Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: S&EC delineated all wetlands, streams and Neuse Buffers prior to site plan development. The project engineer used this delineation to avoid impacts to the maximum extend possible and minimize impacts where they could not be avoided. The road is required by the ToWF and NCDOT as essentially a "service road" to help alleviate local traffic on US1 highway and also provide primary access into the subdivison. The location of this important roadway was by it's connction to Harris Road and distance from the US1 intersection, property boundaries and allocated speed limit. All effort was made to avoid impacts to the stream, wetlands and Neuse Buffers. However, due to design constraints the road had to cross where it is proposed and thereby could not avoid impacts. Extensive efforts were made to avoid impacts to the high quality wetland 4/5 and minimize impacts to the stream and buffers. These efforts included the tight curvature of the road, width of the road and most notably the extensive use of retaining walls. The sanitary sewer crossing furthern downstream will be an aerial crossing. While final desing has not yet been completed, the invert of the pipe will be well above the bankfull elevation of the stream and the location of the piers will be beyond the OHWM of the stream. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: The project will obtain an erosion control permit from the ToWF along with a post -construction stormwater management permit which will help avoid and minimize unanticipated impacts to downstream WoUS both during and after construction. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. Does the project require Compensatory Mitigation for impacts to Waters of the U.S. or Waters of the State? r Yes r No 2b. If this project DOES NOT require Compensatory Mitigation, explain why: The total permanent stream impacts is less than 150 LF and wetland impacts less than 1/10th acre. Both, below the typical thresholds for mitigation. F. Stormwater Management and Diffuse Flow Plan (required by DWR) 1. Diffuse Flow Plan 1a. Does the project include or is it adjacent to protected riparian buffers identified within one of the NC Riparian Buffer Protection Rules? r Yes r No What type of SCM are you providing? r- Level Spreader r Vegetated Conveyance (lower SHWT) r- Wetland Swale (higher SHWT) rJ Other SCM that removes minimum 30% nitrogen r Proposed project will not create concentrated stormwater flow through the buffer Diffuse Flow Documentation 2. Stormwater Management Plan 2a. Is this a NCDOT project subject to compliance with NCDOT's Individual NPDES permit NCS000250? r Yes r No 2b. Does this project meet the requirements for low density projects as defined in 15A NCAC 02H .1003(2)? r Yes r No 2c. Does this project have a stormwater management plan (SMP) reviewed and approved under a state stormwater program or state -approved local government stormwater program? r Yes r No 2d. Which of the following stormwater management program(s) apply: R Local Government r State Local Government Stormwater Programs V Phase II FJ NSW r USMP rJ Water Supply Please identify which local government stormwater program you are using. Town of Wake Forest, NC Comments: The project exceeds the low density requirements, but still proposes around 26% open space. A large, stormwater wet pond designed to both ToWF and DEQ standards is proposed to treat stormwater runoff from the site. The wet pond is shown on the plans. G. Supplementary Information 1. Environmental Documentation 1a. Does the project involve an expenditure of public (federal/state/local) funds or the use of public (federal/state) land?* (' Yes r No 2. Violations (DWR Requirement) 2a. Is the site in violation of DWR Water Quality Certification Rules (15A NCAC 2H .0500), Isolated Wetland Rules (15A NCAC 2H .1300), or DWR Surface Water or Wetland Standards or Riparian Buffer Rules (15A NCAC 2B.0200)?* r Yes r No 3. Cumulative Impacts (DWR Requirement) 3a. Will this project result in additional development, which could impact nearby downstream water quality?* r Yes r No 3b. If you answered "no," provide a short narrative description. The project is a residential subdivision which typically is not anticipated to result in additional development that could leave to downstream water quality issues. However, if it were the ToWF (Richlan Creek water supply 100' buffers, etc.) and DEQ stormwater regulations (NSW 50' Neuse Buffers, Phase II, etc.) should protect such water quality. 4. Sewage Disposal (DWR Requirement) 4a. Is sewage disposal required by DWR for this project?* r Yes r No (- N/A 4b. Describe, in detail, the treatment methods and dispositions (non -discharge or discharge) of wastewater generated from the proposed project. If the wastewater will be treated at a treatment plant, list the capacity available at that plant. Wastewater from the site will be sent to the City of Raleigh (COR) sanitary sewer system (which provides utilities to the ToWF) and treated at the COR water resource recovery facility / treatment plant. The COR and DEQ will ensure that adequate capacity exists. 5. Endangered Species and Designated Critical Habitat (Corps Requirement) Sa. Will this project occur in or near an area with federally protected species or habitat?* ( Yes r No 5b. Have you checked with the USFWS concerning Endangered Species Act impacts?* r Yes r No 5d. Is another Federal agency involved?* r Yes r No r Unknown 5e. Is this a DOT project located within Division's 1-8? r Yes r No 5f. Does this project involve (1) blasting, and/or (2) other percussive activities that will be conducted by machines, such as jackhammers, mechanized pile drivers, etc.? r Yes r No 5j. What data sources did you use to determine whether your site would impact Endangered Species or Designated Critical Habitat? NC NHP & FWS websites. No known Federally listed species exist within 1 mile of the project area. While the project will involve cutting trees, trees will be maintained within 50' along the park boundary and within the 100' ToWF stream buffer areas with the exceptions for the requested impacts. The largest trees most likely suitable for NLEB habitat would be located in these areas. Blasting or percussive activities is not anticipated for the construction of this project. Preliminary clearing and grading work is anticipated to occur outside of the NLEB pup season. Consultation Documentation Upload 6. Essential Fish Habitat (Corps Requirement) 6a. Will this project occur in or near an area designated as an Essential Fish Habitat?* r Yes r No 6b. What data sources did you use to determine whether your site would impact an Essential Fish Habitat?* NOAA EFH Mapper. The project is located in the NC piedmont region well beyond any EFH areas. 7. Historic or Prehistoric Cultural Resources (Corps Requirement) 7a. Will this project occur in or near an area that the state, federal or tribal governments have designated as having historic or cultural preservation status?* r Yes r No 7b. What data sources did you use to determine whether your site would impact historic or archeological resources?* There are no identified sites on the property. The attached map shows the adjacent sites. The only site on the National Register is "Wakefields" house and acres across 1151 highway from this property. No impacts to this site are anticipated. E. Stream, wetland, or pond impacts are stili subject to applicable water quality standards and permitting requirements. Explanation: The stream(s)/pond(s) listed above has been located on the most recent published NRCS Soil Survey of Wake County, North Carolina and/or the most recent copy of the USGS Topographic map at a 1: 24,000 scale. Each feature that is checked "Not Subject" has been determined to not be an intermittent stream, perennial stream, a pond connected to a stream feature, or the feature is determined not to be present_ Stream features that are checked "Subject" have been located on the property and possess characteristics that qualify it to be subject to the buffer rules. There may be other streams located on the property that do not show up on the snaps referenced above and are therefore not subject to the buffer rules. However, if the stream features are present on the tract they are subject to all other applicable North Carolina stream standards and permitting requirements as outlined in 15A NCAC 02B, and may be considered jurisdictional according to the US Army Corps of Engineers.
