Preston Howard, Jr., P.E., Director January 11, 1996 McDowell County DEM Project # 960002 APPROVAL of 401 Water Quality Certification Mr. Charles Abemathy McDowell County 10 East Court Street Marion, NC 28572 Dear Mr. Abernathy: You have our approval to place fill material in 0.2 acres of wetlands or waters for the purpose of constructing the McDowell County Industrial Park-Phase 2 access road, as you described in your application dated 22 December 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 2732 and 2671. These certifications allow you to use Nationwide Permit Numbers 14 and 26 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-1786. This project completes the construction of the main access road serving the new McDowell County Industrial Park, for a length of approximately five hundred (500) feet. Approximately 1,250 lineal feet of access road has been previously permitted and constructed, along with an additional 1000 lineal feet of roadway recently completed by the North Carolina Department of 'T'ransportation. '['his project uses fill material from one (1) of the six (6) industrial sites (Site 6) by beginning the earthwork on this site in accordance with a preliminary grading plan. The project also relocates a stream and fills the old stream bed on another site (Site 4) to allow construction of the access road and to begin development of this second site. Storm drainage pipes and grassed ditches will be installed and constructed to handle the runoff from the woods and overgrown field which generally cover this site. Erosion control measures, including diversion ditches, riprap check dams, silt fencing, and 4 sediment basins, will all be used to prevent sedimentation into the nearby streams and adjoining wetland area. Construction of the stream diversion channel will be scheduled to stabilize the channel prior to allowing any water flow, and to minimize the exposure of unprotected earth.
