In accordance with the North Carolina Department of Environment and Natural Resources policy of
"Enforcement Policy for Self -Reported Violations", Dental Equipment LLC (d/blal Pelton & Crane)
located at 11727 Fruehauf Drive Charlotte, North Carolina is providing the following information to
serve as a disclosure regarding performance of stormwater permit duties under our former General
Permit No. NCG030000, The former permit covered the time period from January 1, 2008- October
21, 2012. Based upon an audit and upon an internal review of facility records, the following items
were identified:
Under the former permit, Pelton & Crane did not submit records of required discharge monitoring
reports, did not conduct sampling, did not perform quantitative monitoring, did not perform facility
inspections on a semi-annual basis, and did not perform an annual review and update, generally for
the period .of time from January, 2008 to October, 2012.
Pelton & Crane has obtained a new permit and is in full compliance with all of the terms and
conditions of the new permit, so that no further issues in this regard will occur at their facility. In
order to accomplish a zero -tolerance policy in regard to permit exceptions, we have taken the
following measures:
1) The facility acquired an on -staff EHS Professional.
2) The facility developed an EHS compliance calendar that will promote heightened EHS
involvement and monitoring of our stormwater responsibilities. All permit requirements are
listed on the compliance calendar.
3) The Pelton & Crane facility is currently compliant with all conditions mandated under the
current stormwater permit:
i) Performed semi-annual lab testing consistent per current permit requirements.
ii) Submitted semi-annual discharge monitoring report per current errnit requirements.

iii) Performed semi-annual qualitative sampling and analysis consistent with current permit
requirements.
iv) Performed annual Stormwater Pollution Prevention Plan review and updated the current
Plan in accordance with new permit requirements.
v) Performed semi-annual facility and stormwater system inspection per permit
requirements.

In response to your renewal application for continued coverage under stormwater General Permit NCG030000
the Division of Water Quality (DWQ) is forwarding herewith the reissued General Permit. This permit is
reissued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between the state of North Carolina and the U.S. Environmental Protection Agency, dated October
15, 2007 (or as subsequently amended).
The following information is included with your permit package:
• A new Certificate of Coverage (COC)
• A copy of General Permit NCG030000
• A copy of the Technical Bulletin for the General Permit
• Two copies of the Discharge Monitoring Report (DMR) Form
• Two copies of the Qualitative Monitoring Report Form
The General Permit authorizes discharges of stormwater, and it specifies your obligations for discharge
controls, management, monitoring, and record keeping. Please review the new permit to familiarize yourself
with all the changes in the reissued permit. Your facility has six (6) months from the time of receipt of the
permit to update your current SPPP to reflect all new permit requirements.
The first sample period of your permit begins January i, 2013. Your facility must sample a "measureable
storm event" beginning during the periods beginning January 1 and July 1 of every year (or, if applicable,
report "No Flow," as outlined in Part III, Section E). Also, please note that Tier 3 Actions in Part II of your
permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.
The more significant changes in the General Permit since your last COC was issued are noted either in the
Draft Permit Fact Sheet that accompanied the public notice (http://portal.ncdenr.org/web/wq/ws/su/current-
notices , or in the Response to Comments / Summary of Changes and Technical Bulletin documents that are
posted on the Stormwater Permitting Unit's website with the new General Permit. Please visit
http://Portal.ncdenr.org/web/wq/ws/su/npdessw (click on 'General Permits' tab) to review that information
for your specific General Permit carefully.

Some of the changes include:
Part II:
• Section A: The Stormwater Pollution Prevention Plan (SPPP) section, if applicable, has been updated
to the most current language of our permits. Additional conditions for specific industry sectors have
been added to the SPPP requirements in some cases.
• Sections B, C. Failure to perform analytical stormwater monitoring may result in the Division requiring
that the permittee begin a monthly sampling scheme.
• Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these
more sensitive waters.
• Sections B, C: The monitoring parameter Oil & Grease (O&G) has been replaced by the parameter
Total Petroleum Hydrocarbons (TPH) for vehicle maintenance areas, and in some cases, other
analytical monitoring requirements.
• Sections B, C, D: Inability to sample due to adverse weather must be recorded in the SPPP, or in
separate on -site records if your General Permit does not require an SPPP. Adverse weather is defined
in the "Definitions" section of the permit.
• Sections B, C. The term "Representative Storm Event" has been replaced by "Measurable Storm
Event." A measurable storm event is defined in the permit.
• Section D: If the permittee fails to respond effectively to problems identified by qualitative
monitoring, DWQ may require the permittee to perform corrective action.
Please review Parts III and IV to understand the Standard Conditions of your new NPDES General Permit,
including Compliance and Liability, Reporting, Monitoring and Records requirements; Operation and
Maintenance obligations; and Definitions. Please note that all samples analyzed in accordance with the terms
of this permit must be submitted to the Division on Discharge Monitoring Report (DMR) forms available on
the Stormwater Permitting Unit's website above. DMR forms must be delivered to the Division no later than
30 days from the date the facility receives the sampling results from the laboratory. Also note that existing
permittees do not need to submit a renewal request prior to expiration unless directed by the Division.
Your coverage under the General Permit is transferable only through the specific action of DWQ. This permit
does not affect the legal requirements to obtain other permits which may be required by DENR, nor does it
relieve the permittee from responsibility for compliance with any other applicable federal, state, or local law,
rule, standard, ordinance, order, judgment, or decree. If you have any questions regarding this permit

Your facility is currently covered for stormwater discharge under General Permit NCG030000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the 11 categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the faciity industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

Permits Unit Web Site at http://h2o.enr.state,nc.us/su/stonnwater.html
If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed
Rescission Request Form. Mailing instructions are listed on the bottom of the form: You will be notified when the
rescission process has been completed.

Your facility is currently covered for stormwater discharge under General Permit NCG030000. This permit expires
on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal
Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued
coverage under the general permit.
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of Stormwater from your facility
without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the l I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional

If the subject stormwater discharge to waters of the state has been terminated, please complete the enclosed

Enclosed is a copy of the Follow-up Compliance Evaluation Inspection (CEI) report for the inspection
conducted at the subject facility on July 1, 2009, by Heather Sorensen of Charlotte -Mecklenburg Storm
Water Services (CMSWS). This inspection was conducted as part of a cooperative working agreement
between Mecklenburg County and the Division of Water Quality. In addition, the inspection was conducted
on behalf of the City of Charlotte in compliance with the City's NPDES Permit, NCS000240, Part II Section
H. Thank you for your assistance and cooperation during the follow-up inspection.
The follow-up compliance inspection found that Pelton and Crane has implemented the corrective actions as
stated in the subject facility's Notice of Violation response letter dated April 21, 2009. Required paperwork
(disposal manifest) was received for final review on October 15, 2009. The corrective actions included:
0 Updating of the Stormwater Pollution Prevention Plan for the facility,
* Implementing measures to prevent the discharge of oil to the ground from the air compressor room,
+ Conducting clean-up activities of the oil impacted soil located outside the air compressor room, and
• Implementing increased inspections and clean-up of the trash compactor area.

Inspection Summary:
Facility Description:
The facility manufactures dental equipment and is involved in metal fabrication. The major industrial processes include
washing, painting, welding, metal finishing, assembly, and carpentry. The facility has an on -site wastewater pretreatment
facility with Permit #0515 from Charlotte Mecklenpurg Utilities; permit expires 2012. The facility operates Monday through
Friday from 6:45 a.m. to 11:45 p.m. Third shift operates on an as needed basis. No vehicle washing or maintenance
occurs on site. No hazardous materials are stored on site_ Bag house dust is taken to BFI landfill and FCC Environmental
collects and disposes of clarifier sludge and used oil.
Compliance History:
On July 26, 2004,CMSWS investigated a paint discharge from the Pelton and Crane facility property to Steele Creek due
to painting activities on site and a storm event. EnviroShield Roofing Services, LLC was contracted for the painting
activities with regard to the roof and drains at the Pelton and Crane facility.
A stormwater Inspection was conducted on February 12, 2009, by Ms. Heather Sorenson of Charlotte - Mecklenburg
Stormwater Services (CMSWS). A Notice of Violation was issued on March 25, 2009 by the North Carolina Division of
Water Quality.
Industrial Operations/City of Charlotte Stormwater Ordinance Review:
Air Compressor Room (Wastewater Pre -Treatment Area) —
On February 12,2009, dark staining was observed on the earthen ground adjacent to the air compressor room that is
located on the backside of the main building. Excessive absorbent material and standing product was observed on the
concrete floor of the room.
On July 1, 2009, the area had been cleaned with a berm installed around the air compressors to prevent any spills to
outside. Impacted soil had been removed from around the building. Analytical samples for Oil and Grease were collected
on June 30, 2009. On October 9, 2009, acceptable sample results were received. A disposal manifest for the
contaminated soil was received on October 15, 2009.
Air Compressor Room (Quality) —
On February 12, 2009, a water hose was observed hooked up to a water spigot with the other end outside the building.
Facility personnel explained that the water hose is used to wash the filters on the air conditioning unit located on the roof.
On July 1, 2009, the water hose was disconnected and removed. It was explained by facility personnel that the water
hose is no longer used for outside purposes and was never used to wash air conditioning filters. The area appeared to be
in good condition.
Trash Compactor —
On February 12, 2009, minor sawdust was observed on the concrete ground around the trash compactor.
On July 1, 2009, the area around the trash compactor was clean and appeared to be in good condition

absorbent materials to be in compliance with the City of Charlotte Stormwater Pollution Control
Ordinance.
It is requested that a written response be submitted to this Office by April 22, 2009,
addressing the above -noted violations in the enclosed report. In responding to the violations,
please address your comments to the attention of Ms. Marcia Allocco at the letterhead address.
The subject facility will have 90 days from the letterhead date to come into compliance

The air compressor room is located outside on the rear of the main building. This room is mostly enclosed and houses
two air compressors_ The room is exposed to stormwater due to an opening in the roof. Two buckets were observed
under one of the air compressors to catch leaking oil. Excessive absorbent material and standing product was
observed on the concrete floor of the room. Dark staining was observed on the soil outside the air compressor room.
Spilled oil has the potential to be discharged to the storm drainage system on site during a storm event, which could
cause a violation of the NC Oil Pollution Act.
The permittee must properly remove and dispose of the impacted soils, absorbent material, and standing product. The
permittee must take steps to prevent the discharge of oil to the ground including repairing the leaking equipment and
instituting routine maintenance and inspection of the area.
These steps shall be incorporated into the Spill Prevention and Response Plan and the Preventative Maintenance and
Good Housekeeping Program required by the permit.
Air Compressor Room (Quality) —
The air compressor room is located inside and is not exposed to stormwater. A water hose was observed connected to
a water spigot with the other end outside the building. Facility personnel explained that the water hose is used to wash
the filters on the air conditioning unit located on the roof. An air compressor was also located in the room and oil
staining was observed around the base of the equipment.
The permittee shall ensure proper containment and disposal of any wastewater (air conditioning washing) and conduct
routine maintenance and inspection of the area as required by the Preventative Maintenance and Good Housekeeping
Program in the permit.

Trash Compactor -
The trash compactor is located outside and completely enclosed. Minor sawdust was observed on the concrete in the
area. Facility personnel explained that dust from the wood shop accumulates on the side of the building and washes
down during rain events.
The permittee shall conduct regular inspections and proper clean up of the area to prevent stormwater contamination
as required by the Preventative Maintenance and Good Housekeeping Program in the permit. Wood material such as

Comment- The general location map did not identify whether the receiving water(s) is
impaired and the site map was missing the site topography; neither correctly identified
the outfall location.
Preventative Maintenance and Good Housekeeping was documented for limited facility
areas in 05 and 08 (detailed discussion regarding the requirements of the permit/SPPP
appears under the Summary section of the report (Industrial Operations)). The SPPP
contained a blanket statement for significant spills (Section 6.5) and was last revised on
January 16, 2008.
The permittee conducted .Employee training in 07, 08, and 09. Stormwater Facility
Inspections were conducted and documented daily for the outdoor processes of the
Wastewater Treatment Plant on 1117/07 through 1/21/09. Inspections of other
equipment and systems with the potential to contaminate stormwater were not
completed. The stormwater systems were inspected on 1/29109. Much of the
documentation for the aforementioned items is not kept with the SPPP.

This letter is to inform you that we have received the notice of violation dated March 25a, 2009 and are
undertaking the following corrective actions to address the violations.
(1) In response to the finding involving the Air Compressor Room (Wastewater Pre -Treatment Area), we
are completing the following steps:
a. Repairing the air compressors in question to address the issue with leaking oil. (Complete)
b. Cleaning up and properly disposing of the absorbent material around the air compressors.
(Complete)
c. Fully enclosing the concrete pad around the air compressors to prevent the possibility of any
future oil leaks to the neighboring soil as well as sealing the roof to ensure that no rainwater can
reach the pad. (Est. completion of 5/l/09)
d. Removing and properly disposing of the impacted soil. (Est. completion of 5/8/09)
e. Instituting a daily inspection of the equipment in the compressor room coupled with improved
Preventative Maintenance. (Complete)
(2) In response to the finding involving the Air Compressor Room (Quality), we are working with our
HVAC service provider to determine if any of the material or chemicals from the runoff from the air
conditioning filters would be hazardous to the environment. If so, we will remove the water hose and
eliminate the practice of washing the filters in areas where the runoff could contaminate the neighboring
environment. Additionally, we will be instituting a daily inspection of the equipment in the compressor
room coupled with improved Preventative Maintenance. (Est. Completion of4/22/09)
(3) In response to the finding involving the trash compactor, we are increasing the frequency of our
inspections in this area and additionally increasing the frequency of clean-up of any saw dust in response to
the results of these inspections. (Complete)
(4) In response to the other findings outlined in the report, we are completing the following steps:
a. Updating our general location map to indicate whether the receiving water is impaired and
correcting the identification of our outfall location. (Complete)
b. Going forward, we will maintain all Preventative Maintenance records for (5) years. (Complete)
c. Conducting semi-annual facility & stormwater system inspections. (Est. completion of 4/29/09)
d. Completing the annual requirement to document that an evaluation of the presence of non-
stormwater discharges in the stormwater outfall was completed. (Will complete at the end of 2009)
