conducted at Outfall 002, Outfall 003, and at drains coming off of warehouse. I sent you the results from April and would like to discuss with you if we need to continue with our monthly monitoring or if NCDENR has any other suggestions or recommendations. Here is a graph of Zinc results since we started collecting data. It appears to me that the drains coming off of warehouse may be a potential reason that the zinc levels are higher at outfall 002. We moved the open top containers in March to where the discharge would fall into outfall 003. As you can see below the level at 003 spiked as well. I plan to obtain another sample with the next rain event.to see what happens at both outfalls but very curious as to what happens at 003. Any input would be greatly appreciated., e _ aceAnalytical ! Mike hope all is '1 I will be mailing the form to RWQ later today. Our results for Outfall 002 are below the benchmark (0.037 mg/I). We have moved the open top containers (metal and trash) to the other side of the facility. In addition I tested two drains coming off of the warehouse. The results from these were 0.068 mg/I and 0.085 mg/l. I still don't want to draw any conclusions at this point and recommend we pull additional samples in March at Outfall 002 and 003 as well as the drains. If the open tops were a reason for exceeding of benchmarks then 003 should go up. The containers were moved to the other side near this outfall. High Zinc levels could also be coming from Warehouse just as you mentioned in your visit to the facility. I know we said we would decide on next steps after February results. The more significant changes in the General Permit since your last Certificate of Coverage include the following: • Part I Section A —A new notation that the No Exposure Exclusion from permitting option may be available to the permittee_ • Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL, may not be eligible for renewed coverage under the General Permit. • Part II Section B Table 1 —An increased sampling frequency from once per year to twice per year. • Part II Section B Table 3 — Benchmark concentrations now replace cutoff concentrations; the elimination of the option to avoid sampling based on cutoff concentrations. • Part II Section B — New provisions requiring the permittee to execute Tier One and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly -monitoring instead of twice -per -year monitoring, until three consecutive monitoring events show no benchmark exceedences. • Part II Section B —A new provision that four exceedences of any particular benchmark will trigger increased DWO involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control measures. SA -A /� IT"ro cxnmx N,a strx"N Zinc/Copper Storm Water Testing 10/18/13 On 9/24/13 Storm Water samples were pulled and submitted to Pace Analytical for analysis. Lab results were received on 10/7/13. The report indicated that our Zinc and Copper levels on Outfall 002 exceeded the bench mark values that are in our Storm Water Permit NCG030000. These results were mailed to NCDENR on 10/9/13 along with the Qualitative Monitoring Reports. Per permit requirements a team consisting of: Mark Cauthen- Quality/Safety/Environmental Manager Scott Smith- Technical/R&D Manager Jimmy Coleman- Facility Maintenance Manager Patricia Anderson- VP Quality/Safety/Environmental Stacy Farrow- Esterline Quality/EHS Manager Documentation from Esterline (Stacy Farrow) and Saab (Scott Smith) is attached to indicate that Zinc -or Copper_is.not used"ih-processes at either facility On 10/1S/13 Jimmy Coleman, Stacy Farrow, and I conducted a walkthrough of the facility to determine potential areas where Zinc and Copper may be present. The facility has several metal buildings, cooling towers and an emission unit that appear to have a galvanized coatings, air conditioning units that have outside duct work, metal carts, trailers, dumpsters for metal and other waste, and metal pallets that also appear to have a galvanized coating. (see attached photos) Saab and Esterline will have the metal pallets moved so that they are inside. In addition we are also investigating the feasibility of having the dumpsters outside covered. This may help reduce Zinc and Copper levels in storm water. While conducting this investigation we also noticed that �our level of Copper�in our process water-i"s—is ppm: Data provided by Harnett County Water Quality Report 2011 and 2012. In addition I have reached out to NCDENR and talked with Mike Laywer and have attached his email response to this letter. This information will be relayed to NCDENR for next steps to take in regards to higher levels of Zinc and Copper. All information related to this will be placed in our SPCC/ICP as stated in our permit.
